It is lucky, btw that we have such an actively enraged and preemptive judiciary that can take unto itself all of the powers of the other, messy, elected branches of government. They are overworked and need a rest.
Btw - Will Congress begin to realize the ridiculousness of this all this and start with the required work of limiting current circuits and courts to jurisdiction in only local matters in certain areas - so, like the 9th circuit could be given jurisdiction of ONLY Laws and disputes that involve matters local to Los Angeles, SF, Seattle and Portland. All other matters would need to be sent to another circuit, newly created and staffed by Trump appointed justices. Same with district courts The Constitution is clear that ONLY the Supreme Court is required to exist. The other courts are left to the Congress to decide as far as number, make up scope and jurisdiction. See Article III - US Constitution Lastly the Congress could make it a federal felony crime to intentionally and repeatedly interfere with the constitutional rights and powers of Congress such that these judges could be impeached. Courts have zero say over issuance, implementation, or negation of EOs that are constitutional and lawful. Their only (perfunctory) role is to confirm those last two conditions are met. Period. Cases are supposed to be appointed randomly, with an exception for "related cases," which activist judges abuse to grab cases they want to rule on. Standing is getting abused. The plaintiffs here include the likes of the CA University system. On a controversial decision, which a district court judge knows will be appealed, the better practice is to stay the decision pending appeal. Especially when no one is getting deported today. Lower courts should refrain from issuing orders that apply nationwide. SCOTUS Kagan would likely agree that this is getting out-of-hand. The constitution spells it out. The SC is the coequal branch, not the Lowe courts. Congress should pass a law stating that no lower court my stay or otherwise hinder the executive or the legislative branches from doing anything. All the lower court can do is refer a case to the SC. I'm not a lawyer or constitutional expert so I don't know if that's possible, but it should be.

There are Constitutionally designated solutions that don't include going rogue including winning more elections, impeaching bad judges, appealing, etc.. Our system was built on checks and balances specifically because it was anticipated that branches of the government would get out of their lanes from time to time and need to be put back in their place. We may get to the point where we have become an ungovernable country but I don't think we've quite hit that point yet. Step 2) The Chief Justice of the Supreme court requests that the house open impeachment for Judge Alsep for gross negligence of his duties. Step 3) Impeachment. It would be very hard for congress to ignore a direct request from the Chief Justice for impeachment, and after all, this is his branch of government. If Roberts is smart, he would write a legal brief for congress, detailing the extreme lack of care that Aslep is showing for the constitution, and the attempted usurpation of co-equal branch powers. The write-up would be a slam dunk. You have to keep in mine Aslep is not just usurping Trump and congress, he is usurping the supreme court as well. In most other societies, the Judiciary had always served at the pleasure of and under the authority of the King, so this was quite a novel way of doing things. What's really egregious about this decision is that the judge only thought that the threshold to compel the supreme executive power of the united states was to make a case that DACA was in the interest of the government.
No legislator proposes any legislation without asserting the same case. His job is to make sure everybody who could vote on a bill understand how it is in the interest of the country. Still everything that may be argued to be in the interest of the country, is not necessarily so much in the interest of the country that it cannot be turned down. The process for dealing with even a blatantly illegal order by a court is to appeal that ruling to a higher court - that's what appeals are all about. And then to the Supreme Court. The SCOTUS doesn't stand for challenges to its authority, and they won't in this case. But if you lose at the Supreme Court, then the executive can either choose to live with the loss and work slowly to change the membership, or he can call out the tanks and bring on the Civil War. No I'm not. No more than Obama was elevating federal judges when they ruled against him. Did you protest then? This is the Constitutional process. Judges make rulings on executive action and legislative actions. That's how it works. And if the executive branch doesn't agree they appeal. Frankly, I'd like to see a lot less executive actions but I have no problem at all with Trump using one to overturn a previous one I didn't support. I would like to go back to presidents letting Congress do the legislating and not pens and phones. This was a stupid ruling not based on law or even commonsense. News flash, not the first time it's happened and sure as hell won't be the last time. I don't have to agree with every decision or approve of every judge, which I can assure you I don't anymore than you do, to say I would rather work within the process than start having Trump just say "Fuck you, I think you're wrong and I'll do what I want". I was wondering if anyone would get around to arguing that if the legislature and executive can't solve the problem, maybe the judicial branch could try to police itself. I would just add that the 9th Circuit is said to have the highest reversal rate in the Supreme Court, and (if I remember rightly) these reversals are 9-1. The least the Supreme Court could do in some of these cases is add a paragraph to their reversals with general remarks about the quality of the arguments. Something like this: "It has been clear for fifteen years now that Judge A cannot write an opinion coherent enough for the nine of us to comprehend, Judge B's concurrence is frankly Fascist, and Judge C's blatantly falsifies and even reverses the meanings of most of the cases listed in her footnotes. It is long past time all three retired and handed their seats to competent, diligent judges who understand the U.S. Constituion and care more about it than their own petty political prejudices. Their efforts in this case, and many others, are frankly embarrassing. We are ashamed to belong to the same profession." It might help, and couldn't hurt.
