Trump Pardons Dinesh D'Souza; Media, Get This, Freaks Out

Mr. D'Souza accepted responsibility for his actions, and also completed community service by teaching English to citizens and immigrants seeking citizenship," White House press secretary Sarah Huckabee Sanders said in a statement, adding "in light of these facts, the President has determined that Mr. D'Souza is fully worthy of this pardon."Prosecution was brought by Chuck Schumer's former aid Preet Bharara. As Ed Morrissey notes, this sort of strawman donation is a very common crime which is very rarely -- if ever -- prosecuted as a crime. Usually it's punished by a civil suit and fine. But Preet Bharara was looking for a scalp. Even a fan of Bharara's, Alan Derschowitz, said this smacked of "selective prosecution." He quotes from the Wall Street Journal:
"The idea of charging him with a felony for this doesn't sound like a proper exercise of prosecutorial discretion," Mr. Dershowitz said. "I can’t help but think that [D'Souza's] politics have something to do with it. . . . It smacks of selective prosecution." ... Mr. Dershowitz said the world of politics is rife with the sort of campaign abuses alleged. They're so common, in fact, he said he himself been called upon to participate in similar arrangements. Pardoning would show two things about her conviction:
1. It was a process conviction.
2. She was persecuted, but none of the financial people who did insider trading and brought the economy down were prosecuted. (Note - I'm not sure I care about this in the legal sense but it is a very populist message for Trump to bring up).

I just don't see the connection, Martha Stewart is on tape engaging in insider trading and even had a broker's license to trade securities. She knew what she was doing and this was years and years before the financial crisis.

What interests me about Manning is that the crime he went to jail for is what has Jullian Assange wanted by the US government. Manning's stolen secrets is what Wikileaks released. Yet Obama pardoned Manning but Assange is still wanted. I always got the feeling that if Obama and his handlers weren't all upset and blaming Assange for helping Trump win that they would have dropped the case against him as well after the election.

First, not all are sympathetic. Second, he ordered a blanket review of ALL cases, not just ones where there was evidence of mistakes or impropriety. Cases where there was physical evidence and witnesses.
And then he issued the blanket dismissal of all death penalty convictions, thus reversing every jury trial. He could have just done that, and spared them the farce and pain of the reviews. he didn't because the majority would have been upheld. So he subverted the review that he started.
And he never bothered to inform the families. He was too busy preening for the cameras.

There are several reasons (tongue in cheek) why I am opposed to the death penalty.
1) It creates unnecessary martyrs. Has anyone heard from Mumia or Ira Einhorn since they got their life sentences?
2) Not just getting it wrong but railroading people. There are three and only three reasons people go into government service: a) power, b) lack of accountability, c) security of tenure. Not hard to see an ambitious prosecutor suppressing exculpatory evidence to obtain a conviction.
3) Unequal application. Women all too often walk for crimes that men would be sent to Old Sparky for. Mary Winkler shot her minister husband in the back. After she was convicted of voluntary manslaughter, the judge gave her credit for time served awaiting trial and let her spend the remaining 60 days (!) of her sentence in a mental-health facility.

It's like I wrote last night. Two things you must know about current internet political conversations.
1. It is never right to bring up comparative instances. That's "Whatabouttism", its a deceptive tactic to divert the focus from of the matter at hand to arguable relative cases.
2. It doesn't matter where or not Hillary specifically violated actual laws by actual actions, it's just that in the range of *other* prosecutions you can compare her offense to, a wide swath of *other* prosecutors would not prosecute it, because unlike *other* cases, she lacked criminal intent.
And if you can silence a Dem, most of the time, you've simply squelched the outer flame and their smoldering inside knowing that if only they had the right facts--which inevitably speak to their point--they would prove you wrong.

And he could have done just that, and spared the families the farcical reviews. Ryan and his allies were hoping for dramatic fireworks and misconduct, and got none but the one case that he seized upon (there was a very real case involving coerced confessions). But the reviews showed the opposite.
So he stopped them and issued the blanket edict.
And screwed over the victims and families a second time. He didn't even bother to notify them.
Which you obviously don't care about.
I care neither for mobs or for elites who pander and sell their office. Ryan did that on a grand scale.

One of those illegals with an illegal drivers' license ended up killing a family of six children along the interstate highway outside of Milwaukee, a piece of his truck fell off, and a minivan carrying the Willis family, with 2 adults & 6 children ran over it and burst into flames. Adults escaped, children all burned to death.
Ryan was trying anything to stay out of prison, including sucking up to the death penalty foes by eliminating the death penalty in Illinois. He went to prison anyway, although not for the deaths of those children, there was plenty of corruption surrounding him that brought him down.

Here lets have this guy "not a lawyer" take a stab at it.
Generally speaking a big cheese like Rosenstein or McCabe would read all the various legal documents and advices from various cognizant authorities that pertain to a "potential action under review". This big cheese would be the person who would give his informed advice on the legal and proper way to take an action or say an action is unhallowed due to XYZ.
Its part of the job to issue memos
So if these guys are giving bad advice unintentionally or maliciously and then trying to hide that from public view so as to hang someone up the ladder, then we got problems.

I think that they didn't want to pay taxes to be abused and lied to, but it's painfully obvious that this means nothing to you.
As for civil suits, when taxpayers do that, they are suing themselves, not the ones who were in office.
This will come as news to you that victims of crime and their survivors have rights too; not just politicians who are trying to cover up other misdeeds.
