Some choice cuts below:First: Oberlin adminstrator says that the school had to be cautious about contradicting student shouting about racism, otherwise they'd throw their food on the floor in the cafeteria. He admits that is sub-nursery school behavior.
Oh, and they say she handed out the defamatory flyers.
McDaniel also went downtown when he heard the protests had started. He said when he got to the small downtown he noticed a large group of students, which he described as "Anger. Noise, Venom ... [students] very angry and disturbed and irate and they wanted to take it out on somebody." McDaniel said he started taking pictures with his cell phone, and a young man came up to him and started blocking his phone with flyers in his hand. McDaniel said he kept moving and the man moved with him, blocking his ability to take picture over and over. "I'm with the college," the man answered when the former Oberlin College police chief asked him why he was blocking his ability to take pictures. McDaniel testified he found out later the man hounding him over picture taking was Julio Reyes, associate director of the school's multi-resource center. "He was attempting to intimidate me and I don’t intimidate easily," McDaniel said. Here, Meredith Raimondo admitted that she had no idea if it was true or false that Gibson's had a history of racial profiling:
In one email, Ben Jones, the vice president of communications for the school wrote to his co-executives in the school administration that, "I love how these Gibson supporters accuse us of making rash assumption decisions, but are totally blind to their own assumptions ... all these idiots complain about the college." He closed with, "Fuck-em... they've made their own bed now." When Roger Copeland, an Oberlin College professor of theater and dance (he is "emeritus" status now) wrote a letter to the campus newspaper soon after the protests ended, and criticized how the school was treating Gibson's in the letter, Jones sent a text message in caps saying, "FUCK ROGER COPELAND." "Fuck him," Raimondo responded in a message. "I'd say unleash the students if I wasn't convinced this needs to be put behind us." Raimondo was given these examples and others and then asked a very simple question. "When personal beliefs get involved in decision making, does that have an effect on trying to maintain professional responsibility?" asked plaintiffs' attorney Lee Plakas. She was asked specifically about herself and the higher-ups in the Oberlin College administration. Her answer was quite surprising. One of the attorney Morons said that if Oberlin appeals the judgment they still have to place the awarded funds in escrow and that the balance immediately begins to accrue interest. So if (when) Obershit loses its appeal, they will actually end up paying more than the jury awarded.

I saw every day how hard the staff worked to de-escalate squabbles among the kids and teach the kids how to be polite to each other and the staff members themselves. I took my granddaughter to the Y pool one time. At first, she was the only kid there. Then a little black girl close to her age got into the pool. My granddaughter immediately went up to this other girl and asked her if she would be her friend. Between the time my kids were very young and when my grandkids were that age, something broke. When I took my daughter to Bard College's program for potential students in the mid 90s, the president, Leon Botstein, fielded questions on other colleges and universities and gave his opinion on every one of them. Leon is an egghead but one who is highly passionate about education and music and, in the latter field has done battle with the wackademics who consider him a hobbyist dabbling where he doesn't belong. Even over twenty years ago he thought Oberlin was losing its way, although at the time wasn't the lost cause of Antioch about which he shook his head.

I don't know when the judge decides on whether to apply the statutory cap on the punitive damages (2x compensatory damages). My understanding is that, under Ohio law, that's a soft cap, so it is not mandatory.
Perhaps the plaintiffs can use the letter that Oberlin's president sent out after the verdicts, saying that it was wrong and they'd appeal and it wasn't over, etc., as evidence that Oberlin has not learned anything, and therefore the punitives award should stand and not be reduced. Yeah, I think Oberlin has stomped all over any reason to reduce the punitive award. They proceeded deliberately, and with complete malice. They voluntary and knowingly took actions that caused harm. They showed no remorse, even after the verdict.

A few years ago, we had school administrators looking the other way when a couple minority students stole iPads and gave them to their uncle who resold them. Those administrators left, new local ones came, and a former cop took over discipline. Suddenly those kids got caught stealing and started suffering consequences, so they left the district. A couple stellar athletes were thrown off teams for violent behavior and verbal altercations with adults; they and their families were shocked that being a star player didn't grant immunity. Oberlin is like our bad old days. A student journalist did a story about the epidemic of Oberlin students who stole from businesses in town; he admitted in the final paragraph that he had stolen from people he interviewed. That tells me that the administrators don't have and certainly don't follow their code of conduct. I'm old enough to remember when some Michigan football players were thrown out of dorms and put on a yearlong probation by AD Bo Schembechler because they bullied and stole from honors kids down the hall. No, $44 million is gonna leave a big mark. They have an endowment of about a billion, from what I've seen, but the thing with endowments is that they are not just a giant pile of cash that you can spend any way you want. The people who set them up generally put the money in some kind of trust or trust-like arrangement and the university gets the interest or other income from that investment. They don't get access to the principal. If you figure a billion invested at a conservative 5% annual return, that's only $50 million a year. $44 million is gonna blow a pretty big hole in that. It's made even worse by the fact that endowments are often earmarked for very specific purposes -- "To plant trees on campus", "To fund the library's book collection", "To provide scholarships to deserving left-handed students of Lithuanian descent", and so on. SOMETIMES you can get around those if you can convince the trustees and maybe a court that the original purpose is no longer valid (I think I heard of a case where there was an old endowment to purchase high-end slide rules for needy engineering students, and they managed to get permission to give the students computers instead). However, "To fund the mob-rule actions of a crazed communist administrator" is unlikely to be one of the purposes the donors have named, nor is a court likely to look with favor at spending the library's book money to pay for that instead. It's made even worse by the fact that endowments are often earmarked for very specific purposes -- "To plant trees on campus", "To fund the library's book collection", "To provide scholarships to deserving left-handed students of Lithuanian descent", and so on.
SOMETIMES you can get around those if you can convince the trustees and maybe a court that the original purpose is no longer valid (I think I heard of a case where there was an old endowment to purchase high-end slide rules for needy engineering students, and they managed to get permission to give the students computers instead). However, "To fund the mob-rule actions of a crazed communist administrator" is unlikely to be one of the purposes the donors have named, nor is a court likely to look with favor at spending the library's book money to pay for that instead. An appeal is no freebie and unless lightning struck and Oberlin scored an outright reversal, it would actually put the Gibsons in an even better position than they are now. Here's my explanation from a comment I made at Powerline last week: An appeal is no magic bullet here because of the need for an appeal bond. In order to stay execution of the judgment during an appeal, Oberlin will need to post an appeal bond of at least 125% of the the full amount of the judgment. This means it will need to put up sufficient collateral to satisfy a surety to take on a $41 million risk. If the appeal fails, the plaintiff can then collect the judgment and post-judgment interest (at 4% in Ohio, apparently) from the surety. 4 percent of $33 million is $1.32 million a year, which makes the waiting by the Gibsons a lot more tolerable. Posting an appeal bond will hurt Oberlin. It will cost millions to obtain and it will tie up the assets that are used as collateral. Possibly of more importance is that it will remove bankruptcy from the table as a negotiating threat. Bankruptcy threats will often factor heavily into negotiations to pay a huge judgment. If an appeal bond is filed, the plaintiffs won't care if Oberlin goes BK because they can always collect directly from the surety. Also, if Oberlin loses the appeal court will probably order it to reimburse the Gibsons' attorneys fees. Thus, between the post-judgment interest, attorneys' fees and the cost of the appeal bond, an appeal will only dig a much deeper financial hole for Oberlin unless it gets the gold ring and overturns the verdict. Plakas took Raimondo apart when he had her on the witness stand - Perry Mason would be proud. Some of that has already been posted, but my favorite moment was when he asked her if she had been handing out flyers accusing Gibson's of being a racist establishment, as a local reporter had said she was. He also said she had a bullhorn at the original protest and appeared to be directing it.
So Raimondo, when asked about this, said "No he's a liar, I wasn't doing any of that!" (She had previously and publicly stated that he had lied about her) Plakas then asked "Well he testified in this court that he had approached you and asked you for a flyer that day, and you personally gave him one. Is that true?" Raimondo, knowing that other people had seen that and that she was now under oath, admitted that "yes, that is true." So Plakas asked "well then, since he asked you for a flyer, and since you admit you gave him a flyer, is it fair for him to say you were handing out flyers that day?" And Raimondo said "No he's a liar! He tells lies about me!!!" and you can be sure that was the LAST time the Jury listened to any words coming out of her mouth. I think he'll find out in a hurry BUT this is a good step in a more thoughtful direction. Part of Twitter's main fault is the character limit: nice for bandwidth and ease of reading by less literate and intelligent people but lousy for conversation or information. Education has become a racket and a sinecure for leftists that should be brought to an unceremonious end. This could be accomplished almost immediately by prohibiting tenure for professors and most especially for college administrators.
The immediate and long term solution to this acting out should also be the elimination of tax exemptions for all colleges and universities. Additionally, all financial aid should be financed by the colleges and universities themselves with no tax payer guarantee of repayment. Students should be allowed to discharge in bankruptcy all students loans in the same way that any other debt can be discharged. And finally college and university trust funds should be taxed annually at the same rate as the annual income for ordinary tax payers. I would also tax tuition for foreign students at at least 100%. If a foreign student is on financial aid then that aid regardless of its source should be taxed at least 200%. The country has no need for degrees that are less useful than an HS Diploma from the 1950s. The government should encourage self sufficiency and real science not lysenkoism or politicized science. There should be tax credits or vouchers for tax payers who wish to send their children to private primary and secondary schools. This benefit should be first funded by any federal financial aid to state education. And tenure should be completely eliminated. We've been in this circle of hell since the 60's when student protester were caved into and their demands at least given consideration when they should have been expelled from the school and if their actions merited it, called the police on them. Blacks are particularly egregious about this. The riot at the drop of a hat and there's no punishment (except for their neighborhood stores getting trashed. All it accomplishes is they see that acting criminally is rewarded. We're doing this now with Muslims. They protest or plant bombs and suddenly anything Muslim is the bestest ever and has to be included in the curriculum but Christianity is icky and has to be stomped out of existence. This is what Academia and the media have foisted off on us in accord with what the left manages to present as being somehow courageous and progressive. All it's done is turn out children into 30 year old whiny brats and taught blacks that they're excused from being civilized because a 100 years ago their ancestors got treated badly. And no we see the ultimate extension of that type of "thinking" (is use that term loosely) where Transgender mentally ill persons (a very small percent of the population) has taken over all forms of media, and common sense in the name of inclusion. Considering the entire practice was likely involved, and for more than two hundred hours, I'd say the hundred kay was pretty low. I had a friend fighting a bogus prosecution--prosecutor needed some numbers--whose most devastating defense witness was the prosecution's expert. Got over six figures pretty quick.
