Chip and Joanna Gaines -- Raked by the Leftwing Last Year For Not Featuring Enough Gay Couples (in Waco, Texas) on Their Show -- Slammed with $200,000 in EPA Fines and Required Abatements

I'm not saying there's a connection.

But I would say that people who offend the leftwing Deep State tend to get plenty of government scrutiny and hassle.

In fairness, though, this does seem like the kind of thing the EPA would go after you for (so long as you're not Protected), given that the potential violations were seen on TV.

The stars of the hit HGTV renovation show "Fixer Upper" violated federal regulations for mishandling lead-based paint, the Environmental Protection Agency (EPA) said.

Magnolia Homes, owned by "Fixer Upper" stars Chip and Joanna Gaines, agreed Tuesday to pay a $40,000 fine to the EPA and complete $160,000 of lead abatement work around their hometown of Waco, Texas, among other measures, as part of the settlement with the federal government.

...

The EPA says the program didn't show the Gaineses and others taking proper precautions to avoid lead exposure to workers and residents when working on buildings built before 1978 that could have lead-based paint.

8 EPA doesn't mess around w/ lead based paint.

Remember the old jokes about "lead chips", yeah comes from that (old paint). Chip and Joanna have torn up tons of houses that were ancient and probably did have lead paint in them, exposing them and their crews to it. Their employees could probably sue them because of it.

The EPA/OSHA also doesn't mess around with Asbestos (insulation sometimes roofing stuff/fireproofing).

**
Lived in Bermuda for ten years up until a few years ago - I can put you some knowledge.
Best Restaurant for a truly Bermuda experience? The Waterlot - real old school Bermuda charm - very luxe
In Hamilton - Port O' Call is my fave.

Make
sure you see the South Shore Beaches (Horseshoe Beach is worth at least
half a day - once there walk easterly on the paths just behind the
beach for a lovely walk past Stone Hole Bay, Chaplin and Long Bay
Beaches.
See the view from Gibb's Hill Lighthouse (and just below at
the "Queen's View"- where a Young Queen Elizabeth II paused to admire
the view while touring her empire for the first time)
Rent a Boston whaler at Blue Hill Water Sports and go out for the day exploring.
The
museum at Dockyard as well as the rum cake factory and a Dark and
Stormy ( the local drink) at the Frog and Onion Pub are great too.

Do NOT rent a scooter unless you grew up riding motorcycles and have some experience with left hand drive.

For golf I recommend Riddel's Bay
and
if you have time - St George's is fun (The old St Peter's church is
nice). Fort Scaur is also nice if you have time.
Drop me a line here if you want more info - I am on most days -
when do you go?

35 There is no such thing as "lead based paint".

Lead is a pigment additive, those paints are linseed oil based....oil based paint.

Titanium dioxide is now used as a pigment additive and paint brightener, instead of lead. Lead existed as a pigment additive in different levels in different types of oil-based paint.
What they SHOULD have done is scrape paint off the wall and had some simple analysis done to see if lead was in the pigment of the painted houses in question. Lead pigment started disappearing in the early sixties, as latex paints were appearing.
And I should sue my late father, for making me paint our old house with oil-base white paint that had lead pigment. That guy was trying to kill me.

39 Everyone does this.

Even established outfits before a remodel basically tell you to not say the house was painted before 1979 or whenever the cutoff is because it means an expensive crew has to get involved.

As long as nobody is eating the paint from a tore down structure that's been hauled away to the dump, it's not dangerous.

52 I have no clue whether they took precautions or not, or if this was an ongoing problem or not. I'll just say this - assuming this is something we want the federal government to involve itself in - something I am quite dubious of - the State of Texas can regulate its lead paint on its own without US interference ... but assuming it is, did the federal government send notice that this was a concern and just ask them to take proper precautions next time - or was it just a fine. This is what galls me. No one could possibly know all the federal regulations surrounding lead paint removal - I'm guessing not even the EPA. Can't we just ask people to try to follow the rules without trying to bankrupt them in the process. Of course not. We can't. So get rid of the EPA and all its bullshit.

54 15 Why was the home allowed to be sold in the first place? Shouldn't the cleanup have occurred before a transfer of ownership? "

The not-so-secret secret is that EVERY building in the US that was built before 1978 has lead based paint in it. And it is absolutely impossible to get it all out unless you tear the building down and rebuild from scratch.

Everyone knows that, so whenever you work on buildings built before 1978 you make a show of going through the motions, or at least saying that you did, and in general when you paint over the old stuff you have sealed it in place. But there's times old paint builds up and it has to be scraped. EPA wants every worker to be sealed up in NASA type EVA excursion suits, and that's just not realistic.

The problem Fixer Upper had was they put on TV depictions of them doing houses the way that everyone in the country redoes houses, and they forget that for television you've got to go through all the extra steps of pretending that you can do something about the old paint, because it makes the EPA feel good.

I think you pretty much have to eat lead paint chips in order for there to be a problem. It's probably not good to breathe the dust either, but I would think that would be more of a problem for someone who does it for a living rather than a one-time restoration.

89 And with asbestos, my understanding is that variety matters. The white asbestos is probably safe per my understanding, (though we'll probably never know for sure because all testing (even if legal) is pointless since the entire category of products is illegal) and it's the blue and brown asbestos that'll wreck up your lungs.

100 i live in a house built in 1937. I'm sure most of the woodwork has 5 or 6 layers of paint with lead additives in it, covered by 3 or 4 layers of more recent latex. Anytime I've had to change something for a remodel, I'm sure some of the old layers have been disturbed.

So What? Me and any workers wear breathing masks when using saws or scraping, due to the dust. And if you look at the literature, the worst effects of lead are on pre-school age children, so keep the kids away from the work site. As far as full grown adults go, use masks and don't breathe powderized residue into your lungs, and it actually won't do anything to you.

Btw, neither will asbestos - that's another big lie, very profitable for some people, that's been pushed the last 30 years. Yes, breathing powderized airborne asbestos is bad - but other than that, it is completely harmless. And since it occurs in long fibers, you never will run into the powderized version unless some person uses a machine to chop it up and put it into the air.

Posted by: Tom Servo at June 11, 2018 05:24 PM (k1TUh)

101 had a few episodes of these shows on lately, and i distinctly remember another episode of another show in which the renovation 'expert' estimated a $3000 cost to remove lead paint for a house built before 1978. offhandedly, the host or contractor remarked that there were asbestos abatement issues that had to be handled as well, most of which definitely didn't make it into the final cost of the renovation. and this house was in california.

this stood out to me because a family member recently purchased a house, which we had tested for asbestos in the kitchen tile and in the ceiling, and it was everywhere. one way to handle the problem is to seal the asbestos so it can't become friable, but the best way is to just completely remove it. cost estimates for a small townhouse started at $10k...not in california.

basically, i'm sure contractors and renovators cheat on this stuff all the time, and i'm sure this was a targeted effort to ruin these people. not that anyone needed the additional confirmation.

109 "Could have had," that's the operative word.

In fact, very few of these places actually had lead-based paint, and the lead from them is so miniscule that the protection required is almighty overkill. The best "protection" is to not eat it by the gallon.

It is much like the hyperscare of asbestos, almost none of which will cause a case of sniffles, let alone asbestosis, which is usually developed after years of mining exposure. There is not one single case of asbestosis from any other exposure, period.

If asbestos is so damned bad, you can bet fiberglass insulation is worse, but nobody is into that scare because of the almighty $$ of the manufacturers.

I don't know, since I don't know if the Towers had used asbestos or not. I do know that is the best naturally occurring, cheap flame retardant ever discovered. It doesn't burn, it doesn't melt.

Remember the tower that burned in London last year, killing 60 or 70 people, because they had put a plastic based "energy saving" coating around the building? And it burned like a roman candle? Suppose they had used asbestos instead - not a single person would have died, the fire would never have spread from where it started. BUT it's natural, no company can copyright it, no way to make big profits from it, so let's outlaw it! Yeah, that's the ticket!!!

130 Because removing lead paint from dwellings, e.g. by sanding or torching creates lead-containing dust and fumes, it is generally safer to seal the lead paint under new paint (excepting moveable windows and doors, which create paint dust when operated). Alternately, special precautions must be taken if the lead paint is to be removed.

https://en.wikipedia.org/wiki/Lead_poisoning

It's not just a danger if you eat it. True, if left alone, the danger is minimal. But, if you are disturbing it in some way, like in a renovation, there are real dangers involved for those that breathe in the air containing any lead dust or fumes.

I think the biggest thing is lead exposure for children in their formative years.
The biggest source of toxic lead is not from idiot children eating paint chips, but from lead used as an octane booster in gasoline.
You may recall that gasoline used to have tetraethyl lead as an octane booster, and that started disappearing in the late 1970's.
There is lead residue in the ground near any major street or highway. It used to be in the air, too. You can look it up.

She also made a little inspirational pitch that if anybody in the crowd ever worked as hard they did to create something some day she would give a presentation about them.
Except what they did would never be permitted by the federal govt she works for. The Wright brothers would have been crushed by safety, environmental and workplace rules to name a few. Plus they dropped out of high school so they were not properly credentialed.
The Federal govt we have today would have stomped out most the innovation that happened 1800-1940. But at least we wouldn't have global warming.

the air containing any lead dust or fumes.

IIRC, the Towers used an older version of what is euphemistically referred to as "flung dung," a fire-proofing cementious coating on steel that can hold up for about an hour, preventing the steel from reaching yield point. Without it, they would have come down much faster.

We still use that stuff, but without the asbestos fibers. It's a cheap, common way to protect steel construction.

One of the biggest scandals in science today, that is NOT being talked about because a lot of people will lose a lot of money if it is talked about, is what is known as the Reproducibility Crisis.

If you remember basic Scientific Method, when someone does a study or experiment, anyone else is supposed to be able to go out and do that study or experiment in the same way and reproduce the same results. (within a margin of error of course) That is supposed to be the test to determine whether or not the result was actually scientifically verified.

Multiple sources that have tried checking this out have found the more than 2/3 of the studies done today, including those used to determine the effectiveness of prescription drugs, are NOT reproducible. Put in laymans terms, 2/3 of what we think of as verified science today is complete garbage.

Yes. The lead lubricated the valves and valve seats. When the lead went away, the engine valves started failing at an alarming rate.
So the auto companies had to re-tool and use much harder steel for the valves and valve seats. They switched to Stellite, which was an alloy used in piston powered fighter planes in WWII.
Just like the sulfur in diesel used to lubricate the diesel engines in a subtle way, and when auto diesel was greatly reduced, there were real engine problems that had to be resolved, because of low sulfur diesel fuel.

205 I've been a fan of the Gaines since the start of their show. I have most likely seen every episode, plus I subscribe to their magazine and read Joanna's online blog.

Chip is a licensed contractor, and a real estate broker, he and Joanna own five real estate offices in the Waco/Central Texas area. They are currently developing a new subdivision in Waco with new builds. They've remodeled/rebuilt almost 200 homes in the 15 years they have been in business.

I"ve seen some episodes in the early years of the show in which Chip and his crews are tearing out drywall, sledgehammering two by four walls, out, etc. with no dust masks, often no eye protection and sometimes no gloves. In the last two seasons, I've noticed a lot more safety equipment , although still not over the top.

It seems like a lot of the homes they remodel for people are vacant, one was slated for demolition and one was on a ranch being reworked for the grandkids. They literally tear most of these homes out to the exterior walls. They bring in outside contractors, to do most of the skilled trades, etc. Most of their redos involved engineers, etc. because Joanna always wants to tear out load supporting walls.

The Gaines have remodeled homes for single moms, black families, Hispanic families, a missionary couple, a bachelor, a widow, etc. They did a remodel last year for a couple whose adopted children have life limiting diseases and were sponsored by Tim Tebow.

Their requirements to hire them as contractors include a clause that the project cannot be located more than 30 minutes from Waco and proof of finance approval has to be in place. That is going to streamline a lot of people. They only did 10 or 12 episodes a year, which again cuts back on how many people they can work for

.I've read articles in which there are people in Waco who are unhappy with the "gentrification" of Waco due to the Gaines' projects, who complain about home prices rising, etc. And then there is the gay mafia who I'm sure wanted to see them attacked in a more direct way than just an online complaint.

Chip was sued several years ago by his old partner whom he bought out just prior to the show starting. Partner said Chip never told him about the show, I'm not sure where that lawsuit stands. Possibly he could have been one source for reporting to the EPA.

Every one of us would tell you that the various "studies" have little to no relationship to the actual chemical science they pretend to portray.
Why, you ask? Because they're not trying to be accurate, they're trying to "change things" or "make a point" (or a buck).

So, one lone nut showed up and told them that there is no such thing as a "transsexual."

And, while he was correct, he is also a loon, so the local newsies promoted the story to show how crazy people who object are.

And still, there is no such thing.

My question is, if gender is not a defined thing, how can you be sure you are of the opposite gender? And do Drag Queens dress like women, and if so, what defines that, precisely? Because no drag queen I've ever seen dresses like any woman I've ever been or known.

278 Let me tell you how to get a new super expensive, and super profitable prescription drug approved. You first come up with your new wonder drug in the lab, which you hope is going to target some new profitable niche market. Then, you initiate 5 different studies, all independent of each other. Odds are they'll come out differently. You keep careful track of how they are progressing. After enough time has passed that you can tell where they're going to go, you terminate the 4 that show your drug doesn't do anything, BEFORE the finl results are ready, so that no one can say you "hid the results". In actual fact, there are no official results, ever. Then you take the one that actually showed some minimal effect of your new drug, take it to the FDA, and say "See! We Proved it Works! If you approve it, we'll give you a seat on our board of directors next year!"

And the FDA says "wow, that is a good deal, approved!!!"

and that's how it all works these days.

280 IG report release expected June 14, I think. There have been several delays. Various committees will get in the act of doing hearings on it thereafter.

There is no press, aside from a handful of people there is no GOP (effectively, on this central issue) in Congress. And half the country is dumbed down beyond recognition, and in various states of delusion or hysteria about Trump (still).

So yes by the far the greatest scandal is US history (any component of those now being investigated qualifies, as did the IRS scandal, which will go unpunished) will get less attention than a celebrity suicide.

But indictments are likely to follow, and those will get some attention.

289 I have long wondered why the EPA didn't go after the renovation shows for not properly handling lead paint. The EPA regs are very demanding. The easiest thing is to just paint over the lead paint, but if you're disturbing more than 3 square feet (I think, check the regs!), you have to go through all these crazy steps like put a plastic tarp down on the floor, seal off the room, seal off the HVAC ducts, take down the wall or whatever, then roll up the tarp making sure none of the dust escapes, and take it to a toxic waste disposal place. I have never seen a show on HGTV go through all of that.

Posted by: biancaneve at June 11, 2018 06:37 PM (A/iod)

290 "No one could possibly know all the federal regulations surrounding lead paint removal"

Actually, no, if you're a contractor or remodeler or a real estate agent you should definitely know the regs about lead paint. The average homeowner wouldn't necessarily know, and that is why the average homeowner is exempt and can disturb more than 3 square feet of surface with lead paint all to their heart's content. But contractors and modelers are expected to know this. The regs may be excessive, but they are a big freaking deal to people in the real estate and home remodeling business.

Posted by: biancaneve at June 11, 2018 06:45 PM (A/iod)

291 Regarding "Asbestos"
Most folk do not understand that there are TWO (commonly encountered) utterly different materials called "Asbestos". There are actually at least SIX different materials, all carrying the name "asbestos".

One type in common use has a soft, almost silky fibre and the other has short hard fibres. Both are "heat resistant", but only one can cause "asbestosis".
The "soft", slky stuff, is chrysotile asbestos and has soft, slightly curly fibres which actually degrade if ingested, is amphibole asbestos.

The nasty, spikey stuff is amphibole asbestos, the fibres of which are NOT degraded / disolved in bodily fluids thus remain a long term hazard.
How did materials with quite different physical and chemical properties get the same name? Who knows?
But, as one expects these days, a HUGE industry (government certified and licensed, of course) has grown up around "asbestos disposal.
Lead-based paints are ONLY a problem if you cheerfully sand them back without wearing appropriate filters / masks. Sanding back ANY paint, timber etc. is fraught with hazards, just on the dust (non-lead) alone. The Dust from certain species of timber is also "toxic". Trees ALL do that to some extent to ward off parasites; some take it to extremes.
It's probably a good thing these EPA clowns will never discover that a prodicious amount od pale green paint was traditionally used inside "government buildings, like offices and schools. The green comes from the Arsenic-based pigment. Then again, maybe "wall-licking" is where all this started....most of them had desks too far from the (lead-glass) windows.

Posted by: Don_in_Odessa at June 12, 2018 05:07 AM (gIxhm)

293 We watch a lot of the programs on HGTV and I'll submit that the other programs more than make up for any lack of LBGTQ or other diversity couples on the Gaines's program.

295 My wife loves watching all these home improvement shows. I have often comments while watching them "Is every third couple buying a home in America gay or lesbian?" It's ridiculous. Has it occurred to people that there just aren't that many homosexual couples out buying homes in Waco, Texas (and want to rehab one - they don't do new homes)?

Posted by: RonF at June 12, 2018 01:43 PM (l8nW6)

296 For those of you asking "How can they tell?", one thing you're supposed to do is put screens over all the floor drains to keep lead paint chips from going into the sewers. Someone noticed that there weren't any screens on the floor drains, and it went from there.
