Orrin hosta Calls for Federal Trade Commission Investigation Into Google

Wait, I thought Private Businesses Could Do Anything They Want...?

A lot of know-nothing bumper-sticker-slogan corporate robots play-acting as conservatives say this all the time. You mean there are some laws restricting what corporations can do, especially if they are monopolies or near-monopolies?

But all the Corporate Cons tell me that corporations are not only people too, but the only people in America who enjoy the full panoply of First Amendment rights!

Sen. Orrin hosta (R-Utah) is calling on the Federal Trade Commission (FTC) to investigate whether Google’s search and digital advertising practices are stifling the marketplace.

hosta sent a letter to FTC Chairman Joseph Simons expressing concern about reports in recent years ranging from Google restricting competing advertising services to collecting data from users' Gmail inbox contents.

"Needless to say, I found these reports disquieting," hosta wrote. "Although these reports concern different aspects of Google's business, many relate to the company's dominant position in search and accumulating vast amounts of personal data."

The letter comes at a time when critics of Google’s market power are gaining momentum, helped along by growing concerns over data privacy. But most of the lawmakers echoing those concerns have been Democrats and hosta, the longest-serving member of the Senate, may be the highest-profile Republican to call for the government to take antitrust action against Google.

Google and the FTC did not immediately respond to requests for comment.

7 Addendum to Saga:

Caitlin is holding her earpiece and arguing.

"But I don't want to do it Mandy! I look ridiculous! If anyone sees me dressed like this I'll be ruined! Whadda mean 'You're on CNN - who'll see it?'"

Caitlin pauses and starts pleading. "I know I'll flunk if I don't get back on the air but is this the best deal you could work out? The alternative is Leavenworth? What's that, a syrup company? A prison? Just for kicking that guy in the nuts when he was perving on me? Okay, I'll do it. Turn the camera on."

TV's in airports cut away from commercials and back to CNN, the chryon reading 'McCain Funeral - Laying the Greatest Hero Since Mohammed to Rest.' The picture shows a sullen Caitlin dressed in an outfit resembling a cross between Strawberry Shortcake and Alice in Wonderland.

"Hi. This is Caitlin, the student intern, Mr. Blitzer is still crazy, blah, blah. As part of my community service for kicking Bill Clinton in the nuts for perving on me I have to dress as McCain Funeral mascot Maverick McPlanecrash's sidekick Little Miss Lindsey. The guy in charge of the souvenir stands says I'll boost sales, or something. Whatevs. I hope he wasn't perving. I hate this place. I hate everybody. What was that Mandy? Part of the deal was that I gotta be perky? No way! Nuh-Uh!"

"Leavenworth for ten years. Perky it is. I'll be so perky they'll get diabetes from looking at me."

She looks over at the mascot. "Gosh McPlanecrash! This is an awfully big funeral! Look at all these people!"

"You know it Little Miss Lindsey! It just shows the love that people had for me! Right now thousands are passing by the open casket!"

"What are they doing, They look like they want snippets of hair."

"Relics! Holy relics of the great hero! Security had to be tripled to make sure the body would be intact to bury."

Under her breath Caitlin mutters "Or maybe to get DNA samples to make sure you're dead."

"What was that?"

"Nothing! How long will the funeral take?"

"Five days! And it is sold out!" Afterwards we'll take it on the road - Broadway, London, Paris, Las Vegas! The musical version is a guaranteed success!"

"Golly, McPlanecrash! A musical?"

"The music of Bruce Springsteen, MC Hammer, DEVO, and Boy George!"

"Has beens."

"What?"

"Awesome!"

"You know it! Now excuse me, I have a to sign photographs for the fans at the Hanoi Hilton Pavilion."

"And this is Little Miss Lindsey reporting from the McCain Funeral."

After the camera cuts Caitlin's smile drops. "Thank God that's over. What do you mean "Not Over?" Mandy, it's over. I'm here for the entire funeral? And I got a song and dance routine to learn as the Little Miss Lindsey mourns the loss of Maverick McPlanecrash? Are you sure I just can't go to Leavenworth?"

51 There is really no reason to tolerate the gathering of personal info - and the cross-referencing - on the scale that Facebook and Google are undertaking.
Sure, the tech giants and their clients benefit, but the rest of us wouldn't notice a damn thing if the plug was pulled tomorrow. It's virtually all downside for us.
Tech companies giving unfettered, unsupervised access to user email and chat accounts on a massive scale. Location tracking through a dozen different methods. Near-ubiquitous exploitation of just about any text and photo data on devices. Rampant real-time audio and video bugging of users.

I have seen it from the inside; take your most pessimistic concerns about privacy, ethics, and legality and bump them up an order of magnitude.
If you want a really terrifying thought, think about the Spanish civil war. Now imagine they had Facebook, Google, Twitter, etc, and that those organizations chose a side - because they HAVE chosen a side.

79 I'm pretty much a free-market guy--but I've never been a laissez faire purist.

But I always knew that there was anit-trust laws out there for companies who got too big for their britches. I can accept "It's their property" up to a point.

The trick is to know that we are constantly trying to find a sweet spot between private and public coercion.

A privately owned market-place, used by almost everybody, that pretends to be free--but isn't is almost as restraining as actual public coercion on a free market. Yes, you can leave the private market--but it's no more optimal than more public coercion in a public market.

In other words, until the rest of the market adjusts--if it would--it's a sub-optimal choice for any of the big-market's targets.

Why can't the owners of 2-3 major corporations use their time and use their resources of meeting rooms and use their control over the companies to agree on what the price of a product should be?!

It's the same argument. But the people, using their discretion of self-rule (the actual #1 concept of our republic), have chosen to limit that form of power-brokering against everybody else.

"you must hire X number of Y" will always be perverted by the Dems.

As for breaking it up, break it up into what? I'm not sure you could , for example, break the advertising division from the search division. they're pretty much one operation now.

You could start prosecuting for actual violations of law, of course; how much of the data collected from email involved health information? That's HIPAA stuff.

Fed workers with SC using Gmail; espionage act.

Is gurgle using 'diversity' programming like 'implicit bias training' ? ; hostile work environment some other EEOC violations.

You oughta read all the provisions that Locke put on "sweat equity". Equity is a social arrangement, it's a social understanding, and Locke simply describes it.

There are two sources of conservative "property". God and Locke (and that's roughly one).

To the Christian God, the author of rights, what you "own" you really don't own for yourself.

To Locke, it is a social equitable arrangement. Which you have an equal claim to--provided you fulfill the terms of contract and understanding.

To the Watchmaker God, well, "he" left us no instructions to the ticking watch. Who says "rights" is the right word? Everything has to be empirically established, and it's hard to observe "rights" or "proper" allocation which makes something "proper" to oneself.

Libertarian revisionists and property dogmatists to the contrary.

If I remember my facts correctly, (trying to be honest), I recollect that the way this whole bakery thing went down was a little bit like a Sue and Settle thinger.

The state board of social compliance (EEOC) solicited (off the record) to find two people (friends of the committee) who would go around to various bakeries until the found just the right one to say "No" to the boner cake and then the two friends of the committee went back to complain to the committee who then sued the shit out of the bakery.

So now we have China and Saudis and many ... deeply owning our conglomerates, influencing boardroom decisions, even as the CoCs align against we the people. The oligarchs became incredibly mega rich via incredible leverage and an unregulated derivative market insuring their bets (and demanding a bailout by US when they failed).

Exactly. Any member of the public who stumps up the money to buy shares has an ownership interest, however small.

Now that becomes dicey when a corporation has different classes of stock, as the Sulzbergers have in the NYT. IIRC, they own the voting shares, the plebs own non-voting shares, which is slimy IMO.

States, municipalities, etc. should own stock only through an investment management company (e.g., hedge fund) of which they are limited partners (i.e., have no say in day-to-day transactions, which are handled by the general partner(s)).

I understand your sentiment, but much like people speculating on housing, such transactions contribute to market liquidity. Recall the NYSE has (had?) market makers whose job was to take the other side of any proposed transaction, the idea being to set the price at such a point as to balance buyers and sellers. Computer trading basically does the same thing, just on a much shorter time scale.

233 1. All shares are voting shares. You can assign a Proxy, but the actual holder does have the power to vote their shares.

The problem with this one is that startups invariably have both preferred and common stock. VCs insist on preferred stock - the only one with a vote - because they write the checks, and want ultimate control over their money, sometimes including anti-dilution provisions as a condition of investing.

The common stock is for the founders, employees, etc. and only becomes valuable in a liquidity event (IPO or acquisition).

It IS interesting, isn't it? Speculation, especially in the context of ticket scalping, price gouging, and house flipping,* drives people wild for some reason. Speculators are creating a liquid market for something, and while they might make money, they might get hosed, too.

You can't "scalp" tickets unless they were under-priced in the first place. You can't "gouge" prices unless the item is in greater demand than usual. You can't flip houses unless people want to buy houses.

*To be clear, I do not have time for people who make superficial strictly cosmetic steps in response to problems in a house, or and then jack up the price. That's fraud, IMO.
