RE: Dersh's remark on motivation. This issue was behind the bogus indictment of Rick Perry a few years back now, at the end of his term. Won't go into the details, but he line item vetoed some funds for a specific program, which he clearly had the authority to do under the Texas Constitution. A lib prosecutor whipped up a case claiming he had done it because of an illegal motivation, and got a grand jury to indict. Got to the Texas Court of Criminal Appeals (Supreme Court for criminal cases) and they ruled exactly what Dersh said in that comment - You cannot question the Executives motives when he acts, if that action is part of the powers of his office.

Holy smokes, I recognize that mountain cabin. I've spent several nights in it, on different occasions. It's a Forest Service research station that's open to climbers. It stands on Niwot Ridge in the Indian Peaks Wilderness Area in Colorado. The tallest peak in the background is Apache Peak, 13,000+ feet. I climbed it several times.

To deny that is to deny that the Court has the authority it wields. If you haven't seen it, it's highly recommended that you check out the documentary called Muscle Shoals. Tells the history of Fame studio in Florence, Alabama. Really amazing that this little studio was such a hot spot for recording.

If you haven't seen it, it's highly recommended that you check out the documentary called Muscle Shoals. Tells the history of Fame studio in Florence, Alabama. Jaw-dropping - but in the ho-hum routine way for so much federal judicial horses**t in recent decades. All sorts of policy musings (not your job, not your competence), ridiculous crap about deference to Congress because they meant well and this is important stuff! and stuff! (WTF?). He had a nice line tonight about not making the laws. Sadly credibility of that statement is low. When I see him (or any other federal judge) produce a correct ruling (in a constitutional case) that's 5 paragraphs, and doesn't stray into things outside the court's competence and authority (that would be any and all policy considerations), I'll believe him, or anyone saying that. It seems that the DOJ and FBI shared the feeling that the administration wasn't going to let them prosecute anybody on the email case. And Comey, at the head, tried to adapt. To blow the whistle on that was to invite criticism of the FBI for being complicit, or without a preponderance of evidence make it look like the head of the FBI was a partisan crank--as the Dems would have doubtless tried to make him look. Just based on the disagreements between the DOJ prosecutors and Comey, it seems reasonable that Comey wanted to not let Hillary "get away with it" so he criticized her about "uncharged conduct"--which ironically no reasonable prosecutor does, because it gives an indication that they are wrong in their failure to prosecute. Thus what Comey ended up doing is making, perhaps the same *type* of decision that the upper DOJ was going to make anyway, but he could at least publicly condemn Hillary's behavior. The prosecutors also thought that "no reasonable prosecutor" would allege that there was a sharp line between Comey's "extremely careless" and negligence. That was the opinion of actual DOJ prosecutors as interviewed by the IG, thus why you don't make a big deal, as a prosecutor out of uncharged conduct. In fact, they thought that Comey's words definitely put negligence into play. So Comey committed an unforced error of trying to criticize Hillary's uncharged conduct, with a speech where he laid out the case against her, and simply stipulated that there was no intent, when intent wasn't required, and laid out a good case for negligence, as was the opinion of seasoned prosecutors, with "extremely careless". And he hid his statements from the prosecutors who were very alarmed to find out he was holding a press conference. They demanded from Strzok to know what Comey was going to say, but Strzok just ended up stonewalling the DOJ prosecutors. There is more that is going on here than deep state collusion--despite whether or not it has the bulk effect of it. The IG report is a very interesting exhibition of bureaucratic tussles resulting in bureaus putting themselves and their functions before the people and their determinations as they try to navigate the maze of wielded power. I thought Huber's report was a total whitewash with the idea that the only thing Comey did was usurp roles that weren't his to bad-mouth Hillary. But I'm seeing some dynamics that support that, but do nothing to mitigate that the swamp is deep. It's a win for the compressed-narrative publicists of the left, perhaps. But there is an argument that whatever Comey did, he was pressured to do by a cynical use of power that would not let anybody be prosecuted for negligence. And I also think that the center shifted around to the then-reality that Hillary was going to be the next wielder of power. And they had already compromised their responsibility to that emerging "reality". But Comey's intellectual and character limitations from his first public notice, and were on full display up to today. And the bottom line - as so often not nearly as complicated as mediocre Beltway types pretend to believe - is that it was absurd and indefensible that a massive, systematic violation of the Espionage Act by dozens of people at the top of one of the country's national security cabinet departments did not result in (many) prosecutions. Not complicated, and not debatable. That's leaving out the laughable "investigation" decisions the IG found - again, indefensibly - to be defensible. The perps were brazen, stupid, and clumsy. Not the slightest effort was made to comply with the law, nor to *not* obstruct justice later. Back to Comey. He's a (characteristically) tiny, tiny Beltway personality of recent years. If he had a brain and backbone, his course was obvious and easy. Actually investigate the case normally, quickly/easily have everybody nailed, choose which ones to immunize for testimony, and present the slam-dunk recommendation for prosecution to DOJ. With the sly observation that, given that the unbelievably bad scandalous criminal activity uncovered involved a likely presidential candidate, there was no way a slam-dunk prosecution recommendation like this would stay secret. If garrett is around - a friend's mother passed and in going through the house he found his father's 1930s Gibson guitar (don't know any details). His father was the only owner/user. The father played with Glenn Miller's band, for Frank Sinatra, and other big music names in the 30s/40s/50s. Friend is going to have it appraised, but I figure it will be pretty valuable. Especially if, as my friend thinks, there are photos of his dad playing said guitar at Sinatra concerts.

Had a good shop day today. Put away most of the debris from parting out the last hulk, and got a mess of weed-whacking done. Front of the garage is done. Alleyway between garage and big shop is done, and part of the front of the big shop, too. That's when the string trimmer ran out of gas. Went through a full tank of 2-stroke mix. And I got the '97 burb on the hoist, and drained the tranny fluid. Going to pop the tranny pan off, replace filter and gasket, and weld up the hole I drilled in the pan to drain it. Yes, it has a drain plug. It takes a T60 Torx, which I don't own, and it is stuck tight. It also leaves about a half-inch of fluid in the pan, which will spill when you tilt the pan to remove it (which you have to do). Make sure he tells the appraiser that he is not to turn a screw. Also, it is a good idea to make sure he pads the case to make sure it can't shift inside. Most of those older cases have a lot of play inside and they also tend to have neck cradles in really bad spots. A bunch of clean cotton t-shirts work just fine to fill any voids. balled up newspaper will work in a pinch, but not for long term storage. If he has any questions, feel free to ask. We have a sidewalk and a main water supply line left to fix. And some cosmetics in the kitchen. But...we will probably winter over and push for the spring selling season next year.
