Sefton: sefton at cutjibnewsletter.com | 20 States File Suit Against Obamacare, Again: If the Law Was Only Found Constitutional Because It Was Supposedly a "Tax," Is It Still Constitutional, Now That It Contains No Tax Provisions?I expect that Chief Justice Roberts, the biggest disappointment since Mr. Plinkett's son, will say "If it was born a tax, it remains a tax even after the tax-part is amputated it," or some other bullshit. Still, I guess hope remains, except, spoiler alert, hope doesn't remain. Chief Justice Roberts did not decide this on the law in the first place -- he decided it on social pressure and politics -- and a change in Obamacare's standing as a tax will therefore not matter to him.The GOP tax law "eliminated the tax penalty of the ACA, without eliminating the mandate itself. What remains, then, is the individual mandate, without any accompanying exercise of Congress's taxing power, which the Supreme Court already held that Congress has no authority to enact," the complaint states. "Not only is the individual mandate now unlawful, but this core provision is not severable from the rest of the ACA--as four Justices of the Supreme Court already concluded."It may still be possible to get rid of Obamacare, but it will take an act of political will that I doubt the GOP is capable of. It always seemed unlikely to me the court would take care of this for us (even if it should) -- life just doesn't work like that, at least not for Republicans. Any victories are hard-won and the result of years of struggle. On the progs get their victories handed to them by robe-wearing Secular Priests. Comments(Jump to bottom of comments)1

That entire decision was BULLSHIT to begin with. It was at the same level of Roe v Wade, which the author of which admitted had zero legal support and was hoping it was just a stopgap until some better argument came along.
It was legal trash without merit. The judges themselves specifically argued AGAINST THE FINAL JUDGEMENT in questioning Obama's lawyers. Posted by: Christopher R Taylor at February 27, 2018 06:41 PM (39g3+) 14

Which is why I think conservatives should change gears and start a movement of judicial activism but for conservative jurists.
The Left racks up basically every victory through the Courts with their liberal activism while our side is committed to judicial restraint with the stupid idea that this will rub off on liberal judges. Of course it never does. We keep losing (even with a conservative leaning Supreme Court) and the Left gets most of what they want with us playing pathetic defense. Justice Roberts is all about his legacy, he wants to be in the history books as a Great Man, a legislative Hero. I've never understood something....why not just....
1) Make insurance available across state lines. 2) Require that insurers post their insurance plans (benefits and premiums) to a website, where people can shop for the best plan. Require the insurers pay for the website operation as a non-profit. 3) Have some sort of honesty in advertising, meaning contracts for insurance must be short, and plain language documents. 4) Have the federal government buy insurance policies for their workers and the poor on this website, but make it a law that only 10% can go to any single insurer. That way we will have at least 10 nationwide insurers participating. 5) Every insurance company on the planet will pile in and offer competitive deals, if only to get the government contracts. 6) Consumers have maximum choice, at low cost, just like we do for every other damn thing. 7) Cost to government = zero. Probably save money over what they are doing now. Really it is just a simple, a regulated marketplace, just like Amazon, Itunes, car insurance, whatever. The why of the Roberts betrayal of the principles of constitutional law. All that matters is that he undermined the law and the republic, and that any and every effort to overturn the court's lawlessness will inevitably lead to lawlessness by the court. We are to smile, sadly perhaps, and shake our heads and just allow the coup to continue unchallenged.

In retrospect, this is now obvious. Posted by: Max Power at February 27, 2018 06:56 PM (q177U) It was clear at the time. Everyone knows he came to his decision based upon the blackmail demanded from him over his illegal foreign adoptions. Those of us who followed the rules.... and adopted legally.... have paid for his malfeasance ever since. Along with everybody who didn't cross that line. Makes me angry that he is still a "justice," since none has been served. Those poor kids. Posted by: tcn in AK at February 27, 2018 06:58 PM (7UW64) 110
If Roberts was afraid of the MSM, then why write an opinion throwing Ocare out in the first place? It's not like he didn't know the MSM would crucify him for the 6 months between the arguments and the opinion writing. If he was going to please the MSM, he wouldn't have written that first opinion.
Only logical explanation is Obama had the blackmail ready but didn't use it until it was absolutely necessary, after the original opinion was written and leaked to him (or not him per se but one of his minions). Posted by: #neverskankles at February 27, 2018 06:59 PM (6nRrz) 111

Don't blame Gorsuch - best guess is that Kennedy didn't want to deal with either topic in what's going to be his last term in the court. If Kennedy says "I'm out" on anything at all, then the conservative wing loses to the libs, 5-4. Better to kick the can down the road with no firm decision than to take a permanent loss. That is a very clever way of using a Thesaurus to keep from saying the word blackmail. Supreme Court Justices don't write a carefully thought out and reasoned decision and then suddenly switch sides because of "social pressure" and "politics". As in: there has never been another example of that in the history of the court. Blackmail or "we're going to kill you today" level of coercion are the only ways that happened. Didn't the lower court already rule? That's what Trump appealed....a lower court ruling.
Posted by: #neverskankles at February 27, 2018 07:00 PM (6nRrz) A judge ruled. The Trump administration appealed this ruling in two ways. First, to an appellate judge of the circuit. And second, they filed a motion to bypass the circuit court part of the process entirely and go straight to the Supreme Court. The Supreme Court simply ruled that they did not want to bypass the regular order of events and take the case directly. Which, incidentally, they hardly ever do...the last time the Supreme Court agreed to bypass the circuit court in this fashion was 1988. Posted by: HTL at February 27, 2018 07:19 PM (hV1Vu) 184

Zman: "Then there is the one story that has never made any sense. That is the case of Judge Roberts reversing course in the ObamaCare decision. He writes an opinion striking down the individual mandate, circulates it around and then suddenly changes course and supports the mandate. It was a such a bizarre turn of events that the dissent just used his brief as the basis of the dissenting opinion. People who investigate blackmail and extortion schemes look for these sorts of anomalous changes in behavior.".......
Not to mention the second ObamaCare case, in which the Court had to make plain words mean the opposite of what they mean in order to continue the illegal funding, rather than just sending the law back to Congress, which is how it is supposed to work. We know that Obama wiretapped reporters, Congress and our allies to get his Number One Goal of the Iran Deal. Justice Scalia believed the Court was also surveilled. Would Obama wiretap and blackmail to achieve his Number Two Goal? To ask is to answer. Posted by: The Gipper Lives at February 27, 2018 07:36 PM (Ndje9) 251

Nah, it was a raging success with respect to its intended purpose: funneling money to Democrat cronies. The union rank and file has been less obedient about voting Democrat lately (some of them even voted for Trump), so actually building the pork projects isn't important any more. As long as all the "planners" and "administrators" and "environmental compliance officers" get paid, it's all good as far as the Dems are concerned. On the progs get their victories handed to them by robe-wearing Secular Priests. This is not always true. Heller, for one. Citizen's United, two. It's best not to write off the judiciary. That's how you get Never Trumpers arguing Hillary is no different. Now, I believe Trump is accomplishing a lot. But even if he hadn't, appointing quality justices matters. This is true even when they occasionally backstab us, because they don't vote in lockstep with the liberal zeitgeist. After Obamacare, I'm not a fan of Roberts. But on every issue, you know how Ginsburg is going to go; her presence in the court is meaningless. Gorsuch > Any Hillary Appointment. And there is a good chance a liberal Justice will leave the court this term, which would change the landscape of modern American politics. Remember the DACA ruling was just that it has to go through appeals first. Not that DACA was constitutional. Posted by: Joelist at February 27, 2018 08:50 PM (3cfz7) 266
The only part of Obamacare (officially, PPACA) that has been repealed since Trump took office is the penalty for individuals not getting coverage (and technically, even that does not go away until the 2019 tax year, so we're still required to have coverage now, though some people are speculating that the Trump IRS may choose not to enforce the penalty for 201.
In particular, the penalty that Applicable Large Employers must pay if they don't provide health coverage to their workers is still in effect. So PPACA still contains at least that tax provision, unless and until it is struck down or repealed. Posted by: jdgalt at February 28, 2018 12:02 AM (3SFo/) 267
