Drug dog sniffs are not considered "searches" for 4A purposes. However, the cops need either reasonable suspicion (federal standard) or probable cause (depending on the state) to search a car. A drug dog alert would satisfy either standard. BUT the cops also can't hold you on the side of the road for an unreasonable amount of time (waiting for a drug dog) without reasonable, articulable, suspicion that you are in possession of drugs. So if they hold you for 45 minutes based on a "hunch," even the dog finds the drugs, it's possible that'll get thrown out in court on 4A grounds. If you consent, you have no argument. ...at least, I'm pretty sure that thats close enough to right. Criminal Procedure is not really my thing. Yes, it is better not to consent to a search. One, do you know who has used your car last and what they have been up to--especially rentals. Two, you can directly challenge the reasonability of the search rather than the stop. Stops have a lower threshold of evidence needed to trigger which is reasonable suspicion. It is defined as articulable objective facts that would make a reasonable person believe that a crime might have been committed and it is lower than probable cause. Searches require probable cause and either a warrant or sufficient objective evidence present for the officer to conclude that it exists. Still, it is easier to get the court to second guess a search rather than a stop. On consent, you would have a much stiffer road to hoe to get any consensual search thrown out. Morale of the story, don't. Where most people get into trouble is they think consenting to a search will make it easier on them or that they have nothing to hide and it will shorten the process. Best to put up with the inconvenience, as said earlier, there is only so long that the police may detain you in an investigatory stop (that is where we enter the reasonable amount of time zone again which depends on the circumstances in the individual case.)
