As someone once fairly in the middle of it all, it's difficult to describe the apparent complete collapse of responsible/serious oversight, how pathetic the current crop of political class mediocrities are.


Obviously there might be a few with potential. But the way Congress has just ceased doing much of anything is amazing. The founders didn't count on a group that was aggressively indifferent to their power, instead of jealous of it.

I see a parallel in magistrate judges issuing search warrants with basically flimsy testimony with few held to account.

Scotus should more or less drop the whole property law basis (from common law trespass doctrine) for the right of privacy and instead investigate considering being left alone by the state as a liberty interest. Check the difference in how the court treats the 5th regarding self incrimination versus the 4th with its balancing test.

The 5th is based on a liberty interest while the 4th is a property approach in origin dating back to the Wilkes cases challenging general warrants in England before the Revolution.

At the very least, hoovering up all information and allowing database like queries without warrants resembles a general warrant and FISA court procedures are a poor substitute for genuine due process on the issue of warrants.

No, there aren't. A FISA warrant is not a normal warrant. It has many features that a domestic warrant don't have including the ability to get one without having a defense.

In addition, there is a "tow hop" rule with a FISA warrant that allows the government to monitor the communication of anyone within 2 hops of the target. It also allows the government to look back at previous electronic communications not just forward looking.

It's so dangerous because it is so powerful.

205 187, Don, that is the evil genius--apparently the Feds were using FARA which requires government registration of agents of foreign influence as a wedge, not to prosecute, but to "dirty" anyone talking to a foreigner that the FBI was interested in. Then they could use FISA to get seize all that target's communications and I believe those within two degrees of separation from the original target.

In the old days with physical wiretaps, it was tedious and difficult to do that. In the new digital era, the data has already been intercepted by the NSA and just has to be queried. Thus, lowering the cost of searches has vastly increased the amount of searches made. Theoretically the identity is masked and the intercepts could be read but required higher approval to unmask. But there were unmasking abuses which is where Susan Rice comes into the picture among others.

Oh, I've got one. I know there was some little non-English-speaking brat whose single mom obtained refuge from ICE in a church. It was during Bush's term.
