As Infobee and John Hayward argue -- what is a hoax hate-crime if not an effort to create waves of hatred and possible violence against a race or group?
BTW, Rush Limbaugh read this thread and pointed out, rightly, that we'd be living in a different, more dangerous world if Smollet's plan to get this fake attack on camera worked. Apparently the camera he thought would film the attack was pointed in the opposite direction. But if he had gotten this basic fact right, we'd have seen coverage of this staged attack of MAGA-hat wearing white men (wearing gloves and ski-masks to hide their ethnicity) beating up and tying a noose around the neck of a black man. This would have of course created -- what's that word? -- Backlash against white people, especially those wearing red hats, and put their lives in danger from bad actors seeking racial vengeance. No one cares about this, huh? This isn't hypothetical: Crazed leftwing lunatics are now sticking guns into the faces of people for merely wearing MAGA hats and telling them "Today is a good day for you to die."According to the alleged victim Terry Pierce, a man pulled a gun on him because he was wearing a Make America Great Again (MAGA) hat. "I have as much right to wear that hat and support my country and my president as he has not to," said Pierce. The police report confirms that the suspect, identified as James Phillips, admitted to flipping off Pierce and Pierce's wife because of their hats. The Aurora, Illinois shooter was a black man. He entered his workplace with a .40 cal weapon, and proceeded to shoot to death five white people.
He also shot at least five cops, whose ethnicity I don't know and who will luckily all survive.
Could that shooter in Aurora have been influenced by the non-stop news coverage of the alleged hate crime against Jussie, and let that be one more thing to get revenge for on his way out the door in a blaze of glory?

I'd prefer something along the lines of 20 years in federal prison for being convicted of a hoax hate crime.
There in fact should be gradations of seriousness, as there is with homicide (negligent manslaughter, manslaughter, second-degree murder, etc. etc.) and sexual assault (attempted molestation, molestation, attempted rape, rape, etc. etc.).
If the hoax hate crime is simply a teenage lie that spun out of control (as with the Tawana Brawley case, who was simply trying to gin up a believable excuse to her mother, covering up why she had been out all night with a boy), then I suppose the punishment should be less, But in instances such as Jussie Smollet's crime, it should be considered "Incitement to racial hatred and rioting in the first degree," earning 20 years in prison.

For one thing, the definitions and decisions of what makes a "hate crime" are entirely subjective and ever-changing, because its based on the latest progressive ideology. They change the list constantly of what is oppressor and who is oppressed, so you can't know or understand what is bad and what isn't.
For another criminalizing personal intent or animosity is a direct violation of the principles of law and the constitution. The founders were extremely clear and vehement about not pushing someone for their conscience or inner thoughts, yet here we are.
Another problem is that "damage to society" is not a proper basis for criminal prosecution or sentencing. That is completely subjective and again changes from year to year. Law has to be based on objective, absolute principles or it simply becomes a tool for oppression by the people in charge.
And finally basing laws and sentencing on how an individual feels about an act is without the slightest proper legal basis. Peoples feelings change from day to day or moment to moment. What feels intimidating or dangerous can change based on one's mood or situation. And to the extent any laws are based on subjective reaction, its based on commonality and social average: would the average person reasonably feel this way, not "did this person feel this way at that moment."
Hate Crimes are a tyrannical violation of almost every principle this nation was founded on and must be eradicated, not expanded.

A journalist gets a lot of credit and importance when they're the first person to report on something. Getting the scoop on it gets you awards. I do think that faking a crime should carry nearly the same penalty as
the crime. Accuse someone of rape falsely and get some of the same

This is the right answer. "Hate crimes" were a PC conspiracy and a "solution" in search of a problem.
As someone up there put it, hate it is a *motive*. If there's a crime that is particularly egregious, that is why we already have the "aggravation" modifier. Assault can become "aggravated assault" without needing "hate crime" nonsense.

I've thought that, too. The acceleration of the news cycle certainly doesn't help.
But the obvious way to deal with that is to indicate the tentativeness and early nature of the report.
Instead of blaring about, e.g., "the attack," publish the facts known to date about "the reported attack."
It doesn't take world-class wordsmithing to keep some editorial distance, which also provides cover if the initial report later gets debunked.

Creating a law, or a budget because you hate someone, or hate people of a certain ideology is just as evil as a crime that gets the additional "hate crime" modifier attached to it.

I just saw a true crime show (about the teenage girl burned to death in Mississippi, https://bit.ly/2U4Lc3O) and they showed the jury returning an acquittal. The judge asks if it's an unanimous verdict and one juror pops up, "No." They then poll the jury and there is more than one guilty. ( They don't tell us the score.) So there's a mistrial.
I've sat through hundreds of jury pollings. Never had one that required any further action. I've heard losing attorneys tell me they seek polling only to embarrass the jurors.

Mr gun (James phillips of TN) had accosted the couple with obnoxious obscene had gestures. The male member of the couple called the obnoxious man out, instead of just getting the hell away from the crazy man as I likely would have done or ignoring the open insult. (Not judging this as wrong, it's just that women, and I am one,usually get the hell away from crazy men and conflict.).
Mr gun becomes alarmed after his target didn't back down or slink away, but argued with him. Like ant coward bully, he felt "assaulted" by the man who stood up to his insults. That's when he pulled the gun. He was scared and didn't want to fight the man, brandished his gun, then lowered it when challenged to shoot or fight.
A doofus coward, who did use "fighting words" with his hands in the store, brandished because the reaction to this scared him.
He didn't do this until he was losing an actual argument.

Agree completely - that is I think the huge danger of allowing a case like this to cause us to make changes in the law, making it easier to "get" someone like Smollett. Any changes we make would be so easily turned against us by the left!!! The laws making prosections difficult for political crimes are there for *our* protection, not theirs, and if a few bad actors are allowed to walk away with nothing more than a fine because of that, it's a price I'm willing to pay for my own safety.

He named two police officers, one of whom had just committed suicide (IIRC) as Tawana's kidnappers. I don't get the sense that GOP Congress members are even remotely aware of how bad it is out here for normal people in the real world. The malicious targeting and property damage aimed at conservatives for exercising free speech rights. I'd guess a HUGE percentage of conservatives don't overtly virtue signal their support of the GOP out of fear of vandalism and becoming the target of assaults and the like.
Sad state of affairs in a country with supposed free speech rights. Same thing about rallies. Whenever conservatives plan rallies out here in Oregon, Antifa shows up with all of their hate and aggression. So --- Shhhhhhhocker -- you don't see many conservative rallies out here, and that's exactly what they want.
Time for new free speech laws, or lawsuits by conservatives until there are, that require police protection of conservatives and the enforcement of assault, vandalism and intimidation charges, and if the police don't do it, create a private action law suit so circizens can sue the shit out of the government.
These liberal-city police departments will undoubtedly grant any Conservative a permit for a rally, but they won't protect the rights of the permit holders. THIS needs to become an actionable civil claim available to conservatives, with city-covered attorneys' fee awards.

In the end, Rush is an old man who wasn't part of the tech generation that came after boomers, so he doesn't really know much about this stuff. Unlike someone my age who grew up around computers and tech, the generation that created the internet as we know it etc, he remembers when color TV became a thing. Jewells, I try to constrain my credit card activity for the same reasons. For things like this, though, there is an alternative. I wanted to hit the tip jar but not use my CC. I bought a throwaway prepaid card in cash (costs 5 bucks at a drugstore, supermarket, gas station, etc. - a non-re-loadable one), put a random ZIP code in for it, and then ran it for Ace. A bit of overhead to buy the card, but also not my actual details.

I suspect that Kameltoe is the reason they moved up the primary here in CA, although they may have done it just to make California's primary matter, which it never has before.
Of course, this could easily blow up in their faces, as Cali is chock-a-block with rabid leftists, so the candidates will all be trying to outflank each other on the left, leading to awkward problems for them in the general election.

Sadly, that IS a good point. Moreover, there is always that hope among me that a good Republican will win the #2 slot in the primary.
For example, in the last Governor's race here. Monkey wrenching, it would be tempting to vote for Reconquista Antonio Villaraigosa over Gavin Newsom, just to start a gd feud between the "Brown" Demunists on one side and the "Green (Watermelon) and Pink" Demunists on the other.
But I stayed true to principles and went with Travis Allen GOP. Allen lost to John Cox GOPee, but to his immense credit, earnestly stumped for John Cox afterwards.

Call me a coward if you like, but it what it is in the modern world. THIS is what so-called "social justice" is all about. Intimidation and silencing of conservatives, and it works. I'll wager I'm in the majority on these issues, among conservatives. It will continue until the GOP in D.C. wakes the F--K up and passes new laws that allow us recourse against the SJWs. Something simple, like deeming with political beliefs to be included among "the protected cases" in anti-discrimination law would be HUGE.

even "I can't breathe" guy was legit. They had a lot of cops to take him down as gently as possible, but he fought them, and his health problems led to his death. It is possible cops were slightly negligent in not getting him aid sooner,, after he was subdued, but it was not a choke hold, and that didn't kill him ... his fighting and not being strong enough to walk around the block was what killed him. as I heard it.

There is no such thing as "hate crime" or "hate speech". There is no such thing as "intersectionality". There is no such thing as "cisgender".
There is no excuse for accepting, adopting, endorsing, assisting, spreading the idiotic crap that has hollowed out our civil society. "Hate crime", as a concept, reflects exactly this problem.
