It's Time for Congress and State Legislatures to Make Hoax Hate Crimes Themselves Hate Crimes, and Felonies to Boot

As Infobee and John Hayward argue -- what is a hoax hate-crime if not an effort to create waves of hatred and possible violence against a race or group?

BTW, Rush Limbaugh read this thread and pointed out, rightly, that we'd be living in a different, more dangerous world if Smollet's plan to get this fake attack on camera worked.

Apparently the camera he thought would film the attack was pointed in the opposite direction.

But if he had gotten this basic fact right, we'd have seen coverage of this staged attack of MAGA-hat wearing white men (wearing gloves and ski-masks to hide their ethnicity) beating up and tying a noose around the neck of a black man.

This would have of course created -- what's that word? -- Backlash against white people, especially those wearing red hats, and put their lives in danger from bad actors seeking racial vengeance.

No one cares about this, huh?

This isn't hypothetical: Crazed leftwing lunatics are now sticking guns into the faces of people for merely wearing MAGA hats and telling them "Today is a good day for you to die."

According to the alleged victim Terry Pierce, a man pulled a gun on him because he was wearing a Make America Great Again (MAGA) hat.

"I have as much right to wear that hat and support my country and my president as he has not to," said Pierce.

The police report confirms that the suspect, identified as James Phillips, admitted to flipping off Pierce and Pierce's wife because of their hats.

Pierce tells 13 News that he was shopping with his wife when Phillips "Pulled a .40 caliber out and stuck it in my face, backed up and said, 'It's a good day for you to die.'"

It's time to criminalize these attempts to stir up Backlash against Republicans, and treat these attempts to stir up lynch parties as the hate crimes they are.








Hoax hate crimes are well beyond the usual threshold at which the media and our Ruling Class declares something to be an "epidemic" and "a scourge which must finally be ended."

Strangely enough, however, this time they're very quiet about the epidemic!

As the Daily Caller reports, there has indeed been an epidemic of hoax hate crimes, and our political-media establishment has done nothing to reduce this epidemic. In fact, they've made it worse, by excusing each new hoax hate crime with the "Deeper Truth" illogic. ("In this particular case, the hate crime may have been a hoax, but the hoax just points out the Deeper Truth of marginalized communities feeling forced to make up hoax hate crimes," etc.)

Could that shooter in Aurora have been influenced by the non-stop news coverage of the alleged hate crime against Jussie, and let that be one more thing to get revenge for on his way out the door in a blaze of glory?

It's bordering on treason in its seriousness.

I'd prefer something along the lines of 20 years in federal prison for being convicted of a hoax hate crime.

There in fact should be gradations of seriousness, as there is with homicide (negligent manslaughter, manslaughter, second-degree murder, etc. etc.) and sexual assault (attempted molestation, molestation, attempted rape, rape, etc. etc.).

If the hoax hate crime is simply a teenage lie that spun out of control (as with the Tawana Brawley case, who was simply trying to gin up a believable excuse to her mother, covering up why she had been out all night with a boy), then I suppose the punishment should be less, But in instances such as Jussie Smollet's crime, it should be considered "Incitement to racial hatred and rioting in the first degree," earning 20 years in prison.

For one thing, the definitions and decisions of what makes a "hate crime" are entirely subjective and ever-changing, because its based on the latest progressive ideology. They change the list constantly of what is oppressor and who is oppressed, so you can't know or understand what is bad and what isn't.

For another criminalizing personal intent or animosity is a direct violation of the principles of law and the constitution. The founders were extremely clear and vehement about not pushing someone for their conscience or inner thoughts, yet here we are.

Another problem is that "damage to society" is not a proper basis for criminal prosecution or sentencing. That is completely subjective and again changes from year to year. Law has to be based on objective, absolute principles or it simply becomes a tool for oppression by the people in charge.

And finally basing laws and sentencing on how an individual feels about an act is without the slightest proper legal basis. Peoples feelings change from day to day or moment to moment. What feels intimidating or dangerous can change based on one's mood or situation. And to the extent any laws are based on subjective reaction, its based on commonality and social average: would the average person reasonably feel this way, not "did this person feel this way at that moment."

Hate Crimes are a tyrannical violation of almost every principle this nation was founded on and must be eradicated, not expanded.

1) The boy who cried wolf. People will being immediately dismissing these things as lies immediately. The press won't and nor will the intelligentsia, but real people will.
2) A *real* backlash will happen and people will start getting beaten or killed. The perpetrators of these hoaxes might be in that group, but the perpetuators in the press very likely will be. This does not bode well for civil life, but the hatred of anything even loosely considered "the right" is well into a territory that can only be described as "pathological."

70 Yeah, hate crimes. The "hate" makes it a Federal offense. But, from the standpoint of a victim, it doesn't matter if the perpetrator "hates" you or not. The result is the same. I've thought that, too. The acceleration of the news cycle certainly doesn't help.

But the obvious way to deal with that is to indicate the tentativeness and early nature of the report.

Instead of blaring about, e.g., "the attack," publish the facts known to date about "the reported attack."

It doesn't take world-class wordsmithing to keep some editorial distance, which also provides cover if the initial report later gets debunked.

The judge asks if it's an unanimous verdict and one juror pops up, "No." They then poll the jury and there is more than one guilty. ( They don't tell us the score.) So there's a mistrial.

I've sat through hundreds of jury pollings. Never had one that required any further action. I've heard losing attorneys tell me they seek polling only to embarrass the jurors.

I bought a throwaway prepaid card in cash (costs 5 bucks at a drugstore, supermarket, gas station, etc. - a non-re-loadable one), put a random ZIP code in for it, and then ran it for Ace. Sadly, that IS a good point. Moreover, there is always that hope among me that a good Republican will win the #2 slot in the primary.

For example, in the last Governor's race here. Monkey wrenching, it would be tempting to vote for Reconquista Antonio Villaraigosa over Gavin Newsom, just to start a gd feud between the "Brown" Demunists on one side and the "Green (Watermelon) and Pink" Demunists on the other.

But I stayed true to principles and went with Travis Allen GOP. Allen lost to John Cox GOPee, but to his immense credit, earnestly stumped for John Cox afterwards.

even "I can't breathe" guy was legit. They had a lot of cops to take him down as gently as possible, but he fought them, and his health problems led to his death. It is possible cops were slightly negligent in not getting him aid sooner,, after he was subdued, but it was not a choke hold, and that didn't kill him ... his fighting and not being strong enough to walk around the block was what killed him. as I heard it.

445 No, Smolett deliberately avoided getting this on camera, because he knew he wouldn't get achance to doa second take. Do you think he's that great an actor that he would stage this with confidence without getting a chance to do a second take. Off camera, it's not necessary to act this at all.

447 Recently a statue near where i live had a snake wrapped around it and a dead bird placed in its hands. Thing is it was a statue of the Virgin Mary outside a former Catholic school, therefore this made no news what so ever, despite being 2 minutes outside of New York City. Something that by a means should be looked into was ignored, wonder why?

Likewise that school is now some hippy center for adult children, with a juice bar and adult jugle gym. They have a camera pointed directly at the statue, but conveniently it stopped recording for the time around when this all occurred.
