Justices Gorsuch and Kavanaugh Vote to Uphold Louisiana Abortion Restriction Law, But John "Obamacare's a Tax" Roberts Defects to the Liberals to Enjoin It, Pending Review By the Full Court

Is there anything left of the legacy of George W. Bush or the neocons that we can call anything but a complete failure or a complete surrender to leftism?

Keep saying "But Gorsuch" and "But Kavanaugh," NeverTrumpers. I mean, you guys have really delivered yourselves, haven't you? You have so many W's to your credit you're perfectly entitled to denigrate other people's successes.

A divided Supreme Court stopped Louisiana from enforcing new regulations on abortion clinics in a test of the conservative court’s views on abortion rights.

The justices said by a 5-4 vote late Thursday that they will not allow the state to put into effect a law that requires abortion providers to have admitting privileges at nearby hospitals.

Chief Justice John Roberts joined the court's four liberals in putting a hold on the law, pending a full review of the case.

President Donald Trump’s two Supreme Court appointees, Justices Neil Gorsuch and Brett Kavanaugh, were among the four conservative members of the court who would have allowed the law to take effect.

There are a lot of "conservative" pundits offering Vintage Punditry. They seem stuck in the same arguments they've been stuck in since 1997, and they seem to treat 2004 like nostalgic oldsters look back on the first summer they had a date.

But what positive legacy do the Bush years leave us with? Just because it was important to some Vintage Pundits as their own Political Woodstock, their own Iraq Summer of Love, does not mean it is objectively worthy.

We got Samuel Alito. And that's about it.

LOL: Speaking of Boomer Nostalgia...

How serendipitous is this?

Likelihood of Prevailing on the Merits:

A commenter wrote that this isn't such a big deal, as this is just a stay of the ruling and Roberts can rule in favor of the Louisiana provision later.

Well, yes but: One of the criteria for enjoining a decision is "likelihood of prevailing on the merits" in the full hearing.

So in Roberts' eyes, he's judging that he's probably going to vote to invalidate the law.

2 Justice Ginsburg is not in the office today, again.

Justice Ginsburg is very disturbed about a conspiracy theory going around that she is physically incapacitated (or even dead!) and that she is therefore unable to handle the normal workload of a Supreme Court Justice.

She believes this may be the work of the same conspiracy theorist who floated claims that Secretary of State Hillary Clinton kept her emails on a 'secret server' and destroyed evidence; that former President Obama's birth certificate was digitally fabricated; that Bernie Sanders and Alexandria Ocasio-Cortez are socialists; and that Hillary Clinton has health problems, among many other absurd claims.

She thinks it is even possible that the work of this conspiracy theorist goes back as far as claims that President Clinton cheated on Hillary and that Vince Foster did not kill himself in Fort Marcy Park.

Justice Ginsburg received a tip that the conspiracy theorist may be the same person as the real killer of Nicole Brown Simpson and Ron Goldman, and therefore she decided to team up with O.J. Simpson to find this person.

They agreed that the most promising place to begin their search is on America's finest golf courses.

Today their search continued, this time on the Celebrity Course at Indian Wells. Justice Ginsburg said she has been outdriving O.J. all day, and made the green in two on the famously scenic 14th hole, which set her up nicely for a two-putt birdie.

Unfortunately, they have seen no sign of the suspect so far.

Justice Ginsburg assured me that she will be able to keep up with Court business during down time, such as when waiting for O.J. to tee off or at the '19th hole.' She said she brought one of her clerks with her to serve as her caddy who will pass along her rulings to me.

Something odd about this case, because I believe Pennsylvania has a provision in the law that abortion providers have to have admitting privileges.

Why wouldn't Louisiana be allowed? Unless no one ever challenged Pennsylvania. I think it went into effect after the Gosnell nightmare.

Between 2011 and August 2015, nine states enacted ''hospital admitting privilege'' laws that require clinicians offering abortion services to obtain the right to admit patients to a local hospital in order to legally provide abortions in their private practice or clinic setting; seven states have similar, facility-level ''hospital transfer agreement'' laws.

40 George W Bush gave us Obama. He got sold a bill of goods from the (suspiciously quiet of late) Wolfowitz/Feith contingent, compounded it by failing to sack failed military leadership up to and including Rumsfeld for YEARS (if there's one thing Marshall gave FDR, it was a realism about the timescale of modern war) and was so committed to his war that he'd give the Democrats almost anything to secure funding. Obama's bottom 5 of Presidents, but Bush 43 hardly scores better.

The current Roberts tempest-in-a-Frappucino is not all that, it's an injunction pending a decision whether the court will actually hear the case. Mind you, I wouldn't be surprised if Roberts set himself up as Anthony Kennedy Redux, in which case the bloody-minded will start squirting more HFCS into their Sotomayor voodoo dolls, but this isn't a big thing. 75 Neocons. Feh.

For the past century, the Left, here and abroad, has held the commanding heights of Western life - politics, culture, finance, education, the whole thing.

What this means is that very person on the "Right" is necessarily (to a large degree) a free-thinker. All of us had to reject the dominant narrative and prevailing wisdom to get where we are ideologically.

It's highly individualistic. Each person followed their own path away from the power structure of the Left, and consequently ended up in places along a whole spectrum of beliefs. The "Right" is pretty damned amorphous, and comprises people who believe ideas from libertarianism to monarchism.

There is only one thing, and one alone, that defines us as a political movement: rejection and defiance of Leftist authoritarianism. We are, put simply, "the other."

If you are not standing in aggressive defiance of the Left, you are not one of us. If you are seen to be consistently cooperating with them, then you are not an anything-con. You're a Leftist.

I draw no distinction between Bill Kristol and Ilhan Omar.

Look back at the Reagan years. Detroit bailouts and UAW workers collecting salaries for sitting around doing nothing. Largely failed Mideast policies (thanks, George). Iran/Contra. 'Compromises' with Dem Congressional leadership that redounded poorly on everyone.

Reagan prioritized disposing of the USSR above all else, and he got there. And compared to the malaise that'd gone before he was a huge step in the right direction.

I like Reagan, but let's be honest, the Soviet Union would have collapsed anyway. I'm sure he got us there a few years sooner, but I would have gladly had the USSR stick around a few more years in exchange for not signing a giant amnesty.

Also, his enormous military buildup and ignoring of the deficits (because military spending somehow doesn't count as government spending) I think put conservatism on a weird, NeoCon path.

Foreign policy was his main focus and I would have rather he spent more energy on a domestic, conservative agenda.

But we don't get everything we want and he did mostly have a Democrat Congress. And the other GOP options were awful, basically Gerald Ford types.

168 Roberts is taking orders/commands from The Bush/Obama Destiny Coalition for Global Unity.

It's not Trump that started him off creating a tax out of a penalty so that the favored means of control of the population can be enacted. That was Obama (and I would guess with applause from Robert's pals the Bushes) and Trump wasn't much of a glimmer at the time. This isn't really about Trump at all. It's about Christianity's obstruction of tyrants and dictators and their constant pointing out that there is a God and that we'd better behave cause he's coming back. No One World Government wants to try and counter/fight that while trying to consolidate their power.

So what needs to be done is fragment, persecute and force to bend the knee Christians and Christianity to secular power before a Global Government can take over.

Personally, I believe Francis was a result of this power play and at the very root of the largest denomination. His subjects of concern look more like the words of Government apparatchiks than a spiritual leader. He's bought and paid for. They know he can't do much but he can drag his feet and throw up road blocks.

This smacks of the "New World Order". And who was it that uttered that phrase as a President?

Yeah, HIM, Daddy Bush and his sprogs. Who just so happen to also be best buds with the Obama Family.

But we got a multi trillion dollar war in Iraq because the Bush family was mad at Saddam hussein, that had ZERO to do with 9/11.

Bush really left the GOP in shambles, he bungled just about everything and could barely form a sentence.

194 I'm not overly exercised about this. It is NOT the final decision but just a stay of a controversial law. With the court split, Roberts cast the deciding vote to maintain the status quo until the case can be heard. This is what I would expect a reasonable Chief Justice to do.

I'll be happy to excoriate him later if he votes against the law when it counts.

195 Some years back, Consumer Reports had a review of birth control methods. In the article, they claimed that abortion was safer than carrying a baby to term. They were able to claim this because when women die from having an abortion, the death is attributed to an infection or hemorrhaging or cardiac arrest, with the abortion procedure not being mentioned.

I guess you make abortion safe by disregarding any evidence to the contrary.

Posted by: Quint at February 08, 2019 12:21 PM (n13/j)

198 Getting to this LA law, it is actually protecting women. They want women getting abortions to be quickly admitted to a hospital should an abortion procedure go badly. That's why they want the abortionist to have admitting privileges.

Likewise, the Virginia law tried to knock out similar *protections* for women that require an abortion clinic to meet the same standards as a hospital.

Despite the bizarre twisting of the word "access" by NARAL, PP, and these ghouls pushing abortion legislation right now, what they are really doing is making it possible for clinics to be substandard, for non-doctors to perform abortions, and more difficult for women who need to be rushed to a hospital to be admitted for care.

Above and beyond the spectacle of infanticide, they are actively setting about harming women.

Un-freaking-believable.

+++++++++++
Technically, sound is sound. At the peak of the analogue era (the 80s), the equipment was more than good enough to be higher fidelity than our ears are. So any technical quality improvements in the digital era are unnoticeable in virtually all cases, and worse (like signal headroom) in a small number of cases.

That said, we can call the technical quality equivalent, with maybe a slight edge to digital or analogue on balance (it depends on your biases).

What the digital era did, though, is make it *much* cheaper. But you still have to do it well (e.g., have talent) - your unit cost (and the costs of gambling) just go down.

Meaning that it was an illegal law composed to infringe on abortion by claiming a safety requirement that would have eliminated all other abortion providers except one guy.

And it probably was composed that way. That said how they get around dictating to a state how it conducts it's duty of regulating the safety of the Public by creating laws to do so?

Whether or not this one results in an infringement of abortion.

A so called RIGHT that now one can define or point out exactly where it derives from.

Maybe this is a back door way of ruling on Roe V Wade. In that Roe has distorted the rights of the states to legislate to protect the public's health. Remember that the plaintiff is the abortion provider arguing that the proposed law interferes with the right of a woman to get an abortion.

244 The great thing about the 70s was that the music was genuine and varied.

Rock sounded like rock (Zeppelin). Soul sounded like soul (Commodores, Harold Melvin, Patti Labelle). Folk sounded like folk (John Denver, Dylan). Easy listening was pleasant (Carpenters). Pop rock (Billy Joel, Elton John) was distinguishable from heavy rock (Black Sabbath) and glam (Queen, Bowie). Storytellers were excellent (Harry Chapin, Al Stewart, Jim Croce, Carole King).

And art rock (prog) was AWESOME (ELP, Yes, Tull)!!!

Everything I named there was on the charts at one time or another.

The charts had amazing variety!

It's not a cliche statement, it's a fact: Everything coming from major labels sounds the same today. Pop, hip-hop, rap: it's all a blend. And there's nothing as pleasant as Karen Carpenter was. NO ONE will get that delightfully sentimental. Everyone's gotta be cool.

One of the criteria for enjoining a decision is "likelihood of winning on the final merits."

So in Roberts' eyes, he's judging that he's probably going to vote to invalidate the law.

Bush et al didn't realize that the Saudis were using Islam to control their people and their enemies and that it was a 2 edged sword in the fact of it's virulent anti jewish, anti christian and outright demand for it's believers to attack and kill any and all non-believers would then turn on the US and would reject democracy and western values.

275 Islamic State is far from defeated, and instead is morphing into an asymmetrical warfare force after the militant group lost almost all of the territory it once controlled in Syria, German Chancellor Angela Merkel said on Friday.

Merkel's remarks at the inauguration of the Berlin headquarters of Germany's foreign intelligence agency BND contradicted statements by U.S. President Donald Trump that the Islamist group has been defeated.

"The so-called Islamic State has been luckily driven out of its territory but this unfortunately doesn't mean that Islamic State has disappeared," Merkel said. "It is transforming into an asymmetrical warfare force. And this, of course, is a threat."

No hospital in the US is going to give gyne surgery privileges to an opthal or radiologist. 45 extra days to get credentialed aint enough. They'd need to go back and do a residency in GYN before the hospital would give privileges.

323 I think Robert's rules differently as Chief Justice than he would as an ordinary Justice. He feels all the attention is on him and because philosophically he leans right, he feels like can't rule that way because he'll look partisan.

I wonder if Gorsuch or Kavanaugh would rule differently if THEY were Chief Justice. That's why I hope neither becomes CJ.

It's always interesting to find out what popes wanted to be before joining the priesthood.

Paul VI, for example, wanted to be a lawyer. (Is it therefore any surprise that the one and only good thing about his reign was the reform of canon law?)

JP I was called to the priesthood from the beginning.
(Maybe that's why God called him home so soon after he was poped!)

JPII wanted to be a playwright and writer. (I'm not sure what that signifies.)

Benedict was interested in philosophy and intellectual history.

Francis always wanted to be ...... a politician.

I'm sticking with "preserving the illusion of Judicial Power".

Roberts knew Obama would go forward with the ACA anyway - so he ruled in favor of it to prevent the Court from being exposed as powerless.

Roberts could have ruled in favor of LA - but he's thinking ahead. He knows Blue States will ignore any ruling limiting abortion - so he's not going to make ANY ruling limiting abortion.

I don't think they are necessarily tied together, no. But Bush- like Bill Clinton, but especially like Obama- presided over the gutting of the industrial states (FUCK calling them the "Rust Belt") and the rural heartlands. It's not that I think Trump is a negotiating genius for bringing us USMCA. I just think he had considerably more empathy for his fellow Americans than Bush ever did- and the will to go against the Chamber of Commerce. That was all that was required.

Bush has some empathy for veterans, but:

1) Considering his ineffectual flailing was responsible for feeding troops into Iraq and Afghanistan, I'd say it's his goddamn obligation.
2) Meeting the baseline standards for American decency isn't a cause for celebration. It's just out of the ordinary compared to Washington. Sodom earned its fate with less vigor.

You have a point.
In my opinion , the best period of rock was between 1965 and 1975--with 1969-1971 being the absolute BEST in terms of greatest number of iconic albums. It was also very diverse and includes every strain from metal to funk to acoustic singer songwriter to progressive rock.
Something did happen around 1973--most of the industry moved to California and got hooked on cocaine. Also radio stations playlists got tighter and tighter and they stopped breaking new music--for the most part.
Listeners settled in to one type of music--you couldn't like Zeppelin AND R&B anymore, you had to choose.
Then tastes calcified.
It was never the same anymore.

I think Shania Twain had a lot to do with mainstreaming it. Her first album was an actual country album and then it became poppier over time. "Up" was a double-album of the same songs done in both "country" and "pop" variants. Once this happened, the "Country == Pop" transition was complete and we got the heyday of pop-country. Now it's pop or rap "country."

BUT it was still a very foolish non-vote.

417 85 yr old people who survived pancreatic cancer AND had a lobe of their lung removed because of lung cancer don't survive for long.
========
P.S.

they never told us it was lung cancer. they said she had cancer in her lung. There is a huge difference -- since she's had prior cancers. If its a primary lung cancer she might have a few years - except you expect she'd be getting more than just surgery, she'd get maybe some chemo too. She's apparently not.

So that leaves metastatic disease. She's had pancreatic and colon. Those metastize to the lung its very bad, late stage in disease course. She also gave a speech in late 2017 or early 2018 where she said that she had a "recurrence of her melanoma". Now she'd never publically announced melanoma dx previously. So snopes lables this report a false. Why? She gave a public speech and made these comments herself.

Melanoma - skin cancer - that has spread to the lungs is stage IV. If so she's already on borrowed time. her odds of surviving stage IV melanoma for two years are 20% - she's probably been stage IV for almost two years already. She'd have to make it to 2020. No one her age is going to be able to do it. they'll try an fake it with a body double if they have to.

They are desperate to murder babies.

They likely only did the surgery to determine whether or not it was a lung primary vs a metastatic leision. The fact that they haven't announced it was LUNG Cancer and that she's going to undergo chemo probably means it was mets.

Bush bought into a lot of free trade stuff that I think a lot of us did. I still support free trade but it has to be fair. And gutting America's manufacturing sector is not just wrong, but strategically stupid. I am a pie in the sky type on this issue in some way. I think Americans should buy American just because the products are better, not because of tariffs. But that is an issue for another time.

Trump saw something the standard GOP people did not. He came at this from a business background and he saw we were getting screwed in trade. He saw that economic theories like "creative destruction" were more complicated. American jobs were getting destroyed, but it wasn't by creativity.

Trump brought something new, something a long list of losing Republican candidates never considered. That is why they lost and why he won. People criticize Trump for this and that, but the fact is he won. We tried moderates and mainstream conservatives over and over, and they lost.
