Of Course: Judge Decides She's Commander in Chief and Orders Military to Continue Recruiting Transgenders, Because We're Now In a Lawless War of All Against All

It seems that judges should have some regard for the constitutional scheme of separation of powers, but apparently Social Justice imperatives trump any notion of democracy and lawful order.

The military must begin accepting transgender recruits Jan. 1 despite a ban ordered by President Trump this year, according to a D.C. district court judge.

Judge Colleen Kollar-Kotelly had already granted a preliminary injunction in the Doe v. Trump lawsuit filed by a group of transgender troops. She clarified this week that her order also blocks Defense Secretary Jim Mattis from delaying the recruiting.

Mattis had planned to begin accepting transgender recruits on the first of the year before Trump tweeted in July that they would not be allowed to serve in the military in any capacity. The president later followed up with an order telling the Pentagon to abandon the plan, which got underway during the previous administration.

"Secretary Mattis is a defendant in this case, he is directly bound by the injunction and he cannot change the policy that existed before President Trump issued his order," the judge said.

In other words, Obama's executive orders as president are still in force because this judge likes Obama better and elections don't matter.

I honestly don't see how the United States remains a coherent unified nation.

Yes, but it takes 2/3 vote of congress. and that will never happen and scrunts like this know that. There has only been one judge who has actually been removed from office by congress. And he was caught red handed in a bribery scheme and sent to jail. He is now an elected rep in FL even though he has been convicted of a felony.

Understand that your average leftist judge really believes that the law is what they say it is. They really believe they, as judges, exist to get the outcomes they desire. That is their function and prerogative as judge.

.Unless they somehow get into Combat real quick, the VA will not have anything to do with them if they get an Entry Level Separation (ELS) which happens with most mentally unstable people. I was kicking out 2-3 dozen Recruits a week when I was assigned to RTC Great Lakes on ELS's in the 1980s and the Navy isn't running anywhere near the numbers they were when I was stationed there.

Heck I was running about that number of Sub School washouts for drugs or mental at Groton CT in 1995-2012. These people get weeded out way before they get to the Fleet in almost all cases. Granted some sneak past, but not many and most of the ones who do manage to sneak past usually get dumped before they are able to reenlist.

I think everyone needs to understand that at most in the entire Military contrary to what the msm and liberals would have us believe we are talking about less than a couple of dozen people out of 2 million member Military.

This is all a result of Congress deciding post WWII that it was going to cede out its authority to administrative agencies and the Court.

Nearly, though not all, of the mischief that's occurred over the past 70 odd years is a result of Congress saying nah brah to exercising its authority.

Congress has control of the courts under Article III but refuses to exercise it. The courts presume they are are more than merely another co-equal branch because the branch charged with reining in the courts refuses to do so because *hand wring* it's not my fault, the court made me do it and you believe in the rule of law, right? *hand wring*

Same thing with regulations though this is a bad example since this is a legitimate exercise of Executive power. But let's swerve over to Net Neutrality. All of this insanity right now is over regulations, not any kind of legislative action.

This craven refusal by Congress to protect vigorously its powers is, in my opinion, the key factor in why we are in the mess we are in politically at this moment.

In the travel cases, it was pretty clear the courts were just usurping executive (AND legislative) authority. In fact, they apparently have succeeded in doing so. The administration has been arguing with the courts in the completely lawless baseless terms the courts have invented for the case - about whether someone seeking admission has "ties to the country" etc. Ridiculous. The president's delegated authority in the matter is clear, and encompasses everything done in his initial EO. Not even arguable.


It's THAT case where the president arguably violated his oath by complying with the court. This case remains murkier to me.

As you can imagine , not too many plumbers working that day. Finally got one of the National over priced outfits to send a plumber. That is when I met Daisy. You'll see some skirmishing over a few border regions coveted by both sides; some of these could even turn into low-level conflicts that drag on for centuries. I imagine the status of Chicago would be one of the biggest sticking points, as it's one of the crown jewels of blue America,
but it's stuck in the middle of an ocean of red. But the broad outlines of the eventual division seem pretty clear. The only real question is how peaceful the settlement will be.

This allows them to paint anyone who opposes them as a radical rightwinger, as if they were the ones trying to force some unprecedented, disruptive change on everyone.
