20 States File Suit Against Obamacare, Again: If the Law Was Only Found Constitutional Because It Was Supposedly a "Tax," Is It Still Constitutional, Now That It Contains No Tax Provisions?

I expect that Chief Justice Roberts, the biggest disappointment since Mr. Plinkett's son, will say "If it was born a tax, it remains a tax even after the tax-part is amputated it," or some other bullshit.

Still, I guess hope remains, except, spoiler alert, hope doesn't remain. Chief Justice Roberts did not decide this on the law in the first place -- he decided it on social pressure and politics -- and a change in Obamacare's standing as a tax will therefore not matter to him.

The GOP tax law "eliminated the tax penalty of the ACA, without eliminating the mandate itself. What remains, then, is the individual mandate, without any accompanying exercise of Congress's taxing power, which the Supreme Court already held that Congress has no authority to enact," the complaint states.
"Not only is the individual mandate now unlawful, but this core provision is not severable from the rest of the ACA--as four Justices of the Supreme Court already concluded."

It may still be possible to get rid of Obamacare, but it will take an act of political will that I doubt the GOP is capable of. It always seemed unlikely to me the court would take care of this for us (even if it should) -- life just doesn't work like that, at least not for Republicans.

Any victories are hard-won and the result of years of struggle. On the progs get their victories handed to them by robe-wearing Secular Priests.

13 That entire decision was BULLSHIT to begin with. It was at the same level of Roe v Wade, which the author of which admitted had zero legal support and was hoping it was just a stopgap until some better argument came along.

It was legal trash without merit. The judges themselves specifically argued AGAINST THE FINAL JUDGEMENT in questioning Obama's lawyers.

1) Make insurance available across state lines.

2) Require that insurers post their insurance plans (benefits and premiums) to a website, where people can shop for the best plan. Require the insurers pay for the website operation as a non-profit.

3) Have some sort of honesty in advertising, meaning contracts for insurance must be short, and plain language documents.

4) Have the federal government buy insurance policies for their workers and the poor on this website, but make it a law that only 10% can go to any single insurer. That way we will have at least 10 nationwide insurers participating.

5) Every insurance company on the planet will pile in and offer competitive deals, if only to get the government contracts.

6) Consumers have maximum choice, at low cost, just like we do for every other damn thing.

7) Cost to government = zero. Probably save money over what they are doing now.

Really it is just a simple, a regulated marketplace, just like Amazon, Itunes, car insurance, whatever.

A judge ruled. The Trump administration appealed this ruling in two ways. First, to an appellate judge of the circuit. And second, they filed a motion to bypass the circuit court part of the process entirely and go straight to the Supreme Court. The Supreme Court simply ruled that they did not want to bypass the regular order of events and take the case directly. Which, incidentally, they hardly ever do...the last time the Supreme Court agreed to bypass the circuit court in this fashion was 1988.

OK. That is not what the court did. They said the 9th was wrong to rule that their was a law that said they had to have bail. The Supremes said for the 9th to rule on the Constitutionality of holding them without bail instead. The SC didn't rule on the Constitutionality of holding them without bail because nobody asked them to do that.

It's best not to write off the judiciary. That's how you get Never Trumpers arguing Hillary is no different.

Now, I believe Trump is accomplishing a lot. But even if he hadn't, appointing quality justices matters. This is true even when they occasionally backstab us, because they don't vote in lockstep with the liberal zeitgeist.

After Obamacare, I'm not a fan of Roberts. But on every issue, you know how Ginsburg is going to go; her presence in the court is meaningless.

Gorsuch > Any Hillary Appointment. And there is a good chance a liberal Justice will leave the court this term, which would change the landscape of modern American politics.

In that scenario, Roberts is probably the "liberal" swing vote, but again better than any of the full time liberals.

In particular, the penalty that Applicable Large Employers must pay if they don't provide health coverage to their workers is still in effect. So PPACA still contains at least that tax provision, unless and until it is struck down or repealed.
