"What this country needs is some common sense legal reform. Here are some ideas:

"1. We need to switch to a 'loser pays' system. Also, the legal costs should be split between the loser and his or her attorney. The lawyers need to be forced to have skin in the game, too. Let's diminish the legal profession's "we get paid regardless of the outcome" incentive to clog the courts with cases of dubious merit.

"2. If you are convicted of falsely accusing someone of a crime, your sentence will be whatever the sentence is for the crime you used in your accusation.

"3. Any prosecutor who withholds exculpatory evidence from the defense shall be strung up by their balls and roasted over a slow fire. Seriously, the prosecutor should be declared guilty of the same crime they tried to impose on the defendant, and sentenced accordingly.

"4. Lying to prosecutors or law enforcement should not be a crime as long as it is legal for them to lie to you.

"5. If you absolutely insist that lying to prosecutors should be a crime, then the determination of whether the defendant actually lied should not be made by the prosecutor due to the obvious conflict of interest, but by an independently appointed officer of the court. And if the accusation is rejected, the prosecutor will incur the same penalties he sought to impose.

"7. "Some folks just need killing" should be a valid legal concept. The growth of the permanent criminal underclass must be contained.

"8. Hate speech should be declared an invalid concept for any legislation or legal proceeding.

"9. 15-year-old boys should not have to register as sex offenders for the rest of their lives for having nude photos of their 14-year-old girlfriends on their smart phones.

"10. Mean tweets, hurt feelings, and losing an election are not grounds for impeachment.

"11. No state, local, or national legislative body shall exempt itself from whatever laws it passes.

"12. Epstein didn't kill himself."

We need to have a debate on who is really supposed to decide what is and is not constitutional and amend the Constitution accordingly. The courts just usurped that power in Marbury v. Madison, the constitution doesn't really specify who decides. The framers obviously didn't think it should be judges, because Madison lost the case.

You'd never have women who made a false rape accusation recant and admit it was a false accusation. I personally know at least once case where the girl made a false claim and was talked into telling the truth by mutual friends of the "victim" and the accuser.
It could have gone very badly for the young man otherwise.

I've been in a JP court where the Judge was an ex-deputy, no law degree, college degree in Football, with minimal readin' and writin' was sitting on the bench. Guess how that works?

Judges biggest buddy and top contributor lawyer comes in with a case. Judge asks him "well how do you see this case?" His buddy tells him how he wants it. The other side attempts to make some kind of motion, Judge says "No I think I know how I'm gonna rule." He then calls his best buddy up to the bench and says "here would you write it up for me? I'll sign it after lunch."

End of case. Seriously, I've seen that happen.

Pretty much every other country does loser pays. Except Japan, and their legal system is such that it so difficult to bring a case to court, it doesn't much matter.

Yeah, my only issue with "loser pays" is that the law can be so convoluted that both sides may have legitimate arguments that need to be sorted out by a judge. I don't really think either side should be penalized with the court costs of the other side in such a case.

246 I handle Workers Comp claims in CA. The plaintiff attorneys incur zero expenses as all Med / Legal expenses to litigate their claims are required to be paid by the insurance carrier. We even have to pay the plaintiff attorney for his time at depositions. And the alleged injured worker doesn't have to worry about being paid during litigation of a disputed claim because CA has a separate fund that pays the claimant during that time whether his claim is legit or not. The prosecutor from that case told us that crimes like this need to be taken off the sex offenders list, or the list becomes useless. It really should be reserved for those likely to reoffend. She was in favor of having the list reviewed periodically.

The prosecutor from that case told us that crimes like this need to be taken off the sex offenders list, or the list becomes useless. It really should be reserved for those likely to reoffend. She was in favor of having the list reviewed periodically.

A person should automatically be removed from the list after five years unless certain requirements are met.

Part of the reason that I'm a proponent of reinstating the whipping post is that there are plenty of crimes which don't merit jail time or your life ruined, just a firm punishment that reminds you, "Don't do this again".

I don't think I like this one. If I see someone commit a crime, and I can't convince anyone that I did, I don't want to be liable for prison.
