The constitution of the United States is thw document used to establish and codify a system of government for a given people within a given territory. I'm no lawyer but I see the constitution applying to everyone on US soil, whether legal or not. So a foreigner can't be stopped without probable cause, can't be thrown in jail for saying something, etc.
BUT... The constitution doesn't say anything about a foreigner's right to be here. So yes he has constitutional protections, but we can also throw his ass out of the country any time we want. I was one of the ones who dodged the bullet and got to keep my job. But I'm sad to see some friends get laid off, and it's likely the site will close in the next couple of years, so I still should look for work, but at least I can do it on my terms & not be desperate. IANAL but I'd guess that foreigners do not have *any* Constitutional rights, merely rights granted by laws passed by congress that could in theory be revoked. So foreign diplomats, foreign visitors with visas, and illegals must all be treated according to certain laws. But those are subject to change - they can be revoked without a constitutional amendment.

Mansfield not Boston and it really isn't that much further than Jersey. It's gotten way bigger but it's still a pretty cool country outdoor amphitheater that has a big tradition of parking lot parties. Did I mention outdoor summer shows?
