Fusion Co-Founders Glenn Simpson and Jonathan Winer Refused to Talk to IG;
James Comey and Former FBI Attorney James Baker Also Avoided Fully Testifying

Specifically, Comey and Baker refused to get recertified for a classification clearance, thus blocking the IG's efforts to "refresh their recollection" with classified documents.

"Refreshing a witness' recollection" by showing him documents is a common thing at trials and in investigations.

But sometimes witnesses lie about events, and sometimes lie about having no recollection of certain critical details. James Comey, for example, has a steel-trap recall as to things he wants to claim to his media and government coconspirators, but has all sorts of convenient memory lapses about stuff that could get him into legal trouble.

So the IG wanted to "refresh his recollection" about this convenient periods of Lost Time by showing him classified documents and notes that would explain exactly who he talked to and when he talked to them and what he said to them.

Rather than agreeing to do this, Comey said, "Nah, I decline to get new clearance to see classified material," thus preventing the IG from "refreshing his recollection."

Had he been confronted with a lie about a convenient lack of memory with a document that explained exactly what happened, he would have had to make a choice between telling the truth, or doubling down on his lie even in the face of a documentary record "reminding" him of the truth.

Now, one can get out of a lot of perjury charges by claiming one just didn't remember right, but if someone shows you documentary evidence about what the facts are and you still claim you don't remember, or you remember a version of the story at variance with the written contemporaneous record...?

Well, that makes it much harder to plead "no intent" to a perjury charge.

And so Comey -- the Straight Arrow Truth Teller -- choose to avoid such efforts to get at the truth and keep himself without a security clearance.

For whatever reason, he did not want his recollections to be refreshed.

What is that the Democrats (by which I mean "the media") say whenever a Trump associate declines to testify...?

"The only reason to not testify is because you're guilty."

Hm, why does that rule never seem to apply to Glenn Simpson, James Comey, and the rest of the Straight Shooters Gang?

Unpopular opinion: I don't think anyone in the FBI was in on a plot to get Trump. I think they genuinely believed the bullshit from the dossier. The strongest evidence I have for that is Peter Strzok's text message to Page that "There's probably no 'there' there." That tells me that at one point he believed in Russiagate but had come to doubt the conspiracy. I think they're guilty of gross negligence, but not conspiracy. Brennan and people in the CIA/NSA, on the other hand, I believe framed up the whole thing by getting Misfud and Downer to "incept" Russiagate into the Trump campaign. But those guys are probably too careful to leave behind evidence to nail them on.

"we concluded that the federal ethics rules did not require Ohr to obtain Department ethics counsel approval before engaging with the FBI in connection with the Crossfire Hurricane matter because of Nellie Ohr's prior work for GPS. However, we found that, given the factual circumstances that existed, and the appearance that they created, Ohr displayed a lapse of judgement..."

That's it. Good old "lapse of judgment." No intent. No bias.

86 Wray is pissed!

Asked whether he thought the FBI unfairly targeted the Trump campaign, Wray offered a terse reply: "I do not."

Wray, reacting to the release of the IG report in an interview with ABC News, said that one key takeaway for him was that "the Inspector General did not find political bias or improper motivations impacting the opening of the investigation or the decision to use certain investigative tools during the investigations."

"Including FISA?"

"Including FISA," Wray said

Wray pushed back on the "Deep State" characterization of the bureau's work.

"I think that's the kind of label that's a disservice to the men and women who work at the FBI who I think tackle their jobs with professionalism, with rigor, with objectivity, with courage," Wray said. "So that's not a term I would ever use to describe our work force and I think it's an affront to them."

Maybe, but only in that Abrams borrowed heavily from previously used themes in the same way (young people ignorant of the past get an artifact from a heroic predecessor and use it to protect their people from the same old threat).

If Disney/Lucas hadn't produced Force Awakens it would have sued the maker for plagiarism, the show is just about 100% rewritten of the original Start Wars.

The idea does support my view that writers/directors with a few exceptions can't hold things together well and need to copy rather than innovate.

221 In terms of conclusions, and the laughable claim that there is no evidence of "intentional" massive malfeasance - just, um, massive malfeasance - the IG report *is* very much a whitewash.

And as I keep saying - *in context, which is known to the IG people - it is pretty brazenly a whitewash. They just happened to really believe a ridiculous thin "tip" about some no-name, and they just happened to *not do the standard, instant defensive briefing to Trump's camp* that has been SOP since forever, and they just happened to then embark on a months-long festival of felonious false FISA warrant applications, even as [of course] no evidence emerged of anything to substantiate the very dubious tip*.

This report *is* the perfect bookend to the Mid-Year Exam outrage, which unlike this one - probably - was successful in blessing and immunizing probably the greatest govt.-centric obstruction and denial of justice in our history.

* presumably Durham has been able to confirm the fraudulent nature of even that "tip"

What today's report did do was essentially confirm every statement uttered by Nunes, Jordan, and every other Republican and constitutionalist sounding the alarm on matters concerning The Greatest Hoax committed in American History. Horowitz put his spin out there with at least one hand tied behind his back. He couldn't force ousted DOJ and FBI employees to testify, and he couldn't subpoena at least some documents that might have been withheld (not that the FBI would ever do such a thing). The IG investigators, as far as I know, have confirmed that gross irregularities were committed by public servants that had a direct impact on a national election. It will be up to Barr and Durham to prove the criminal intent and methods.

292 Ben Had, huh?

First, it's ridiculous to believe that Wray was in any way especially "confirmable" vs. any number of other names.

Also, and more important, the idea that the onus for leaving a key national spot unfilled when reasonable nominees are offered will fall on the president is dangerously wrong.

DHS a current example. Trump was told the few qualified available people who totally share his [and a super-majority of the public's] very sensible immigration policy views are DOA in the Senate.

Like key parts of his immigration policy, Trump refuses to "politicize" the issue, including esp. with the GOP - he just rolls over. Kobach, Cuccinelli - oops, can't put people in charge of a key agency who actually are on the same page.

So no, no reason to settle. Unfortunately Trump is at the mercy of Beltway types when it comes to many appointments, probably unavoidable. But the "empty post" argument absolutely needs to be inverted, years ago, and the Trumpentwatters sizzling with agitation against Senator X or Senator Y for blocking a key appointment.

315 307 A modest proposal: President Pence (2025-2033) has Donald Trump retained as a "President Emeritus", and that such a Cabinet position be created.
Posted by: Curmudgeon at December 09, 2019 06:38 PM (ujg0T)

Ya know, I really like VP Pence. He seems like a genuinely nice guy. I would worry, though; is he too nice to be President?
Posted by: Emmie at December 09, 2019 06:53 PM (87gB3)

Exactly. President Emeritus will be the "Bully Pulpit" guy, the Fighting Back Against The Slanted Media guy, the Twitter guy. While President Pence can spend time formulating better policy.

319 I continue to digest the OIG Report, and what's striking is how similar it is to the Clinton OIG report, AND how similar both of them are to Comey's original investigation in Clinton.

That is, the players involved lied, failed to follow procedures, broke rules, engaged in abnormal behaviors and processes that resulted in benefit to only Democrats and those in their orbit, misled investigators (and in FISA scenario, the Courts), etc., etc.. AND, therefore there is nothing to see here, and to the extent decisions and outcomes appear unjustified, that's not true because Prosecutorial Discretion.

So, to all the Feds monitoring this site, let me break this down for you:

(1) Everything that was done to Trump and those in hir orbit was not only NOT wrong, but are to be encouraged and repeated.

(2) Future Presidents are highly encouraged to fire existing Dept. heads and to replace them with wild, hard-core partisans. These elected officials should hand-pick career baureocrats for all politically motivated uses of the Fed's awesome surveillance powers against political opponents. And, those gambits should all be rolled up to be managed by the political appointees.

(3) But don't worry, even if you don't follow the rules or even break the law, as long as there is discretionary consensus among the political appointees, everything is fine and there will be no prosecutions, reprimands or other negative consequences whatsoever. In fact, you are highly likely to receive extra private sector compensation through GoFundME, CNN gigs and the like.

In summation, the lesson from 2016 is that there is no lesson. Nothing wrong, and nothing to see here. Please proceed with all due haste to lie, break the law and break the rules for the benefit of the Democrat party.

How far can you stretch the law and the rules? Great question. We've been asking it for years. The answer as of today is, "more than previously tried." Let THAT sink in a minute.

Agreed. Hannity spent his entire radio show today spinning so hard about how great this report was that I suspect he drilled through to China. It was sickening ... I only kept listening because I was hoping one of his guests would blast him with the consensus opinion of the horde.

Oh, I'm sure they'll do that. Why not? But then they'll have to sign on to the rest of the report, too. The many, many catalogued irregular actions signed off at several levels of authority, all the way up to Rod Rosenstein. That's in the report, too. What ties all of those "irregularities" together? I'd venture that nothing Horowitz has investigated in the past has equaled, much less surpassed, the coordination of so many senior level DOJ-FBI employees for a single objective, while those employees were armed with the most spurious of evidence. Durham now has a big, fat target.
