Alan Derschowitz: Trump Shouldn't Fire Rosenstein. Instead, He Should File a Motion to the DoJ Requiring Rosenstein to Recuse Himself

Interesting.

Derschowitz says that if the DOJ refuses to recuse Rosenstein, then Trump could/should seek a similar order from a judge, but why not start with the DOJ motion first?

"If I were a lawyer for Donald Trump, and I am not, I am just saying what I would say about anybody, I would be making a motion in front of a judge," he explained. "First I'd make it in the Justice Department, to recuse Rosenstein. Then I’d make it in front of a judge. You cannot be a prosecutor and you cannot be a witness in the same case."

Meanwhile, now that the Electronic Communication (EC) that sparked the Trump probe has finally been released to Congress, people can start making judgments about it.

I'll say this, outside of Dershowitz, Trump seems to be getting piss poor legal advice.

Maybe JackStraw is right and people like Sessions are getting their ducks in a row and laying low, but here from the cheap seats I see Trump making a lot of dumb moves and not dealing with these people appropriately.

Stupid things like suing Stormy Daniels, saying he would allow himself to be interviewed by Mueller, keeping on Rosenstein, not having Sessions open up DOJ investigations into these people, on and on. I would argue just cooperating at all with Mueller is stupid, how many people have they now destroyed?

I'm no lawyer, but Trump seems to not be getting good advice. Maybe Dershowitz could lend a hand here.

To be fair he didn't sue Stormy, his lawyer did, and based on the stipulations of the NDA agreement Cohen would have been negligent in his legal duties not to do so. His lawyers also advised him NOT to do a Mueller interview either. I do think his legal team is a hit or miss in terms of quality though.

But here's what is so dangerous. Clinton's impeachment was about lying under oath in a sexual harassment civil suit.

Say Mueller interviewed Trump and asked sexual details about his alleged affair(s) with other women and he lied about it? Grounds for removal via impeachment?

I would argue that's stupid, but we don't exactly have a lot of credibility if we make that case after Clinton.

Trump could easily get himself tangled up in something stupid like that. That's why in my opinion Mueller should be fired. Once you have a DOJ hostile to the President and trying to take him out, it completely undermines the branch of government the American people elected into office.

Trump should do what Dershowitz suggests. But they need to find a good judge to present the motion to.

The prohibition of being both a witness and prosecutor is obvious and clear. If Rosenrosen is potentially a witness, he should be out.

If someone wrote this book nobody would believe it. There's so many facets and things we don't know yet. My biggest fear in this is that it all gets swept under the rug and we never prosecute the actual guilty ones. The Clintons come to mind so I don't think that's an irrational fear.

Read last year (and I forget the source) about how legal reviews of bills have pretty much gone by the wayside. Congress is all about making laws to please the contributors...I mean constituents...and who gives a rats ass if they are even legal. Let the courts figure it out. Sundance is meticulous and does not engage much in speculation. He does tend to bore folks with short attention span and desire for immediate action. He does give his opinion from time to time. He did exemplary work in the Trayvon Martin case a few years ago.

Overall, much of his material dealing with process jives with what I know about the legal process, administrative, and criminal law--which is a bit. He can be a bit on the sunny side that everything will turn out all right in the end which some find grating.

BTW, CTH is NOT the place to exhibit the free flowing, ahem, commentary that flies here. It does have a strict commentary policy and has considerable religious overtones in the official posts.

Your commentary is also pretty much spot on as well.

you are talking about theory. yes, in theory the executive can fire and hire personnel in the executive branch. since these are somewhat extraordinary circumstance and this is happening in the middle of a special counsel mess, a tidier, smarter and more practical move would be to go the judge and do exactly as AD suggested.

the rules were written by serious men that played hardball and wrote the rules for hardball. you are suggesting a stopgap half measure that undermines everything in the long run AND puts Trump at the mercy of a judge. What happens if the judge refuses Trump's request? Will Trump exercise his Constitutional authority then?

Will it look better or worse if Trump goes to a judge to beg for action and gets rejected by the judge and then takes action on his own or if he simply acts within the bounds of his authority to begin with?

But just consider what has already happened, how many people from senior level positions at the DOJ/FBI have been removed, some of whom are obviously cooperating with a federal prosecutor who has been on this probably since last summer, and look at the behavior of the people who are in the crosshairs.

They are taking turns throwing each other under the bus and contradicting sworn testimony. This is not the behavior of innocent people.

If you believe as I do that Trump has known what happened since the fall of 2016 when Admiral Rogers told him and you accept that all these scandals are related and it is massive and it will take a careful, well laid out prosecution to overcome the media, the left and the common wisdom, it all makes sense.

Well to me anyway.

1. The hounding of one, then another goverment scientist for the 2001 anthrax attacks. One sued for millions and won, the other killed himself, and a scientific panel later found no basis for suspecting either one of them.

2. Prosecuting four innocent men for a 1965 Boston murder and keeping them locked up for 30 years despite exonerating evidence in FBI files -- to protect FBI mob informants who committed the actual murder.

Both were Mueller shit shows, as US Attorney and as FBI. He doesn't care.

I am pretty sure that DJT knows via NSA intercepts and other sources of information that a breathtaking level of corruption, illegality, and partisanship by senior law enforcement and intelligence community members exists.

I was around for the Watergate and Church committee hearings and saw similar type activities but they were aimed for the most part at national security type issues and other countries (apart from the actual Watergate breakin itself).

The Deep State was bad during the late Clinton years, the WOT under Bush gave it new tools ostensibly to fight terrorism, and went into overdrive during the Obama administration. The apparatus for a security state and apparent legal justifications now exist with our remaining bulwark being the lack of total control of law enforcement.

As somewhat of a historian, for our country to continue, we need a cleanup on a Justinian level scale.
