Michael Cohen Sentenced to Three Years

A lawyer on Twitter, Robert Barnes I think, commented that if Cohen had important testimony about Trump, he wouldn't have been sentenced to jail. He would have gotten immunity.

There's a lot of hopeful chatter by leftists and their kissing cousins the NeverTrumpers that Cohen has "tapes" of Trump stating, in the sort of way that no one ever directly says, "These payments are for the purpose of influencing a federal election."

Now, if those tapes exist, they have to be authenticated. You can't just introduce a document or tape or picture into court. You need to present a living witness who can authenticate the exhibit and say, "This picture accurately reflects Wilson Street on the day Johnny The Shark was murdered" or whatever. They never do this on tv shows-- the prosecutor just gives the thing to the judge and he accepts it -- but in real court, such documentary evidence need a living witness to testify about how the document was made, why it was made, etc., and most importantly of all, state that the document accurately reflects what was said or what was seen.

You need to lay a foundation that demonstrates that the evidence is what you claim it to be.

Otherwise, a rando could just hand a photoshopped picture to a judge.

My point here is: If there are tapes, the prosecutor still needs Michael Cohen to say, "These tapes fairly and accurately record the conversations I had Trump in [X time frame] and have not been edited or altered."

It's not as if having the tapes means you don't need Cohen.

So if there are tapes -- why is Cohen going to jail?

Do they intend to call their key witness out of prison to have him testify? Will Cohen be willing to testify? (He could invoke the Fifth, remember.) Won't it complicate things to have a key witness authenticating a key audio recording -- the lynchpin of the case, actually -- who's just come from prison for lying and self-dealing?

This just all seems very strange to me, if Cohen has "the goods" on Trump, if he has "the tapes" that will prove Trump's perfidity.

Squeeze Play? A friend comments that it's possible, or even likely, that the prosecutors are hoping the sentence causes Michael Cohen to re-remember things in a way more helpful to their cause, and that he'll admit more, or make up more.

But even if that's true -- that makes the existence of tapes that prove Donald Trump violated a (usually minor) section of the election finance law very doubtful. If tapes of the type the Loonies exist, then Michael Cohen is an absolutely essentially authenticating witness. A star witness.

Yet they say he hasn't provided enough and are still trying to squeeze him with jail time?

I'm not an expert on this stuff though. I also think the action would have to go through the normal administrative process, no? FEC would have to have an adjudication and all of that?

Plus, while NY may be a one-party consent state, I believe FL is a 2-party consent state. So if any of these conversations were recorded while Trump was in Florida, that could be problematic as well.

Sure, Trump told Cohen to do something legal in a novelly illegal way (if they had a crystal ball that said acts would be illegal in the future if an aggro biased DA wanted to get them on anything at all possible) instead of doing it in a legal way just for the sake of doing it illegally (if they could predict the future).

That's another possible issue. Cohen definitely violated the ethical rules by breaching confidentiality like that. I'm not sure how the rules of evidence would play here, but usually both the lawyer and client need to waive confidentiality for a lawyer to be able to testify about anything he learned in the course of representing a client.

Yeah, it's a mess.

And at the end of the day, isn't the normal remedy for campaign finance violations a fine (that the campaign pays), anyways?

The "crimes" they had on Cohen were tax evasion and lying, for his own benefit. There appears to have been no reason to lie about Russian business dealings. He also plead to campaign finance violations, which Mueller can't prove or even indict Trump on, aside from the facts not fitting the crime.

So his "crimes" had nothing to do with loyalty to Trump, whereas the real reason Mueller targeted Cohen had nothing to do with Cohen's stated reason of going too far for Trump. It was just standard lawyer work for a famous client,which perfectly fell within the legal confines of campaign finance laws.

Lawyer on David Webb's show the other day said he can't believe there isn't more outrage over the blasé from the legal profession over the loss of client atty privilege in this case which is one of the hallmarks of the US' legal system.

He also said what is the point now of going to a lawyer if 1. you know anything you say to them might be used against you if it was written down or recorded, even when it is an innocent question because, duh, you aren't a lawyer.
2. the lawyer blames the client for his own violations, another unethical thing.

Why can't your normal laymen make a citizen's arrest? Most states don't require the actual witnessing of the felony. They only require that on misdemeanors. Sure, the DOJ refused to prosecute. But, a non-stop deluge of continuous and ongoing citizen's arrests would at least focus attention on the issue.

As it is now, we sit back and whine when the Attorney/Client privilege item is totally disregarded; we allow prosecution to be selective based on political ideology; we observe government whistleblower's abused by the very entity they are reporting; we see the press acting as an investigative arm to a special counsel; we see open disregard for Court and Committee subpoenas. We see all these things, but are "helpless" to right the wrongs.

But, in this case, where obvious felonies are observed based on released documentation providing every single citizen documentation of a committed violation to federal statutes...why can the citizen's arrest laws be applied to at least apply some sort of pressure from the rabble against the offenders?

Pipe dream? Sure. But, at least it is a positive step of action instead of sitting on the couch whining.

If you have a digital recording of someone saying, "I am not a number, I am a free man!", you could effortlessly change it to say "I am a number, not a free man!" with about two minutes of effort, or even change it to say "Free not number man I a a a number man freeeee!" or anything you want.

The only trick part is background noise, and intra-sentence intonations - -which word the speaker is emphasizing, and how much the elide words together (slurring). But with enough verbiage in the recording, you usually have a huge "database" of words and sounds said by the speaker, said in all different intonations, which you plug in wherever you need them.

Even I, with minimal computer skills, was able to edit sound recordings this way with almost no training.

Short version: Digital sound recordings basically prove nothing, because they can easily be faked and altered.

Assuming Sauron could've detected the ring within a certain range implies the actual successful plan was daft in the first place and succeeded through dumb luck, but even if he could, much of the dangerous land trek was clearly unnecessary. There's no need to go all strike team until within whatever arbitrary detection radius the eagles can't pass through.

Not exactly. Tolkien wrote that he started writing his history of Middle Earth to underpin the languages he was inventing/exploring, because language, he realized, is a record of the history of the people who speak it. It's more like linguistic backstory.
As for Tolklien's exercises being useless, I suppose one could say that, if one ignored the fact that Tolkien was a philologist by trade - that is, someone who studied language. And if one ignores the fact that his escape into "useless" made-languages helped keep him sane during the Battle of the Somme.

As well, say they used campaign funds for the payments. No amount of taped conversations saying it was exclusively to help him win the election so was a legal campaign expenditure would let him get away with it. This is a nothingburger. The court would have to rule that such payments were legal campaign uses which will never happen.

If Trump was on tape saying "We need to make these payments to save my campaign, there's no way I'm getting elected if these ladies start blabbing. Plus my wife will be disappointed in me." He's off the hook.

Plus the hook is almost always imply a fine.

I'm reading the laws and regulations right now but "influencing" language seems to be what defines an organization not an activity. A PAC is an org to influence, get it? I'm trying to figure out this expenses thing but it's things like
