Leftwing Idiots: Kavanaugh is a "Radically Conservative," Ultra-"Partisan" Judge

You had me at "radical."

Important to note for this (the leftwing writers forgot to mention it): The DC Circuit Court of Appeals was a special target for Democrats, and was stocked to the brim with lefty fish. Indeed, the desire to stock the DC Circuit Court full of liberals was a prime reason Miguel Estrada was filibustered, and then why Harry Reid ended the fillibuster of federal judges (below the Supreme Court level), to push in their leftwing judges above conservative objections.

So Kavanaugh's dissents will tend to be dissents against a very left-wing circuit.

In federal appeals courts, cases are usually decided by three-judge panels. Across the D.C. Circuit during Kavanaugh's tenure there, 3 percent of the votes were dissents. But Kavanaugh cast a dissenting vote 7 percent of the time. When Kavanaugh authored the opinion, 14 percent of the time the co-panelists dissented against him, compared to only 10 percent of opinions that provoked dissents when he wasn't the author. In contrast to this rift-making, Justice Neil M. Gorsuch -- as well as previous nominees rejected for being divisive, such as Merrick Garland and Robert Bork -- generated more agreement than Kavanaugh relative to their peers on the opinions that they wrote.

We also found that was extremely polarizing in his votes. We measured how dissents vary with the party affiliation of the president who appointed judges. (For the sake of our research, judges elevated by a Republican president are "Republicans," and vice versa.) Judges who tend to dissent mostly against those appointed by the opposing party's president contribute to "vote polarization." When sitting with two panelists appointed by Democrats, Kavanaugh dissented 19 percent of the time; in other cases, he dissented 5 percent of the time, which is nearly double the rate of his colleagues. Kavanaugh's vote polarization is especially clear in cases relating to constitutional, civil rights and due process law. (In a recent abortion case, for example, he dissented against the Democrat-controlled majority ruling that guaranteed an undocumented immigrant's right to an abortion while in state custody.) Gorsuch and Bork, by contrast, did not display the same degree of vote polarization. Garland was actually more likely to cross party lines than his D.C. Circuit colleagues did.

He'll do.

38 Considering the suffering of Obama's 8 year Reign of Error, he fucked up big time by not:

A) immediately granting amnesty and citizenship to the 20-30 million illegal aliens already in country while he had the supermajorities (instead of pushing Obamacare and Dodd-Fagg)

B) not pushing out Baader-Meinhoff and appointing another young lesbian softball player/radical

C) allowing Reid to kill the filibuster.

That would have really screwed us over big time. Especially if the amnetized illegals were given money to settle in Texas, Florida and Oklahoma.

45 These stats about how conservative or how many times you dissent or whatever, its got a sort of fun baseball appeal but the numbers really don't mean much. You can't learn much about a judge Ior a legislator) from numbers, you have to look at the cases.

Take Ron Paul for example: the dude would vote against every bill that fit his speeches... when he knew they would pass anyway. But when it came to act on them, he'd take every earmark and sneaky trick to fatten his district that was available to him. So his votes LOOKED good but in reality he was just as bad as anyone else.

63 Let's be honest, the Senate didn't take up the Garland nomination because they didn't want Obama to replace Scalia. That's it. Whatever other reasons they stated were just excuses, that was the real reason.

And I'm fine with that, it would have been a horrendous result if Obama had picked yet another low-octane true believer for the court and swung it 5-4 against the constitution. The GOP was playing really really long odds that maybe a Democrat wouldn't make that pick, and they won.

In retrospect everyone, and I mean virtually everyone knew with 100% rock solid absolute certainty that hillary was going to be the next President. Heck, RCP and others had her chances the week before the election at 99.9%. There was absolutely no doubt in anyone's mind that she would win against Trump. Even Trump himself knew he was going to lose until late on election night.

When you look at it that way everything that was done and more importantly, everything that was not done these "mistakes" make sense. They bet everything on hillary winning and Trump crushed her and their dreams and plans.

Kavanaugh's dissent in Agri Processor Co., Inc. v. The employer later discovered that the workers were illegal; terminated them as required by federal immigration law; and sought to overturn the tainted union election."

Case in point: Adolf Hitler was awarded the Iron Cross 2nd Class during WWI. Therefore, he gets a pass for everything that was done in WWII because "war hero?" Of course he doesn't.

So true about the German military ( and pretty much all the EU except for one or two countries). A complete joke. They essentially outsource their military protection to the US and pay nothing for it. F*ck those guys in particular.

Canada is the same. I go to Halifax to visit family often. Home to Canada's Atlantic Fleet. Complete joke. Give me a helicopter, a Staten Island Ferry and the South Brooklyn Warrant Squad and I am reasonably sure I could take all of their "warships" as prizes within 15 minutes.

And yet Canada complains about the US early and often. "Hey Maple-syrup-brain Trudeau! - you sleep under the blanket of freedom I provide at NO COST - I expect you to say `thank you' and then to shut the F*ck up. The little kids' table is in the back rec room. Go and take a seat and leave the decisions to the adults, we're busy."

We'll likely never really know what happened on OCare, but its possible that it is meaningless once Obamacare unravels. The good is he put an outer limit on the Commerece Clause, and he got the 7-2 vote on Medicaid Expansion in his favor. Maybe that was the trade. I don't know. He was exercising judicial restraint and letting the legislative process win out. He put it back to the people, who exercised their rights by voting out the Dems and voting in Trump.

403 I'm seeing the typical leftist pattern here. When leftists look at any situation to come to a conclusion about some moral aspect of it they always fixate on the irrelevant bits.

If there's some conflict involved, they don't ask who did what, they ask what were the skin colors of the parties involved? They think they can "prove" institutional racism or sexism by citing statistics instead of actual cases that demonstrate racism or sexism.

And here again, they are not looking at which judge supported what, but at statistics about dissent from the majority in order to prove that the judge's judgment is unreasonably biased.

When my liberal father tried to guide my thinking as a child with such insinuations, I could clearly see it was pure bullshit even then. I honestly think they have some sort of cognitive lack when it comes to such things.

It just seemed to me that Roberts got scared of Obama calling him names and changed his mind.

There seems to be a lot of credible reports out there that Roberts did a last minute switch up.

Roberts also fucked us on the other ObamaCare case with the ACA subsidies where it was plainly written "exchange established by a state" and Roberts wrote the majority that it was basically a drafting error and it would be covered by the federal government.

Clinton Campaign's Brian Fallon Previews #MeToo Strategy to Take Down Brett Kavanaugh

NEW YORK -- Brian Fallon, the head of Demand Justice, a new progressive activist group established to play a vital role in opposing President Trump's Supreme Court nominee, spelled out the group's battle plan against the confirmation of Brett Kavanaugh.

Fallon, who served as press secretary for Hillary Clinton's 2016 presidential campaign, took to CNN last night, where he gave Chris Cuomo a preview of his organization's likely attacks on Kavanaugh.

Fallon spelled out two tactics that he claimed were potential "wild card" issues in the nomination.

One is to attempt to stall Kavanaugh's confirmation pending the release and full review of the thousands of pages of the Starr Report, which documented the case to impeach President Clinton and which was drafted in part by Kavanaugh.

The second tactic is to raise questions, despite any current evidence, about whether Kavanaugh knew about sexual harassment allegations related to former Ninth Circuit Judge Alex Kozinski for which Kavanaugh clerked in 1991.

There's something almost too civilised about a country whose fighter jets stick to office hours (note to would-be terrorists and airspace infiltrators: they also stop for an hour and a half for lunch, and there's no service at weekends). It was French and Italian jet pilots who escorted the Ethiopian Airlines plane hijacked by its co-pilot safely to Geneva airport on Monday morning - because, at 6.02am, it was still nearly two hours before the Swiss air force came to work.

"Switzerland cannot intervene because its airbases are closed at night and on the weekend," spokesman Laurent Savary told AFP. "It's a question of budget and staffing."

Somewhere in the middle of the evening this androgynous black person with kinda short cropped hair got up and spent the whole 20 minutes in character as "Fontaine," a sort of deranged black street bum. It was actually pretty funny. You couldn't tell what gender the comedian even was.

Many many years later, I first became aware of a new movie star called "Whoopi Goldberg." I thought, "Dang, she looks familiar" But couldn't remember how or why. On a hunch, I looked up the name of the comedian who created the "Fontaine" character, but saw that Fontaine was actually a chick called Caryn Johnson. I shrugged it off.

It was only later that I learned that Whoopi Goldberg WAS Caryn Johnson, and that the person I had seen as "Fontaine" all those years ago had eventually morphed into the person known as Whoopi Goldberg today.

Unfortunately, with the name change, she lost her capacity to be funny.

The whole effect is lost if you put high heels on those stupid platform shoes. The whole point is the elevation of the heel relative to the flat of the foot, and how it accentuates the legs O.o A nine-inch heel is absolutely pointless because no one could even stand in such things... therefore, they add a massive platform to the flat of the foot that does nothing but make the woman have to walk on stilts.

598 Strip clubs... in my early days, I went to one and lo and behold, there was my neighbor up on stage. She saw me, and after her set, ran over to the bar where I sat and Begged me not to tell her husband she worked there.
Awkward ( she said she was trying to save up some money).
A few weeks later, her husband came by and said she had took off to Calfornia to be a Dancer.

There are also pregnant stripper, underage stripper, druggie stripper, and hooker stripper stories. Apropos of it's a messy business.
