I called these "Resistance" judges lawless. It seems like the Supreme Court has recognized that and stripped them of their power to make further lawless rulings. The language they use in these orders (knocking down both injunctions) is here. What the Court says, basically, is that if the Court of Appeals for each lower court disagrees with the lower court, fine, the Supreme Court's stay of the injunction terminates automatically (as it would be moot-- the Court of Appeals would have voided the injunction). But if the Court of Appeals agrees with the lower court and wants to continue the injunction, then the Supreme Court's cancellation of that injunction remains in effect until the Supreme Court decides the case for itself.

One of the issues here is district courts issuing opinions with immediate nationwide application. It's a tricky legal issue, but if the Circuits won't fix it, I think SCOTUS will, Posted by: Queen Cersei at December 04, 2017 05:56 PM (cAXIk) 38

I called these "Resistance" judges lawless. It seems like the Supreme Court has recognized that and stripped them of their power to make further lawless rulings.
About time. The problem with being selective about laws, like illegal immigration, is that it begins to seep into other areas. A sense of lawlessness arises. Lawlessness becomes the law. Lawlessness becomes virtue. We have seen this taking hold in people's minds and actions for years now. We have seen it with states refusing to help ICE, we have seen it with judges, in schools, with police. And it continues to spread, building up speed. Media, which should be gatekeepers for this stuff, and point out the dangers, is instead gung ho-on bringing it about. Queen Cersei, you and I wish (about ignoring illegitimate court rulings).
Sorry, but Gabe has always seemed utterly in the thrall of the guild's mindset, which is unable to lift its gaze or thinking one micron above whatever appears to be the status quo, to actually apply constitutional reasoning or logic to this topic. So "knock it off" is a dumb, wildly inadequate take on what is a systemic crisis. The district judge in MA who dismissed one of the first-round travel policy lawsuits said it all. Executive was within its authority with the ban. Courts have nothing further to say about it. Everything - everything, including SCOTUS's action posted about here - merely stipulates, continues, and implicitly endorses completely illegitimate court usurpation of clear executive authority, as delegated by Congress. But everybody continue to celebrate SCOTUS saying "we're good with usurping executive authority on national security matters, without a trace of authority to do so, but that's for us, when we get to it". Rhomboid, while I appreciate your issues, we are where we are, and it's not where you want us to be. Objecting to judicial review is so 1804.
The reason Kagan and Breyer are part of the 7 to 2 is that to knock down such a clear exercise of Presidential constitutional authority is to ask for a backlash. Forcing trannies into the military is another. Judicial review isn't all bad. See Youngstown Sheet & Tube Co. v. Sawyer, 343 U.S. 579 (1952), where SCOTUS stopped Truman from seizing all the steel mills. Posted by: Ignoramus at December 04, 2017 06:23 PM (cAXIk) 151

Gumdrop, that's why I've been talking about "lawlessness" here, in its many forms, for several years, as the true and worst crisis facing the country. It didn't start under Obama, of course, but it got much worse. Judicial lawlessness has been creeping, or galloping, by turns, for years and years. Obama added administrative lawlessness (omission, commission, the works).
And as Tom Servo reminds, it's Congress's constitutional duty to oversee the courts. But the sabotage of the constitutional order stretching back to Marbury v. Madison - making the non-accountable branch not equal but superior to the executive - was just a reckless move that took many years to finally blow up the system. Okay. Why can't we have an honest discussion about the following?
If a white judge in the south ruled consistently against minorities, you know there would be inquiries. Now, why is it that in the case of people like Derrick Watson there is no inquiry into his racism? Why is there no inquiry into his racial motivations as there would be if the judge were not hawaiian or black or hispanic? Why does this shitstain favor people who want to "fundamentally change" America, who do not even understand it, and are probably not capable of doing so? It seems obvious to me this asshole is racially motivated and should be called out on those grounds. Posted by: Steve and Cold Bear at December 04, 2017 06:27 PM (/qEW2) 172

Judicial Review is like a filibuster. The courts rule on cases. When they "strike down" a law, they are saying that they rule for the defendant in this case, and if you bring a similar case they will rule for them in that one too. The problem is that if, push comes to shove, they still have to hear the case, and there is a physically limited number of cases they can hear.
So in one sense, it's a bluff. You can accept this, or you can call their bluff and continue to arrest other people for the same reason and force them to work though the appellate process. Make them do a real filibuster and not just threaten one. That's what Lincoln did. Posted by: Pot at December 04, 2017 06:28 PM (60v4h) 176

Ignoramus, they're not "my" issues, they're the country's issues, of course.
And surely you're not thinking I reject all judicial review. Of course not. But since giving final say to the unaccountable branch is an insane thing, certain to eventually result in what we're seeing, judicial review must have its limits. Disregarding the law and constitution, vs. enforcing it, delegitimizes a court. Legislating. Usurping the treaty power. That's the limit. It's been crossed earlier, now it's flouted with contempt. So the endless tea-leaf reading and kremlinogical speculation about Justice This, Justice That, or some made-up "doctrines", while confused for intelligent analysis by the legal guild, are just wheel-spinning that's all besides the point, as the law and the constitution are shredded. You can pick any problem facing the country, and I can say "there we are, fuhgeddaboutit". Not denying the inertia is yuugge on this one, but does happen to be the most consequential challenge. As Gumdrop (and others) have noted here and long before, it's contagious. Trust me, a lawless court or executive pursuing non-authoritarian, non-racist, non-social engineering freak policies would meet instantaneous and 1,000-megaton resistance. There'd be no "there we are" - not for 10 minutes. Posted by: rhomboid at December 04, 2017 06:35 PM (QDnY+) 211

Jane,
Many years ago a roommate showed me how she dealt with this: she raises her voice. Saw it once in a crowd. Loud voice: Why do you have your hand on my purse? I tried it once when a man behaved as you describe on a commuter train. Lots of seats open but he picked the one next to me. Leg touching, arm touching, etc. I channeled my roommate and said in a carrying voice, Are we having a problem here? He moved away so fast. Though I think the camera idea is even better. Posted by: dantesed at December 04, 2017 06:42 PM (88xKn) 242
Rhomboid, think of the problem this way - our system is set up so any two branches can usually nullify the 3rd branch if they support each other. The President has the power to stand up to Congress if he knows that the SCOTUS will have his back - BUT if he doesn't have heavy, overwhelming support in the Congress, the Executive doesn't dare antagonize the SCOTUS, because SCOTUS and Congress acting together can easily destroy any administration.
Trump has far too many enemies in this Congress for him to even think about trying to play games with the SCOTUS. His only chance for any success in the short term, and in the face of all of this "resistance", is to keep at least 5 of the justices strongly sympathetic to his goals. And for all of this crap about the SCOTUS not being a political branch - oh hell, that's just a story for little children, to help them sleep at night. Judicial review is complicated.
Were it not for it, Christian Bakers lose. Bake the cake, or go home. Tom, not really - about Congress, I mean.
You're absolutely right, Trump has an astonishing lack of support in Congress. But part of that is actually due to the fact that Congress is mostly made up of very, very small people. Weak, and timid. Hard to game a hypothetical without specifics, but on a given issue, Trump could absolutely call a lawless judiciary's bluff, and Congress would pose no material problem. Sputtering and b.s., most from the usual suspects. But if it were a legitimately popular move, I'd not be at all worried. Travel policy fiasco was actually tailor-made for this - obviously a sensible/popular policy, flagrantly usurped by the courts, ignoring the law, not enforcing it. As I said before, those so inclined can celebrate all they want about the latest SCOTUS action - being practical, I see a handful of judges and plaintiffs with no conceivable "standing" having usurped US admissions policy, including that exclusively related to national security, with impunity, for nearly a year. Recall the "ban" was actually a temporary review. Seeing this glass as 95% full is pretty silly and superficial. Posted by: rhomboid at December 04, 2017 06:50 PM (QDnY+) 278

OK my only creepy story. 17 year old gangly teen, heading to college. I was alone in Chicago's huge train station, waiting for the train to Kalamazoo (yes, its a real place. So is Walla Walla Washington which I've lived in). For some reason Amtrak went to Kazoo and not Grand Rapids, where I needed to be ultimately, but it had a shuttle.
So I have a 3 hour layover and I got tired of dumping quarters into the Star Trek video game. So I'm wandering around exploring. I looked outside and apparently the train station is in the worst conceivable ghetto part of the city and I rapidly got back inside. Then some dude was following me. Like a bad detective, but he didn't care if I knew. Following me everywhere, getting a little closer. I had a roll of cash in my wallet because I needed it to travel and eat, so I was worried, and at that time I weighed like 120 pounds soaking wet. About 6' tall, just skinny as Manute Bol. I was 2000 miles from home on my own and had no idea what this guy had in mind. After a while I got tired of him and ducked into some tchochkie store and found people to be around and he left me alone. No idea what his plan was, what he wanted. He could have been just friendly but I felt really uncomfortable and nervous anyway. And very alone and vulnerable. Posted by: Christopher R Taylor at December 04, 2017 06:50 PM (39g3+) 280

To peel off a Senator you gotta soak them in turpentine for a while. Or GooGone. Then they come right off. Or so I've heard. Posted by: Hands Solo at December 04, 2017 06:53 PM (EzdLW) 289

Every lawyer knows one thing above all - the System can never be Changed.
Posted by: Tom Servo at December 04, 2017 06:46 PM (k1TUh) I would love if one of you lawyers could answer a question for me. We are going to probably be in a 5 year contract lawsuit. We got the bullshit demand letter. The impetus for the letter instead of talking to us and trying to renegotiate the contract is the guy we have the contract with is 90 and his new crazy girlfriend is 29. We are going to have to have a meeting with both parties attorneys the man, I want to exclude the girl from the meeting. She's not in the contract, has nothing to do with anything. Can we exclude her? We are still in the letter writing stage with our attorney and his attorney. Just as an FYI, in 100 years of farming what is happening to us has never happened in our area. I just passed my husband's office door--office aka Trump-hating cave--and there was a story of Moore and a young girl. Please tell me it was an old one and the media hasn't dug up yet another one.

I tried it once when a man behaved as you describe on a commuter train. Lots of seats open but he picked the one next to me. Leg touching, arm touching, etc. I channeled my roommate and said in a carrying voice, Are we having a problem here?
"What the hell are you doing?" said Loudly, also works. In a store I'd get a male employee to walk me to my car, b/c I'd be afraid of him stalking or getting my plate number. But in an enclosed space, like your example, "wth" works. Especially b/c other people want to see what the hell the guy is doing too. Owen Benjamin has a bit he does on the piano where he has themes that play behind a woman's thoughts and a man's thoughts. The man's one is just goofy but the women's I think has some validity.
Its basically the "something has gone wrong" theme that plays in every soap opera ever. Dunnnnnn https://youtu.be/7T11UpfyFa8?t=1m36s And its just being silly but... I think its got an element of truth. Women are like herbavores, constantly on the lookout for danger and trouble. Trying to be ready to react, before the danger happens. See it coming, hear it coming. Guys don't live like that, we live generally in the moment, responding to what happens. We have the James Bond theme ready on cue: something happens, bam the theme music starts and we act. For women, its a matter of being prepared, even when there's nothing to prepare for. Its why they can be a bit ridiculous with extensive, conspiratorial theories. He's late coming home... DUNNNN the music starts. What is he doing? Maybe he's with another woman. Maybe they're in the office right now? Why isn't he texting? She's preparing herself. A guy has his own problems, guys are thoughtless because: in the moment. Why didn't you remember today was the first month anniversary of our first kiss? Uh, what??a Posted by: Christopher R Taylor at December 04, 2017 06:57 PM (39g3+) 297

You can try to control the rules of engagement, but it may not work. One tack is to have your lawyer imply to the other lawyer that he best represent his real client or he'll get in trouble.

Posted by: CaliGirl at December 04, 2017 06:55 PM (Ri/rl) I don't know what the contract is for but all things being equal it's unlikely you have a legal basis for excluding her if the opposing party wants her there. Maybe there's something in the contract regarding confidentiality of its terms or existence, which golddigger's presence might violate. Once you start getting to meeting time you could have your lawyer communicate to the other that her presence at any meetings is unacceptable, etc. Posted by: Insomniac - Nobody in Particular at December 04, 2017 07:10 PM (NWiLs) 307

Under certain circumstances, communications in furtherance of settlement are considered privileged or at least confidential. It's possible that the presence of a third party who is not necessary to the settlement negotiations could jeopardize that status. The existence, extent and conditions will depend on the law in your jurisdiction. Long story short, you need to talk to your lawyer about this.

Hypothetically, if a judge ordered a defendant to be taken out back and shot would it be entertained with the same level of professional deference as the Hawaii judge's actions?
Surely a profession which earns its livelihood debating and documenting how to count angels on the head of a pin would have a contingency plan for such an event. Posted by: Burnt Toast at December 04, 2017 07:49 PM (IWbvi) 320
If a Hawaiian (or other) judge decides, screw it, I'm ruling in defiance of this ruling, can they be arrested? Or is that simply grounds for immediate impeachment by congress? I certainly think it would be grounds for that.
Toss one of these judges to the curb, and watch the rest immediately fall in line. Posted by: Dean Wormer at December 04, 2017 07:51 PM (fftfA) 321
