White House Concedes Acosta Lawsuit, Will Permit Him to Keep Pass;
But Establishes Rules Whose Violation Will Result in Reporters Being Stripped of Their Passes in the Future

Last week, Byron York wrote that the media's stance would result in written rules for "journalist" behavior:



And here you go. (LOL at "authoritiarianism.")



The Hawaiian judge ruled that there was a due process violation because, I guess, there were no formally announced rules for "journalist" behavior.

Well, now there are, and I imagine this list of rules will grow to include each new bout of misbehavior from "journalists," especially the queeney Drama Volcano Jim Acosta.

And then, when passes are stripped, the White House can point to previously-announced rules and defend their decision as being in comportment with due process.

One thing about these rules: They do not state that a reporter cannot put his hands upon an intern who is trying to retrieve the microphone. The Department of Justice cucked out about pointing out that Jim Acosta put his hand on the intern's arm to push it away. By not including this as a rule, the White House continues the cuck-out, and implicitly concedes Jim Accoster's claim that he did not do what it is self-evident from the videotape that he did in fact do.

Why?

I guess a lot of DOJ types don't want to deal in actual facts. They just want to protect #TheResistance.

It's not worth it. This was an uphill battle on 5th Amendment grounds. I haven't read the briefs or opinion, but I have to imagine that some flavor of administrative law applied, and its a real PITA.

Might as well go back, set up rules, THEN yank press passes. Much less headache for everyone involved.

...Which is a pretty reasonable analogy.

And most administrative law doesn't happen anywhere near a court room.

A better analogy would be a new EPA rule that was passed without the comment period or any procedural due process that fucks over a bunch of business owners.

On the flip side, Trump has the Chevron doctrine on his side (for now) which basically says that courts won't second guess agencies (or the white house, in this situation) if their interpretation of the rules or law is "reasonable."

Trump could have pushed this issue on the "political question" side of things and fought it all the way to SCOTUS I guess, but it's not really worth it just to fuck with Acosta.

Some observations.

Crenshaw might be one of the most intelligent people in this, or any Congress.

He's very quick. I've yet to see a journalist get anywhere near snagging him in a rhetorical trap.

On the issues, he has a vast command of the concepts, facts, arguments and counter-arguments. And while not being paralyzed by minutia (think: Jimmy Carter), he KNOWS the minutia, and makes it dance to his tune.

He's very personable, in every setting, with every body. That's a genuine humility he has there. It's not an act.

Being a SEAL, he has a work ethic which may only be matched by Trump himself.

And... he is absolutely ON the TRUMP TEAM. Ran on it, spoke on it, campaigned on it.

He's got a value far higher than being a Congressman. But it's a good place in the next two years, to let the Nation get to see him there, as we down here in Texas have seen him, here.

There's no fee or permit needed for cutting a (single) Christmas tree in the Chugach National Forest here.

However, it does need to be at least 150 yards away from any road or maintained trail (makes sense, otherwise the area near the trails would be denuded).

Each National Forest has its own rules, but I think most of them do allow this (sometimes with a permit).

Here's what SHS and PDT need to do:
Announce at the beginning of the next press conference that they will be taking 20 (or 30 or 40, but some specific number) total questions, that questions will be limited to 30 seconds each, and that statements will not be 'answered' because statements are not questions and have no answers, nor will rhetorical questions such as "Isn't it true that X?" or "You did X, didn't you?" Only real open questions ("Is it true that X?" "What does the administration plan to do about Y?") will be answered, and only if the questioner is recognized and offered the mike first, but (important proviso) statements and rhetorical questions and even legitimate questions when they are shouted out by someone who has not been recognized and handed the mic WILL count against the limit.
Acosta or someone will undoubtedly shout out a question before she's done speaking. How to handle that? Have a whiteboard over to one side, behind a rope-line with a couple of Marines or SS guys guarding it. The whiteboard will have 20 (or whatever) numbered squares already on it, and an intern (the tall brunette would be great) with a magic marker. When someone shouts out a question, SHS or PDT will say "You haven't been called on, one question down", nod to the intern, and she will check off the first box. If the shouter (most likely Acosta) tries to argue, reply "You still haven't been called on, and that's a statement, not a question", nod to the intern, who checks off box 2. After 3 out of 20 have been wasted by an obvious asshole, the looks and whispered comments of the rest should shut him up, without anyone have to haul him out.

As for the 30 second limit, SHS or PDT or (better) the whiteboard intern would have a hidden stopwatch with a 30-second timer, started when SHS calls on someone, after s/he introduces him/herself (e.g. "I'm Jo Nakamura from the Japan Times and I would like to ask . . ."), when the actual question begins. If that takes more than 30 seconds, "BZZZZZZT!" "Sorry, time's up. Next question?" (Maybe allow 40 seconds for non-native speakers. Actual experiments might improve these numbers: the point is to have a hard limit.)

As for the microphone, bring in the largest, most muscular intern in the White House, and inform them all that 'Bubba' or 'Leroy' or 'Brunhilde' (not their real names) will hold the mic as close as s/he can to the right level, and anyone who touches the mic, the intern, or any bit of the intern's clothes will be expelled. Tell them 'Bubba' has permission to apply double force to anyone who touches him intentionally, and that he's an experience defensive lineman who's been been begging the SS guys to let him help if they need to physically remove a recalcitrant reporter.
When someone follows all the rules and asks whether the resemblance to the methods of kindergarten teachers is fortuitous, say "Certainly not. We are consciously trying to get the behavior of the press - SOME members of the press [nod meaningfully at Acosta] - up to kindergarten standards this week, aiming at achieving 6th-grade courtesy by the end of the year.
