It's Our Constitution...If We Can keep It.

It's a little histrionic, but the point is valid and powerful...

The Law That Ate the Constitution

During a democratic town hall event hosted by the Human Rights Campaign and CNN on October 10, 2019, then-candidate Beto O’Rourke proposed revoking the tax-exempt status of churches and religious organizations that oppose gay marriage. “There can be no reward, no benefit, no tax break,” he intoned, “for anyone, or any institution, any organization in America, that denies the full human rights and the full civil rights of every single one of us.” O’Rourke’s abuse of the term “civil rights”—his pandering attempt to borrow the moral grandeur of 1964 in order to abrogate the First Amendment—is no longer an anomaly. On the contrary, as Christopher Caldwell so ably shows in The Age of Entitlement, his remark is a perfect example of what civil rights has come to mean.

One of the most astute observers of contemporary politics, Caldwell argues that the United States now has two constitutions. The first is the one on the books. The second arose in the 1960s and replaced the old liberties with new, incompatible ones based on group identities. “Much of what we have called ‘polarization’ or ‘incivility’ in recent years is something more grave,” he writes. “[I]t is the disagreement over which of the two constitutions shall prevail.” More bracing still, he puts the blame for this crisis on the most sacred totem in American politics: our civil rights legislation.

Civil Rights today is no more than an industry designed to transfer wealth from person "A" to person "B," at the expense of the intent of the framers.

I find most offensive the idea that Americans are incapable of change. That we are incapable of making informed decisions. For instance, I believe it is a business owner's right to exclude anyone he wishes from his establishment. And it is my right to bypass his establishment on the way to one whose owner is more in tune with what I believe about "civil rights."

Would America have moved past race as a primary indicator of social standing (and so much more) without federal civil rights legislation? Yes, I believe so. Would it have happened as quickly? Perhaps not, but we would not have been left with a massive federal bureaucracy that is coupled to an equally massive grift, which have combined to sour the basic idea of civil equality.

It's a mess, and I don't see much on the horizon that can reverse it.

19 Regarding the civil rights thing, it appears that civil rights not enumerated in the constitution have taken precedence over the enumerated ones. That's the way the left likes it.
Freedom of association has been stripped away from regular folks, to the detriment of all.

They opposed civil rights as long as it was about ensuring that everyone got to enjoy their God-given, inalienable rights.

The Left only champions "civil rights" when it involves allowing some people to trample the inalienable rights of other people.

I was impressed with him back in 2016, flying or riding from one campaign event to the next, without missing a beat: holding rallies, giving speeches, answering questions, and always appearing sharp. It's an exhausting way to live, even for a relatively short period of time, but he never acted like he was feeling the strain -- unlike, say, Hillary Clinton, who wasn't putting forth anywhere near the physical effort that Trump was, but still appeared worn and tired much of the time.

Ollie McClung ran Ollie's Barbecue, which the federal courts held was engaged in interstate commerce and therefore subject to the CRA because some of its supplies originated out of state. The logic of Jim Crow laws is interesting. If all whites were discriminating on the basis of race, no Jim Crow laws would have been necessary. They just would have gone on discriminating. Instead, logic would dictate that Jim Crow laws had to be passed because there were whites who didn't discriminate sufficiently and this lack of discrimination was a threat to the white power structure. That would indicate that the white power structure knew that discrimination was an untenable position.

That explains why all the players can be heard in the locker room singing spirituals, the blues, and praying loudly, "Oh, Lord, whens we gunna be free?"

It also explains all those white players in the game. And Samoans.

83 No, there's only one constitution, and one set of animating concepts and values shaping it (even as it evolved and was amended).

The racism, tribalism, rent-seeking, and authoritarian/totalitarian obsessions now grouped together as "civil rights" or "human rights" issues are simply directly contrary to the most fundamental concept of the USA: the individual is the unit of account, the individual has the rights, the government has limited authority.

There are no tribes, races, colors, genders, or preferences for paper or plastic involved.

Chicken and egg, as far as how the country devolved to this sad state. But the combo of - 1) lack of historically American values (see above) actually held by so many current "Americans", 2) lack of critical thinking capacity 3) lack of knowledge or understanding of our history 4) the institutionalization of shake-down/theft, hate, bigotry, and the normalization of authoritarianism - seem to present pretty daunting challenges.

Affirmative Action institutionalized legal Racism far more than Jim Crow ever did IMO.

Why? Because we can't seem to ever get stupid Supreme Court decisions overturned.

Try this:

There's World Power A (an older, established power) and World Power Z (the fresh, new upstart).

Everywhere they meet there are skirmishes on every border. A tense situation hangs over them.

World Power Z is taking ground bit by bit, region by region.

Eventually, World Power Z takes a small patch of land that causes World Power A to snap, "THAT DOES IT!"

World Power A shoves troops into that tiny spot "whereon the numbers cannot try the cause; which is not tomb enough and continent to hide the slain."

World Power Z send troops in.

A stalemate ensues. Villages are burned. Innocents are slaughtered.

The Question:

95 Caesar, excellent point about Jim Crowe.

And when you have "affirmative action" - just about the platonic ideal of a violation of everything the constitution was supposed to establish and protect - tolerated for a nano-second (much less blessed by such idiotic nonsense as O'Connor's infamous deranged opinion) - then the whole system really has surrendered its legitimacy.

And though judicial lawlessness and constitutional derailment are responsible for most of today's dysfunction, it was/is the most pathetic failings (race "guilt", victimhood mentality) that have allowed evisceration of our values like affirmative action.

166 Legally, the constitutional problem began with the sloppy wording of the 14th amendment, which essentially is the amendment that rewrote the entire constitution in it image. There's an enabling element at the end of the civil rights clauses that says "Congress may pass any laws which are necessary to enact this" which right there wiped out all of the existing restrictions on federal power. That's why the CRA of 1965 is constitutional.
The 14th is where all the trouble with citizenship come ssf from as well.

As expected, the SJWs and the progressives and everyone who hate the Church is on board with the hate. Catholics are quite clear about Church teaching on this matter. Teachers sign a contract. Such utter bullshit.

Luckily, the Archdiocese is, so far, standing firm.

Why is everyone else allowed to have their belief system, but Catholics are not. I think these guys did this on purpose, to seed discord, to cause problems.... to try to bully the Church.

They are allowed to have a belief system because they don't have one. Post-modernism, all truth is relative. All churches are going through this kind of thing, not just Catholic. It will only get worse.

231 The big hurt between moslems and Jews is that hatred of Jews is hardwired into the very beginning of Islam. Their foundational myth in the Koran is that Ishmael was the firstborn son of Abraham and beloved of Allah, but Isaac conspired against him and his mother, drove them out, and stole his birthIslam. And Ishmael's descendants , the Arabs, have sworn revenge against isaac's descendants ever since.

So hatred of the Jews is at the very center of islam, always has.been, and always will be.

233 I think that yes, the civil rights legislation of the 1960s was in fact needed as many governments were very keen to deny them to people based on pigmentation. As one obsessed with everyone being as free as possible and for governments on ALL levels being as microscopic as we can get away with, this had to be done. BUT I am willing to concede that as beneficial as this was, the pendulum has swung so far as to have society thoroughly reject individualism and embrace the group mentality (which leads to concepts such as group rights, which the Left and too many on the Right believe trump individual rights.)

A few years ago, World Vision announced it was going to provide benefits for same-sex partners. The usual suspects proclaimed how wonderful it was, but it took them about a week to reverse the decision and I don't think they've fully recovered from. Thousands upon thousands of faithful donors and sponsors said, "See ya" and found other charities to give their money.
Personally, I quit giving to them years before that. Still makes me mad as to why I finally pulled the plug.

I don't think you will ever get rid of prejudice based on the other not looking like you, that is fairly hard wired into the human psyche.

However, black integration and society at large was moving upward and segregationists were starting to be called out (how else would there have been a cry for legislation or protests?)

The question is not unlike abortion. In a sane society, you would not need a law against something in order for it not to happen except in aberrant cases.

254 The CRA has many fatal flaws (discussed in this thread), and had costs and damage that have to be weighed against the "benefits" (namely, compelling behavior that most would agree was normal and desirable). Dunno, maybe a very serious and very very laser-like restrictive public accommodation standard would "fix" most of the grievous damage done to freedom of association.

But it's really a separate question about "racism", attitudes, etc. As well as state discrimination/social engineering ("affirmative action").

Even doing a half-hearted version of MLK's character-not-color approach, and refraining from idiotic outrages like affirmative action, in the decades following the CRA would have yielded a very different current reality, which is what we're discussing.

Not their businesses or business practices or anything other than the fact that they are Jews. Muslims, Arabs can live in Israel but no Israeli can live in Palestine. There is a reason that the United Nations passses more decrees against Israel than any other country on earth. It is not about land. They don't care about human rights in North Korea or Somalia or Kenya or Venezuela. No, everything is about Jews. As Christians you can lament things being imposed on you that impinge on your right to practice your religion the way you want but it is not he existential threat that Jews face every day in Israel. The Muslim world does not want Jews to exist. Period.

281 The real problem here goes back to the FDR administration. Roosevelt, like his grandpa, wanted to sweep aside inconvenient things like our constitutional rights; but unlike Teddy he didn't have the patience to go through the process of actually amending the Constitution, so instead he started appointing unjust "justices" who would lie about what it meant. Then when even that started to fail him, he threatened to pack the Court if it didn't start reading things his way.
The result has been about a century of illegitimate precedents which cry out to be struck down no matter who says we can't. Trump was elected, in my opinion, to be the bull who will rampage through that china shop and smash it but good.
If even he proves unequal to the task, we'll need to consider farther-right candidates. Rush Limbaugh anyone?
