But: Other Sources Say He'll Use an Executive Order?



This, alas, is true:



#twoweeks. Take it from someone who knows.

Whoops: While those "sources" says Trump is dropping the fight, other sources seem to dispute that.

And I should have wondered -- maybe Trump is only dropping the effort to get the question on the census via one route, but intends to use an executive order to put it on.

b) so what? Even if they tell the truth about their citizenship status, it changes nothing, except maybe telling ICE where to focus their deportation efforts. But you don't need a census to know where illegals live.

The impression I got from Barr was that he didn't believe the APA would be a barrier to getting this done in time. SCOTUS ruled that Commerce did have the authority but their reasoning was contrived. But they also basically said come back with the right reason. I'm unclear how that wouldn't be a priority.

Yeah - I don't consider this to be a very important issue on its face.

But, I think the Courts being completely lawless is a big, very important issue. Trump really needs to rub their nose in it, and put them in their place.

So, while I don't much care about the census, I think it's an ideal time to do it. The American people will not be upset, the Congress won't have the stones to impeach/convict, and the Courts will be subdued, so Trump can actually get some shit done going forward.

Right, that's the ruling. In other words, Commerce's lawyers fucked it up (on accident or on purpose).

I think the APA *will* be a problem though, since the 571 rule making (or whatever, I forget the sections of the APA) requires notice and comment periods and an entire process that typically takes a pretty long time, and I think they're on a pretty strict deadline for printing the census.

There's no reason they can't go back later and do the rule making the right way and not fuck it up, and get it included on subsequent census forms though if people really care that much about the question.

I think it's wonderfully effective as a slice of low budget horror. The number of movies that actually scare me is very small and Halloween doesn't fit, but it's still tension filled and fun.

It does tension well. Good set ups and lots of background detail.

But it doesn't feel like horror in the way In the Mouth of Madness does. It's almost more of a random crime story with a slight touch of the supernatural (in the first movie) around how unkillable Michael Myers is.

That latter feature gets ramped up quite a bit more in the inferior sequels.

The question before the court wasn't whether or not the question could be on the census. Everyone agrees it COULD be on the census.

The question was whether the ridiculous rule making process under the APA was followed.

Which the court said it wasn't. There's all kinds of case law on this stuff, but basically the court said "you need to have a better reason as to why you're asking the question on the census then the one you proffered. So start over, but with a better reason, and you're good."

I've only seen some of the sequels, but the immediate one was little interested in doing anything other than jumping in with the slasher crowd (that Halloween had helped popularize, though not start).

Halloween and In the Mouth of Madness are two very different types of horror, of course. Halloween's visceral while Madness is more existential. It's much harder to pull off the existential because, I think, it's related to the idea of awe.

Awe requires big things, in particular ideas. Existential terror requires conveying the idea of something so big and terrifying that we can't comprehend it. The Endless covers this well, of course.

I would say that, based on my limited viewings, Halloween is more successful at reaching its easier target than Madness is at reaching its more difficult target.

None, it would have no impact.

That's the thing that so many people are missing here -- Read the second section of the 14th amendment.

"Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State."


They chose to use the word "persons" in the first part, and "citizens" in the other.

It's pretty clear that the number of PERSONS is what matters for apportioning seats, not the number of CITIZENS.

Whether we like it or not, short of a constitutional amendment, how many people are citizens v how many are here illegally or otherwise doesn't matter when it comes to apportioning seats.

Considering how many sequels and how many rip offs that followed Halloween, my judgement might be outside the mean. But I feel Mouth of Madness hit it's goal better than Halloween did.

I agree that The Endless did the time loop horror better than Mouth of Madness did. But the stakes are higher in Mouth of Madness. The end of the world, the Old Ones coming to drive us all mad like in Call of Cthulhu.

Carpenter shows that madness, shows its spread, shows a skeptic forced to accept that reality...is not solid. There's a better plot and a better character arc, not to mention being true to the meaning of horror...that everything is NOT going to be all right.

Lori Strode survives Halloween, Michael is stopped, if not captured. It's more a thriller or a drama than a work of horror, ironically.

The question before the court wasn't whether or not the question could be on the census. Everyone agrees it COULD be on the census.

The question was whether the ridiculous rule making process under the APA was followed.

Which the court said it wasn't. There's all kinds of case law on this stuff, but basically the court said "you need to have a better reason as to why you're asking the question on the census then the one you proffered. So start over, but with a better reason, and you're good."

I like the slow burn of the first half. I can see folks getting bored with it, but I liked the long takes and the subtle uses of The Shape over a faster paced/edited work.

Carpenter shows that madness, shows its spread, shows a skeptic forced to accept that reality...is not solid. There's a better plot and a better character arc, not to mention being true to the meaning of horror...that everything is NOT going to be all right.

Lori Strode survives Halloween, Michael is stopped, if not captured. It's more a thriller or a drama than a work of horror, ironically.

I've only seen Madness once, and I'm really curious about reforging my opinion of the film with another viewing. The RLM video reupped my memory of the film pretty well in specific moments, but not the overall impression of the film.

Maybe now that I've seen the film and actually heard discussions of it, I'll be able to approach the film in the correct mindset to understand what it's doing more readily. Weird movies that you have to figure out as you go along can handicap themselves that way.

That's the language in the first section of the 14A referring to what a citizen is.

Not the language in the second section laying out how reps are to be apportioned.

I don't know why people are even arguing this point, I'm just saying that there's nothing legally we can do short of passing a constitutional amendment changing the 14A that says illegals arent counted for apportionment purposes.

It's shitty that that's how it is, but that's how the 14A was written (by Republicans, keep in mind, trying to anticipate the kind of shady games they knew the Dems would play with the recently freed slaves and whether or not those people would be considered citizens or not). It made sense at the time, now it kind of sucks, but unfortunately we just have to live with it.

It was a treaty thing, which is why we specified indians not taxed. They were /are mini sovereign nations inside the US, and thus not subject to US laws, essentially. It's super complicated, I don't really know exactly how it works, but that's why the "Indians not taxed" is in the original constitution and the 14th A.

I happen to know my Social Security number by heart, but don't remember how I came to know what it was.

In fact, to my knowledge, I've never received any communication from the Federal govt. at all, ever. I mail in my taxes every year, but have never heard back from them for any reason.

I suspect they may not know I exist, or I fell through the cracks somehow.

They were saying that they did not believe the administration was giving its true reasons for wanting it on. They never even considered whether those reasons were valid. Yes, I looked it up. You can read the rules printed in the federal register, but the long and short of it is:

If someone has a permanent address where they spend the majority of the year that is OUTSIDE the US, they are not counted unless they are "long term visitors" (been here I think it was 4 months or longer, think foreign college students, for example), in which case they are counted.

Homeless people are counted at where they are on the day of the census, otherwise everyone else is counted where they spend six months plus a day a year.

I mean, honestly, I'm just explaining to non-lawyers what the law says. If you don't like what the law says, you can change it.

But as is stands -- there is not a court in the country who will agree that "persons" means anything other than "persons." And if we did somehow find a judge willing to go through the kind of pretzel logic required to change the definition of the word "persons," we probably wouldn't want him to be a judge, and he would definitely get overturned and smacked down on appeal.

Tell me, do they issue census forms at detainment facilities for illegals? Just wondering. I really don't know (though I suspect they do .. because that would just be so ridiculous).

You already pasted a list of the reasons why someone thought that "persons" was ambiguous enough to have to write more law to define it - though you really aren't allowed to define first-level Constitutional terminology in law since that is tantamount to amending the Constitution.

If you have the time and money, feel free to hire a lawyer and try to argue that "year" used in the US constitution refers to something other than the gregorian calendar years.

If you lose, then we'll have case law establishing what "year" means. If you win, then we'll all have to live under a new definition of "year."

I'm really not sure what point you're trying to make here.

Typically when there is an ambiguity, judges look first to the statute itself to see if there is definitions, then previous case law, then the legislative history, then, if really desperate, law dictionaries, english language dictionaries, old treatises, and whatever other sources they can find.

When there's no real, legitimate disagreement (like what a "year" means) it doesn't come up.

We only switched to the Gregorian calendar 20 or so years before Revolution. That is RECENT. It's not as if the idea of "THE year" was deeply embedded in our culture for a hundred years before that.

They can, they just need to follow the APA procedures to get it on the census.

The problem is that there's a hard deadline on when the census needs to be printed and mailed out, and it's unclear whether or not there is enough time between now and then for any rule change to go in to affect in time for this census.

And if we did somehow find a judge willing to go through the kind of pretzel logic required to change the definition of the word "persons," we probably wouldn't want him to be a judge, and he would definitely get overturned and smacked down on appeal.

There is a built-in fuzziness to ALL human language - which legalese is part of. It is how the world is. It is how the universe is. Human language is not anything like formal systems of mathematics. Don't pretend that it is.

That is not a license to make a mockery of English, though - which is what lawyers and judges do.

Don't harsh on Harry or on lawyers and judges for this, POP. Language isn't like math, so that's why we have a legal system to define precisely what these fuzzy words mean. Once that consensus is reached by the USSC, then that is what the word means.

Either we have a system of defined concepts (with an ultimate arbitrator) or we don't. That's what Rule of Law means. "Persons" includes illegals unless and until we get a constitutional amendment to clarify or a different Court (as the final arbiter)

Thank you. And correct, this is a huge part of the function of our judicial system.

Because no country can function outside a framework of laws. And there are always going to be some ambiguities in the law, as it's impossible to imagine every possible scenario when drafting laws, and that's what courts are for -- to clarify the laws to the best of their ability (and/or say "Congress, this is unreadable, you fucked up. Re-write the law.")

Now, you can argue that the Civil Law systems used in most of Europe and Asia function better than the common law system we use in the UK, US, Canada, etc., since judges have much less power to clarify / interpret laws then they do in the US. There are pros and cons to both systems, and both seem to work fairly well.

That's an interesting argument, I'm not sure if the governments' lawyers tried that argument or not.

What falls under the APA and what doesn't is always kind of a... interesting area of the law.

Any formal action taken by a Cabinet Agency requires APA measures, typically. I can't see why the census would be different. It's not a matter of legislative delegation is the only difference with the census forms. But agency action triggers APA notice and rulemaking procedures unless it's a quasi-judicial action.

Hugh Hewitt has been pushing that idea. His plan is for the President to get a few of the relevant cabinet members together in a meeting. Discuss the reasons why this question is needed. Then sign an executive order outlining that rationale and ordering the question to be added.
