9th Circuit: Trump Cannot Use an Executive Order to Reverse Obama's Executive Order on DACA Because We Like Obama and ORANGE MAN BAD

This aggression shall not stand.



"In a world where the government can remove only a small percentage of the undocumented noncitizens present in this country in any year," the panel said, DACA lets it "devote much-needed resources to enforcement priorities such as threats to national security, rather than blameless and economically productive young people with clean criminal records."

This is the political argument Obama used to justify his policy. This is not even close to a legal argument mandating that Trump accept Obama's rationale.

Anticipating another outbreak of Hawaiian Judge Syndrome, the Trump Administration asked two days ago for the Supreme Court to take authority from the 9th Circuit and decide the cases themselves.

It doesn't matter how much the 9th Circus might like the original EO and think that it was justified - all that matters is the question of the president's authority to change it or remove it through an EO. Tht they think the original order was good is completely irrelevant. It doesn't matter if they think enforcement dollars are better spent elsewhere. Those determinations of relative value or quality are the job of the legislature.

107 I noticed that on the ballot last Tuesday, you can't vote against a judge, you can only vote for the judge. If there is not an alternative candidate to vote for, you can only leave that line blank.

So any candidate for a spot in the court system running unopposed could be elected by one vote. There isn't anyway to vote that candidate out of that slot.

And most people have no idea who these people are; they make very little news.

We know the Obama administration did not vet any of the DACA applicants, as Obama promised. Heritage served DHS with an FOIA request to try and find out the DACA approval standards it was using, and DHS admitted that it did not vet DACA applications -- just stamped them "approved." DHS said it didn't have the money or the personnel to review the applications.

So much for being "blameless." We know for a fact that quite a few of the actual DACA recipients have been identified as known gang-bangers, and some others have been arrested for crimes like assault and rape and murder.

As for their "economic productivity" that too has just been assumed, never proved with any actual facts. If somebody did an actual study, we'd probably find that, like so many other illegal aliens, a hefty percentage of them are receiving welfare.

But they're judges, not actual policy-makers, so they can just pull "facts" out of their asses.

So one could be "An EO by a previous President can be undone by the current President", and if some sleaze tried to file a case in order to get some sympathetic judge to stay the action, that case wouldn't even make it to that stage. It would have been filtered out in advance.

It would not be subject to the judge being honest enough to toss it out. It would just be a common sense principle.

My tail bone shattered into many pieces over a decade ago when I fell hard on concrete. It never did heal although scar tissue formed around the pieces. That was THE WORST pain I have ever felt and I gave birth to three children (child birth pain was not even a close second to that).

It's because he is a world-class dickhead and goes out of his way to undercut her professional work, when her level of success is by far the highest point in her life.

He has been doing this for over 2 years now. He doesn't have to do this, he isn't in a public job like her. It's not once or twice, it happens all the time. So every time he opens his mouth, it embarrasses her. She is in a no-win situation.

I also didn't read the link to his latest comments. As far as the photo being "illegal". the great traffic court judge Napolitano this morning on F &F said that appt. the new interim AG is illegal. That the interim AG has to be someone who has been confirmed by the Senate as Deputy AG , etc.

Even Doocy wasn't having it. He point blank said to Judge Nap that considering all of the lawyers in the WH, they certainly had looked at this appt. and determined it was proper. Doocy actually was insinuating Napolitano didn't know what he was saying.

551 Eh, I mispoke, Broward can generate about 850,000 votes. So "finding" 46K is 5% of their total. But to be valid they have to be verified. Validation means 46,000 unique IDs and 46,000 unique signatures. Also impossible for more than 30K of those to be for Nelson, the other 16K will be for Scott.

Scott still ends up with a 6K lead. That generates a recount, which is already going to happen. That then brings in all the undercounts from the panhandle. Broward won't get any more votes after shooting their wad on this silliness.

So we will be biting our nails, but Scott will end up the winner.
