A Short Tutorial On The General Flynn Case Procedures [AlexTheChick]

A primer on just what is going on right now from a procedural posture in the Flynn case. Please note that this is just that, a primer, and thus significant amounts of nuance will be left out. As will the profanity I used while typing this.

Cast of characters: Department of Justice – the prosecutor. Flynn – the defendant. Sullivan – the judge. DC Circuit – the circuit court (appellate court) that oversees Sullivan’s district.

Flynn filed a writ of mandamus (do the thing) which the DC Circuit granted. That decision was made by a three judge panel. Three judge panels are how matters are heard initially on the appellate level with some very limited exceptions.

Yesterday, Sullivan asked for a rehearing en banc. That means the entire panel hears it. Requests for en banc are a possible step in the appellate process. En banc is generally denied but it is not uncommon for en banc to be requested. Why is it requested? Because that gives the entire circuit the chance to issue a ruling and thus make clear that this is what the circuit holds, not just three judges.

Today, the DC Circuit issued an order on its own motion (sua sponte) ordering Flynn to file a response to Sullivan’s petition. In other words, the court wants to hear from Flynn directly why en banc should be denied. The DOJ may also file a response, though that is not mandatory. Flynn’s response is mandatory. Sullivan has been prohibited from filing a reply to that.

The ten day time limit is the normal time period for responses. The word limit is a bit unusual but not overly so. The stay is completely routine. Since the court wants briefing, the court will stay until briefing is done.
Despite the unique factual circumstances at issue, the procedural matters are standard. Order entered, en banc requested, reply requested, order stayed. That’s how the procedure goes.

Stop reading into matters being filed at deadline. Everyone does that. Stop reading into the court requesting a reply. That’s routine. Stop even attempting to figure out how votes will go because of the stay. That’s pretty much required.

As to how is Sullivan a party in this? Because the writ is directed to him. His actions are at issue and thus he is the actual party at interest.

14 it's pure silliness, Sullivan's petition filed yesterday was a non-event. One appeals judge has to move for a vote. Since there was a dissent, there you go...right?

At the end of the day, the two biggest issues are too embarassing for a judge to even consider.

What does "by leave of court mean"? Duh, it means the prosecutor has to tell the judge. What else could it mean? That the judge gets to investigate the entire DOJ to find evil Bill Barr's hands on the dismissal? Nope.

Second, the writ was granted because of the above point, the DOJ will face stupid damage because they'll have to answer questions from ... who? Gleeson? uh no. not gonna happen.

Finally, Sidney Powell's releasing fucking embarassing Brady evidence. Just end it now

33 some were saying that because Sullivan isn't a party he couldn't file his petition yesterday. That misses the point, at this stage, the petition has no legal effect. An appeals court judge has to get the ball moving by voting for an en banc hearing. the petition is just a request. The judges already know whats' going on.

And reading Sullivan's idiotic motion, aside from getting every legal issue wrong, he's also in the dog-house for acting so insane, they had to grant the writ of mandamus against him.

His only real arguments are "I wasn't bad enough for mandamus". And that breaks down to "you gave the writ to the DOJ but Flynn asked for it..."

yeah, this is a good point. But the petition is irrelevant, there's no legal effect of it.

Sullivan mis-cites Sineneng which oops...states the judge is passive. Not good.

But, at the end of the day, what matters is there's one judge to spark the internal vote and then 6 to agree. Happens whether or not there's a petition. Especially in a high profile case where everyone is ALREADY aware of the issues.

The only issues are:

1. what does "by leave of court" mean wrt dismissal
2. how to stop biased, unhinged amicus Gleeson
3. does it matter if writ granted to DOJ not Flynn?

The judge, of his own volition, inserted himself into this process, did he not? Isn't the decision whether to seek an en banc ruling properly let to either the prosecution and the defendant? Sullivan ought to be hauled before the appellate bar for a competency hearing.

an interesting point, his unhinged petition is probably not going to go over well. But the DC CIR is filled with crazy lib trial judges, so it's par for the course.

Sullivan is lucky they granted this because he needed to comply with the writ (he may have had another week) but then he would be in trouble...contempt or removal.

89 It was my understanding that the 3900 word limit ubder Federal Rules of Appellate Procedure Rules 5, 21, 27, 35, and 40 is a recognition of the computer age. The limit for pleadings under those various rules used to be 15 pages. The word limit came about when computer technology allowed simplified accurate word counts. It was assumed that a "page" equaled about 260 words (double-spaced), therefore, 3900 words was equivalent to 15 pages.

Not to go off on a tangent (while I do exactly that) - This, to me, is one of the places the remake fell down. I think the judge in the original, put in a difficult place, had a clever solution handed to him. In the new version, it seemed to be "well, we believe in God, so why not Santa?"

As should have been crystalline clear, I was addressing only the current procedural posture. From that limited perspective, everything that is going on right now is normal procedure. I am not addressing, nor shall I address now, the underlying facts. I am addressing only the mechanics of what is currently happening. And those mechanics are completely normal.

The judge is not a "party", the judge is not even an individual; the judge represents the court.

I stated explicitly why Sullivan is a party to this appeal. Again, you are free to believe that is not the case. However, I assure you that all those involved in the case believe otherwise.

There may be some misunderstanding of parties as currently being used on appeal. Sullivan is not a party in this case. That is accurate. However, he is THE party for the purposes of the appeal. The only person whose actions are being addressed are Sullivan's. The writ is directed to his actions. For purposes of the writ and the appeal of the grant of the writ, he is the party at issue.

You may think all of that is stupid, because of how stupid it is, but that is how the FRAP views things.

A writ of mandamus is (very rarely) issued to direct the court to fulfill a ministerial duty. (because the upper court is not going to direct the court with respect to using it's discretion--that waits for a full blown appeal)
look at it this way--a hearing is afforded in American courts so as to fulfill the "due process" requirement in the constitution--a defendant has a right to be heard.
So--who is being afforded "due process" by this en banc hearing? there's where you see the absurdity.

How it usually works is petition, reply, counter reply.

When a court says okay reply but no counter reply, that's the court saying shut up you assholes we are done with listening to you.

And, yeah, do to various and sundry fuckwittery by lawyers vis a vis font size and kerning, courts have VERY precise requirements as to how things can be filed. In fact, the Federal system requires a separate affirmation by the submitting attorney that the word count function of a word processing system has been used to insure that the word count requirements were followed.

McCauley, in Extraordinary Popular Delusions, made a very good case as to why Trial By Combat may have been your best option in the middle ages. In a time where "Courts" were notoriously corrupt, and especially if you knew you were going to be judged by some Lord of the Manor who had always hated you, then Trial by Combat at least gave you a chance to come out on top.

It also meant that the Big Bruiser of the village could go on terrorizing his neighbors to his heart's content. Of course if he got too obnoxious, there were always people around who'd gotten pretty good at making home grown poisons.

In fact, the Federal system requires a separate affirmation by the submitting attorney that the word count function of a word processing system has been used to insure that the word count requirements were followed.


The scientist in me would tie their asses yo for weeks at a time with questions of how and when word counter was calibrated and whether the firm in question has a certified record keeping system that documents said calibrations.

Not to mention the question of how often the firm brings in outside word counter calibration standards' checking firms to determine whether everything is on the up and up vis-a-vis standards set by all and sundry certification standards'-setting bodies.

Oh, it would be fun!

179 To me, if'n I was a Federal judge, I'd be pissed that the DOJ brought this case, lied about everything, then had to slink away after it was discovered this was a criminal, political hit job. But what does thug Sullivan do, jumps in a tries to continue the prosecution.

That the court didn't slap him down and dismiss the case shows me that the entire court is corrupt. Period. End of story.

Is it any wonder sane people hold the courts and by extension lawyers in contempt. I know there are a number of lawyers on this site and you get tarred with the same brush but even you have to see time is running out.

"Absent an order of the court, a reply to the responses will not be accepted for filing.

Couldn't "absent an order of the court" be read to mean that while the court is telling Sullivan "we're done listening to you", the court is also telling everyone "but we might change our minds and let Sullivan reply to Powell's responses after all." ?

The main reason there's a page limit is because everyone on the court already knows the arguments that will be made by each side--no one is really being educated. Mainly, the court needs to hear the timeline of what happened.*

Argh! Having been deposed as both witness and expert in liability and patent cases I immediately flashed back.

The kicker, though, is that one experienced in such a role can easily play the lawyers. While the lawyers have been through it all, and know the right questions to ask, and can anticipate the answer(s), they can not anticipate all answers, or the tenor of those answers.

It isn't all that difficult to kick the props out from under those guys, if one is experienced.

I heard on a radio news blip yesterday that Amazon has asked all employees to remove the TikTok app from their personal phones. Same claim of "security".

Before it was very difficult to find the info, and sometimes one had to leave Amazon to find the product maker's website.

Yes. I've forgotten her maiden name, as it was Polish and lacked any vowels, but she got the "Curie" from Pierre, and he was a stud in his own right, doing a lot of the seminal work on magnetism in particular (e.g., Curie temperature). Overshadowed by Marie because ... reasons.

Trump is a Grand Master. The DACA citizenship issue is a Blue Chip in negotiation with the Democrats/Nevers.

He is choosing to spend it this way, instead of negotiations with Congress. It seems like a change to me.

Is PDT realizing it is time NOW to spend it, because it will not be of value later?

Most DACAs are now teens or in their twenties, so they are to a greater or lesser extent, already "Americanized" about as much as could be.

The administration has long ago, and obviously and inarguably, ruled that DACA was unconstitutional. That position surely has not changed, so any EO would be very limited in what it could do.

Impossible to believe that Trump will be attempting any version of the ludicrous illegality of the original DACA EO.

He has long correctly pointed out that Congress must change the law, only "fix".

He seems to tell the reporter that SCOTUS's recent ruling "gave" the president more powers, and this is related to some new "bill" (already we've got a contradiction) that is coming. Then he seems to confirm that something will be in an EO.

The whole exchange is kind of batshit.

Which I don't care about, all I care about is what happens.

Cruz and a few others already going ballistic, reminding all that only Congress can change a law. But as I said, Trump muddied the waters enough that I'm not too concerned, and I expect a clarification.

410 With all respect, I am not sure that the author is correct on the issue of whether Sullivan is a party. Certainly, no citation is citation to precedent or rule is given, and the logic that the because there is an instruction to the court, the court is party, falls flat on its face.

Appeals Courts regularly remand cases with instructions to the lower court Judge, to include reversing their rulings. That does not make them parties to the dispute with procedural rights. A lower court does not get to argue against an appeal of an order or decision; the order or decision speaks for itself.

411 The question to AtC and others here who suggest that the Appeals Court is just following routine "hey, no delay intended, brah" - is simply this:

Couldn't the District Appeals Court have just used one word to Sullivan's request today?

"NO"

I don't think there is anything in their "rules" that suggests they have to seek a reply from Flynn and the DOJ - they just requested that for their own review. Meaning that this is, basically like Tom Servo and CT have suggested, really ultimately a delaying tactic with no clear ability to change what the three panel ruling already ruled.

Being a liberal requires that one ignore reality/facts (unless convenient or required) and create in ones mind a separate yet equally plausible reality that can ignore any fact. Up to and including the laws of physics which are the rules of how the Universe works.

They also require that one ignore thousands of years of recorded history telling us how human beings react in certain situations and what they generally will do under normal conditions. (normal being whatever you want it to mean. Along with those thousands of years goes jillions of stories at least one of which will prove your point whatever it is).

To learn the law and how the legal system works (two sometimes exclusionary situations) requires this sort of mind and an emotional mind set that allows one to compartmentalize well.

I coulda been a lawyer but I was too crazy for them. So I became a technician. That's dumber than an engineer but smarter than a designer.

It has EVERYTHING to do with:
1. Orange Man Bad2. Flynn has the goods on Dems but is gagged3. Gag must be continued PAST THE 2020 ELECTION
So protocol be hanged! The only process that matters is step 3 in the second sequence above. Therefore, the DC court will find *some way* to allow for Sullivan to prevail, thus taking this farce well through the summer, where Flynn will ultimately prevail (he MUST; even no precedent cannot prevent overt bastardization of not having a prosecution as part of actual sentencing recommendations). Of course, by that time SCOTUS is shut down for the year (barring presidential election shenanigans) and Flynn's case, and MORE IMPORTANTLY, HIS SILENCE, must remain in place until after the election.
