Hugh Hewitt: The Failure to Confess That the Steele Rumor-Sheet Was Paid for By Hillary and the DNC is a "Damning Omission"

Hewitt was a former prosecutor who reviewed many similar applications.

Yes, a footnote said, vaguely, that the Steele Smear Document was commissioned by a "political" source. That's not quite the same as saying "Donald Trump's opponent in this election commissioned this word salad of unverified rumors and smears, and his opponent now seeks to initiate criminal process against him to even out the email investigation against her."

Here's a bit of what Hewitt wrote:

Upon publication of the Nunes memo, a retired federal judge emailed me: "There is not an officer of the court in the land who in the context of this particular application to the FISA court should not have identified the source of the information as having been the [Democratic National Committee] and the Clinton Campaign. If I had granted the application and then subsequently learned that the information was sourced to the DNC and the Campaign, I would have rescinded the authorization and issued a show-cause order to the Government to explain who and why this sourcing was not made known to the court. The fact (if it be that) that the Government told the court that it was a political source, but did not identify who, in this particular instance, is highly probative that the Government purposely misled the court."

Hillary and her campaign management sitting at a table. Someone mentions how much it would level Trumps claims of crooked Hillary, if they only had something to accuse him of.

Yeah... FISA was just reauthorized, and supposedly Nunes put some new language in for more protection...

But the only thing I've found online with the actual verbiage really didn't change a dang thing.

Like... if someone searches all the data they have collected, and finds something, they have 24 hours to get a warrant... AFTER THEY FIND IT.... the only penalty they have for NOT getting a warrant is they can't use it in court.

So they can search the shit out of you... with no warrant, then either get an Ex Post Facto Warrant, OR, they can use it anywhere BUT a Court...

Language of the latest bill is scary.

Scarier... the FISA Court 'finding' is supposed to be independently done every time, to renew.

Seems to me that there is a penalty for perjury, and that any self-respecting judge would bring down the long arm of the law on that sort of behavior.

At which point, DJT needs to do a little culling of the herd, so to speak.

In fairness, in a properly functioning system, no application would be made unless there were compelling circumstances to do so, in which case granting the request would be appropriate.

Which is not to say the present system is necessarily functioning properly. But if the vast majority of such requests were valid, I can see where a judge might whiff on the odd duff one.

Certainly possible, considering the way FISC is set up. The warrant requests are supposed to be stringently vetted (Woods procedures) before being presented, which is what the low denial rate is attributed to.

However, the strange forced recusal of judge Contreras on the Flynn case just a day or so after Flynn made a plea deal was fishy - since Contreras is also currently a FISA court judge.

198 " The fact (if it be that) that the Government told the court that it was a political source, but did not identify who, in this particular instance, is highly probative that the Government purposely misled the court."

And the Court *wanted* to be mislead. The Court had the opportunity to ask who the political source was, and could turn down the application until it received an answer.

That is the other part of the scandal - the complicity of the judge in the shadow coup-attempt.

Simple explanation to all of Ace's peccadillos; first Ace is an Aztec and they like to walk around in the skins of others cuz Sun God (aka SMOD); secondly, he speaks of shelves but this is merely a cover for his skin holders - evidently the movie Predator had a life changing impact on Ace; finally, Ace needed the hangers since his crawlspace is full.

See, there is always a simple explanation for things.

286 I have to take fairly major objection to this part of Hewitt's article, mainly because he damn well knows better:

"That an omission of a material fact occurred in the warrant application does not indict former FBI director James B. Comey or any of the other reviewing or approving officials up to and including Deputy Attorney General Rod J. Rosenstein. Staffs exist to prepare and review these applications, to search for just such a crucial omission or false assertion. . . . To expect the nation's top cop or its top law enforcement officer to read and carefully review even the least important applications is to expect too much of an overwhelmingly burdened key players."

This is flatly wrong and Hewitt damn well knows it. He damn well knows it.

When you are the attorney signing anything, but most particularly a pleading, you are 100% completely and totally responsible for everything in it. My staff screwed up isn't an acceptable response. You signed it. If you didn't read it or if you said "This is right, right?" and then scrawled your signature, that's on you.

I got into it with my boss about reviewing something last week and he threw at me "What I can't trust what you did?" and I shot back "Hey, it's not my name on the door and my license on the line." Because that's true. If I screw up, he's the one who bears the consequences, not me. Now, I take that very seriously indeed which is part of the reason why I've always fought with my various bosses that, no, it's not a compliment that you can trust my work. I don't want you to trust my work because I don't want to get you in trouble please, for the love of God, check this.

Hewitt knows this. He knows full well that the attorney who signs off on it is completely and utterly and totally responsible for what he is signing. So if that attorney wants to accept the help of his staff to take some of the burden off of him, then that attorney also has to accept the risk that if and when the staff screws up, he's the one responsible.

I'm so sick of all these attempts to give people power without also demanding they take responsibility.

Right. And Comey is an attorney, and former prosecutor, and former general counsel, etc. etc.

So, yeah, he knows what his signature on a pleading means.

But even if he didn't, as you say, it doesn't matter. It's a bit of a legal fiction, I suppose, but affixing your signature to any document you file with the court is saying, "I attest that this is true and that all facts and arguments are presented in best faith etc. etc"

The old "ah, shit, some nameless person lied and I didn't catch it" move would not work with mere mortals. Fortunately for Comey, he's an insider in the deep state, so no big deal.

These types of courts and the attorneys practicing in them are pretty cliquish. If you are in the club, you don't get questioned. It's bad form to inquire of a member his or her veracity or credibility. You can bet that they talk off the record, go to each other's parties and attend the same conferences. In the rarefied air of intelligence and FISA courts the players don't rock the boat much. I guess I am trying to say it is cronyism of the first order.
Posted by: ObjectionSustained at February 06, 2018 01:13 PM (w/SOb)

I'll give Jack Straw a break and I'll mention that the FISA court has been pissed about the DOJ and FBI about lack of candor to the tribunal since at least 2014.

Note, however, that it doesn't appear that being peeved has extended to such things as not rubber stamping the warrant applications.

345 "That an omission of a material fact occurred in the
warrant application does not indict former FBI director James B. Comey
or any of the other reviewing or approving officials up to and including
Deputy Attorney General Rod J. Rosenstein. Staffs exist to prepare and
review these applications, to search for just such a crucial omission
or false assertion. . . . To expect the nation's top cop or its top law
enforcement officer to read and carefully review even the least
important applications is to expect too much of an overwhelmingly
burdened key players."

This is flatly wrong and Hewitt damn well knows it. He damn well knows it.

When you are the attorney signing anything, but most particularly a
pleading, you are 100% completely and totally responsible for everything
in it. My staff screwed up isn't an acceptable response. You signed
it. If you didn't read it or if you said "This is right, right?" and
then scrawled your signature, that's on you.

I got into it with my boss about reviewing something last week and
he threw at me "What I can't trust what you did?" and I shot back "Hey,
it's not my name on the door and my license on the line." Because
that's true. If I screw up, he's the one who bears the consequences,
not me. Now, I take that very seriously indeed which is part of the
reason why I've always fought with my various bosses that, no, it's not a
compliment that you can trust my work. I don't want you to trust my
work because I don't want to get you in trouble please, for the love of
God, check this.

Hewitt knows this. He knows full well that the attorney who signs
off on it is completely and utterly and totally responsible for what he
is signing. So if that attorney wants to accept the help of his staff
to take some of the burden off of him, then that attorney also has to
accept the risk that if and when the staff screws up, he's the one
responsible.

I'm so sick of all these attempts to give people power without also demanding they take responsibility.

*throws things*

That is my take too. Both the surveillance of Page and the surveillance of Papadopoulas was aimed at getting access to Trump (circuitously because there was no way in hell they were going to get a warrant to spy on him directly). With all of the wiretapping they got nothing on Page and they only got a dubious "lying to the FBI" charge against Papadopoulas.

I say dubious because the FBI refuse to tape their interviews so we have only the FBI agents' written account of what is said. In a he said/she said between the FBI and a private citizen, the private citizen is not going to be believed even when the FBI apparently lies all the time.

363 STIGMATIZING CONNOTATION

From the DOJ's own counsel.

https://tinyurl.com/ya67az4x

"STIGMATIZING CONNOTATION
The application of "Glomarization" in the privacy context is appropriate because disclosure of the mere fact that an individual is mentioned in an agency's law enforcement files carries a stigmatizing connotation, one certainly cognizable under FOIA Exemption 7(C), 5 U.S.C. § 552(b)(7)(C).See, e.g., Fund for Constitutional Government v. National Archives & Records Service, 656 F.2d 856, 865 (D.C. Cir. 1981) ("The disclosure of [the fact that specific individuals were the subjects of a criminal investigation] would produce the unwarranted result of placing the named individuals in the position of having to defend their conduct in the public forum outside of the procedural protections normally afforded the accused in criminal proceedings."); Baez v. Department of Justice, 647 F.2d 1328, 1338 (D.C. Cir. 1980) ("There can be no clearer example an unwarranted invasion of personal privacy than to release to the public that another individual was the subject of an FBI investigation."); see also Miller v. Bell, 661 F.2d 623, 631 32 (7th Cir. 1981) (identities of individuals merely mentioned in law enforcement records protected), cert. denied sub nom. Miller v. Webster, 456 U.S. 960 (1982); Maroscia v. Levi, 569 F.2d 1000, 1002 (7th Cir. 1977) (same).

Indeed, only through the consistent application of this masked response to third-party requests, regardless of whether responsive records do actually exist, can the privacy of those who are in fact mentioned in law enforcement files be protected. For example, if an agency provided a "no records" response to its first nine requests for third-party investigatory files, it could not then respond to the tenth request -- where records in fact do exist by "refusing to confirm or deny" without, in effect, disclosing the very fact sought to be protected. See, e.g., Antonelli v. FBI, 721 F.2d 615, 616-19 (7th Cir. 1983), cert. denied, 104 S. Ct. 2399 (1984); Rushford v. Civiletti, 485 F. Supp. 477, 478-80 (D.D.C. 1980), aff'd mem. sub nom. Rushford v. Smith, 656 F.2d 900 (D.C. Cir. 1981); see also Gardels v. CIA, 689 F.2d 1100, 1104-06 (D.C. Cir. 1982) (operation of "Glomarization" in national security context)."

364 I have not heard a word on whether the FISA judge has even been interviewed to answer all of the questions that are being raised.

Seems like that should have been the first person interviewed.

It is as aggravating as the Benghazi stand down investigation. In that case another it is another instance where the answer could have been obtained in short order.

You start from the bottom and work your way up with just one question. Who gave you the order to stand down? Easy Peasy.

Did the FISA judge grant the warrant based on the dossier? Seems that question could have been answered a year ago if they were just able to asked the judge.

This is why people hate the government. They do nothing in a straight line.

371 The fact that the FBI concealed that the target of the FISA warrant (Carter Page) was really an undercover employee is 10,000 times a bigger deal than the fact that the dossier was paid for by Clinton.

They are both extremely bad, but with this information, there's no way to legally Justify the FISA warrant AT ALL.

The entire basis for everything is based on Carter Page being a potential Russian spy coordinating between Trump and Russian agents.

The fact that he was an FBI mole completely destroys that justification and instead shows an effort by the FBI to not only spy on Trump, but to actively entrap him, like they tried to do with the DTJR / Natalia Veselnitskaya meeting... Remember that she was personally admitted into the US by Loretta Lynch.

This entire thing was a coordinated black-op from the beginning and both Page and Popadopalous are moles/plants that provided the connection the FBI needed to justify everything that has followed since, including the Mueller investigation...

ARREST THEM ALL NOW!!!

Posted by: I smell something rotten at February 06, 2018 01:50 PM (iWzUm)

372 It is possible that the FBI didn't tell there employee Carter Page he was working for the FBI's Commitee to Re-Enthrone the Empress- Desk (C.R.E.E.P.) when they sent him into the Trump Campaign

Hell, they could have told Page he was on a secret patriotic mission to protect Trump.

It didn't matter what he was doing at the Campaign, only that he was there, so the FBI could tell the FISA Court that he was a Russian agent, thereby justifying wiretaps on the Trumps.

Criminals.
