Mueller Examining Whether He Can Indict Trump For Obstruction of Justice Based On His... Public Tweets

Insulting his insubordinate subordinates on Twitter might now be a crime, Mueller has decided.

For years, President Trump has used Twitter as his go-to public relations weapon, mounting a barrage of attacks on celebrities and then political rivals even after advisers warned he could be creating legal problems for himself.

Those concerns now turn out to be well founded. The special counsel, Robert S. Mueller III, is scrutinizing tweets and negative statements from the president about Attorney General Jeff Sessions and the former F.B.I. director James B. Comey, according to three people briefed on the matter.

Several of the remarks came as Mr. Trump was also privately pressuring the men — both key witnesses in the inquiry — about the investigation, and Mr. Mueller is examining whether the actions add up to attempts to obstruct the investigation by both intimidating witnesses and pressuring senior law enforcement officials to tamp down the inquiry.

Mr. Mueller wants to question the president about the tweets. His interest in them is the latest addition to a range of presidential actions he is investigating as a possible obstruction case: private interactions with Mr. Comey, Mr. Sessions and other senior administration officials about the Russia inquiry; misleading White House statements; public attacks; and possible pardon offers to potential witnesses.

I don't think so. Mueller must be getting ready to wrap things up. His report will address all the various claims about Trump, like obstruction. To do that, he needs to examine stuff like tweets and Trumps motives in firing Comey. I'm guessing his report will say things like Trump is very disrespectful to certain norms, but that technically, there's no crime nor grounds for impeachment.

Why else would he be looking at tweets, for heaven's sake? He can't actually be thinking of claiming criminal activity based on mean tweets.

Mueller will say he can't indict Trump so here's what I would indict him on if I could. It will be short on substance but the other side won't care. At all. The message will be clear: Vote for Dems right now so we can rid ourselves of Trump.

There's no other reason for Mueller to spin his wheels on this "obstruction" nonsense. He complains about stuff that he personally has the power to fix. Why does he not? He could pull enough of that and still give the House what they were looking for. It's pretty obvious that foreigners and potentially foreign governments were involved with this so some of that might need to be redacted but he could release enough to make this all go away.

The real open questions are when did surveillance of the Trump campaign start and what was the evidence used to start the investigation? Also, how many copies of the dossier are there and where did they come from?

We pretty much know this but if he ordered the evidence released the investigation would be over.

And yet what did Trump tweet out when the FISA warrant was released? Congratulations to JW for doing something Trump himself could have done with a snap of his fingers a year ago.

Trump also knows that Rosenstein signed one of the FISA warrants and he hasn't come down on him. Dana Boente, another signer of one of the warrants, was actually promoted in the DOJ.

I agree with the statement above that there are things going on behind the scenes that we don't know about. The only other explanation is Trump is incompetent and allowing all of this to happen when he has the power to stop it.

It might, it might not. No one knows what effect it would ultimately have. All I know is conventional wisdom is usually wrong. Doing the right thing is usually right. So impeach away.

If the end result of this is that it leads to more impeachments within the executive branch, then lets have it. Its a remedy that has been far underutilized.

Whatever the numbers are, they are running far above average which is more or less 1000 in previous years etc.. Currently, the numbers in PACER currently are abnormally large numbers compared with past numbers.

Now, from my understanding, there are a variety of sealed court proceedings, indictments, search warrants, etc. that these numbers may reflect.

Some are probably related to human trafficking, some to gang activity such as MS 13, but some jurisdictions have provided a number of specifically sealed indictments that was unusual enough for local news to address it-e.g. Arkansas for example.

It is clear for whatever reason, that the DOJ has taken up using secrecy to a greater extent in jurisdictions for court proceedings. What that means is unclear but it is unusual compared to past practice.

ADA Huber exists but what he is doing, really no one with knowledge is talking. It is to be noted that large server farms such as the NSA's Utah Data Center are in this jurisdiction. Facebook and others internet giants also operate server farms in this state.

Regarding Sessions and Rosenstein, part of the issue was the recusal and Sessions will probably get fired for it sooner or later. Rosenstein is a complicated case as he is involved in the Uranium 1 scandal, the FISA scandal, etc. Second, for whatever reason, Republicans, particularly in the Senate, still support him. I suspect that corruption among the gang of eight and the Senate Intelligence Committee has something to do with that.

Code breaking and intercepts has been a U.S. strategic strength dating back to WWII, I'd imagine that some of the flip flopping comes from the collateral damage to real programs of national importance that revealing the whole extent of misuse of intercepts for political (and perhaps financial) reasons. The misuse of government contractors to access such data has long been a problem with Snowden, etc. demonstrating that outsourcing such things compromises security. I also suspect that the Five Eyes group has been used in a round about way to use other countries to spy on U.S. citizens and pass that information to U.S. authorities thus avoiding any oversight. I also suspect that is why Trump dislikes May who was PM during at least some of the shenanigans of spying on the Trump campaign.

It is clear that the national security and law enforcement institutions have malignant cancerous growths--a political tumor if you will. How to excise the tumor without killing healthy function is a difficult task, perhaps made worse by hacks such as Sessions, Wray, and Rosenstein.

What can the average Joe do about it, work your friends and neighbors into supporting Republican candidates for office.
