Surprise! Deep State Aligned "Republican" Senators Once Again Refuse to Dig Into Obamagate

Trump's Senate allies on Monday stopped short of echoing Trump's claim that Obama acted illegally when the Justice Department began probing incoming national security adviser Michael Flynn in late 2016. And they indicated that the Senate would pass on investigating the former president as they conduct their own investigations that could soon ensnare other senior Obama administration officials.
"I'm not anticipating calling President Obama, "said Senate Judiciary Chairman Lindsey Graham (R-S.C.), whose panel is investigating the origins of the 2016 Russia investigation, even as he vowed to bring in former senior Obama administration officials as witnesses. Those ex-officials include former FBI Director James Comey and former acting Attorney General Sally Yates.

Senate Republicans largely demurred on Trump’s public effort to lean on investigators to target his longtime adversaries, but they said they understood why he was frustrated.
"He was accused of being a stooge for [Vladimir] Putin and then subject to the appointment of a special counsel," added Sen. John Cornyn (R-Texas), a senior member of the Judiciary Committee. "I understand why the president feels like he's under assault. But I think we need to do our own independent investigation. Obviously, Mr. Durham is doing his. We’ll hear from them. But I think we have an important role to play in terms of congressional oversight."

And, here, Tucker is right. Don't know if I'd go for "partners," but I think they have been standing on the sidelines cheering on Team Blue during the coup. McCain was certainly a partner - he was helping out with the pee-pee dossier from early on.

As for the ongoing coverup - they will run interference for the coup plotters as any investigations proceed, and that will be much closer to "partnership."

I have never liked the phrase. It is meaningless to me. When it comes to the Presidency, the Constitution is the law - that is usually where we are fighting. And the President is conferred Constitutional powers that only the President has. If the President acts outside of those powers, he is acting in an unconstitutional manner, and the proper push back should come from Congress, the Courts, and ultimately the People.

At the same time, the actions those affiliated with the Obama WH have undertaken, even against private citizens, is its own kind of damaging, and I would argue more so in the long run. And Graham either can't or won't realize that.

I can't even get that far. Yes - packing the judiciary with strict Constitutionalists can't solve the problem - the judiciary was been overstepping its proper role for over 200 years, and gotten more arbitrary, capricious and morally rancid with each successive generation.

But even to approach the problem in that insufficient manner assumes facts not in evidence, as the legal eagles say.

Where are these Constitutionalists we're supposed to be packing the Courts with? McCabe's notes state that Yates was briefed on the Papadopolous information. Comey, McCabe and Yates would all tell IG Horowitz that they did not recall this conversation, despite the existence of McCabe's notes.

Let's take that at face value and assume - against all evidence - that the three of them were being truthful and they did not remember the conversation. There was evidence that the meeting took place, they didn't remember, and the told the IG that.

Contrast that with Flynn. He spoke with the Russian ambassador while on vacation in the DR. He acknowledged that when speaking with FBI agents (who broke protocol) about the call. He didn't remember some detail about the call and said as much or he remembered a detail incorrectly.

These are similar scenarios on the face of things. Many details differ (and the FBI didn't think Flynn was lying at the time, but that is all neither here to there to the point I am driving at), but these are similar scenarios.

Flynn was accused of lying and had his life destroyed over it while Comey, McCabe and Yates have had no consequences over what is effectively the same event.

This is the deep state. Right here, in full relief.

Yeah, the only real justification I can imagine for a congressional hearing about a potentially criminal matter is to begin to collect information that would then get turned over to the DOJ to pursue. It's why hearings are so much more prominent when a chamber is out of power in comparison to the White House. They have to do something because the White House isn't going to do it.

The case around the hoax has been building within the DOJ for at least a year, if we go by Durham's appointment. What information is the Senate going to dredge up to hand over to the DOJ that the DOJ hasn't already gotten?

The real problem, I think, is that Congress has been abdicating it's role more and more, until it's become almost completely irrelevant to the actual running of the country. Congress was always the one that should have stepped in and stopped the courts from taking over, but Congress was GLAD to let someone else deal with all of the hard questions, while they just sat back and talked about bullshit while collecting their fat paychecks.

An overly powerful Judiciary is the symptom, but an incompetent and useless Congress is the disease.

One of my great disappointments was a former student who has gone so far left that she wanted to persuade a rape victim to not press charges against her rapist because he had been abused as a child, and needed to be "rehabilitated."

I asked her how she squared that with "believe all women," and she had no answer, she just got mad.

The bureaucracy as well, which is the main effective lawmaking body in the US. I think it's an intrinsic problem to the design though. Attempting a balance of powers by dividing executive, legislative, and judiciary functions is not wholly possible and creates some serious administration issues. Balance of power is necessary, how to create it needs revision.

Congress is supposed to be able to limit Court's lower than the Supremes, but don't.

Supremes are supposed to be able to 'guide' the lower courts. They don't.

And short of impeachment, which is for crimes, not bad rulings, they are appointed for life.

I have been assured that GOP Congressional inaction in the face of a marauding Leftist DoJ is completely acceptable because Congress has no ability to interfere with the DoJ.

I think it's the least we can expect of our elected GOP officials - a blustery and toothless show of support for their own Party's beleaguered President. I don't think that's such an unreasonable demand...

The bureaucracy as well, which is the main effective lawmaking body in the US. I think it's an intrinsic problem to the design though. Attempting a balance of powers by dividing executive, legislative, and judiciary functions is not wholly possible and creates some serious administration issues. Balance of power is necessary, how to create it needs revision.

Why did Hitler think he could defeat the combined economic, industrial and military power of the US and Britain and the USSR? Because he thought they wouldn't fight. When they started to fight, he thought they didn't mean it.

It comes down to deterrence. We have nukes but will we use them? We have military superiority or supremacy in almost all things, but will we use it? Are we a real tiger or a paper one?

Losing deterrence is high-risk and expensive, but nowhere near as risky or expensive as regaining it. And it isn't just military. The same argument applies in many dimensions.

342 Thing about the judiciary is that the problem is systemic, has been for some time, and while changing personnel (judges) is great and the right thing to do - and the only practical option, unless a transformation occurs within the Senate GOP (and that party has 60 reliable votes there) - obviously it is a holding action of sorts.

It's clear there's no chance it will happen, because the Legal Cult mindset (deference to courts, any court, without any reference to law or the constitution) has a death-grip at all levels, including most of Trump's legal people.

Wish there were a breaking point. The district court outrage in one of the asylum cases, in which the judge specifically flouted the statute limiting his jurisdiction, actually caused the Unthinkable to be raised at fairly high levels in DOJ, according to an inside source. But - nothing.

Absent congressional action - and if judges are defiantly ignoring statutory jurisdiction limits, even congressional action seems to no longer be sufficient - then at some point repudiation by the executive is the only choice.

Unless one just wants to continue to muddle along and hope for the best, which is not much of a strategy. Unless, against the odds, the "personnel strategy" (judges) is available indefinitely (via control of Senate and WH), the inertia of the other side will eventually have its day. That inertia includes, of course, a degraded legal education system, to back up and propagate the lawless, authoritarian social engineering model, with fresh blood, being graduated every year.

The tell is they all make their statements in the same "buzzword" marketing voice. This generates "headlines" which carry the news cycle until the next one steps up with more "news". The DNC just changes the messenger to make their message seem novel and interesting.
