West Virginia Legislature Has Forced One Of Its Supreme Court Justices Off the Bench, and Its House Judiciary Committee Has Prepared Articles of Impeachment Against the Remaining Four

It's actually called the West Virginia Supreme Court of Appeals but the function is of a state supreme court, so I simplifiedfor the headline.

They're being charged with lavish spending on the taxpayers' dime.

The West Virginia House Judiciary Committee approved 14 articles of impeachment against the four sitting justices of the West Virginia Supreme Court of Appeals on Tuesday.

The eighth day of the committee's meetings regarding possible impeachment produced the first material results when 14 articles of impeachment were introduced at 9:25 a.m.

The articles serve as formal charges or accusations that the justices committed one of the impeachable offenses listed in Section 9, Article 4 of the West Virginia Constitution.

The articles of impeachment charge Chief Justice Margaret Workman and Justices Robin Davis, Allen Loughry and Beth Walker with maladministration, corruption, incompetency, neglect of duty and certain high crimes.

In total, Loughry is the subject of eight articles of impeachment. Workman and Davis each are the subject of four and Walker is the subject of two.

Former justice Menis Ketchum was not a subject of impeachment because he resigned from the bench last month.

Streiff, from whom I got the article, opines that the federal Congress should take a page from the West Virginia legislature's book. Impeachment is one of their powers -- in theory. But it's a use-it-or-lose-it sort of thing. When you don't use a power, many begin to consider it dead-letter and unofficially repealed.

To borrow a concept from our former neocon friends: For too long we have prioritized "stability" over all other things. This has in fact given us "stability," but it's the "stability" of the cesspool, at rest only because the shit can descend no lower.

When the stability produced is the lowest-lying shit, maybe it's time to risk shaking things up a bit.

Good for the WV legislators for taking action. This kind of abuse of taxpayer money goes on far too often, at both the state and federal levels, and rarely ever gets punished.

221 They should've done it the way it's done in Massachusetts. Whenever the legislature votes themselves pay raises (about once a year) they cut the judges in for a bump too. That way there when the inevitable citizens "watchdog" committee tries to sue over the raises for some constitutional reason, the judges throw it out of court. I've been slowly but surely making my way through the stupid number of accounts I've got using LastPass's "Security Challenge" feature and changing weak and old passwords to random garbage. It'll also flag passwords for specific sites that haven't been changed since data breaches. Pretty slick.

When I was with DOD as a Civilian, writing down network or program passwords was an automatic termination offense. Never saw a single person fired let alone disciplined for doing it in almost 10 years.

Supposedly he had ruled pre trial to permit a witness to attend part of the trial (probably an expert) usually witnesses are separated (not allowed to hear court testimony) until after they have testified. This does not apply to parties who are witnesses or to witnesses who are essential to the presentation of a party's case -like say an expert witness.

I guess he saw the guy sitting there and realized he was a witness and yelled at the prosecution to get him out. Then later realized he had agreed to allow him to attend. Its his screw up if so. It happens. They just want the jury to be told that it wasn't misconduct on the part of the prosecution since it was implied by the Judge's reaction.

Not a big deal if so.

I guess he saw the guy sitting there and realized he was a witness
and yelled at the prosecution to get him out. Then later realized he

happens. They just want the jury to be told that it wasn't misconduct
on the part of the prosecution since it was implied by the Judge's
reaction.

I had a web site once, with two factor authentication - forgot the password, and don't have the 'cell phone, and don't feel like arguing with them about who I am, and it is really me and not a hacker.

I just hate the thought of having to prove my identity and identity theft is one of my very worst nightmares.
