WaPo: Horowitz Report Will Say... That FBI Acted Properly In Opening Criminal Investigation Into Trump

And Barr disputes this finding.

Attorney General William P. Barr has told associates he disagrees with the Justice Department's inspector general on one of the key findings in an upcoming report -- that the FBI had enough information in July 2016 to justify launching an investigation into members of the Trump campaign, according to people familiar with the matter.

...

The discord could be the prelude to a major fissure within federal law enforcement on the controversial question of investigating a presidential campaign.

Barr has not been swayed by Horowitz's rationale for concluding that the FBI had sufficient basis to open an investigation on July 31, 2016, these people said.

Womp womp, I guess.

Is the WaPo story right, or is it further fake news of the kind we've seen all too much of?

I think it's probably right. Horowitz is an Obama stooge and you're all familiar with his previous work, which is retroactively whitewashing and blessing the DOJ's decisions with Hillary's emails.

The DOJ spokesman issued a statement saying that Horowitz "is a credit to the Department of Justice. His excellent work has uncovered significant information that the American people will soon be able to read for themselves. Rather than speculating, people should read the report for themselves next week, watch the Inspector General's testimony before the Senate Judiciary Committee, and draw their own conclusions about these important matters."

Some people take that to mean that Barr is directing spokesman to low-key deny the story, but I think that is reading too much into it. It's probably just an empty statement intended to tamp down controversy while people figure out what they're going to say and do when the whitewash is released on December 9th.

For what it's worth, Lindsey Graham advises to ignore all pre-release spin.

And he knows a thing or two about pre-release.

"Be wary of The Washington Post and New York Times reporting on what's coming up with Horowitz. They've been trying overtime to spin this thing, to diminish its effect, to downplay it," the Republican South Carolina senator said in an interview with Sean Hannity on Fox News.

27 I go the other way, I take whatever line the WaPo is pushing on this with a large grain of salt. Considering how they have acted towards Trump, they would spin every rumor that comes out about that report in the way that most favors supporting all of their narratives - from Russia through Stormy Daniels to Ukraine to whatever fever-dream Jerry Nadler had last night after sacking the golden Corral.

It was a lackadaisical special agent from the Portland Maine office who accidentally transposed a 2 & 7 which set this whole thing in motion. Could have happened to anybody. We have given him 2 weeks off with pay as punishment. In addition, he will be transferred out of the Portland office to Boston.

We have put additional safeguards into the system to make sure this won't happen again.

48 A whitewash would be very bad. One group of people in this country still believes in something approaching the ideal of "rule of law." That group is conservatives.

The perfidy in this is obvious to anyone who is not deliberately and willfully blind to it. If it truly is a wet fart - and for whatever it's worth, my money is on "wet fart" - it could change that. If no one in power is willing to give "rule of law" even vague, empty, mealy-mouthed lip service, then why should anyone else bother?

It probably won't be vigilantism and rioting in the streets, at least not very soon. But it may well be casual contempt for the law and its enforcers and, critically, being unwilling to cooperate with lawmen.

I'm already there, but I'm a radical and I understand that. But this kind of thing may well push others into the same camp.

They're playing with matches and I fear that they could well end up burning the house down.

The WaPo and NY Times aren't among them.

FWIW, you can still have a report that says "there was enough to open an investigation" and still draw conclusions that laws were broken to continue the investigation when it was clear there was no reason to.

You can also conclude that not informing the campaign of suspected foreign influence is a bad choice.

I'll wait for the report before setting my hair on fire. It was a foregone conclusion that this IG was going to try to frame the conclusions in the least unfavorable manner.

I don't know what is happening but its entirely possible that they've taken place, but instead of going for publicity and narrative control, the DOJ is trying to build solid cases behind the scenes. I have no real confidence this is taking place, but if it was, it would look just like this.

113 I give no credence to WaPo or NYT or any of the kept media. I am assuming that this will be a whitewash because the last IG report from Horowitz was essentially a whitewash.

There is, however, one conclusion that we can draw from this entire exercise over the past several years regardless of what this particular IG report says. That lesson is, "this system is broken and corrupt to its fucking core."

I prefer the "nuke it from orbit" approach. Just dismantle DoJ entirely and try again with entirely new leadership and brutal rehiring practices for junior folks. GS-12 and higher need not apply at all.

126 We'll wait and see, report will be out on the 9th - on the one hand, perhaps it will be a whitewash; BUT, I see plenty of room for weasel words in the WaPo report. For example, it may say that there was a predicate for opening it - but was there a predicate for renewing it twice? We don't know. Also, it may say the FBI didn't do this - but what if the CIA did it instead? Horowitz wasn't investigating any CIA aspects, only DOJ and FBI. We already know Durham is outside those parameters, since he's investigating a man in the Pentagon.

It's probable that a lot of people got their hopes up too high on this one report; but that doesn't mean there still isn't going to be a lot of good that comes out of it.

the Problem is that most on the Right played the usual the IG is above reproach crap.

Meaning that any actual indictments will be spun as Political.

Its the same playbook they used to get Mueller to investigate Trump for two years. There was no legal basis, but they set up a political basis once Sessions recused himself.

We have known for 2 YEARS about FISA abuse, but everyone was waiting on the IG. Not a single indictment has gone forward because everyone was waiting.

Not with the IG whitewash, they will be able to tie the DOJ's hands up politically.

Just as they have with this sham Impeachment report.

No evidence, but still going forward, with allegations that are not a crime anyway.

Yonks ago, Jim Geraghty proposed an upgraded primary system designed to better balance out large and small states and to bring more geographical parity.

The key to this system was that the first primary was in Hawaii. In late January. For, you know, the super good reason of being in Hawaii in late January and not in Iowa.

Additionally, as DOJ IG Horowitz was never tasked or empowered to interview CIA officers who are known to have been at the heart of the pre-July 2016 operation. I agree. But I think I know why they did it, in addition to super hot girl for RDJ to interact with. First off, Downey likes certain actresses and tries to get them work (he did for Paltrow, for instance). He and Tomei did a movie early in her career and have long been close.

Second -- and this is inside baseball movie geek stuff -- I think the MCU Spider-Man stuff is deliberately done as an alternate universe. Black Mary Jane. Geeky buddy of Peter Parker. Iron Man builds his costume. Aunt May is hawt. Almost all the details are like 45 degrees off true, to make sure viewers understand this isn't quite Spider-Man, but another alternate universe version, and I think that was part of the Deal Sony insisted on so they had the only "true" Spider-Man.

True Justice requires martial law and firing squads. We're not politically powerful enough yet to obtain True Justice. Low grade bank robbers are easy, they have no power. But look at someone powerful like John Corzine, who stole more money from the bank than every small time bank robber for the last 100 years combined. He walked. Why? He had power, and powerful friends. That's the way of this world. The powerful never face Justice, the best you can hope for is to foil their plans. And sooner or later, they all die, and then you can laugh and go piss on their grave.

266 48 A whitewash would be very bad.

309 Re that Breitbart article linked @135 - here is something I commented on November 1:

Abuse of power is likely the wording they will use.

The bill of impeachment is determined by the committee. They create the bill and vote it out to the House, which then passes - or doesn't - a resolution that adopts the bill, and that is impeachment.

In this case, the resolution assigns the investigation of the President to the House Intel Committee - Schiff's joint. Then the results of that investigation are to be turned over to Judiciary - Nadler's committee.

Judiciary will craft the bill of impeachment and vote it out to the House. The House votes on each article.

So likely what will happen is that they will have various and sundry things in the bill that the "moderates" can vote against and leave behind the abuse of power count over demanding that a foreign power dig up dirt on a political opponent (leave aside that this isn't what happened, and Biden is running against Trump in his dreams, but they are nothing if not loyal to their lies). The moderates will say that they aren't voting for crazy and divisive things but that they are really, really concerned about the national security of the United States and we can't let him get away with using military aid to one of our bestest allies to meddle in our democracy no sir not on my watch!

All they need is one count to survive, and its an impeachment

A number of years ago they arrested some pedophile in Belgium who oddly for just being a normal guy had a bunch of houses and plenty of money with basically no working history. They arrested him once, gave him a slap on the wrist and let him out again.

After he got out he moved on to murdering and raping kids. And eventually he got caught.

When arrested this second time he claimed he was part of a network including a bunch of European elites.

And then a bunch of witnesses and investigators started dying. And they convicted Dutroux, and one of his buddies and all congratulated each other on solving the case.

The European police have shown no interest in assessing if there are any truth to his claims or how he got so much money...

Oh, when did you read the report? I hadn't realized anyone had been exonerated. Why do hypotheticals when NOBODY, not even Devlin Barrett, actually knows what the report says?

I thought this was all in reaction to a report by one of the coup plotters favorite narrative engineers that people say they hate and would never believe and have now been freaking out about for going on 20 hours.

As was said above nicely by Orson, the IG and the DOJ have two very different investigations scopes and powers. Horowitz is looking at FISA abuse and NOT at the predicate for starting the investigation. He has no powers to subpoena or indict and can't look outside the DOJ.

What if, as most people think, the person who started this investigation and force fed it to the DOJ was John Brennan? How would Horowitz know? But Barr would know. Maybe we should read it for ourselves instead of relying on the very people who have been lying to us about Trump colluding with Russia for the last 3 frigging years.

Yes, but they are related to each other:
ICIG: "Did you ask for this stuff correctly and in line with established procedures?"
Barr/Durham (supposedly): "Was is correct to ask for this stuff at all, regardless of whether procedures were followed?"

If the predicate was bullshit, it doesn't matter if the I's were dotted and the T's crossed.

It will still be interesting to read, though, because the FISA system was abused and people signed off on information that they almost certainly knew to be false. That is all pretty well known and out there thanks to some crack work by a small number of very good journalists and investigators.

The Inspector General of the Department of Justice can only look at things within the Department of Justice. He can only interview CURRENT DOJ employees. He can't talk with retired or fired employees unless they agree. He can't look at the CIA, State Department, IRS or any other agency in the federal government.

He can only look at the DOJ and only in a limited fashion. Period.

The Attorney General of the United States and his appointed federal prosecutor, in this case John Durham, can look at everything and everyone. He can subpoena anyone. He can even talk to foreign officials in places like Italy, the UK, Australia and other places which Durham has been doing.

I enjoy it. I loved the first 20 minutes rather completely. Werner Herzog is great.

But, the fourth episode is just a new story when the first 3 episodes told one story. It's weird to me. Serialized television is really hard to do, and that felt like it was the objective of the show, especially considering the shortness of the individual episodes and the season overall.

So, this departure into a new story with different stakes and new characters was...odd and unsatisfying.

If they wanted to make an episodic show where each episode is a new adventure, then the first three episodes led me down a road the show probably shouldn't have.

One thing that people need to remember is that Federal IG's have zero law enforcement powers. They can't compel testimony and they can't subpeona anyone.

trying to present that the IG report and the DOJ investigation are one

so, they then apply the label "Politically motivated" to any

425 My ancient Olde Legalle Ethiks text tells me that "continuing to advance" a baseless argument or case, once the attorney has found out it has no basis, is unethical conduct.

I would imagine this applies to prosecutors in spades, who not only incur legal fees on the other side but who, when continuing a baseless investigation, cause actual human beings who have done nothing wrong to live in fear that the government will clap them into PMITA prison.

So, apart from the "origins" issue: when did Mueller and Weissman know this was (at best) a big nothingburger (even apart from the appearance of being in bad faith from the get go) and what did they do about it?

426 IF the WaPo is accurate, the DOJ is about to sanction using fabricated evidence and perjured testimony to establish probable cause. Nice republic we had there.

427 Going out on a limb here predict The Report will be more of the usual "Except for this low-level nobody we've selected for public flagellation everybody else did EVERYTHING BY THE BOOK. Nothing to see here folks - move along, move along."
