Gun Thread: Innocent or Guilty - Conclusion [Weasel]

In last week's episode, we discussed jury duty and a trial involving firearms. For those interested in a review, last week's thread be found HERE. (do not comment in old threads!). To recap the case briefly; responding to a disturbance call, police find a felon in possession of two muzzleloading rifles which they inorrectly assume is allowable. The rifles were later surrendered to the Commonwealth Attorney's office by the defendant, with the barrels plugged, ostensibly rendering them unusable. During a subsequent search of the defendant's apartment and associated storage space, a functional revolver and ammunition are recovered. The defense caims the rifles were not technically firearms since the barrels were plugged and denied knowledge of the revolver.

Last week we paused after the jury took the first vote...

...which was 8 to 4, for acquittal. I will tell you now I was one of the four votes for a guilty verdict.

Here's my thinking:
I didn't really believe the rifles were plugged at the time of the original call because it didn't make sense to me for the defendant to keep "permanently" plugged modern rifles absent any collector or stated sentimental value. If they were not permanenetly rendered inoperable, and I did not believe they were, then the defense assertion they were no longer firearms was invalid. The defense case with respect to the rifles in general was weak and unconvincing, and while I suspected the rifles were plugged after the fact, the police had bungled that part of the case so thoroughly I decided to disregard the issue of the rifles altogether and focus on the handgun. Had there been onvincing testimony the barrels were not obstructed when first found, my decision would have been different.

The prosecution seemed to have arrived at the same conclusion in their decision to focus on the handgun. As demonstrated by photographic evidence and testimony, the manner in which the revolver was found did not in any way support the theory that it had been slipped through the space above the door and dropped, or otherwise planted, into the box where it was found. The physical arrangement of items in the storage cage made that explanation highly improbable, if not altogether impossible. The defense did not make the assertion that any specific person (e.g. a jealous girlfriend) had planted the gun, only that it could have been dropped inside by a passerby. The gun was found with other items clearly identifying and belonging to the defendant. The storage space was under the custody of the defendant which I agreed represented constructive possession of the items inside. At the end of the day the gun was in a box full of the defendant's stuff in a space controlled by him.

So we discussed these elements for a while and took another vote, and this time it was about evenly split. Back and forth some more and after a few hours it's finally 11 to 1 for a verdict of guilty. The holdout seemed steadfast but could not support or provide any logical reason for their position which, as stated, was simply not wanting to send anyone to jail. It took some time to disuade them of this opinion, mostly because I believe they were enjoying the attention, but finally it's unanimous. Guilty as charged.

Once the verdict was read in court, the trial went directly into the penalty phase. The jury is informed the sentencing guidelines dictate between 2 to 5 years in prison. No more, no less. The jury also now learns the nature of the previous felony; aggravated assault, which had been committed by the defendant in another state a few years earlier, and for which he served his time. The decision regarding a sentence comes quickly; 2 years. The consensus of the jury in choosing the minimum sentence was the fact the possession did not occur during the commission of a violent act.

Concluding Thoughts
Last week, based on the case summary provided, you all made what I thought were compelling arguments both for and against conviction, and many of the same arguments were made in the jury room. Some of of you based your opinion on the prosecution proving (or not proving) the defendant's legal ownership of the revolver, while others seemed to base their opinion on whether it was right to deny 2nd Amendment rights to a felon who has served their time. For those in this first example, keep in mind, the charge was possession rather than ownership. For those in the second example, it may be useful to think of two concepts in law; Malum Prohibitum - wrong because it's prohibited by law but not inherently immoral (speeding, commenting in old threads), and Malum in Se - wrong because it's immoral (murder, carrots in chili, voting for liberals). I think the actions of the defendant are an excellent example of malum prohibitum.

As I heard the case I suspected the defendant's previous felony was serious, otherwise the nature of the crime would not have been suppressed. However, I did my best to focus solely on the facts at hand as I saw them; Felon + Gun = Crime. I was forced to think quite a bit about whether I wanted to convict or not based on some of the same reasoning advanced in the comments last week. In the end I realized my quandary had more to do with the question of whether I thought the law was right, rather than whether I thought a law had been broken. I had not been asked if I agreed with anything, only whether I thought, beyond a reasonable doubt, a law had been broken. Since I believed the facts and circumstances proved constructive possession, to return anything other than a guilty verdict would have meant, in my opinion, inserting myself into the legislative process.

When I said I thought I'd been selected as a juror based on my stated 2nd Amendment views during voir dire, I think the defense was hoping I'd act emotionally and vote not guilty because of the percieved infringement of the defendant's 2nd Amendment rights. Does this mean I personally adhere to each and every law simply because it exists? No. Would I blindly adhere to a law I found so objectionable I was otherwise unwilling to obey? I'll leave that to your imagination. Suffice it to say I would make that decision accepting the risk of punishment for my actions, and hoping they would be judged dispassionately.

Sending someone to prison is not an easy thing to do. How would you decide the case, and if guilty, what length of a sentence would you impose?

25 As I posted last week on a subsequent thread. I was put in such a position at a federal trial. The defendant was a career criminal and I was called forward by the judge because I indicated on the jury questionnaire that I though all federal gun laws and drug laws were unconstitutional. The judge asked if I could render a fair verdict on this case which was guns and drugs. I say yes I can. So the defendant's lawyer knew I would send him up the creek. He had to use one of his three strikes to keep me off.

I would not have convicted him on the gun laws themselves, but on the fact that he was a career criminal and still dealing drugs. If it had been a State case there would have been no question of convicting him.

that takes me well below the "reasonable doubt" threshold to convict.

They're not overtly rude but you can see the frustration and shortness they have with the semi-neophyte non-buying customer and what must seem to them overly simple or even stupid questions. No prints on a gun in a case means that someone wanted the gun found in his 'possession'. In the parlance, it is a drop gun or a throw away. The fact it was a 'tip' a week later that caused said gun to be found raises my suspicion. If they had found it during the initial call I'd have less of a problem.

As I mentioned, I thought, and the others agreed, a drop or plant was extremely unlikely or impossible given the physical layout of the storage area and where the gun was found in relationship to the door. Your argument is a good one though, and was sort of why I thought the topic would make an interesting discussion.

I think I would have too. The defendant doesn't have to prove anything. The state does. I don't see that they did, on the muzzleloaders.

The exception is the handgun; I don't recall the particulars but if he was the only one with access to the storage cage then the revolver is his. He can't take it to prison with him though. That's against the law.

It is an interesting topic, to be sure. I was called for a case where the perp tried to claim his dealer offered him a great deal on distribution quantities of drugs ala a Costco discount card type situation because he wanted to throw a party and that is why he had so much.

110 Since I haven't beden shooting, I've been che checking the guns, especially the black powder stuff. Not a speck of rust anywhere and I mean to keep it that way. Renaissance Wax is great at protecting the outside of the pieces, both wood and metal.

In the meantime I realize there are some guns I haven't fired in a while. So I start thinking: if I had to thin the herd, which ones would go. It's a mental exercise right now but it does force me to think of my shooting habits and preferences.

Since I'm shooting at longer ranges and using high-velocity instead of standard velocity ammo I thought it would be a good idea to adjust the sights.

ha ha, it was a fiasco.
Came back the next day to do it over again.
Started out by shooting at steel flippy targets from 20 yards. 10 shots, 10 misses. Yeah, I *really* screwed over those sights.

Wound up moving the paper target to just 15 yards so I could see where the shots where going.
Ok, now it's getting reasonably close.

Then I put a 5 shot group into ONE HOLE! Ok, now we're making progress!

One last tweak and tried the steel again at 20 yards.
10 shots, 9 hits.
yeah, that's more like it.

A bit later I put the paper target at 48 yards and shot the crap out of it.

Good progress!

133 Here's an obscure matter. On another site, someone asked about the 222 Remington cartridge. Not the 223 but the old 222. I think that and the 22 Hornet are fun rounds, especially in a Contender. Turns out the cartridge isn't dead. Starline, my favorite brass, still offers brass cases for the caliber and at a decent price.

I have a Nikon with great glass, but I have heard others say they have seen them with all sorts of problems. For competition I use Nightforce scopes but realize that's not an option for everyone. I plan to discuss scopes sometime soon, but until then, check Sightron.

Years ago, I was called for a criminal case in Federal Court in Des Moines. Got to the court room, sat down with the other prospective jurors, looked around. Of maybe 30 or 40 people in the courtroom (judge, clerks, court reporter, bailiffs, guards, prosecutors, defense counsel, defendant, prospective jury pool), there was exactly one black person. Yep, the defendant. Good luck with that whole "jury of your peers" thing.

(And I managed to get myself excluded because I had previously planned business travel)

I've been to the range a lot here lately, with a Kimber Micro 9, a Kimber K6 in .38 Special, a Kimber Ultra Carry in 9 mm and a Kimber Ultra CDP in .45. (Yeah, I like Kimbers). And no matter which gun I'm firing, my shots always - always - pull to the left. I can get a really nice group with the semi's, not so good with the revolver but I'm not crazy about the trigger pull on that one, but it's always to the left of what I'm aiming at. My husband means well, but he's not great at giving advice on something he's already good at.

Any ideas?

147 I've been on one local jury. Stupid high school kid was pestered by his buddies to get them some 'shrooms. The local psychelic mushrooms are pretty mild. He gave them some, which they took at home. They puked them up, the dad found out amd called the cops. Tests on the puke was inconclusive as to what they were. The defense attorney pointed this out, yet most of the jury was ready to convict. Me and another juror convinced them there was no real evidence of a crime. We all voted not guilty. Kid was sitting in the car with his mom when I left. I had him roll down the window and I told him not to do anything that stupid again.

161 You should know by now how I'd vote on a jury: not guilty because F the system until the guilty in power are held accountable. Just having some guns is not sufficient cause for being jailed now, no matter what he did. As long as its not causing real harm to anyone, I do not think anyone should pay a price for any crime until we get some justice in this country.

If I was on a trial jury, I would have believed anything he said, just because he said it. Which is not the best way for a juror to be.

64 shots at 7 yards on a B-27 target.
473/480/x14
Shot groupings were between 50 mm and 110 mm.
Nothing outside the 9 ring and most of those in the 9 ring were barely outside the 10 ring.

BTW, I would have voted guilty based on the facts you presented. It is frightening how bad the defense, prosecutor and cops screwed up a case.

The 22 Hornet holds a place in my heart. It was the first center fire rifle cartidge I ever shot. My best friend inherited his grandpa's rifle, an ancient Belding and Mull press, dies and components. This was before the internet so all we had to go by were the instructions with the dies. I don't remember if they were accurate but they fired and didn't blow up the rifle. The rest is reloading history. LOL

No sooner did I walk in the gate, but there was a table where one could fill out free raffle tickets for "valuable prizes". Having done so, not five minutes later, I heard my name being called on the P.A., and went to the show office, where I learned I had won two VIP passes to any future gun show in 2019! Kewl.

I bought some .30 Mauser ammo, which hopefully will fit the Chinese Mystery Pistol, and a multi-caliber cleaning kit, and some raffle tickets, and some shooting glasses, and a soft travel bag (for $20.00).

Met some very fine folks, and saw some interesting guns.

No it wasn't....the gun was found in a storage area that was not under the sole control of the defendant. At this point we have no clue who had access to the storage area because the defendants lawyer was an idiot and didn't ask who else had keys to the storage area from what we have been told.


Plus the prosecution for what ever reason decided they didn't need to check the gun for prints and the idiot defense lawyer for whatever reason never asked the court to check the gun or ammo for prints.

I've been to the range a lot here lately, with a Kimber Micro 9, a Kimber K6 in .38 Special, a Kimber Ultra Carry in 9 mm and a Kimber Ultra CDP in .45. (Yeah, I like Kimbers). And no matter which gun I'm firing, my shots always - always - pull to the left. I can get a really nice group with the semi's, not so good with the revolver but I'm not crazy about the trigger pull on that one, but it's always to the left of what I'm aiming at. My husband means well, but he's not great at giving advice on something he's already good at.

Any ideas?

Benchrest the pistol, see if the sights are on. I'm assuming they are from what you're saying.

Try to pull directly back. See if that makes a difference. Straight back, move slow. See what that does.

242 143 OK, so I have a question one of y'all can probably help me with...
I've been to the range a lot here lately, with a Kimber Micro 9, a Kimber K6 in .38 Special, a Kimber Ultra Carry in 9 mm and a Kimber Ultra CDP in .45. (Yeah, I like Kimbers). And no matter which gun I'm firing, my shots always - always - pull to the left. I can get a really nice group with the semi's, not so good with the revolver but I'm not crazy about the trigger pull on that one, but it's always to the left of what I'm aiming at. My husband means well, but he's not great at giving advice on something he's already good at.

Any ideas?

Couple of things to check: Are you pressing "into" the gun, in anticipation of recoil, as you squeeze the trigger?

Also, how much of your finger do you have on the trigger? Shouldn't be much more than tip of your finger.

(pressing into the gun is common. I still do it, and kick myself, mentally, every time I catch myself doing it)

So, okay, you've bought a $250 Nikon or Vortex. Both fine choices, by the way.

With respect to one's need to stay in budget, you're going to be a lot better off to save up from another few paychecks, and spend a similar amount on the base(s) and rings.

No, I'm NOT kidding.

The difference in machining accuracy in the premium equipment is measureable, and the results when installed, prove it.

Further, even if you've got a beautiful, glossy Weatherby MkV... do the right thing, and buy triple-screw "tactical" rings.

They offer about a fifty-percent greater surface area in the ring, and that's HUGE when you want that scope to never move, even a molecule.

Plus, spreading the torque of tightening those screws over a larger area, you're less likely to bind or dent the scope tube itself.

Weasel can go over all the "how to", inch-pounds of torque, lapping bar and other nuances.

But DON'T. BUY. CHEAP. BASE(S) and RINGS!

There is huge difference. Air from a car's defroster vents starts coming out at ambient temperature, and warms up as the engine does, so the windshield warms gradually. Hair dryers begin shooting hot air almost immediately, and sometimes in a narrow jet. Differential expansion cracks the glass. Ask me how I know! Better yet, I will tell you, because it's a funny story.
Back when I was going to university, I was in a car pool. I had a '61 VW Beetle. Put 4 or 5 young men in a Beetle, in Vancouver, B.C., which is foggy and clammy all winter, the windows steam over in a heartbeat. Now I had a gas heater in this car, and it worked, and made it toasty warm inside. So I took the end bell off the gas heater, brazed a pair of metal tubes into it, equipped with butterfly valves to close them off, and linked those tubes to the defroster ducts of the car with vacuum cleaner hose. First frosty carpool day, I show off my invention: started the gas heater, pulled the control knob to direct some of the (very) hot air onto the windshield, and Presto! it sure did clear, accompanied by a Snap, Snap! as both lower corners cracked clear across.

I'm not sure what the issue is but I know of one good general cure for a lot of bad habits, of which I have a few.
Try interspersing a few snap caps randomly into your magazine (or revolver) and when you pull the trigger on one you should see no movement, or you can see if you are pushing, diving, flinching etc.
If you see movement on firing a snap cap try to consciously avoid anticipating (or you may need to look for other mechanics).
There are many possibilities but oftentimes it all comes down to a flinch.

It takes time especially if the detachment was on the optic nerve area itself. That's cupped a bit so the retina doesn't fit down as well there after the reattachment.

It will get better it just takes time. You can improve the time and your sight by fitting a pair of old glasses with the other eye blocked out so you have to look thru the 'bad' eye.

This will force the eye to work harder to focus and that in turn will improve your vision. Until it's fully reattached it will still have a dimple where the optic nerve is. And that will take 2-3 years to get better. About a year before it's not quite so bad so hang in. Go to an ophthalmologist to check your eye and eye pressure. but you knew that.

If the defense knows their client is guilty, and is relying on "it was planted" then them pushing for a more thorough fingerprint check can only damage their defense. And if they claimed someone else had a key, that someone else is going to end up testifying which could also undermine their defense, especially if it looks like they're smearing someone completely uninvolved.

But if I had money to blow and was after a perfect mount, I'd invest in it. But given the machining processes these days, I'd think it's less needed than in the past when tunes weren't as uniform.

I've been to the range a lot here lately, with a Kimber Micro 9, a Kimber K6 in .38 Special, a Kimber Ultra Carry in 9 mm and a Kimber Ultra CDP in .45. (Yeah, I like Kimbers). And no matter which gun I'm firing, my shots always - always - pull to the left. I can get a really nice group with the semi's, not so good with the revolver but I'm not crazy about the trigger pull on that one, but it's always to the left of what I'm aiming at. My husband means well, but he's not great at giving advice on something he's already good at.

Any ideas?

I'm not going to try to diagnose your shot-placement problem from here. I'd need a video of you shooting, at the very least.

That said though, I'm going to prescribe a cure, and I'll promise you that the cure will work, IF that is that you follow these instructions diligently.

1. Buy some snap-caps in your revolver's cartridge designation.

2. Go to www.corneredcat.com, and review the chapter on "SIGHTS". Learn what the CORRECT sight picture should look like.

3. In reference to (2.) above, learn to focus SO hard on the FRONT sight, and ONLY the FRONT sigh, so much so that the tiniest speck of dust on the blade is as plain as day in your sight.

4. Select a blank, featureless section of wall in your house, for your Dry Fire practice. Do NOT...I repeat NOT]/b] use a light switch or any other "feature" as a "target". You want no target at all for this exercise.

5. Bearing in mind the Cornered Cat sight picture illustration, begin to conduct DOUBLE ACTION trigger pulls on your revolver, striving to NOT pull the sights out of alignment all through the trigger pull. And especially so, right before the sear "breaks" and releases the hammer.

6. Concentrate not only up to the point of the "break", but hold that sight picture till AFTER the hammer fall. If you do this right, your sights will still be ALIGNED after the hammer falls. This is the same "follow through" that any baseball batter, golfer, tennis player or other athlete depends on for success.

7. Fire only TWENTY "clicks" per day for the first week. Build up to FORTY, in increments as you get better at holding that sight alignment.

8. This will build up your muscle memory, and here's your bonus. Once you've mastered the Double Action Revolver Trigger, everything else you shoot is gonna be a piece of cake.


That's my instructions.

Follow them PERFECTY, invest SIX WEEKS of DRY FIRE ONLY, but build up your skill at dry fire to where those sights just DON'T move....

Your success your next time at the range is going to astonish you. And everyone else in attendance.


I'd say "good luck"....but in this case, HARD WORK beats "good luck", every time.

Do a search for 'front sight penny drill' for a similar one you can do at home; you check the weapon clear, set a penny or empty casing or similar on top of the front sight of the pistol, aim at a point on the wall, and try to pull the trigger (on a snap cap or empty chamber) without disturbing the object on the front sight.

In our case, we were charged only with determining if there was enough evidence to go to trial. It could get a bit tricky sometimes, determining the ownership of the firearms in question. However, in just about every case, the grand jury unanimously agreed that there was enough evidence presented by the prosecution to move forward. We were also allowed to hear about previous crimes committed by the felons, most of whom had a rather lengthy rap sheet of related offenses. Interestingly, on a grand jury, only 9 people (out of up to 12) have to agree for the case to move to trial instead of a unanimous finding for a petit jury. Of course, once a case goes to trial, then it's up to the prosecution and defense to determine what will and what will not be admitted into evidence at trial. Evidence presented to a grand jury has a lower burden of proof.

423 No it wasn't....the gun was found in a storage area that was not under the sole control of the defendant. At this point we have no clue who had access to the storage area because the defendants lawyer was an idiot and didn't ask who else had keys to the storage area from what we have been told.
Plus the prosecution for what ever reason decided they didn't need to check the gun for prints and the idiot defense lawyer for whatever reason never asked the court to check the gun or ammo for prints.

One cool thing I saw at the gun show: illuminated bullets. Not tracers; they have a phosphorescent coating on the back end of the slug which gets energized by the flash from the burning powder, and remains glowing for a half-second or so. Visible at night, or in an indoor range. Works best for slower bullets, like the .45 ACP. They don't make them in .22 rimfire (I asked) because bullet is too fast, and the glowing dot is too small. Basically, only the shooter, or somebody behind him, less than 30 degrees off-axis can see them.

You have to admit,though, the choreography and athleticism of pro wrestlers is nothing short of astounding. Some of the stunts, they land wrong and someone is going to get hurt. I'll never forget watching a clip of a pro wrestlers ankle fold in half because his boot stuck to the mat rather than slip. Awful to watch.

What the defense attorney knows/suspects, and what the prosecution can prove are not necessarily the same thing. Also, the decision is ultimately the defendant's.

I don't think you've followed at all the comment I was replying to. The comment claimed the defense were idiots for not pushing for fingerprints and clarifying whether or not someone specifically other than the defendent had physical access to the storage area.

I suggested in response that the defense might have been entirely reasonable to not pursue such lines because they might've have only turned up the defendent's fingerprint and eliminated any doubt that someone else had access.

Keeping the situation as nebulous as possible ccould have easily bene the defense's best course of action, allowing room for the juror's to doubt the prosecution's argument. Clearly it was somewhat effective with an initial jury vote being 8-4 in their favor.

526 Well, this interesting! The Chinese Mystery Pistol is evidently not chambered in 7.63X25 mm Mauser. Tried a round of that in the chamber, and it stopped abruptly, leaving a quarter-inch of the rear of the case sticking out. And the bullet seems too large in diameter to fit the barrel. Feels like the shoulder on the case is hitting a ledge in the chamber.


Funny. Diameter-wise, the case seems a good fit for the chamber, and the cartridges stack well in the magazine.

I'm inclined to agree with your assessment Sjg. For the defense, nothing good was going to come out of that line of inquiry. I guess the strategy was to plant the seed and move on.

And this is purely speculation on my part, but several of the initial not guiltys did not seem very committed to their initial vote. Not sure what to make of that really.

My only experience on a jury has been a civil case, but heading into the room after the trial a couple jurors had strong opinions and no gave no visible intention of ever changing them, some seemed to be looking to get an idea of what the group consensus was and go along with it, and some just wanted whatever ended the deliberation as soon as possible.

Fortunately since it was civil it didn't have to be unanimous.

Nothing but a serial number on the side of the main frame. No maker's name, no internal markings whatsoever. Patterned after an FN Model 1900, but it sure doesn't take .32 ACP, and the whole gun is larger.

A great many Chinese provinces made copies of European guns, and with no markings on yours, I'd think a casting will be the only *safe* way to measure-out the dimensions.

Include an inch of rifling in the casting, and you could get pretty close to bore and groove figures, too. Of course, you'll want to slug the bore to get really accurate measurements.

I'm betting it's going to come up to some obscure, little-known cartridge that few have ever heard of.

I would not put it past the Chinese gunsmiths of that time, to have "hybrid-ized" their own design, in that they had ten-thousands of THESE bullets and fifteen thousand of THOSE cases, and made up a set of reamers and dies to make it all work.

That's just a flamin' ass guess, but such "field expedient" rigging isn't exactly unknown out on the frontiers.

As I said, I had a life altering personal experience with the so-called "justice" system that was just wrong on all counts. I too was framed and railroaded in the name of the narrative.
