Evening Briefing

Trump signs Executive Order asking judge to modify consent decree (which Obama apparently agreed to) that forbids holding children for more than 20 days. The judge almost certainly won't do that, which means we're back to catch-and-release.

Even though a modification of that decree to permit holding families as a unit seems to command a plurality of support:



This is the point in the script where the NeverTrumpers start howling about Trump being soft on immigration, ignoring the part where they've joined the liberal mob for a week in agitating for just that outcome.





Four things the media won't tell you about the border crisis.


The Obama administration responded to these rulings with a combination of deportation raids targeting criminals and a "catch-and-release" policy for families apprehended at the border, who would usually be issued notices to appear at an immigration hearing at some later date. This "catch-and-release" policy is what the Trump administration is trying to end.


To that end, Trump has invoked Flores as the reason for separating parents and children, saying the settlement limits what federal agencies can do with children brought here illegally and apprehended at the border. He blames congressional Democrats for failing to negotiate on an immigration bill that would solve the problem--although saddling Democrats with all the blame is disingenuous. Republicans have also failed to act on immigration (although now they say they're ready to pass a bill to keep families together).

The media have been nearly unanimous in contradicting Trump, arguing that Flores does not force the federal government to separate parents and children, and that the administration has discretion in how it treats these families.

Both sides have a point. Flores does indeed limit how long, and under what circumstances, federal immigration authorities can detain children. But it only "forces" the separation of families if the parents are detained and prosecuted for illegal entry. In that case, families are separated because children can't stay with their parents if the parents are in criminal custody.

Before Trump's "zero tolerance" policy, families caught crossing illegally were often released within a few days and the parents fitted with an electronic ankle monitor to reduce the likelihood of them absconding. Back in March, when I was reporting on the border in McAllen, Texas, I met a number of people from Central America who were wearing an ankle monitor. Most planned to cut it off and throw it away when they got to where they were going.

I'm having a Bush flashback: It shouldn't be up to The Federalist to explain these things. Trump should do a primetime address explaining them.

"Reporter" admits he's a Democrat seeking to "inflict" damage on Trump, then pretends he didn't mean that.

"You can't inflict this kind of policy on Americans, and not pay a political price," Heilemann told MSNBC's Nicole Wallace, referring to Trump’s recent executive order to stop separating families who entered the United States illegally. "We have a great chance to inflict [a political price on Trump] and his party on November. We, I mean the Democratic Party."

Heilemann quickly tried to cover his tracks. "I'm not part of the Democratic party, but people who object to this policy, which I think is a lot of people."

Christopher Steele visited the State Department just before the 2016 election to brief people there on the Steele Dossier Sid Blumenthal and Cody Shearer Dossier with the Words "Totally by Christopher Steele" Added at the Top.

Former British spy Christopher Steele visited the State Department in October 2016 and briefed officials there about his work on the infamous anti-Trump dossier, it was revealed on Wednesday.

"Based upon our review of the visitor logs at the State Department, Mr. Steele visited the State Department, briefing officials on the dossier in October 2016," Senate Select Committee on Intelligence Chairman Richard Burr said during a hearing held to review the U.S. government's response to Russian meddling in the 2016 election.

Steele's visit to Foggy Bottom in Washington, D.C., prior to the election has not been previously reported.

Burr revealed Steele's visit during an exchange with Victoria Nuland, who served as assistant secretary of state for European and Eurasian Affairs in former President Barack Obama’s administration.



Sounds like Hillary's Minions were frantic to get this reported as a story -- "Steele briefs State Department" was their last effort before the election to get this sham printed up.

But it would take Clapper and Comey staging a false briefing with Trump -- which did not brief him at all -- to get CNN the "news hook" they told Comey they needed.

Finally -- Instapundit apparently isn't as submissive to the whims of Jake Tapper as Tapper's Fanbois are.

6 Am I wrong in my reading of the EO that this might not be a return to "catch-and-release?" The EO says they should *try* to keep families together, not that they *must* do so. The way I read this, the putative parents can remain in detention after the 3 week period, but the minors can't be due to the consent decree.

And what's next for the consent decree when California Judge declines to remove it? Fight up to the Supreme Court?

I don't know that reg works, but it might be time to start considering that action. Knock everyone off the air, speak for 60 minutes setting the record straight, and then return to normal programming.
You shouldn't do this often or it will lose its effect, but it might be a solid move to do it *once* to cut through the noise.

It's basically a bomb to. Say they sue over the EO. Trump says oh well he tried to keep the families together but the leftist judges and democrats overruled it.

Plus the EO doesn't have him dictating a new policy it seems tells the homeland security to file requests with a court in California, I think to make exceptions to the law. If they do it, the democrats will lose it as an issue, and if they don't do it, they will once again be blamed for ripping families apart.

It's basically bulletproofs the argument that it is Congress (and now the courts) who are to blame for this shit. That's my read at least.

46 Instead of catch-and-release the adults and the kids into the U.S. after 20 days because the kids can't be detained for more than 20 days, why don't we give the adults this option at the 20-day mark: they can either voluntarily go back home with their kid, or they can remain in custody and we'll place the kid with relatives or in foster care until their case is resolved.

If the parents (or people posing as the parents) choose to remain in custody at that point, then they are the ones who are choosing to be separated from their kids. If they really want to be with their kids, they can. If they make a different choice, that's on them.

The best we can hope for is the judge rejected the change to Flores and then Trump saying "I tried its up to Congress now. The status quo separations must remain until Congress acts. That's the law."
The risk there is that Congress passes a law that codifies catch and release, DACA and maybe even some amnesty (4-8 weeks before the elections), forcing Trump's veto hand. He might not even veto that.
Regardless this will be the story for the next three months. No more OIG, FBI, Russian Collusion collapse, etc.

Sending children to jail with their parents until the Supreme Court weighs in is the opposite of brilliant. Even if the Fed judge goes along with the extension another suit will be filed immediately and Hawaiian Judge #6 will issue an injunction at light speed that forces catch-and-release to be reinstated until the SC decides.

One thing that is neat is that the outpatient cancer treatment center I've been going to is moving out of the local hospital to a new building only five minutes from where I work, which is convenient. It would be practically walking distance if the PA Turnpike wasn't in the way.

Then Trump can show with evidence that he tried and that congress has to fix it. Also he can alynski the judge(s) who decide the case. Trump understands communication and politics better than most will him credit for until maybe roughly another 20 years pass. I would say he's likely a once in a generation talent on both fronts, which still sounds insane.

The Commies had a snowball rolling down a hill and gathering speed and Trumpy just redirected the path back toward them, leaving his (and therefore *our*) rising popular support well in place.

If Trumps hand was not forced then he manipulated the shit out of Dems. I think he called a poorly thought out bluff or called on a player who overestimated his hand. The Dems didn't anticipate Trump putting up a basically worthless EO that kept zero tolerance in place. Now this manufactured crisis is out of the crisis stage. It has been returned to a normal political dispute which gives the space for emotions to cool and the liberty movement to get out our message and inoculate against another one of these coordinated freakouts. He did look weak though basically like Obama when he said I can't do DACA myself then did DACA a couple years later only Trump did it in two days.

I think he put DOD on it because the military is super good at putting together fortified bases quickly in the middle of nowhere. HHS would turn it into a major goat fuck but they'll probably still run the well being type stuff to make sure the kids are ok. Military will probably be in charge of security and infrastructure only. Plus I noted in the order that he'll only put kids with their families if it is clear they are family. So the camp probably won't really have to be that big making it easier to keep it manageable. Could end up being a pretty nice camp which may convince judges to alter Flores?

I remember being disturbed by it, but then, so many things are disturbing these days.

Just read about the bloodbath caused by Muslims in Maine. My heart sank. This was the line that did it:

One Lewiston resident noted that there had been other incidents, but nothing had been done: “It’s like the police are scared. But they need to put a stop to it or there are going to be riots.”

The police scared is what has happened throughout Europe. It was my fear for here too.

It depends what you have faith in. The bible is clear the world is full of suffering and hard times. My faith is in God thru Christ, and the Holy Spirit has been left to comfort, empower and help. We are commanded to be a light in the darkness.

Yes, I get down too. However, faith in faith is empty. It offers nothing back. Even to believe in God takes help from him, IMO.
