Andrew McCarthy: If There Were Any Question That Rod Rosenstein Had a Conflict of Interest in the Russia Probe, His Threat to Subpeona Congressmen to Get Them to Stop Doing Oversight On Him Should Dispel Any Remaining Doubts

You don't allow people with conflicts of interest to act as judges or prosecutors in a case. Their emotional/personal attachments in the matter may cloud their judgment and cause them to behave unprofessionally, unethically, and even illegally.

Threatening retaliation subpoenas against Congressmen doing lawful, constitutional oversight, because you want to protect your friends or yourself, is the kind of thing that people with conflicts of interest do.

[R]osenstein has clung to his role as Mueller's ostensible supervisor in the investigation notwithstanding that he is a central witness in Comey's dismissal. He authored a memorandum that, ironically, posits that a troubled official’s removal was necessary "to restore public confidence" in a vital institution. The Trump administration used Rosenstein’s memo to justify Comey’s firing even though there are salient questions about whether it states the true rationale for the firing -- precisely the questions Mueller is investigating.

Conflicts of interests can be tough to analyze because some are contingent and hypothetical. Others, however, are obvious and straightforward. In the latter category are "actor on the stage" conflicts: If a lawyer is an important participant in the facts that form the subject matter of a controversy, he is a witness (at the very least) whose actions and motives are at issue. Therefore, he is too conflicted to act as an attorney representing an interested party in the controversy.

To point this out is not to attack Mr. Rosenstein’s integrity. I do not know the deputy attorney general personally, but people I do know and trust regard him as a scrupulous person and professional. That's good enough for me. And indeed, while I disagree with his appointment of Mueller (because it was outside DOJ regulations), his impulse to appoint a special counsel suggests that he perceived an ethical problem in directing an investigation that would have to scrutinize his own conduct. That is to his credit.

Nevertheless, it is not to his credit to threaten members of Congress with Justice Department subpoenas for their emails and phone records. It suggests that the conflicts under which he labors are distorting his judgment. And in any event, to point out that a lawyer has a conflict is not to assert that he is acting unethically. A conflicted lawyer recuses himself not because he is incapable of performing competently but because his participation undermines the appearance of impartiality and integrity. In legal proceedings, the appearance that things are on the up and up is nearly as important as the reality that they are.

I'd say McCarthy is being charitable in suggesting that the subpeona threat merely gives rise to an appearance of impropriety. Though his article does then argue that Rosenstein's threat was outrageous.

He asks some salient questions:

On what basis is the Justice Department still withholding some documents and massively redacting others; and when will President Trump, instead of blowing off Twitter steam, finally order his subordinates to comply with lawful congressional demands for information? If there were credible allegations that a Republican administration had spied on a Democratic campaign, we would not be hearing precious concerns about the viability of the Justice Department and FBI as critical American institutions; in unison, the media and the political class would be demanding transparency.

Finally, note that Attorney General Sessions was counseled by Justice Department officials (none of them Trump appointees) to recuse himself under circumstances in which (a) there was no criminal investigation (which the regulations call for in recusal situations); (b) his contacts with Russian officials were not improper; (c) there was scant evidence of criminally actionable collusion between the Trump campaign and Russia; and (d) Sessions apparently had no involvement in approving FISA surveillance of Trump officials, and had less involvement than Rosenstein did in Comey’s firing.

On what planet is it necessary for Jeff Sessions to recuse himself but perfectly appropriate for Rod Rosenstein to continue as acting attorney general for purposes of both the Mueller investigation and Congress’s probe of Justice Department investigative irregularities?

Yeah, I think we're at the point now where it won't look like interfering in an investigation. There's hands off and then there's failure to perform one's executive duties.

Really the only way forward would be for Jeff Sessions to rescind his recusal and take full control of the DOJ and Mueller investigation.

And that I had stood my ground and refused to change anything, and told the boss that I would quit if it was changed? And that my accuser then quit in a huff when her bullying attempt failed?

Well, things have now turned EXTREMELY ugly. Turns out there was not just one accuser, but two - - two young hispanic SJW activist women who recently got hired in a low-level position and almost immediately started flinging accusations of racism around (even though it had nothing whatsoever to do with their jobs).

Well, after the initial brouhaha with me, one quit, but the other stayed -- and just now she had stomped in and demanded that the OWNER of the COMPANY and all senior employees take "anti-racism training" classes - -and if they refused, she was going to take the case to the state and/or federal level, and bring in lawyers and civil rights commissions and the media and All The Threats.

The owner (also a woman) is not a strong-willed person, and she is now in tears and flipping out, and may very well SHUT DOWN THE COMPANY AND RETIRE rather than face all this bullshit.

I'm getting this all second hand from overhearing a conversation, but shit just got real.

(The original dispute, for those curious, was whether a type of bread eaten in Mexico was "borrowed" from the French colonists who occupied the city of Puebla in the 1860s, which I wrote in a document. This is verifiably true. But the new SJW employees said it was "disenfranchising" and colonialist" and "racist" to state this historical fact.)

Well that's part of it.

The other part is the absolute false statement that Congress is entitled to any documents from the DOJ at any time they demand them. Inexplicably this keeps getting reported as fact and it is just plain false.

Two specific cases where this is not true, if the documents are part of a criminal inquiry or if they are being used in a grand jury proceeding.

Both of those circumstances are present in this situation and have been as far back as last fall, likely longer.

But for some reason it is now popular to think that Congress, a group that is not usually held in very high regard, I believe the term dogshit gets bandied about from time to time, is totally above reproach for wanting every document under the sun despite the fact they leak everything, have zero prosecutorial power and generally don't advance the ball much at all when it comes to investigations.

But yea, Trump could in fact end this anytime he wants by declassifying everything. He hasn't. When you can snatch the pebble you will be a jedi or something.

2. McConnell is keeping pro-forma sessions of the Senate so Trump cannot recess appoint anyone.

3. Trump could fire Sessions then replace him with someone who has already been confirmed but that appointment would only last for roughly four months.

Whereby Trump would have to nominate someone for to fill the spot in four months.

We don't know they aren't. We do know that the DOJ is not talking much publicly about investigations because traditionally the DOJ NEVER talks about investigations. well we'd see the weakness of the original FISA application, which was denied. We'd see if that was based on the same crap as the one that got approved.

My suspicion is that the original FISA app contained the Blumenthal/Cody Shearer "intelligence," which was substatially the same as Steele's "intelligence." And I suspect that after they shot that down, they hired Steele as a front-man whose reputation and prior history of working with the FBI they could play up as if that proved the allegations from unnamed "sources," even though his "report" was largely a rewrite of the Blumenthal/Cody Shearer garbage.

Having gotten a different judge than the first time (i'm guessing), they were able to hide the shitty provenance of this "intelligence."

They also do strategic leaks all the time. Both sides. Schiff has even leaked damaging (and erroneous .. funny that) information that he was being briefed on before the briefing was even over. It's quite likely that both he and Swalwell are both under investigation for leaking.

I'm sorry but the FISA application is highly classified and remains that way today. When Goodlatte asked the DOJ for a copy of it he simultaneously asked the head of the FISC, Rosemary Collyer, to show him the application and any court transcripts that were part of the application hearing.

Collyer refused citing the classified nature of the application and the fact that the proper channel was to go through the DOJ but she said she would be monitoring the case and be willing to reconsider if necessary. Yes, I've been following this whole thing kind of closely.

All we are going to hear about tomorrow is how the DOJ handled the Hillary email scandal and nothing to do with FISA.

And classified or not I will keep stating the fact that Congress is not entitled to documents being used as part of a criminal case or that has been used before a grand jury. They have reminded everyone of this repeatedly.

Go search Chad Pegram's twitter on March 22, 2018. He specifically notes that the DOJ said they were scouring information requested by Congress for anything related to a criminal inquiry or that was being used before a grand jury for exclusion.

This isn't a guess. I've actually been following this kind of closely.

And the state investigators/commissioners ALWASY side with the minority accusers in any dispute about racism in the workplace. Always.

He was not happy that Rosenstein appointed special counsel in violation of the law, but he recognized it as a special case and backed off a bit. Of course, I'm a big fan of McCarthy ever since this sham investigation started--publicly, I should say. I haven't seen one time that he sited the Law and has been proven wrong, and plenty of times that other experts have confirmed it soundly.

Congress is constitutionally and legislatively responsible for oversight of executive branch agencies.

Who else is going to oversee the DOJ? The DOJ? The CIA?

One of the ways in which oversight is accomplished is through the turnover and review of requested documents.

The only way there can be an issue is if the executive makes a privilege claim for requested documents, no such claims, to my knowledge have been made.

That fact that some of the requested documents are allegedly part of an investigation is wholly irrelevant to Congress's request.

The thing to realize is the DoJ, the FBI, and the entire executive branch apparatus are not in the Constitution, the are creations of Congress.

The DoJ didn't even exist until after the Civil War. The Attorney General was originally just the President's lawyer (sort of like WH Counsel). US Attorneys were created nearly at the beginning and they were under the Dept. of the Interior.

The FBI didn't come along until much later.

All executive power is vested in the office of the President. All executive functions are done under his authority. And yes, that includes the investigative and prosecutorial functions.

And Congress created the DoJ and FBI, and Congress can destroy them.

433 So, I think it's pretty clear that the FIB was not doing what they now say they were doing: protecting the Trump campaign from Russian interference.

Because Veselnitskaya did not slip into the country in a way that the FIB couldn't monitor. Furthermore, the FIB shows no attempt to stop such "interference" and the Trump Tower meeting has been the subject of investigation with everybody rooting for jailtime for Trump staffers.

I haven't seen one actual instance where the FIB *protected* the Trump campaign from Russian influence.

To be specific:

The is a type of bread in Mexico called the "bolillo." A small/mid-sized loaf of white bread with a crunchy crust.

And they absolutely DEMANDED that this outrageous racist falsehood be stricken from the document.

But I said I would quit if one word was changed. Because I was correct and they were wrong.

Then owner, who is weak-willed, had to decide which employee to offend, me or them. So she waffled and hesitated.

During that hesitation period, one of the two abruptly quit, claiming it was "racist environment" at the workplace because her demand was not immediately met. Even the boss's hesitation was racist! You must cave IMMEDIATELY.

So now just one of the two remains, to continue the harassment.

Turns out there were also outraged by a second issue as well, another "racist" writer at the company -- a "rock critic" who they claimed covered too many "white bands" and not even non-white bands. His defense? 95% of bands that identify as "rock" bands are white dudes (who could has guessed?), so it wasn't his fault -- he simply covered the bands that existed. But no -- they wanted him to seek out every minority rock band in existence and only cover them, to the exclusion of all the white rock bands.

The owner was still waffling on that issue too when the whole thing blew up.

That's why the owner is afraid of - EEOC hearings and all the rigamarole of being publicly humiliated as a "racist."

Needless to say, the owner is not racist in the slightest. I don't think I've ever heard her even refer to the concept of race in over ten years.

I don't think she's capable of it. What she is though is marketable. Pretty sure that there have been other female drivers out there better than her, probably even some trying to make it today, but they might not have the looks and personality to get them to the position she is at.

The "weight" is great. The break-down really is nice. The iron sights are outstanding - mid-mounted peep and nice post.

I really like it. Was looking for the Carbine/Pistol combo. Very happy with the purchase.

It's why I've been saying I can't make up my mind on Rosenstein. He's done some things that could be seen as Deep Statish but there could also be an innocent explanation.

And Trump hasn't made any moves to dump him or force him to turn over information. Hard to know what his real motivation is right now.

I really don't know which side Rosenstein is on, but I just saw that he himself is briefing the president tomorrow noon about the IG report on the Hillary email investigation. From previous tweets it appears that the president is a fan of Andrew McCarthy so I expect he has read this piece. I would think that if the president has any pointed questions to ask that he will.
