The Morning Report - 10/11/18

ainthe.jpg

Good morning kids. Thursday and we're packed to the gills so let's get to it. First up, Hurricane Michael slammed into the Florida Panhandle with much wind damage, flooding and devastation, and is continuing north into parts of Georgia and South Carolina. . Governor Rick Scott says 100% of the effort new is on search, rescue and recovery. Prayers for all affected.

The big story and one that is the now as yet non-orchestrated but growing campaign of political terror aimed at the enemies of the Democrat-Left-Media complex and its constituents. The infuriating thing, which is typical of the aforementioned, is its projection and hypocrisy. I suppose the fuse was lit decades ago with the emergence of talk radio and then the internet that at first challenged the total control of the narrative vis a vis what was/wasn't news and what the public was supposed to think about it culminating with the rejection of Clinton in 2016 by a candidate that, for the first time in history, was an individual whom they could not destroy despite employing every weapon and tactic it had.

And after 2 years of a relentless assault on him (see the link about the nature of Trump media coverage [as if you really need to]) President Trump has not only dismantled much of Obama's destruction, he has defied conventional wisdom on everything from economic and foreign policy to what a politician/president should or should not do on the campaign trail and in office. He has stripped them bare, exposed them to a vast new audience as the frauds that they are and raised the collective conscience of the average American citizen. A humiliation like that cannot go unchallenged.

The entire sad and disgusting spectacle of what the Left attempted to do to Associate Justice Brett Kavanaugh blew up in their faces, and catastrophically. Forget the institutional Left; All but the most grudging of Never-Trumpers are, if not necessarily wholeheartedly changing their minds about the President, are appalled by what the Dems have done; and it has galvanized a seemingly somnolent GOP base into righteous indignation and fired them up three weeks from what is seen as a crucial midterm election.

But on the other side of the coin, it has not humbled or shamed the Left. Even after a year that has seen a Dick Durbin-linked plot to mass-assassinate a ball field full of GOP politicians that nearly killed Steve Scalise, a violent beatdown of Rand Paul by his neighbor (leaves, my ass), physical assaults by terrorist "Antifa" goon squads on peaceful Trump supporters, confrontations and intimidation by same of administration officials and others in public places, doxxing, harassment, death threats and other miscellaneous thuggery, one would think that responsible leadership of the Democrat Party and media punditry would have forcefully and unequivocally have said "stop" long ago. Well, not only have they not said that but they are actively encouraging and cheering it on. Think about it: the former Democrat candidate for President of the United States has openly stated that it is completely justifiable to confront Republicans with force, stating they "cannot be civil." Are we to infer that she not only does not condemn what happened to Steve Scalise but that she approves of it and wants to see more of it?

I mean, for crying out loud; has Susan Rice come forward with any sort of statement about the fact that her son, who happens to be a college Republican at Stanford was physically assaulted for his politics on campus? Knowing who she is I imagine she may have made some sort of anodyne statement which doubtless will be buried by the press or phrased in such a way as to attempt to paint what happened to him as the fault of the President, the GOP, conservatives and the fascist patriarchy, etc. *vomit* I guess, in the words of her former colleague Eric Holder said, he must've gone low so he got a justified kick.

This is madness and it cannot stand. The Democrat Party and their media overlords are driving this society to the brink of chaos. Actually, we're at that brink right now. Whether they win or lose the midterms - especially the latter - I think things are going to get much worse in the immediate aftermath.

Along with the assault on Rice's son and Eric Holder calling for stomping conservatives, the FBI arrested a man who had planned to detonate a 200 lb. bomb on the DC Mall this election day, we also have a charming Toledo city councilwoman who is doubling down on calling red state America "dumbfuckistan." Also RNC's Ronna McDaniel, David Catron, Daniel Greenfield and the IBD editors on Clinton and the Left's incitement campaign.

To the scandals the MFM won't cover, ethics complaint filed against Oregon Governor Brown in wake of Project Veritas sting, CA Dem Cisneros' foundation in hot water for environmental shenanigans, Obama had some sort of secret plan if PDT lost and did not accept it (I think that that plan is still in effect, nein?), Democrat millionaire chaired a board cited for sexual misconduct, Joe's Man-Chin siphoned opioid money to fuel his Pinochet-mobile.

In politics, the RNC made huge donation gains in the wake of the Kavanaugh confirmation, experts poo-poo the blue wave, Pennsylvania could be trouble because of the recent gerrymandering, Manchin and Donnelly might be in trouble, McAssKill hates rural Missouri, women are fired up to vote GOP because of Kavanaugh, a look at Leah Vukmir's chances in Wisconsin, "Agarn" O'Rourke's chum not a fan of the po-po, the most popular governors are all GOP, this broad in VA-5 Leslie Cockburn not a fan of the weather-controlling matzo-makers, and Murkowski must have some nasty dirt on McYertle. I mean, really Mitch?

Big story at the foreign desk is the missing Saudi dissident causing a strain in relations, Peru arrests a top conservative and others there over corruption charges, Hungary tells EU "basz-mag," UNESCO can die in a fire, the Chi-Com menace, and a Chi-Com national is arrested for economic spying here.

Domestically, CVS is buying Aetna and that could be a big deal for healthcare, PDT blames the Fed for the 800+point dump of the Dow, SCOTUS looks at the suit against Marylin Mosby, PDT continues to nominate lower court judges at a record pace (good, more please!), Doomberg is paying the salaries of government lawyers looking to sabotage/law-fare the Administration on guns and enviro deregulation (lock HIM up), and SCOTUS rejects an appeal to reverse a Kavanaugh decision scrapping an Obama EPA regulation.

From hither and yon, Kanye West is taking Jim Brown to the presidential luncheon, CNN attacks him as a race traitor (which means black people must be fleeing the Dems in droves), Humberto Fontova on the anniversary of Che's execution, and an essay on the next target of the cultural revolution, Winston Churchill.

Anyway, links from around the world, across the nation and up your street. Have a better one and remain blessed.

37 More Noos; today is Thursday, October 11, 2018. On this day in 1767 surveying for the Mason-Dixon line separating Maryland from Pennsylvania was completed. This border between MD and PA later became the defacto border between the Northern States and the South. I would say that demarcation should shift South a great deal and include the Eastern 1/3 of VA in the North now.

43 I suppose the fuse was lit decades ago with the emergence of talk radio and then the internet that at first challenged the total control of the narrative vis a vis what was/wasn't news and what the public was supposed to think...

Well, that's part of the story, and an important one. But as I keep reminding people, we've seen the left act this way before, at least those of us with some years. They were like this in the late 60s and early 70s. It took the landslide loss in 1972 to get their pols to say "OK, cut the shit, chlldren. Sit down and shut up, so we can run a faux-moderate like Carter."

I also have to point out that the media character assassination game was already in full swing in 1964, and their hagiography of JFK was similar to Obama's.

For that matter, the propaganda was just as bad in the previous decade, in the treatment of Hiss and Chambers. (One of the fun events of the past 20 years was the blaring headlines of "Hiss Cleared" by both WaPo and NYT, followed by "Oh, never mind.")

But they don't change. They represent the most fixed and inflexible ideology I've ever heard of. Pharonic Egypt and Imperial China were freer and more flexible. (And that's not a joke, it's quite literally true.)

52 Is the last entry about Justice Roberts handling the ethics complaints actually bad? I didn't get that impression from reading the story, but I admit I'm not an expert on such things. From the article:

"It's possible the complaints will never be investigated if the lower-court judges determine they have no jurisdiction over a Supreme Court justice under the judiciary's ethics rules."

Am I missing something? Because it sort of sounds like Roberts might have just sent these complaints off to die without having to take a personal stance on things (which fits his MO as sort of squishy, but still gets us the results we want).

90 Forget the institutional Left; All but the most grudging of Never-Trumpers are, if not necessarily wholeheartedly changing their minds about the President, are appalled by what the Dems have done; and it has galvanized a seemingly somnolent GOP base into righteous indignation and fired them up three weeks from what is seen as a crucial midterm election.

That is as good an analysis in one - admittedly compound - sentence as I have seen. The effect on my wife still amazes me, and she says that's true of some of her online friends, too.

One caution: I am all for triumphing over the libs, and those holdout NeverTrumpers (they remind me of the Japanese who were discovered, when I was a kid, every so often on some Pacific island. But less admirable.)

But I don't like the "neener, neener" approach to those who are coming around. It can't help. They should be welcomed. After all, if you are a really rigid Trump supporter, you'll have to excommunicate Schlicter for what he wrote during the primaries.

Given the number of illegal aliens in CA, and that they can get drivers licenses + motor voter, it's probably in the millions.

You would think they could easily check since they could easily produce the list of illegal alien IDs and check voter registration from there. but...they don't want to know.

155 So Chief Justice Roberts has referred the BS 'ethics complaints' against Kavanaugh to the 10th District appeals court judges rather than the DC court because Garland stepped aside. Before we start attacking Roberts on this issue he didn't have much choice on this unless he wanted pull a Holder and simply ignore the law.

I am tired of this no-trust, no-justice, two-tier law country.

We talk about how PDTs poll numbers would be if the MFM treated him fairly - imagine what this country would be like if we had an AG who was actually awake and combating domestic terrorism instead of busting pot smokers and holding masturbatory press conferences about MS-13.

159 JJ, I don't think you understand what Roberts is doing by sending off these ethics complaints. First of all, by law, he can't simply ignore them, and it isn't proper for him to handle them himself - that is NOT the role of the Chief Justice. As has been noted before, the man who by rights should have been hearing them turns out to be Merrick Garland, but he recused himself as he wanted nothing at all to do with this circus. (He gave no reason, and he doesn't have to)

Ordinarily that would mean that the complaints would be handled by someone else on the DC Circuit, one of Garland's colleagues on the circuit court, probably an Obama appointee. Roberts has ruled that the complaints are to be sent out of the DC hothouse circus entirely, to some lower profile judge or judges to consider.

And the best part, it is highly likely that these Judges will in turn decide that they, in fact, have no jurisdiction to enforce a ruling over a sitting Supreme Court Justice, and thus the complaints will simply be dismissed.

I know we would all love a nice clear dismissal at the outset, but all Judges on both sides love to make things go away just by fiddling with the technicalities. Which is what it looks like Roberts just did.

Tattoos were exotic when no one had them. Then having one tattoo became common and to differentiate yourself from the copycats you had to have two, then two big ones. Then sleeves, then facial tattoos and body piercings. It will be whole body tattoos before it's over and not having tattoos becomes cool because everyone else has tattoos everywhere.

Posted by: grammie winger at October 11, 2018 08:27 AM (lwiT4)

Well, he had 3 options:

If he decided to ignore them altogether, then the left gets to scream about "investigated complaints about a sitting SCOTUS justice" tainting the legitimacy of the court.

If he decides to personally say "these are all bullshit and you know it. These are all summarily dismissed." Then he puts a target on his own back as being partisan in the way Kav did when he defended himself. The left will start filing complaints against him.

If he does this, he gets to say "Look, we followed the established procedure with dealing with complaints, and this impartial source found them unsubstantiated, so we're done." This deflects blame from SCOTUS and himself, but also sets the precedent that any additional complaints that are lodged in this way won't even be wasting his time. He'll just send them off to die like these ones.

As it stands, the only complaint the left can lodge against him will be similar to the one they lodged about the FBI report against Trump, that it was somehow incomplete and didn't do enough, or something. That's a far less persuasive argument to the LIVs.

191 Another thing about these "ethics complaints", and another trick that Judges love to do when they just want an issue to go away - you're not going to be hearing anything at all about them for a long time, because the judges these complaints are being sent to are going to say "wow, that is a very serious issue, let me look at my docket, yes, i think I can fit it in 9 or 10 months from now. Maybe. Unless I'm busy."

Laymen wonder why cases float around in Legal Land for years and years - this is why. When something is contentious, and a Judge doesn't want to take heat for deciding it, they put it off and put it off and put it off until finally the mob has gone off to chase some Shiny New Thing, and then they dismiss it quietly.

AND it sets the precedent that every whack job Kavanaugh accuser deserves an investigation!
_________________

Roberts is just going by the book. Complaints of misconduct by lawyers and judges are supposed to be investigated. So Roberts will have the Kavanaugh complaints investigated. In some cases, that "investigation" will amount to nothing more than reading the complaint and realizing it's bullshit. In other cases, the investigation will take the form of a phone call or two, or maybe a review of Kavanaugh's testimony transcript. Then the investigator will write a report concluding there is no credible evidence of wrongdoing, and the file will be closed.

Roberts gets to cover his ass and say he went by the book, Kavanaugh gets to say the complaints against him were investigated and found to be without merit, and everybody goes on their way. The screeching lefties will of course be unsatisfied and claim there was a cover-up, but they were never going to be satisfied no matter what happened, so who really cares?

If he did nothing, the complaints by law would have been handled by one of Merrick Garland's colleagues on the DC Circuit, likely an Obama appointee. By sending them off, Roberts sent them to Judges who aren't going to be part of the DC political circus.

Roberts did NOT have the option of simply dismissing them, because Supreme Court Justices don't hear these kinds of cases. His job as Chief Justice is, in an area where the original Judge has recused himself, to reassign the case to someone else.

Once again, I think he made the best possible choice out of the options available to him. What else would anyone here have wanted him to do? As I say, he does not have the legal authority to dismiss them himself.

243 Another FYI, it looks like most of these complaints are about Kavanaugh's testimony in front of the Senate Committee. It's a long standing principle of American Law that, except in cases of perjury or confession to a crime (which must be proved) a witness testifying in a legal hearing has absolute immunity for anything they may say. In simpler terms, no one is allowed to file a legal complaint about someone because they don't like what he or she said on the stand.

Well, Reince Preibus was on Jay Weber show this morning giving some political analysis and he confirmed my analysis. He said that if Walker wins by 3 or 4 points it should be enough to drag Vukmir over the finish line.

266 The air feels like its going out of the Beto Bubble.

Of course, let me reprint (from memory) something I posted here about 2 months ago:

I quote myself, "Cruz has ALWAYS been way ahead, just like Abbot was always way ahead of Wendy Davis. But the polls early on will all be fixed to say "look it's neck and neck! Beto might win this thing!!!" the purpose of that is to keep bringing in the Left Wing Cash, and to (they think) build up this feeling of a "movment" that everyone will want to be part of. But then, as the race gets closer, the pollsters will start to worry a little bit about their future credibility, so they'll start to show Cruz ahead by 6 point, then a little more, then a couple days before the race, they'll show Cruz ahead by 10 - 12, with a lot of undecided, and then Cruz will win by 15 - 20. "

That entire chain of events, including the shifting polls, has always been predictable, because that is EXACTLY what happened with Wendy Davis 4 years ago.

And after it's over, the Dem Donors can look at themselves and say (as one did last time) "Well, I should have just taken my money and put it in a dumpster and set it on fire for all the good it did."

I think it's safe to say that both @jack has a strategy in place as to when he will suspend DJT's twitter account (a few days before mid-terms? When the unredacted FISA docs are released?), as well as DJT as to how he will respond to it.

Twitter is slowly migrating non-progressive users over to Gab (involuntarily), so that by the time DJT makes the switch he will have all of his fans* already set-up, including followers, etc.. So it will only be the MSM and haters who are scrambling to get on Gab in order to "argue" with him (i.e. fill his tweet responses with snark).

Heh. Bet Jack hasn't considered that!

If they were smart, they'd do an audit of their polling firms.

Something intensely uncomfortable, in order to figure out why the polling firm is going wrong. Why they're lying to their clients.

I'd rather know I'm going to lose something months early than desperately hope for an upset, spending tens of millions of dollars, instead of focusing on actually close races.

Hell, I'd be willing to pay double for polling, one for public consumption and one privately, (at least at the beginning) if it ends up saving me from wasting significantly more money.

Every time I see this update, it makes me wonder how Florida could be even remotely close.

The pattern, as far as I remember, is always that Democrats outvote Republicans in early voting, and then it's largely a question of how many Republicans turn out on election day. Is it enough to overcome the disparity from early voting?

And here we see that more Republicans are turning in their ballots early than Democrats. Are Republicans voting for the Democratic candidate who's under investigation for corruption and wants to bring an income tax to the state?

Seems doubtful.

334 Just fyi with the Fed, although I don't agree with the necessity of interest rate hikes, they are consistently following the policies that they have followed for about 40 years now. First put in place by Paul Volcker (who caused Reagan a great deal of grief in 1981 and 82, people forget that) and then by Volcker's disciple, Alan Greenspan.

Volcker's rules are cut interest rates when the economy is bad, keep them low as long as it doesn't recover, start jacking up rates as the economy starts to grow, to stop it from growing too fast. Like I said, I don't agree with that, but that has been Fed Policy for over 40 years now.

The new President of Washington and Lee is making sad headlines, prompting me to wonder about his background.
President
Dudley was raised in Arlington, so he's only nominally a Virginian, and
went to Williams College. He did his graduate work in Philosophy at
Northwestern. He taught for his entire career at Williams, specializing
in Hegel and Kant.

No ties to WL, or even Virginia. No special
relationship to the history of the place. Probably views the individuals
Washington and Lee through the modern lens as slaveholders and
militaristic heros. Oh well, the Trustees must have wanted change when
they hired him last year, and now they have it.

My dad took me to W&L once. In Lee's chapel he said that Lee would become viewed as an enemy of America at some point.

It made him very sad.

Also, when my dad was a kid, my grandfather took the family to Appomattox Courthouse, and my dad refused to get out of the car because he didn't want to acknowledge the surrender, or something. He's kind of weird.

Also, he's a world renowned statistician, so not exactly a dummy.

A $3.35/thousand gallon fee is causing my neighbors to squeal like a stuck pig. The recent arrivals squeal the loudest because back home they did it better, dontcha know.

The fee has been in place for a decade or more and has been ratcheting up yearly, slowly at first and now gaining speed as the construction phase hits full swing. The fee will top out at $5.35/thousand gallons.

Germany is starting to realize that their "Energiewende", their policy of trying to go all wind and solar, is destroying their economy, as they are now stuck with the highest electric rates in Europe. (rates which are 4 times as high as electric rates for industry in Texas, for example)

Heavy manufacturing typically uses huge amounts of electricity. Germany's manufacturers are increasingly saying that they are going to have to move their plants outside of the country just to stay competitive economically, just because of electricity rates.

Murkel's government says, well maybe we can give you subsidies forever, without a clue as to where the money is going to come from.

Germany was supposed to adopt western economic policies when they unified. Looks like Murkel is giving them an East German economy instead.

417 Update to RCP "Battle For The House" site - all caveats on "crap polling" not withstanding...

D 205 (173 Safe + 14 Likely + 18 Lean) (R -13)
R 199 (161 Safe + 13 Likely + 25 Lean) (D -1)
31 Toss-ups (29R, 2D) WA-5 (GOP Open) Toss-up -> Lean GOP

Other changes in the last week
NC-9 & NJ-11 (GOP Open seats) Lean Dem -> Toss-Up
MI-11 (Open GOP) & MN-2 (R-Lewis) Toss-up -> Lean Dem
OH-12, NC-2, NY-27, WV-3, TX-23, VA-9, MT-AL, CA-50, WI-1 (All R, mostly open seats) Toss-up -> Lean GOP

So in the net, basically 5-seats went "off the board" as potential Democrat pick-ups. Getting to the point where the Democrats basically have to run the table on open toss-up GOP seats to get to 218.

Keep in mind, most of the Likely/Lean Dem GOP flip seats aren't even being polled anymore (such as NJ-2, PA-5 and PA-6, all Open GOP and listed as Likely Dem)

The SC GOP?

Posted by: TheJamesMadison, Order The Battle of Lake Erie in Paperback Today! at October 11, 2018 09:24 AM (9ZlHt)

The VA GOP is an interesting animal. It wasn't all that long ago that the GOP governor beat his Democrat opponent by 30 points, and nearly every statewide non-Federal position was held by a Republican. The GOP held huge majorities in the legislature, had split representation in the US House, and after the whole Wash Post macaca crap, two Dem Senators. And then we piled into the handbasket. The Obama/Holder Justice Department convicted the governor of what the Supreme Court held to not even be a crime, and then the party began shooting each other and themselves in the foot. The VA legislature fought a great holding action against McAuliffe, but the result was they got slaughtered at the polls, and I don't expect that the slim majority in the legislature survives the next election cycle.

I don't think the SC GOP is that dumb, and their results should be the envy of Utah. I don't think that other than the Federally mandated gerrymander district for Clyburn, there is a single Democrat in a statewide or Federal elected position.

Corrupt, maybe, but not dumb.

Eeyore, I think MP4 can give a lot more insight into this line of thought than I can, but that won't stop me from giving it a try.

Years ago...years...entertainment options were limited compared to today. Movie stars, singers, sports figures, etc. were pretty well revered, in a way that is really rather foreign to us today.

Long story short, when Ted Williams would put his name on a baseball bat, Sears was pretty well assured it would sell like crazy.

This kind of model became the standard, mainly out of habit mostly. As you say, I think very few people actually pay attention these days..."stars" are more cynically manufactured (not that they weren't in the past, of course) and there are a lot more of them because of the explosion in media and entertainment outlets. More supply - more people mouthing off - a huge din that most people now tune out.

There are several different hash recipes, and various BBQ houses around here have their own recipes.

My favorite is Clyde Cone's, which is located down in Ridge Spring, SC.

To give you an idea of how good I think that is, if I was given a choice between Clyde's hash and a swimming pool full of Czech hottie "actresses", I would be hard pressed to decide.

I was born in Tennessee, raised across the south (VA and a couple of places in FL), currently live in SC, and have the above described father, but I've never really identified with the Southern Heritage thing.

I get it. I have ancestors who fought in the Confederacy. Hell, I could join the Sons of the Confederacy really quickly because my great grandmother was in the Daughters of the Confederacy (Jesse Maury fought in the Texas 7th Infantry and got injured in Arkansas).

I've just never identified with it personally.

451 This is kind of buried, but I want to make a point about midterm polling.

Having read the links about polling expects, like Barone (who I respect), I am struck by the fact that there is an institutional disagreement regarding poll validity.

The polling experts operate from the position that polls are generally wrong to one degree or another, but you can use historical trends to gain a sense of where the error lies and what will happen. This results in their acceptance that there is a D+8 generic advantage and structurally that should result in mean a Dem increase and maybe taking back the house.

But there is another theory, one which I noted in 2016 which proved true in that election. The majority of polling, with a small number of exceptions (Rasmussen, IBD/TIPP, USC) have structural bias toward Democrats that show up in every poll. This is why CNN shows Trump with a 41% approval while Rasmussen shows 51%. That difference is very significant because it is a large factor in midterm results.

If there is a structural bias, then the comparisons to 2010 that the media is using are invalid. Because in that case Trump is really at 50% and Obama was really at 30%. They aren't both at 40% as is currently being claimed.

All of the experts so far (that I have seen) are talking like the polls are all valid and just showing settings in different directions. But there is an alternate interpretation that they aren't talking about. Most of the polls could be intrinsically flawed with bias, and only (e.g.) Rasmussen is showing accurate results.

The mid terms may end up with the Dems picking up only the CA and PA seats that have been set up for them to take, and no pick ups of red districts at all.

We will see in a few weeks, but if we are discussing "how could the polls be wrong again?" after the election, then this is why. The polling industry continues to ignore their structural bias toward one party.

468 OK, if we're reading crystal balls.

No blue wave. No red wave. Districts are gamed so much that any change is muted at best (or worst).

Any enthusiasm for the GOP right now is mitigated by the historical tendency of the party in power to lose seats. Vote fraud will also dampen any wave.

The next Congress will be substantially similar to this one.

Well, it's a long time ago, but in 1985, when Barone was doing polling for WaPo, he had the D's up by 19 in the VA governor's race. The actual margin was less than half that. But since he called the correct winner, no one called him on it, even though anyone could have predicted that much that year.
