John Kerry Violates LOGAN ACT by Sending Message to Palestinian Leader/Terrorist Protector Mahmoud Abbas Telling Him to "Stay Strong" and Refuse to Negotiate With Trump

Kerry reportedly sent word that Trump would not be president for long, and that Kerry could run in 2020.

I was told it was a crime when Trump aides, during the transition, reached out to foreign leaders.

"We have one president at a time," the Washington Post and other DNC front groups intoned.

Well?

Where is the call for a special prosecutor now?

In fact - Congress should step back into this, as clearly the DOJ regs (under which Mueller's office was created) are not reliable. Mueller's appointment was contrary to the regulation, and was comically absurd (thus the need to move Rosenstein to some job that's a better fit for his intellect and judgement).

If the DOJ and FBI are *so* corrupt that they cannot be used for their principal purpose, than something more radical is required. Not sure what.

Until Trump, otherwise, indulging the stupid criminals of the Palestinian gangster clans has been one of the largest scandals of US foreign policy, for decades.

Note that a certain amount of kabuki and two-faced enthusiasm has its place, and played a role, in some of our "support" for the Palestinians. Up to a point. The success of the US, from the 1970s to 1990s, at being the champion of both Israel, AND the Gulf Arab oil states, sufficiently for strategic purposes, was a masterful thing. After Oslo went about as expected, and the first Gulf War, and completely after 9/11, there was no utility to continuing the Palestinian charade.

About 30% will always pull the lever for their party candidate no matter what, and the middle 40% or so will mostly believe what they're told on news media.

I don't know how many of you were online and active during the 2004 election, but I knew a few lefties who were true believers in the whole "Diebold CEO is a Bush fundraiser whole stole the election in Ohio" conspiracy.

In retrospect, it's kinda obvious that all of those same folks would become even more hysterical after Trump's election, and they'd spread delusions to more moderate Democrats via social media.

Russian hacking conspiracies are the same story with a different book cover.

Posted by: Ever at January 24, 2018 02:31 PM (OLS0m)

Trump tweeted that because Flynn plead guilty to lying.

I'm saying that it's definitely possible that Flynn never lied about anything, and that he either misspoke in an interview (with no lawyers present), and that was used against him; OR the FBI agent simply misremembered / lied.

Then Flynn is in a position to spend tens (hundreds?) of thousands of dollars and god knows how many months / years fighting the case, or he pays a fine and is on probation for a short period of time.

The overwhelming majority of people choose the "plead guilty and walk away" route.

Yeah I saw that but... Mattress firm must e some eastern US thing, never heard of them.

The biggest money laundering scoop I ever saw was when World magazine ran an investigative piece on how organized crime was using abortion clinics to launder money. Huge story, but nothing came of it. Was in the 90's.

See, nobody wants to look too closely at abortion clinic finances or ask questions, they are politically protected. Great for money laundering.

How can pro-Israel' leftists live with themselves

Such persons exist?
Posted by: Bertram Cabot, Jr.

Oh hell yeah. They're a significant demographic, specifically in NY and SF. For the most part they are older-generation "limousine liberals" whose policial opinions were ossified back when it was still cool for liberals to like Israel (i.e. pre-1973).

Remember that when Israel was founded it was considered to be practically "socialist" with a lower-case S, what with all the kibbutzes and all the radical Jews settling there. Even before 1948, the whole "Zionist" movement for decades was dominated by leftists. And then from 1948 to about 1967 the whole country was beloved by the American left because it was seen as a successful experiment in socialist ideals.

But the 1967 and (especially) 1973 wars changed all that, when leftist opinion turned against Israel as a nation, since it became quite obvious that israel was no longer an "underdog" but an unapologetic ass-kicking military victor. Then American far-left strategists taught Yasser Arafat to adopt Marxist terminology and frameworks in his PR campaign against Israel, and the Left en masse flipped sides and embraced the new underdog.

"En masse", that is, except for a group of die-hard socialist-zionists in the US who couldn't abandon their ideal of a radical Israel. Those people still exist today as the pro-Israel Left."

And we've seen intel is no different than any other agency. And they're granted exclusions to normal process/oversight because "national security", so they are an even bigger threat. We are living in very interesting times.

Lawyers, man.

They bill by the hour, demand huge "retainers" up front, and spend god knows how many billable hours on flurries of motions and research and whatnot.

And if you're in Flynns position, you want a good defense attorney with experience defending against lying to the FBI type charges.

I wouldn't be surprised to learn he was already 6 figures in to it before he took the plea.

278 But the 1967 and (especially) 1973 wars changed all that, when leftist opinion turned against Israel as a nation, since it became quite obvious that israel was no longer an "underdog" but an unapologetic ass-kicking military victor. Then American far-left strategists taught Yasser Arafat to adopt Marxist terminology and frameworks in his PR campaign against Israel, and the Left en masse flipped sides and embraced the new underdog.

I don't think it was underdog/winner dynamic so much as Israel was friendly with the US, so the USSR curried favor with - and armed - the Arabs.

All the questioning... paperwork... letters going back and forth.... its all billable hours...

Hell... I was part of a court case once in Calif, when I was living in Denver... I had to get a Calif Lawyer, and then fly back for a deposition. Their lawyer then cancelled at the last minute... and rescheduled...

So I would have to fly out again...

Point is though, that Kerry's sums, added up into a total, CLEARLY rise to the level of Hang the Bastard.

This most recent of his offenses, is but the flourish of the signature as he signs his own Hanging Warrant.

Put it on Pay Per View. Proceeds to fund Veteran anti-suicide programs, such as Camp Hope in Houston, TX. One of many excellent, run BY vets, FOR vets programs across the U.S. of A.

Teriyaki Sauce:

Soy Sauce
Brown Sugar
Grated Ginger
Garlic
Rice Wine or Red Vinegar

Also, you can add stuff, like pineapple juice, orange juice, sesame seeds, black pepper

Stronger is better for red meat, milder for seafood, fruity for salmon

More garlic for smoking fish

338 BTW, did you see my picture of Gloria Swanson from this morning? Not so much for her, as for her shoes and stockings:

I love stockings like that. For a while, late 80s or so, it was cool for girls to wear stockings and I loved it. So pretty and sexy.

Not necessarily. Third parties often gain undue influence by propping up a minority government.

Sure, but that's just one of the parties having a faction in it control more than it used to (tea party, radical left, etc).

The real difference is that sometimes, sometimes you get someone really ghastly who becomes popular and gains power in a parliamentary system like Herr Schickelgruber.

Posted by: Christopher R Taylor at January 24, 2018 02:52 PM (39g3+)

339 286 as for flynn and lawyers...the case for perjury is cut and dried. This isn't a corporate merger. So, I guess he's not savy enough to cap his legal fees pretrial.

Honestly, what can the fbi do? re-re-re-re-interview him?

oh, but lawyers are cunning and expensive. right. A murder trial is a hundred grand but talking to the fbi about an alleged perjury charge is a million. not even a trial.
Posted by: zibbly wibbly at January 24, 2018 02:45 PM (V3U1L)

Huh?

The costs vary wildly -- you could easily spend a hundred grand just on expert witnesses for a murder trial if you had the money. I have no idea how much OJ spent at his trial, but I'm sure it was way more than $100,000.

Flynn was probably getting billed somewhere in the $1000/hr range for a really good criminal defense attorney. Just meeting the lawyer and talking about your case cost $1000.

Having the lawyer and an associate review the case, research case law, etc. etc. and you've added another $5,000. Etc. etc.

It's very easy to hit tens of thousands of dollars before ever stepping inside a court room.

Also, these "lying to police" type charges are very complicated -- motions going back and forth and stipulations and whatnot about what is material, whats not, case law on what is considered a "misstatement" verse an "omission" verse a "falsehood" etc.

It's more complicated then you think.

372 Proportional representation parliamentary systems with minimum vote share thresholds, commonly five percent, usually end up with four parties being seated, sometimes five or six.

First past the post parliamentary systems like you see in Canada and the UK are a different beast though.

You'll usually see two major parties swing back and forth in the majority with a third party clinging to relevance on the margins.

And if that third party ever grows significant, then you end up with minority governments in power, or two party collations doomed to fracture within years.

I don't think there's a single lawyer in america who thinks anyone would ever attempt to enforce the Logan Act. There's a reason its been on the books but unenforced for 200+ years.

Could Flynn have read WaPo and thought he was receiving actual legal advice? I don't know, maybe.

But I doubt he would have been worried about it. Common sense should say it's not illegal to talk to someone just because they happen to be an ambassador from another country.

And if he WAS worried about it for whatever reason, then his logical next move would have been to hire an attorney, no? Which we know he didn't do.

405 hmm. a million divided by 1000 is 1000. That's a half year of work for, I guess, the type of attorney who bills 1000 an hour.

it defies at least my imagination that there's some sort path to that number based on cut and dry stuff "we have your interview and the transcript" as if there's some sort of back and forth after that which would be productive. Here's a clue, flynn, after the first $10,000 in legal fees without charges being filed, tell the fbi to fuck off and charge you.

never seen an episode of law and order where the cops/DA keep going over and over the thing. The lawyer's always be like "don't answer that, if you want-charge us, otherwise we're leaving we're done here"

here, flynn was facing "we may either charge you wiht logan act violations or perjury" to which a good lawyer would say "see you in court" not hmmm "let's bill a million dollars negotating this bullshit witchhunt" The cops have to hand over evidence. There's a right to a speedy trial. There's no requirement that suspects conduct discovery for the cops because, you know, fifth amendment.

wow, and I was just going to type 'fine, who cares, it's flynn's life"

At least one of them did and, IIRC, he won.

The Bundy persecution, and it was a persecution, makes me even more livid than usual.

One of the charges was based on the claim that the Bundys were lying when they asked people to come help because they were surrounded by cameras and snipers. The DOJ response to that was that it was ludicrous and a fantasy and the like.

Gee. Hmm. Why did the charges get dismissed with prejudice? Oh, because the DOJ didn't provide the requested information about the cameras and snipers.

It was only by God's Own Hand that situation didn't turn into Waco or Ruby Ridge, even more than it did.

412 400 Could Flynn have read WaPo and thought he was receiving actual legal advice? I don't know, maybe.

But I doubt he would have been worried about it. Common sense should say it's not illegal to talk to someone just because they happen to be an ambassador from another country.

And if he WAS worried about it for whatever reason, then his logical next move would have been to hire an attorney, no? Which we know he didn't do.

*I* never said the million dollar figure, you did.

I said I wouldn't be surprised if he wasn't in to the six figures in billable hours.

I've seen divorce cases wrack up $200,000 in billable hours in a matter of months before the first court appearance. (granted, that's husband and wives attorney fees combined).

Hiring an attorney is MUCH more expensive then you seem to think.

Law and Order is not an accurate representation of how the legal system works, nor does it show the pre-trial motions and negotiations between the defense and prosecution which often times are more important that what is said in the court room in the rare event a case actually goes to trial (the overwhelming majority of cases do not go to trial.)

432 No, you really don't understand how it works.

I understand fine. You misunderstood me, I wasn't being very clear (using short hand, trying not to post a huge wall of text again).

I wasn't saying that literally a faction of one party gained control over that party in a parliamentary system. I was saying that effectively that's what happens.

See, if the Silly Party gets a large minority, and the Staid party has to form a coalition with them to govern, that's the equivalent of, say, the tea party faction gaining power in the Republican Party and forcing them to move to the right.

The same two parties are almost without exception always in power, but they have to work with lesser parties -- factions -- at times to keep that power. Like the GOP has to work with factions in its midst.

Its still, ultimately, 2 parties no matter who wins, its just a matter of the shape of those parties changing sometimes.

437 hmm. a million divided by 1000 is 1000.

I'm one of those political geeks who actually watches the UK and Canadian election returns online. Good fun.

Again, there's a difference between FPTP and PR parliamentary systems, but yeah, most Americans can't be bothered to sort through the differences.

The progressive wet dream seems to be adding preferential (instant run off) voting to FPTP systems and requiring majority winners in every district. I'm not sure how that'd shake out in the long run, but short term, it would likely result in center-left governments in Canada and the UK for the foreseeable future.

From the whistler blower memo I read, it went farther than that -- turns out that the Bundys were 100% correct and that they were surrounded by snipers, that the BLM AND the prosecutor were well aware of that fact, and so instead of disclosing the potentially exculpatory evidence to the defense, they just, you know, destroyed it.

well, hmmmm, sometimes, in really important cases, if you can afford it, you hire more than one lawyer, maybe a team of lawyers, which includes lawyers, paralegal, document production, many, many things which you may not have gleaned from watching television.

Dude, it happens Every. Single. Day.

And, again, you're the one saying a million -- I doubt the number was that high.

But just dealing with a straight forward first time DUI could run you $10,000.

It is not uncommon for criminal cases to run in to the millions, especially if you're hiring expert witnesses, etc.

It's INCREDIBLY expensive to go to trial in this country, which is why it happens so rarely. I think it's something like only 3% of federal criminal cases go to trial. Most people settle (like Flynn did) because unless you're a multi millionaire or willing to roll the dice on a public defender, it's almost impossible to afford adequate defense.

507 From the whistler blower memo I read, it went farther than that -- turns out that the Bundys were 100% correct and that they were surrounded by snipers, that the BLM AND the prosecutor were well aware of that fact, and so instead of disclosing the potentially exculpatory evidence to the defense, they just, you know, destroyed it.
Posted by: Harry Paratestes at January 24, 2018 03:10 PM (F5+ro)

I work (SHUT UP I SOMETIMES WORK AT WORK) for a solo practitioner who is an old fashioned general practice attorney.

A run of the mill custody dispute with a couple of kids, some back and forth on what to do about the house and a bit of arguing about how to split the 401(k)s will run you $10-15,000. And he doesn't bill anywhere near $1,000 an hour.

A commercial landlord commercial tenant dispute over one of the parties violating the lease will run, eh, I'll low ball that at $35,000-$40,000 before anyone sets foot in the courtroom. Three day trial will run you about $8-10k, that's not counting any costs for witnesses.

A dispute between business partners on how to divide up the business when they (read their wives) can't get along? There's a cool $25,000 at least.

That's not total, that's for each party in it by the by.

We're small fry. The big shot commercial litigation firm in town has a $50,000 retainer to even begin to work on a case.

Lawyers are stupid expensive. Stupid expensive.

Corrupt cops can keep you in prison for a while with bogus charges, but they can't do it forever. It always surprises me how few people understand the power of silence during questioning.

I have seen more than once, on the accusation of a major crime, our local police hold some defendant in jail for the full 90 days they're allowed (especially if he's poor and can't make bail) and then, on the 91st day release him with no charges filed because they had no evidence at all that they could put in front of a courtroom. The accused walks away free with no record, no conviction, and no chance of bringing the case back up unless they find something new that they didn't have before.

It happens more than you think.

559 As I said, Flynn was a spook's spook. He knew all the procedures for
tapping foreign actors and he must have know his conversations were
tapped.

Furthermore, he had to know as soon as Strzok walked into his office
why he was there and he should have declined any interview without a
lawyer being present. And on top of all of that, he knew by then that
the FBI had been tapping Trump's campaign for a long time.

The whole thing seems very odd to me.

591 I have seen more than once, on the accusation of a major crime, our local police hold some defendant in jail for the full 90 days they're allowed (especially if he's poor and can't make bail) and then, on the 91st day release him with no charges filed because they had no evidence at all that they could put in front of a courtroom. The accused walks away free with no record, no conviction, and no chance of bringing the case back up unless they find something new that they didn't have before.

It happens more than you think.
Posted by: Tom Servo at January 24, 2018 03:26 PM (k1TUh)

Try seven years in jail before being brought to trial all while having your demand that your right to a speedy trial be respected be cited as reasons for repeated competency checks.

https://finance.yahoo.com/news/second-circuit-details-marijuana-convict-113250948.html

That doesn't begin to detail how Kafkaesque all of that was. Mind you, there were charges pending and this is nigh to the Platonic Ideal of everyone messing up in every way possible but, yeah, this stuff happens on a smaller scale all the time.
