The Morning Report - 8/10/20

Good morning, kids. Monday and the big story is, of course, President Trump making like Moe Howard and slamming Malig-Nancy Pelosi's and Cuck Schemer's heads together by unilaterally enacting Chinese Lung AIDS relief via executive order. The end-run around them was not only a brilliant political move but just the right thing to do; and that is something that this president has been mostly stellar at for his entire term.

... When the virus first appeared, Trump, in good faith, allowed Fauci to lead him down the primrose path. This meant giving in to, and signing off on, the Democrats' demands for stimulus bills. His agreement made the Democrats foolhardy. With the economy on life support, deaths from the virus dropping, and Americans desperately wanting to go back to work, the Democrats decided that they could again lard the latest stimulus bill with all manner of things. They assumed Trump would be either trapped or compliant.

What they hadn't realized was that Trump, like a cat watching a rat draw near, was just waiting for the right moment to spring. Saturday was that day. In the kind of press conference that helps win elections, Trump explained that he was cutting through the Democrats' ridiculous negotiating tactics and using his executive power to bring relief directly to Americans...

The executive orders Trump signed do four things:

1. Create a payroll tax holiday for Americans earning less than $100,000 annually. The executive order will be retroactive to August 1 and end on December 31, putting more money in employees' pockets.
2. Continue enhanced unemployment benefits at $400 per week, which is $200 less than the Democrats were demanding, which Trump alleges (probably correctly) makes going back to work more attractive.
3. Extend the eviction moratorium on federal subsidized housing.
4. Suspend student loan payments. (It's to be hoped that Trump will not ultimately endorse Elizabeth Warren's demand that the Wuhan virus should be used as an excuse to forgive all student loans. If someone was stupid enough to get a $300,000 gender studies degree, taxpayers should not be on the hook.)...

The Democrat-Media Complex went into absolute freakout mode, doing the fatally-wounded-Pris-replicant flail, flinging all manner of dung from words like "unconstitutional" to the tired but usually effective bromide of "killing Social Security!" Kind of funny, as in disgusting, that Malig-Nancy Pelosi declared Trump's actions as "unconstitutional slop." Unfortunately, a mobbed-up old battle-axe doesn't have the vocabulary to come up with that on her own, and what makes it that much worse is that she was parroting our very own Ben Sasse! Yay!

"The pen-and-phone theory of executive lawmaking is unconstitutional slop. President Obama did not have the power to unilaterally rewrite immigration law with DACA, and President Trump does not have the power to unilaterally rewrite the payroll tax law," Sasse said...

Well, Senator Sasse, you are correct in the abstract, but this is illustrative of the overall pickle we're in as a nation and society. The Democrats will use the Constitution as a shield as well as a cudgel when it suits them. When they can't and it doesn't, they ignore it completely, banking on the fact that a rogue judiciary and the SCOTUS will rubber stamp anything they do. And even then, the bureaucracy is always there to implement laws with zero constitutional authority, again relying on the judiciary to cover their ass and carve it into granite when the lawsuits fly. We on the other hand, have to always play by the rules even when the entire thing is rigged from start to finish.

Look, I get it. I'd be lying if I said I thought that this end run was kosher. But neither was DACA and look what happened when Trump exercised his absolute legal authority to end it. With America's cities going up in flames and Bolshevik Revolution 2: BLM/Antifa Boogaloo a red nether hair's breadth from wiping us out for good, should we be sticklers for following rules that the other side never does?

Or perhaps I'm over analyzing this whole thing. As I said, from a political standpoint, it was brilliance. Trump read Alinsky's damn book and played this perfectly. Look at what the Democrats are being forced to do - oppose a program giving money to average citizens who are hurting because of Democrat-imposed lockdowns and shutdowns. Cutting off the people from Uncle Sugar does not go down well with the public, especially less than 90 days from an election.

Paul Mirengoff, who's no big Trump booster was blown away:

...Questions surround the legality of accomplishing at least some of these things via executive order. Trump's response to that might be, "so sue me."

There are also questions about the fiscal impact of some of the measures, at least for those who still care about the national debt. In addition, there are questions about the efficacy of a payroll tax cut and the wisdom of extended generous unemployment benefits.

However, as a political matter, Trump's move looks like a masterstroke. Since the days of FDR, the public has always seemed to approve of presidents who act to ameliorate suffering while Congress diddles. A flurry of activity, even of the futile or potentially counterproductive kind, makes a president look energetic and caring.

In this instance, Trump's move might well force congressional Democrats to reach a deal. That outcome, too, would be a political win for the president...

This move comes right on the heels of Angel-of-Death Cuomo's decision to order New York state's public schools to open on time for the fall semester. The two, like virtually everything in the links across all categories, are interrelated. People need to get back to work and the continued lockdown is now a political albatross around the Democrats' collective neck, with the violent riots and Joe Biden's liquefied medulla oblongata the cinderblocks tied to each leg.

Insofar as the only way they can defeat Trump is through the Mail-In Voting swindle, having the schools open, and in a state as important politically and population-wise as New York, means it's safe to vote in person. Schools representing a large percentage of polling places in NY and no doubt all over the country. Naturally, Cuomo can pull a fast one and order them shut but to do that would earn him the wrath of New Yorkers across all political lines.

Even putting that aside, the nation has had enough; enough of the riots and thuggery of Antifa and BLM, enough of Dr. Falsie and his Medicine Show, enough of having lives and livelihoods destroyed and enough of being blood-libeled as racists. Again, at the risk of the pessimists shaking their heads, let me just ask, given all of this, can you still see Biden's carcass dragged over the finish line in a clear, unambiguous victory come November? I can't.

I haven't talked to my accountant about this but from news reports I thought it only covers the employee portion of the tax. Basically, it sounds like workers are being offered the chance to defer paying taxes until next April. Presumably the pressure then builds on Congress to defer the payment date even further, but who knows.

I don't see how the employer even has that option?

The employee "pays" the tax... the employer just takes it off the top line before the check is cut and hands it to The Gummint.

If Uncle Sugar isn't collecting that money, it has to go into the employee's check. Otherwise, it's at best a huge pay cut, and at worst, theft. (i know, i know, taxation is theft...)

Here's hoping it makes Americans think long and hard about the absurdity of payroll taxes in the first place... we've mostly become so inured to the concept that we don't even think about it anymore.

They would be delighted to continue providing us auto coverage though.

We switched everything to USAA.


We lived about 200 yards from the Thames river on a hill over 100ft above the high tide mark and over 2 miles from Long Island Sound. At that time the last hurricane that had come through the area was in 1938.


They just wanted to get out of the home owners insurance business all up and down the east coast.

Depending on where you live, $100k is a lot of money or a decent middle-class life or, in a small number of places like San Francisco, barely getting by. For better or worse, $100k is a BIG ROUND NUMBER that has been used as the cut-off for a long time for a breathtaking array of policy decisions.

It is often lower. Student loan interest deductions, I think, are terminated at $72k by the IRS. The tax brackets themselves are normalized to inflation to prevent bracket creep, but virtually nothing else is.

My biggest annoyance with the insanity of tax law is that the employer is *forbidden* from putting their half of the payroll tax on an employee's pay stub. 342 A good point on No Student Loans, but understand what this means - (and I think it's important for every young person to understand this) - it means NO Ivy League pedigree, no Big Name School degree, no graduate work (unless it's late in life) because all of those things have had the price jacked up based on the availability of endless student loans. SO the way to advance without this (well, there are several strategies) but one is start off at a 2 year JuCo with off campus housing, aim at a job and an industry you like, after the 2 year degree work a bit, maybe then go for a 4 year if your company will pay it and let you take courses part time in the evenings. The glorified "4 year experience" is out, forget it, it is just a big waste of time anyways.

what has happened to inner city youth is absolutely the fault of public school teacher unions. specifically, the protection of incompetent and malicious teachers in that system.

when we worked with Mastery Charter, they would come to Philly's failing schools and literally change NOTHING (well, uniforms) except teachers didn't have to be in a union. Pay was comparable, and they wanted to keep the existing teachers for a smoother transition.

but many teachers refused to work in their schools anymore, solely because they would lose "union protection." they would be held a tiny bit accountable. they'd actually have to work.

that experience really opened my eyes way back then to what was going on with Hero Teachers. please I know there are many who are great! there were a lot who chose to stay after the handover (this was done when a school was absolutely failing and broke) and they were so much happier with Mastery in charge.

BTW Mastery was Chaka Fattah's pet project, he grew up with Philly public schooling and knew it desperately needed to be reformed. that's how I came to know him. for a "worthless criminal" Dem, he really cared about this mission and probably worked longer hours for Mastery than he did for the City ha ha.

(probably he gored the wrong ox with that project and that's why he ended up in jail for stuff that everyone in city govt does routinely.)

My mother had about a million to leave me, then my step-dad got dementia and went into a 9k a month nursing facility. I don't regret one cent she spent on him. He was a wonderful man. Still haven't been able to have his funeral. Stupid COVID.

Maybe she wanted to leave to her relatives and was happy the way she lived. I don't know. It is just that I've seen examples of people waiting till retirement to do things. And that never came. Because got sick and died.


My aunt passed away a few months ago. Aged 89. No college degree, worked at a blue collar job all her life. She had no kids and never married. She lived very frugally. She passed away with nearly $1M in net worth. She never splurged on herself.

Strip away Congress's ability to write, "the secretary may determine" to cover up the fact that Congress doesn't write laws but enabling acts, and we're on the right path.

I'm not in the "no student loans" camp. I am entirely in the "no special rules for student loans" camp. No deductions for interest. No special rules regarding bankruptcy. No alternate qualification mechanisms. No government ownership of loan outfits.

If student loans were treated like any other consumer debt, interest rates would be the twenties and suddenly the lender will care - a lot - about your major and your performance. Are you looking to study engineering? Have good grades? Okay. 10% and it'll stay there if you keep up your studies. Post-feminist social theory will be another story.

And faced with that kind of burden, the demand for loans is going to dry up. You won't take one on unless it really has a good chance to convert into earnings. And then when the spigots are turned off, the costs of college will crater. Many institutions will go bankrupt and fail. That's okay.

Then on their death they can transfer 100 acres in a flourishing business district of Houstan, for example, at a stated value of $1 per acre, which then can be immediately sold for $1 million per acre. And the seller can claim "I made that money myself, I only inherited $100 worth of land!"

The best part is that when you jump generations like this, all Capital Gains taxes are nullified, and it simply revalued at the new, current price. Wealthy families have been using this trick since the days of the Astors and the Vanderbilt's.

On housing, the "old rules" are the safe rules:
- ~3x income
- No more than 25% of gross income on housing expenses ("front-end ratio"); no more than 33% of gross income on all debt service combined including cars, credit cards, etc. ("back-end ratio" or total debt-to-income/DTI)
- 20% down or more, saved organically

Under the "old rules" you'll be fine. You can still do better if you can afford it - 33% all-in DTI is too high for my liking - but you're not going to drown.

Unfortunately you're right - school won't solve the core problem, but it is a respite. I was abused in my home as a child, and I lived for school days. Weekends were a nightmare for me. I watched all of a Biden commercial late last week. It was filled with Joe saying "Build Back Better" and "Buy American" and other slogans. IIRC, there were text items running at the bottom, much of which Joe did not voice, such as Federal money will not be used to buy from China. Really. So for all of Joe's pals and backers with "private" deals with China, it will be business as they want it, and our drugs, medical PPE, and G-d knows what else can still be made in and bought from China.

And the portions were so big, generally, that each entree provided the core of a second meal -- so it wasn't as bad as it could have been. Still, we haven't been out more than 2 or 3 times since March. We've done takeout from a couple of our favorite places a few times. But, even with the increase in food prices at the grocery, eating at home has kept more cash in my wallet.

Those people don't care, and the other party cannot/will not field a decent candidate. Ain't happening.

507 Obama was our Marius and Trump is our Sulla. The Republic is dead, and the Empire has yet to begin. That's a great tragedy, but we are now faced with a choice of several regrettable, but nevertheless distinguishable, post-Republic environments.

If we obey the Constitution and our foes do not, we will lose, and the Constitution will perish. If we win, by whatever means necessary, we can restore the Constitution afterwards. That's how war works, doesn't it? You put aside the rules of civilization, win, then resume civilized life.

Now, will we actually resume the Constitution after we win? That's the struggle beyond the struggle. Rome didn't. France never found a stable government after monarchy -- everything they tried crumbled in less than one lifetime. Russia, I don't want to think about. Spain didn't, but found stability of a sort. England exchanged a king for a parliament, and it only took 80 years of intermittent civil war.

We are not Rome, nor France, nor yet even England. We might pull it off. I'll be in there pulling for Constitution + a few amendments, as long as I'm able. AFTER we win.

519 For those who have lived along the border, roadblocks (sometimes made by weeds and rocks) mean illegals are waiting at the fringes of the road to threaten and rob you when you stop and get out of your car to remove them. I personally know people that have been robbed and assaulted that way.
