I am not a lawyer, not have I stayed in a Holiday In lately. But as I understand it any evidence that the police gather from an action that is not allowed to be used in court, not any downstream evidence they obtained through that um-permitted action.


It is not a law, nor is it in the Constitution, including the 4th amendment. It is a precedent made up by activist black robes in the courts.

Yeah, what a scam. I have a BIL who bought one of them. Keeps his house at like 60 degrees and huddles in front of the thing. But 5,000 btu per hour in the northeast doesn't cut it. Except in a very, very, very small room.

We rarely get snow here despite having some cold ass weather. The problem is the cold usually comes in with a high so the skies are clear. It takes a special set of circumstances to get snow. We have maybe one snowfall a year here on average. We are supposed to get some rain over Christmas due to a low moving in, but it is going to warm up too.

And you would not want a heat pump in Wisconsin. Better off with an oil fired forced air furnace.

In my sons new house he has an unvented gas fireplace with the phony logs. I'm seeing a lot of that anymore. Dependent on room size up to about 15,000 btu per hour. No chim chimney. No venting required.

Which would seem to indicate that you could just about close off the damper and be safe. Probably want to have a CO detector though. Bi-products of good combustion are CO2 and water. Bi-product of insufficient combustion is CO.

What cha' gonna' do? You gonna' put your freedom, job, and reputation in the hands of Appellate Courts Judges who might decide 4 to 3 and five years later that the stop was unlawful?

In real-life the trial Court judge decided there was too much 'wrong' and not enough 'right' to justify the stop and search. The guns and the recovered money were thrown out. Bad guys walked. Of course if I hadn't stopped they would never have been arrested in the first place.

112 What is interesting is that many lawyers coming out of school in the last 10 years have spent 7 or 8 years in college campus settings where the 1st, 4th, 5th, 6th and 8th amendments are routinely ignored, denied, and refuted.
On the 1st I would bet over half of new lawyers believe there is such a thing as "hate speech" and the "heckler's veto". On the 4th many people have the attitude "if you did nothing wrong, you have nothing to hide". In our current regulatory system everyone is a criminal, they are just looking for a way to catch you. The 5th, 6th, and 8th do not even exist on many college campuses and are routinely abused cities and municipalities.
These people will end up being the DAs and ADAs that will have no problems violating your rights to add another conviction to their record. Mueller, Mueller, Robert Mueller.

Could get into long discussion Re: this. Fourth Amendment prohibits 'unreasonable' searches - not 'imperfect' ones. To my mind when a trial Court, appellate Court votes 2-1, and next appellate votes 3-2 all agreeing search was 'reasonable' then when Supreme Court decides 5-4 it was unreasonable there is something wrong with the definition of 'reasonable'.

"I don't think that word means what you think it means". is my response to the Supreme Court.

There are fairly recent cases wherein 'good faith' of cops is determinative of the issue. Was it reasonable for cop to believe search was valid? I like this standard much better.

This goes to what I've been saying, that the war is cultural, and that culture is something that is learned. A culture is a group of learned emotional reactions to things, words, ideas, people. It is usually learned in childhood by being immersed in the "culture" you are born into.

What the left is doing is working to instill a new culture in young people through the entertainment industry and the education system. Going to school, to college, is to be completely immersed in the Progressive culture. To advance you must at least pay lip-service to the Progressive culture. Doing even that can warp your emotions. You become what you do, say, think, everyday.

Higher degrees are now required to be considered to be hired to run most every organization. If you don't fit in, your life can be "derailed" and you might not even know why or who did it. Best to align yourself completely with them to get somewhere.

Those with grad degrees were by far the most "I'm with her" group in the election. Real world experience after college can change that but only if the job is one with objective standards to meet not the subjective ones where pleasing the (lefty) boss is more important than getting something tangible done.

Justice Marshall in Marbury v Madison stated that it is the province of the Court to declare what the law is.

Marshall was hardly an activist in a modern sense....but he also was a direct inheiritor of the Revolution and certainly had liberty in mind when he declared that bit about what the power of the Court was.

There has to be a method to bring government to heel or there will be tyranny instead of liberty. The Exclusionary Doctrine must survive or there will be no liberty. It has been attacked at every turn but it survives best in the Evidence Rules.

As I study law I am both alarmed and comforted by the reach and the limitation on government.

THIS seizure is about leaking damaging information - not about finding collusion (which there is none). Instead, we'll see leaks of 'kushner said in an email the Paul Ryan is a lying snake and can't be trusted' or blah blah blah.

The goal here is to undermine his ability to work with anyone to get anything done.

Of course, they'll 'stop using them' after being threatened with legal action (our bad, we thought it was OK to get procure them), but they'll have already made copies so they can continue to go through them looking for statements they can use to poison the public, Congress, and the 5th column bureaucracy against him.

When more leaks come out from these illegally procured emails (and they will), Mueller's entire team should be fired the charged with conspiracy against the US President. We'll know they were the source of the leaks, and if none will admit to it, the obvious answer is 'they are all involved'.

Trump should order all of Obamas PTT emails turned over. I'm sure there is a trove of fun statements and plots in those. Make Obama do his the work of fighting this out him or be exposed to the light of day.

They are singling out Christmas to never be mentioned while trying to make a buck off of it. I was at a grocery store yesterday and the cashier asked if I want to make a holiday donation for a food pantry. I asked what holiday? No response.

I agree completely - we forget that the biggest reason the original founders and those who followed were so insistent on putting limitations on government, AND on making the Courts independent of the executive and legislative branches, is that they had lived under a system that didn't have any of that, and they knew first hand how heavy handed and tyrannical a government could become when there were no restrictions on its powers.

I have always maintained that Marbury was a bad decision based on a corrupt judge appointed by Adams to make an all powerful central government though the courts. Jefferson disagreed vehemently with that decision and wanted it reversed but he could never get enough support because the Federalists still wanted the all powerful central government.
Adams could not get it at the Convention so he did an end-run. And BTW, Marbury was a setup case they did before hustling out the back door at midnight.

Yes, but there's no way to make that happen - not in the past, not now. "Fruit of the poisoned tree" and other restrictions on police behavior came about BECAUSE of wide spread corruption among law enforcement in the 20's and 30's. And the problem with corruption on that scale is that you can't ever convict anyone because the prosecutors are in on it, the DA's are in on it, the juries are rigged, etc. A corrupt system is often corrupt all the way through, and it takes a huge political effort to make any changed in one. (example - Chicago is still just as corrupt today as it was when Capone owned the police force and the DA's there)

What Judges came up with to fight this corruption, on their own, with no need for any help from anyone else, is this exclusionary rule. If the cops play dirty, the perp walks. End of story. If even a corrupt system wants to get convictions, then play by the rules, or don't play at all.

Perhaps a more narrow view. If the dossier was used to obtain a FISA warrant, and that FISA warrant resulted in surveillance of the Trump Campaign / Transition, which ultimately resulted in the illegal unmasking of Flynn. Which then initiated FBI interviews where the Comey team determined his misstatements were the result of confusion and declined to indict.

Since in this instance if the FISA warrant was fraudulently obtained, wouldn't all evidence collected under that warrant be Fruit of the poison tree?

My daughters house has one of those. In a room about 400 sq feet. Vents out about five feet from the ground.

While my sons house, with a room with an open area in excess of 700 sq feet is totally unvented.

If I remember my science correctly, when burning natural gas, with insufficient oxygen carbon monoxide is created. Small room, big fire, oxygen gone. Dangerous.

A friend of mine works for a fireplace company (gas inserts, pellet stoves, etc.) and tells me that regulations in many areas do not allow it. He says that they act as heat sinks and remove much more heat from the home than they provide.

We have gas fireplaces and I think they are crap. We just run the furnance.

222 Funny, actually; about the only long-distance travel I've done these last few years is going to the larger hamfests - huge, mostly outdoor flea markets of ham radio & general technology stuff - which necessarily involves carrying mass quantities of cash-in-small-bills. First day of Huntsville or Dayton at 0800 I often have 2 - 3 k distributed around my pockets; by Sunday afternoon I have gas money for the drive home and a car full of weird crap incomprehensible to those Not Of The Body.

.We have one of those in our house. Propane with a 100 gallon tank buried outside. We don't use it because the dogs hate it.

This past summer wasps took over the vent on the outside of the house and I had to call the pest guy because I am allergic to bees. There were over a hundred of them in that vent when I took it apart after he killed them and one huge bloated queen who had been laying eggs like mad.

Hard to do with nat gas, since it is the cleanest burning fuel. Easy way to tell - gas flame should be blue with a yellow tip. Any smoke at all and there's a problem with your combustion. Charcoal and any wood products have a much greater potential for CO production.

Unless your room is hermetically sealed, meaning no air can get in - then you shouldn't be burning anything at all. But hard to find unless you're in a submarine.

235 My fireplace is the old style without additional apparatus, we don't use it often but do in emergencies like no power. If burned all weekend it can keep area of the house comfortable. My sister has the vent and fan system and can heat her house basically just using that.

I have both. On the thermostat there is a cutoff setting. I have mine set to 36 degrees. Over that, the heat pump, under that LP. Maximizes efficiency and keeps the house nice and toasty.

The most comfortable system of all is hot water baseboard. I doubt they even install them in new homes anymore. I figure I have about a thousand feet of copper in this house. Snaking up/down/ across and around every room. Sixty five degrees? Feels like a summer day. No 'wind chill' cooling, because no fans.

But efficiency? Not very.

My first winter here I had cut down a bunch of scrub oaks in the back yard and I bout a load of fire wood and tried using the fireplace with wood. It did take out more heat than it put in. After that I didn't use it unless I lost power until I had the gas logs installed. Now it doesn't get used at all. The damper remains closed and the doors remain closed. It is a custom insert fireplace w/o a fan so it is pretty much worthless.

I wish I had known that when I bought it. I looked at having it torn out an an insert with a fan put in after a couple of years. The carpenter pulled the facing boards off the front and looked at it, then went outside and looked at the chimney and the wall. He said could not pull it out w/o tearing out the outside wall because the house had been built around the POS.

.Yep had the baseboard water pipe heat in our house in CT. 65 year old house and we had leaks nearly every year of the 15 years lived. there. That plus it was an oil fired boiler, we spent about $3,000 for heat every winter.

I have a full basement and one story rambler. So mine is completely accessible. I do have a lower story game room that the tubing is buried in the crete. Radiant is like wiring, should never bury a connection.

I would think code in your area would prevent them from burying a coupling in concrete.



The tube itself is well engineered to survive the concrete, chemically, I think.



I went with radiant in a new family room. It's a nice type of heat, but it take a little while to warm up. If the temps are swinging 30 to 60 over the course of the day in the fall, it can not keep up with the quick swings.

No cooling capabilities as far as I know. Its fancy baseboard hot water type heat.

You don't bury a coupler, just make one continuous run attached to the reinforcement. You have to make an test valve , fill the run with air and check for leaks before they pour. The run still has the air in it when they pour. When they poured mine, I started to get little bubbles rising. I freaked out but the crete guy said it was just coming from other sources and it would stop.It did

Mini-splits. The btu's to cool in this area is a tiny fraction of the btu's required to heat.

313 I put PEX in concrete ... did some solar, was going to supplement with wood. Need to finish that old project now that my 15 year elder care mission is done. Could be a nice hunter's lodge in the woods ... not sure I want to work that hard. lol

I trickle water through now to keep the empty place from freezing winter. At higher flow rates over a few decades, I guess tubing could wear out just from friction. Some sort of glycol probably flows smoothly. idk.

LOL, The ones you install for about 2K to 3K. Sorry would not work with radiate heat on the walls or floorboard. That leaves you with what my parents had in their older house with radiate heat. Window units mounted in a couple of windows on different sides of the house.

I hated that the sister was trying to get back at Beuller throughout the movie but because her shenanigans led to her finding a boyfriend she forgives Beuller and covers for him when finally caught. The audience is supposed to root for Ferris, but I found nothing likable about him. I never want to see that movie again.

I've got one of those in my house. Had a 'vent free' in the old house.

The vented style uses a lower efficiency burner, higher risk of CO that forces the use of the vent. Result is that a lot of that heat goes out with the vented gas.

The case where cops collected licenses a hydroponic store then later ran a test on tea found in the trash leading to a false positive and a SWAT raid comes to mind, The test was known to have a high false positive rate but since it was the test they bought/used it was reasoned the warrant was valid because the officer didn't know any better.
Also SWAT raids in Wisconsin and seizures of personal computers should have tipped you off that loosening definitions in the law will be used as a shortcut of legal process as a means to an end.
Giving the police the "I didn't know" excuse when it is their job to know is a bad idea.

345 I have a 100 year old house with the old radiators. I put a Vermont Castings gas fireplace insert into the original fireplace and it works great. Adjustable flame height and forced fan. Remote control and a temp setting to shut it off. Vents out the original chimney. Not cheap but looks like a "real" fireplace, almost.
