Michigan Judge Rebukes Transexual Governor "Gretchen" Whitmer and "Her" Fascist AG, Telling Them the Barber Has the Right to Remain Open

Update: You don't say, Genius?

Stay-at-home orders intended to curb the spread of the coronavirus could end up causing “irreparable damage” if imposed for too long, White House health advisor Dr. Anthony Fauci told CNBC on Friday.

“I don’t want people to think that any of us feel that staying locked down for a prolonged period of time is the way to go,” Fauci said during an interview with CNBC’s Meg Tirrell on “Halftime Report.”

He said the U.S. had to institute severe measures because Covid-19 cases were exploding then. “But now is the time, depending upon where you are and what your situation is, to begin to seriously look at reopening the economy, reopening the country to try to get back to some degree of normal.”

Are you fucking kidding me right now.

...

The judge refused to grant the AG's motion to force the closure of the barber shop, which means he's free to continue trimming hair.

Michigan Chief Medical Executive Dr. Joneigh Khaldun had argued in an affidavit that Manke's shop was a threat to public health, but Stewart said not enough evidence was shown to prove that.

"The attorney general has not presented any studies underlying the doctor's conclusion,” Stewart wrote in his opinion. "The attorney general has not shown any nexus between the cutting of hair and an increased risk of transmission. The attorney general's filings rest more on general facts about COVID-19 than specific practices or conditions at Manke's business."

...

Nessel [the fascist AG] personally attacked Manke last week, questioning his motives for wanting to open his barbershop.

"Mr. Manke, he's not a hero to me," Nessel said. "He's not a patriot. A patriot is a person that fights all enemies, foreign and domestic, and does everything possible to protect his fellow countrymen and countrywomen. And, to me, Mr. Manke is doing just the opposite of that, and he's being selfish in his behavior in that what he's doing is allowing the virus to spread."

...

"The government is not my mother," the barber said to hundreds of anti-lockdown protesters in front of the Michigan state Capitol in Lansing last week. "Never has been. I've been in business longer than they've been alive."

Clips of those statements at the link.

Freedom is on the bloom in Ohio as well -- there, a judge has blocked the fascist Republican DeWine's Nazi health minister from shutting down all gyms, even as she claims "absolute authority" to do so based on a 1908 edict scribbled down during a panic over tuberculosis.

In a scathing nine-page decision, Lake County Common Pleas Judge Eugene A. Lucci excoriated Acton and her health department for exceeding their authority, saying the director "has no statutory authority to close all businesses, including the plaintiffs' gyms." Acton, the judge said, "has acted in an impermissibly arbitrary, and oppressive manner and without any procedural safeguards."

Judge Lucci went on to say that fundamental liberties--the right to own and use property and earn a living--are at stake in this case. Acton has "criminalized lawful businesses, imposing strict liability for violations, including severe criminal, civil, and equitable penalties," the judge opined, noting that "some of the plaintiffs' businesses will not survive the lockdown of two or more months."

...

Members of the Ohio legislature have been up in arms in recent weeks, calling for Acton to be stripped of her unchecked power--and rightly so, as Ohioans continue to suffer under the weight of the lockdown orders, which have devastated families, business owners, and the state's economy. Ohio has nearly a million jobs in the last two months.

A measure currently under consideration in the Ohio Senate (and already passed by the House) would limit Acton’s shutdown orders to 14 days and require her to consult a joint legislative commission if she wishes to extend such an order.

Ohio Governor DeWine, heady with power, has vowed to veto the bill if it lands on his desk.

Judge Lucci seemed to disagree, saying that if he failed to issue an injunction, "There would be a diminishment of public morale, and a feeling that one unelected individual could exercise such unfettered power to force everyone to obey impermissibly oppressive, vague, arbitrary and unreasonable rules that the director devised and revised, and modified and reversed, whenever and as she pleases, without any legislative guidance."

"The public would be left with feelings that their government is not accountable to them," Lucci warned.

Oh, would they?

What a crazy feeling. Only crazy people would feel such crazy feelings.

199 I cannot over-sell the importance of this reasoning from Judge Stewart:

"The attorney general has not presented any studies underlying the doctor's conclusion," Stewart wrote in his opinion. "The attorney general has not shown any nexus between the cutting of hair and an increased risk of transmission. The attorney general's filings rest more on general facts about COVID-19 than specific practices or conditions at Manke's business."

Substitute anything for "cutting of hair" above, and it applies. Opening a church for Sunday services, operating a bar, anything.

There are no hard and fast facts today about bug transmission. Hell, yesterday the CDC revised it's ESTIMATE of the period a Wuhan bug can survive on a surface. Emphasis on estimate.

Everywhere there are still restrictions, lawyers should be working pro-bono bombarding courts with challenges to restrictions using Judge Stewart's ruling.

210 A few stories from the Illinois Policy website:

Illinois lost 762,200 jobs from mid-March through mid-April, the largest monthly jobs loss in state history, new data shows.

Illinois Gov. J.B. Pritzker has done more to restrict everyday life in Illinois than any other leader in the nation, according to a survey of COVID-19 control measures by Wallet Hub.

Particularly concerning is that the state is scheduled to grant $261 in pay raises to state workers on July 1 - including an across-the-board pay hike of 2.1% as well as automatic "step" increases for an additional year of service. Meanwhile, more than 1 million Illinoisans are out of work entirely, with many still waiting for unemployment benefits.

Congrats Illinois. You are the worst run and most corrupt state in the union. And even better, the fck wits will keep voting this in office.

Gretchen Witmer reminds me a lot of that Rachel Dolenz woman, the white woman in Spokane that swore up and down she was black and ran the local NAACP chapter.

Both are living in a fantasy world and want to control anyone not bending at the knee to them.

455 So saying things are "opening" does not mean they are open as they were before the closings in March. Things are "open", but with a "new normal". Just received this e-mail update from Universal Orlando Theme Parks:

We're excited to announce that our gates are about to reopen. Universal Studios Florida, Universal's Islands of Adventure and Universal's Volcano Bay will welcome guests beginning June 5th.

This carefully managed reopening comes with stringent new health, safety and hygiene procedures in place. So, as we enjoy our parks and hotels together again, everyone will need to follow CDC guidelines and the recommendations of health officials, and Universal Orlando's policies.

--- Everyone is required to wear a face-covering during their visit.
--- Temperature checks will be required upon arrival, and guests with a temperature of 100.4 degrees or greater will not be admitted.
--- Practice social distancing and keep at least 6 feet (2 meters) between your travel party and others.
--- Wash your hands with soap and water often for at least 20 seconds.

Yes, there are more rules to follow now --- but to play together, we also need to work together for the safety and health of all our guests and team members.

Note that any public location where people are present provides an inherent risk of exposure to COVID-19 and we cannot guarantee that you will not be exposed during your visit.

Yeah, good luck enforcing the "stringent" new normal policies.

456 408 I've read the one state where citizens just can't seem to catch a break is Oregon. The courts just keep rubber stamping the governor there. "She's always right!! She's always right!!"
Posted by: qdpsteve at May 22, 2020 05:49 PM (L2ZTs)

Yep, that's why a lot of us have been saying for a long time that Controlling the Courts is more important than controlling any other branch of Government. Once you control the Courts, all you gotta do is get your guy in place and they can do anything they want.

458 It doesn't matter. Nobody can tell a male ewok from a female one. Not even another ewok. Which leads to social confusion.

Aren't Ewoks unisex - like worms and such shit? Like, don't they just split apart in some sort of gross mitosis and create more Ewoks...I might be mixing up a few things there, but I think I am close.

How hard is it to navigate in a desert? Sun rises in the east, sets in the west. You want to go east across Sinai, then north ... and that took 40 years??

Next time have the guys do the navigating.

473 Fauci is fundamentally irresponsible. He treats every issue as if he were conducting a college seminar and is on all sides of the issue from one day to the next. He never ever gives a balanced, judicious statement on any topic. He is forever chasing mirages: mitigation, testing, contact tracing, shutdowns, quarantines, vaccines. When every recommended course of action is taken to its logical reductio ad absurdum, he shrugs his shoulders and says "well, I didn't mean that." This might be fine in a tenured professor. But this man wields influence and power. It is past time that he retire.
