Steve Hayward: Should the NeverTrump "Thought Leaders" Who Are Only Now Realizing That Supreme Court Nominations Are Pretty Important Continue Being "Thought Leaders"?

As Doc_0 notes, the retirement of justices isn't a black swan event that just snuck up on the NeverTrump Super-Cons. Not only do actuarial tables combined with a basic understanding of How Time Works suggest that 3-4 justices will retire over the course of Trump's two (or more...?) terms, but we knew for a fact the next president would appoint at least one justice, given that Antonin Scalia died months before the election.

And yet: This seems to have completely blindsided the very important people who tweet on twitter all day long about how fucking smart they all are.

Should these "influencers" continue to influence?

I'm not saying it was tantamount to an endorsement of Hillary, although hardcore NeverTrumpers did do that, and they're currently rooting for Dems to take over Congress. But if you'll indulge me for a few tweets, this is the thing about conservatives and 2016 that still bugs me.

I'm all in favor of vigorously contested primaries. I didn't vote for Trump myself, and he wasn't in my top 3. I got some angry feedback when I wrote highly of other candidates. I'd have no inherent problem with people supporting a primary challenger to him in 2020.

But at some point the primary is over, and the election absolutely does become a binary choice, with gigantic stakes given the size of government, power of SCOTUS, etc. I deeply wish the stakes were lower and elections were less important, but they're not.

When Trump secured the nomination, Republicans - especially politicians, writers, pundits - either decided the stakes were high enough to support him despite his flaws as the underdog in a tough and important election, or they decided opposing him was worth President Hillary.

There is a fantasy about the "third option" of staying home that needs to be put to bed forever. That's not how it works. You stay home and the Democrat gets half a step closer to winning.

Now, if you thought the stakes were low enough that either actively helping Clinton win or passively allowing it were acceptable courses of action, then fair enough... but it's disingenuous to change your mind now and say, "Wow, SCOTUS is really important."


We knew that in 2016, and it was pretty clear several SCOTUS nominations were on the table, one of them PROMINENTLY so. We knew what would happen if Clinton locked in a far-left SCOTUS for a generation.

This is important because we're talking about the judgment of prominent pundits and politicians, people who (at least in theory) hold significant sway over public opinion. They told us to trust them last time as they took a position that would have put Clinton in the White House.

I'm glad if they've seen the light, but I'm sorry, I just can't cut that much slack for seeing a light that should have been as obvious as the rising sun in 2016. The retirement of aging SCOTUS judges is not a black swan event.

When it really mattered, when the chips were down and the Republican nominee needed all the help he could get to win the longest long-shot victory in recent memory, there are people who went AWOL or actively supported the Democrat.

No, I don't want to "dump" on them and I don't spend time needling them. (The clowns who are still trying to give Congress to the Dems are another matter.) But a higher standard must be set for the political judgment of influential people.

And for what it's worth, I felt the same way about those who judged it preferable to toss 2008 to Obama instead of supporting squishy McCain, or bailed on Romney in 2012. How did that work out for you, guys? Still think giving Obama the White House was a small price to pay?

The fact is that the stakes are so high, we're so close to crossing so many lines, the Democrats are so aggressive about using power, that I don't think any presidential or congressional term can be sacrificed even for sincere long-term plans to improve the GOP.

I understood all of that in 2016. I'm pleased to see conservatives who didn't coming around. I welcome them one and all. But if they're prominent and influential, it still matters that they made different calculations in 2016, and will ask their audience to trust them again. /end

75 The fact that its such a huge issue who gets to be the next Supreme Court justice is just painfully obvious proof at how overly important and powerful the court has made its self over the decades.

I mean, partly its the left having the vapors over everything to a degree only seen in meth-addicted manic depressives, but its also the overly powerful state of the judiciary.

And the best way to dial that back is a court strongly dominated (like 6-3 or more) with judges who will rule strictly and carefully by the constitution, rolling back the excesseses of previous courts, and weakening their position.

I honestly don't see that happening, I fear how far the left will go to prevent it. There is literally no scenario or horror that they could try that is off the table. A nuke in a major city isn't too far for them to consider.

IMO, he's way past Lincoln already. Outrageous? Here's why I think that. Lincoln had the Civil War thrust upon him, and after a lot of fits and starts, stepping on his dick, and a lot of roughing up of the Bills of Rights, he eventually prevailed.

I'm still hoping that Ted Cruz, or anyone other than Trump if Cruz falters, gets the nomination. Regardless, I and many others will not be sweet-talked, bribed, threatened, or scaremongered into supporting Donald Trump for president. Never, ever, Trump.

But it didn't proceed and the reason is almost entirely because McConnell and to a lesser extent Grassley refused to let it go forward.

Kind of hard to hack on Republicans and not admit it was Republicans who not only blocked Garland but made a Supreme Court Justice seat a big election issue for Trump.

In the mid-late 70's I was considering going to law school. I -very briefly - meet Kennedy at a social/recruitment thingee for McGeorge Law School, where he taught Constitutional law. I told him I was a 'very strict constitutionalist' and asked if he thought the legal profession had a place for me. He didn't answer me direct, instead he invited me to sit in on some of lectures and make my own decision. I did so,

I came away with several conclusions:

(1) Kennedy has an intellectual passion for not just the Constitution, but also the very concept of a Constitution as 'the law of the land".

(2)'Strict Constitutionalist' is - in practice - a much more complex concept than the words imply. A 'Four Corners' test by the most reasonable people with the highest professional integrity will almost certainly result in differing opinions.

(3) He held 'results oriented' Justices in disdain. Arriving at the 'correct' decision is far more important and critical than reaching the 'popular or fair' result. Political (read 'popular' or 'ideological') issues should be decided legislatively, not judicially.

Over the years I've read Kennedy's decisions closely and concluded that the law professor I heard had stuck to his guns. Yes, he authored several controversial opinions. But he did so based on his scholarly assessment of 'the law' rather than a citizen's opinions of what 'ought to be right'. He is a very good writer and teacher. Reading his opinions is a fantastic education in 'Constitutiional' law.

You may disagree with his results - but arguing with him on his grounds will lead to embarrassment: and maybe, just maybe, a better understanding of how this whole thing is 'supposed' to work.

The fact that there is nothing written into the constitution regarding the process by which a state may leave suggests that the idea wasn't even part of their thinking.

Now, personally I think that's a flaw, and there should be a process outlined and part of the constitution. An amendment would be a good idea. But its not there, and that does not in any way translate into "so you can just bail!" because that's not how countries work or have ever worked. The default inevitable position in all cases in history has been "you cannot just take part of our country and leave."

Kind of hard to hack on Republicans and not admit it was Republicans who not only blocked Garland but made a Supreme Court Justice seat a big election issue for Trump.

Agreed. It really moderated my opinion about McConnell, whom I knew to be a clever tactician but never considered a particular ballsy guy. THAT was ballsy. I couldn't see Ryan showing that degree of courage. That may be wrong but anything remotely similar doesn't spring to mind.

For the same reason it was critical Trump became president it is critical that the Senate remain in Republican hands. As things have unfolded, the USSC has an outsized, unjustifiable influence. It is what it is, and it's much better to be on this side of that reality.

To create a union where a state could blackmail the others with threats of secession when ever that state had a fit of pique about something? First, was George Washington thought or didn't think is beside the point. If the union were to indissoluble, those entering in it needed that to be clearly stated. No small print, or secret codicils: if this is indissoluble, the states choosing to join needed to know that.

And I notice no one has essayed an answer to the question of how this differs from Britain leaving the EU?

Yes, they kept their own currency and did not convert to Euro currency. A few other countries also followed that route, iirc. For the ones that did convert to Euro, it makes leaving the EU much more difficult.

Considering that ACA is pretty much killed, whereas McCain would have created something near as bad only with Republican fingerprints on it that the party would still be "compromising" with the Dems on fixing, Obama over McCain worked out fairly well. Sure, Obama nominated Sotomayer and Kagan, but we'd have to pretend that Chief RINO McCain would have done better. He might have, but I wouldn't have bet money on it.

He hung tough on not giving Obama his pick (after the Left murdered Scalia - and I firmly believe that because I don't believe in coincidences) and says that Trump's nominee will get a vote before October. They insisted that Trump would nominate a Souter at best, or would seriously nominate his sister, Ted Nugent, or some other ridiculous choice. And you know what? Any of them would be better than the arch-proggies that Hillary would have nominated. She would have dumped Garland too.

I get that - I didn't want Trump in the primaries either. I'm still not happy with the scorched earth treatment his Republican opponents got. That damages the brand for years to come.

Doc Zero had some great conservative writing as a commenter (kind of a COB arrangement) in Hot Air's old green room, back when Michelle Malkin still ran the place. He got employment at a couple places I tend to not follow, but it's good to see his writing in public again.

The green room posts are still archived, and they are still worth a read.
