Robert Barnes: "I'll Give You a Little Secret.... Judge Sullivan Is As Dumb as a Pile of Bricks"

This guy posts as Barnes Law on Twitter. I believe he represents some of the parents and students of Covington in their defamation cases, but not Nick Sandmann.

I only specify that because I have previously misidentified him as Sandmann's lawyer.

Anyway:

Barnes says it's "widely known" that Sullivan is "dumb as a pile of bricks," and also widely known that he is almost entirely dependent on his clerks to do his work for him -- which is the reason, Barnes speculates, that he was so absurdly stupid in accusing Flynn of treason. He is dumb, does not read the cases, and barely skimmed the case, and therefore thought that Flynn was somehow implicated in treason.

He noted that the Supreme Court just ruled on the maneuver he is attempting, that is, summoning amicus filings in a criminal case. The Supreme Court said "no." Sullivan ignored that, either because he's ignorant as shit, or didn't read the briefing his clerks had written up for him, or because he's so fucking partisan he doesn't care what the law is.

As you probably know, this idiot, who is supposedly himself a lawyer, and jurist, and learned judge, had to hire his own fucking lawyer to explain to him what the law is.

As others are asking: Does he think the taxpayer should pay for his personal lawyer? Of course he thinks that. Why? Who knows! He's a judge! He gives orders, he doesn't explain himself!

Former Whitewater deputy independent counsel Sol Wisenberg told "Bill Hemmer Reports" Tuesday that the Michael Flynn case judge's "highly unprecedented" move to hire a personal attorney could indicate that he's "in trouble."

U.S. District Court Judge Emmet G. Sullivan's decision to retain high-profile attorney Beth Wilkinson comes as the D.C. Circuit Court of Appeals reviews Sullivan's order not to immediately grant the Justice Department's request to dismiss its case against the former national security adviser.

"High profile attorney" means "high cost attorney."

So enjoy Ms. Wilkinson's work, everyone: You're paying for her, because this retard knows he doesn't understand the law and needs someone to write his defense for him.

...

"I think what they're [U.S. appeals court] saying, [is] 'Judge, what are you doing? You better explain what you're doing,'" Wisenberg said. "I interpret it as a flashing neon sign ... a wake-up call to him [to] explain what you're about because the moves he's made have been very, very unusual."

...

Rather than granting the DOJ's dismissal, Sullivan appointed a retired federal judge to argue against the department's position and to consider whether Flynn needed to be held in criminal contempt for perjury.

"There's no question that what he seemed to be doing was delaying this process," Wisenberg explained, " and ... the D.C. Court of appeals [is] saying, 'You're going against clear law here. What are you doing?'"

Back to the video. Robert Barnes says that Sullivan "does not understand the legal basics," which is why he's had to hire a lawyer to explain to him what the law is.

Later in the clip, he discusses the likely outcome in this mandamus hearing. First of all, he thinks there is a "high likelihood" the motion is granted and Sullivan is ordered to dismiss the case. The motion also asks for Sullivan to be recused from the case, and I guess Barnes also means the Court of Appeals will order that as well.

He calls the hiring of a private lawyer with taxpayer funds an "abuse of power," and suggests that Sullivan's cavalier decision to do this suggests that this isn't his first abuse of power.

Unfortunately, he doesn't think that Sullivan will be suspended by the Court of Appeals or suffer any further consequences beyond the extreme embarrassment of being ordered to do his fuckiing job and also being removed from the case for lack of objectivity.

And also: Lack of intelligence.

Hopefully the Court of Appeals will read this dumb bunny the riot act, and then this moron's clerks can explain to him what the words in the order mean.

12 Hey ace and everybody!

I can absolutely believe Sullvain does next to no work himself, because I've worked in law firms and at a lot of them, that's how the top attorneys operate as well. They do next to no work and delegate everything.

There's too much law to remember on top of that, and it's only human nature to forget most of it. I'd bet that after five years, many top-level attorneys are as stupid as Sullivan undoubtedly is. All they care about knowing is how to accrue absolute maximum billable hours.

A while back I said, there's no end to judge arrogance. There's no end to arrogance in the law field, period.

46 Judge Sullivan will blame his clerks for this fiasco, but he is the one that has to sign everything. I know, I was a law clerk, and while I drafted orders and responses and did research memos I always provided the judge with the material I used, the copies of the case law and statutes and he always read everything through and would ask questions. And the why for what the judge and me did was because his signature was going on the order and it was going to correct according to the law. We wanted nothing coming back to haunt us.

76 We all know he's an Affirmative Action Judge, we're just too nice to say it.

We had a JP like that here in my town. He had been a local football star and then a Sheriff's Deputy, and he was popular with the votes in his district. Only those who worked in his courtroom could figure out that he could barely read and write, and the JP position in Texas doesn't require a law degree - or any degree, for that matter.

How he decided cases, he would listen to them, pick who he liked, and then ask the winning attorney to write up all the papers and orders in the case for him, which of course the winning attorney loved to do. He would sign them all without reading them.

If you were ever in his court and saw you were up against one of his buddies, you just gave up right there. You'd think attorney's would protest, but those who became his pals loved him more than any other judge in town because guess what, they never lost. Guaranteed.

I do fiscal analysis of proposed legislation for a state government. I signed off one day on an analysis of a bill which my boss had written under my name. I missed that she had failed to address an entire section of the bill. I was the one who got the angry phone call and ass-chewing from the Representative. My name on the bottom line, my responsibility.

86 It's not even a secret that most judges are not the brightest.

I found out a few years ago that a former boss of mine is now a judge and I was horrified because not only is she, well, not bright at all, she is an utter wuss and does not have anything approaching a judicial temperment. She got the position because of family political connections.

I didn't watch yet so I don't know but tons of people are pointing out how can Sullivan have a private lawyer work on this stuff without there being ex parte communication.

I fully expect there to be a motion filed requested an extension of time to file a response. I also *crosses fingers* expect that to be slapped aside.

As far as what consequences will there by for Sullivan? Retiring to a nice appearance contract with CNN and/or MSNBC is my guess. Oh, you mean negative? HAHAHAHAHAHAHAHAHA

Bus and light rail service suspended city wide until further notice, and my local USPS depot is suspending mail delivery until further notice too.

"Flash looting" pretty steady today, and there's a good chance it'll spread throughout the entire metro area, unless the National Guard is deployed in large numbers. Reports about random Walgreen's and CVS's being attacked in suburbs now.

People are literally traveling in groups of three or four cars without license plates. This looting isn't a bunch of locals on foot and bicycles smashing up big corporate locations.

It's coordinated gangs looking for any untouched stores. It's a fucking gold rush, and the cops aren't mostly unable to stop looting in specific locations because the mobs are too big to contain.

184 There is a much more enlightening piece of that interview.

... but I kept getting bad grades and I was like, "What?" But I dug in and found that they had written a template of the "correct" answer and the correct answer was to pretend the law wasn't was it was, to just manipulate quotes from different parts of it, and pretend that it already supported this outcome because the goal was "your outcome is this, so how do I manipulate the history of events and the history of law to pretend the law supports something it doesn't in fact support." And that's what's happening across the country, so a lot of these clerks are really bad. And in Federal court, I'm often battling the clerks, not the judge - unless the judge is an old-school judge who doesn't care what the clerks think and does what they want.

"It's a process" is the ingrained comeback to any polite request for accountability. Or she'd get her put-upon boss to cover for her, give her words to say. The top tier of SC's social services can't hold onto a director for CPS. They run screaming within six months. It's sad, bad and makes me mad. Do NOT let the gov't get involved in your family for any reason. Do NOT get involved in foster care, if you love your own family.

What grammie winger said. This is similar to what you can witness at Angkor Wat. Please note, I am not calling actually people monkeys, just that the methodology of young raising by the parent is similar. There's a series of u-tube videos of the monkeys and how they raise their little tree rat babies based on the monkey pecking order (adult males on top, then adult females, then juvies, then babies) and how that pecking order is turned on its noggin by the damned tourists hand feeding the babies, and then the juvies and adults punish the babies. It's hard to watch, but not quite as hard to watch as a cop kneeling on some dude in handcuffs throat.

I actually think they WILL do that, but you have to realize, if they hadn't given him the chance to answer for himself, then they themselves would be open to criticism from the level above THEM. So they are going very carefully, while being as firm as they came.

Also, Legal Time is not Real Person time. 10 days in Legal time is like 5 seconds in Real Person time.

Daughter just last week was called in on a case of sexual abuse of a child, mom strung out on drugs, "uncle" drunk and combative, child went to DCFS. She'll likely live out her childhood in foster care, with little stable influence. And she was very very young. Daughter says she has no chance, barring divine intervention.

I knew a few soldiers in the Army who were foster parents, and they had horror stories about the foster care system. At this point I think it would be kinder to the children to simply take them and place them in boarding schools for a minimum of a year before considering giving them back.

Reading the tea leaves, it looks like Trump is pushing the FTC's ability to punish deceptive business practices. In my unstudied opinion, there's a lot of opportunity there. For example, shadow-banning people is inherently deceptive. Also, having broad rules that make it easy to interpret any behavior you dislike as a contravention to those rules is inherently deceptive.

Trump might be able to force them to have much more narrow rules and make them defend their decisions to ban some and not ban others with punishments for deviations from their rules.

Here, let me opine on which is better - elected or appointed judges.

If you elect your judges, then appointed is better.

If you appoint your judges, then elected is better.

I trust the pattern is obvious.

Psychopaths had a federal case that went to trial and the presiding judge was on senior status which is eh sorta retired but we haul you in when the docket is too full.

Judge was 78. He made a WILDLY inappropriate comment to the court reporter who did the smart thing and didn't respond at all. I'm talking a comment for which she would have been well within her rights to slug him.

To all of their credit, both my bosses and the two lawyers for the defense all objected immediately to the comment. Judge's response? What are you gonna do, I'm 78, I'm on senior status, and they won't ever get rid of me.

It made me wonder just what all said judge had been up to with his clerks over the years.

I have a good friend that had a mechanical contracting firm. A big tycoon that has something to do with Beanie Babies stiffed him and that was the straw that broke the camel's back.

Of course that was after his shop unionized and his top two guys did that. He was a great boss that his wife bitched about because he would pay for vacations for his top workers and they didn't ever go.
My experienced opinion is that unless your husband sees light at the end of the tunnel, confirmed light, then shut it down. Don't go throwing good money after bad. Employees are out for themselves, the owners of small businesses should be too.

Pay attention, social unrest is social unrest, whether it's because some guy was murdered (yes he was) by the police, or because a whole shitload of people said "we ain't following your orders on this Covid bullshit".

Any police officer involved fatalities surely crossed her desk at some point or another. Long story short, she was an integral part of the city government including the mayor, police chief, city council, etc., and there were whispers about her "problematic" prosecutorial record during the primaries, long before this most recent incident.

Are you talking about this case here, the one in Minnesota?

I've only seen about 20 seconds of video, so I don't know, but there's talk of the cop's facial expression.

I know there was the case in St. Louis, guy clipped the cop's car, I think, then a chase, with the cop's audio saying "I'm going to kill this guy." They managed to stop the car somehow, cop gets out of the car, the window is lowered, and the cop puts his weapon inside the window, shoots the guy however many times.

After the shooting, other cops drag the dead guy out of the car. Meanwhile, the shooter cop returns to HIS car, is seen on video rifling through his "go bag," emerges from his car, then GETS INTO THE DRIVERS SEAT OF THE DEAD GUY'S CAR!

Case went to trial. A bench trial. Cop was acquitted.

The Cub Grocery store two blocks away was also looted, and they looted everything all around them too.
