FBI's Top Lawyer Thought Hillary Clinton Should Be Prosecuted Over Email Crimes, But Was Talked Out Of It

Comey's defense for his own campaign to free Hillary Clinton from legal consequence was that "no reasonable prosecutor" would press charges for this set of facts.

Well, sure -- I mean, except for the FBI's own top lawyer.

Turns out "A Higher Loyalty" refers to Hillary Clinton.


For most of the past three years, the FBI has tried to portray its top leadership as united behind ex-Director James Comey's decision not to pursue criminal charges against Hillary Clinton for transmitting classified information over her insecure, private email server.

Although in the end that may have been the case, we now are learning that Comey's top lawyer, then-FBI General Counsel James Baker, initially believed Clinton deserved to face criminal charges, but was talked out of it "pretty late in the process."

The revelation is contained in testimony Baker gave to House investigators last year. His testimony has not been publicly released, but I was permitted to review a transcript.

During questioning by Rep. John Ratcliffe (R-Texas), Baker was unequivocal about his early view that Clinton should face criminal charges.

"I have reason to believe that you originally believed it was appropriate to charge Hillary Clinton with regard to violations of law -- various laws, with regard to mishandling of classified information. Is that accurate?" Ratcliffe, a former federal prosecutor, asked Baker.

Baker paused to gain his lawyer's permission to respond, and then answered, "Yes."

He later explained why he came to that conclusion, and how his mind was changed:

"So, I had that belief initially after reviewing, you know, a large binder of her emails that had classified information in them," he said. "And I discussed it internally with a number of different folks, and eventually became persuaded that charging her was not appropriate because we could not establish beyond a reasonable doubt that - -we, the government, could not establish beyond a reasonable doubt that -- she had the intent necessary to violate (the law)."

Ah yes, intent -- something the law does not require to be proven. Something Comey straight-up invented as a Double Secret Probation Element of the Crime only for Hillary Clinton.

Any prosecutor anywhere will tell you that.

I have used private email for business precisely once - when the network card on my laptop broke, and I had to use a personal machine to email, and it could not access my work webmail for some damn reason.

Even then, I got express written permission to route my stuff through personal email that day.

This behavior is not normal for anyone, in any sector, and I don't even handle particularly sensitive info.

Yep, and here's the thing, it's impossible to email classified data out of the system. You'd have to scan it in. Did they bother to investigate who scanned it in? That's why she was acting stupid about markings, I imagine that she thought that whoever was scanning it in understood to tape over markings first.

SOmebody tripped and hit the photo button on their smarts phone while they were falling towards the classified paper. Then, they tripped again and mistakingly hit the bluetooth connect to the unsecured computer and mistakingly downloaded the pictures that were mistakingly taken during 126 separate trips and falls in the bathroom office. Then SHrillary, mistakingly found the photos on the computer and assumed that they were legitimately on there, so she attached them to emails and sent them all over the world on unsecured lines to unsecured computers and people without security clearances.

Happens all the time. Trips and falls. Dangerous stuff, but what are you going to do?

Yep, they were all protecting the appointments they expected Hillary to give them when she was president, which they knew was going to happen. Not only was the media constantly assuring them that she was unbeatable, but they were also running their own covert "destroy-Trump" ops behind the scenes.

It wouldn't have mattered if Hillary had written and signed a memo to everybody at DOJ stating explicitly "it was my specific intention to violate federal laws regarding the handling of classified material," the FBI still would not have recommended prosecuting her, and the DOJ still would not have prosecuted her.

I doubt it. They picked it up off the fax, but whoever scanned it in had password access to a secure system, printed it and scanned it in. It's even odd that Hillary didn't at least handle the secure stuff on her secure system while doing her wheeling and dealing on her own server. Unless, of course, you were sharing classified data with people that she didn't want a record of getting it like Blumenthal or Russians.


Did they investigate who she sent classified documents to? And who those people sent it to? Anybody could get it since it was unsecure, but who was she purposefully communicating it to and what were they thinking of getting classified data on their accts, were their accts secure?

I think its possible he was blackmailed.

I think it is also possible he thought he was doing the best possible thing by calling it a tax because then it showed the administration was lying though its teeth saying it wasn't a tax increase when it was, and thus it would have a political impact. (I think that's stupid, but possible) The thing that weighs against that, is that he would have had the opportunity to argue this logic with the other conservative judges to get them on board or not and if not convinced should not have drafted an opposite opinion. Its unusual. He changed his vote at the last possible minute.

So it is not beyond the pale to question it. He did adopt his kids from Ireland and at the time there were a lot of shady adoptions going on, and Ireland is still pissed about those things, and could make an issue.

These things, I'm saying, are not equivalencies, at all. In the face of undeniable evidence they still deny - -women have penises! In the absence of evidence to the contrary we are still question. Otherwise they get to shut us up without any evidence. Don't fall for it.

But the odious part is the restriction on kicking out tenants. It basically allows tenants to have permanent residence whether they pay or not or if they destroy the property. It makes it almost impossible to evict.

As a landlord myself, I'd never put up with that and would be listing my properties asap.

He would have perjured himself, multiple times, in the adoption paperwork. He would have committed fraud. it would be provable using documents that the deepstate probably has. He'd lose his license, get kicked off the court and not be able to practice law again.

Sessions did the right thing. I said it at the time and I stand by it.

There is no way in hell the Attorney General of the United States could oversee an investigation where he was a potential target. I know some people like to pretend this isn't the case but it is.

And it doesn't matter anyway. This was always going to go to a Special Counsel because of the corruption at the DOJ and FBI at the time. Hell, McCabe took out a criminal investigation of Sessions.

Sessions is a sideshow as far this investigation. The Deputy AG is not a janitor, he is the COO of the DOJ. And he did a very solid job.

Go read the article I just linked. Facts. And then make up your own mind.

Well I don't disbelieve the Roberts one. Its within the realm of what's provably been happening in DC. Maybe it was just his idea of a esoteric solution to something he viewed as more of a political issue than a legal one, but its was a weird thing to do and a weird way to do it.
