Judge Re-Instates Group Defamation Lawsuit by UVA Fraternity Against Susan Erdeley and Rolling Stone for Fabricated Rape Story

A trial judge dismissed the suit, finding the allegations could not support a "group defamation" finding. Group defamation suits are a bit tricky: You're not alleging that someone said you, personally, committed a heinous act, but that a "small" (that's the legal requirement) group of people committed the heinous act -- which group includes you, so you may be subject to a diminished reputation due to the smearing of the group. If the group is smeared, then you, as a member of the group, are likely to have a damaged reputation.

But it's a balancing act of deciding how "small" the group has to be in order to say that smearing that group smears an individual (unnamed) member of it.

The trial court judge dismissed the fraternity student's individual defamation claims, and also their "small group" defamation claims.

An appeals court has reversed that ruling and re-instated the small group defamation suit, as well as two (of the three) individual defamation suits: So the suit will now proceed, and, if the past is prologue, the rest of the media will duly ignore.

The one thing Erdeley won on was the claim that remarks she made in an NPR podcast were defamatory. But the court reinstated the defamation suit as regards her Rolling Stone article.



The ruling is here.

The small group defamation charges, the appellate court found, should stand because it is very unlikely that a gang rape could occur in a fraternity house without the other brothers knowing. Therefore, even if Erdeley wasn't naming them as perpetrators of the rape, her article sure suggests that the other brothers are somehow guilty in it, and tainted by it, because -- and this is just common sense -- if there was a gang rape, they must have known; and as they never reported such a gang rape, they must have chosen to actively conceal a heinous crime.

The court wasn't bothered by the size of the "small group." Usually, a small group is 25 members or fewer; but New York (the state the lawsuit was filed in) casts no firm upper bound on the number. That the fraternity had 53 members is no bar to suit for small group defamation, the appellate court found. (Actually, the trial court found that too, but the appellate court affirms.)

Furthermore, the appellate court found that Erdeley/Rolling Stone had strongly implied in the article that a gang rape was a common initiation ritual at the fraternity -- which would obviously implicate all members.

Consider first the description of Jackie’s purported rape.  Not only did nine men associated with the fraternity participate in the alleged offense, but several made comments -- "Don't you want to be a brother" and "We all had to do it, so you do, too" -- implying the event was part of an initiation ritual.   

Other allegations supported that implication. For example, the Article stated that two other female students reported to Jackie that they had been gang‐raped at the fraternity, suggesting that gang rapes regularly occurred at Phi Kappa Psi. Moreover, the Article described a decades‐long “trail” of sexual violence leading back to the fraternity, including a gang rape committed there in 1984.  Connecting the dots, a reader could plausibly conclude that Phi Kappa Psi had a long tradition of requiring pledges to participate in gang rapes as a condition of membership.

Indeed -- that is precisely what I concluded when I first skimmed the story, and was more naive about the media straight-up inventing #FakeNews.

The court also reinstated two individual defamation cases. One man claimed individual defamation on the grounds that he occupied the only room in the frat that corresponded to the description that Jackie Coakley provided, and ergo, he was individually defamed, as most people would know (or could easily find out) the alleged "rape room" was his. Another man's claim was reinstated because Jackie Coakeley claimed one of the rapists was a lifeguard at the school's pool; the man suing wasn't a lifeguard, but was known to frequently use the pool, and therefore it is plausible (if not exactly a slam-dunk) that his participation in the non-rape was strongly implied by the article.

The New York Times had an interesting (as usual) way to describe Jackie Coakley's attempt to pity-pressure a boy into liking her by fabricating a group rape: They claimed that her rape story was merely "unproven:"


Well, the appellate court here is a bit more firm on the question of whether this was merely an "unproven" gang rape or a fabricated gang rape. They say, as a legal matter, it's the latter:



I got all of this from KC Johnson's timeline -- not seeing much about it in the media. Go figure.

He cites another interesting story the media isn't much interested in -- the public overwhelmingly agrees with Molly DeVos' framing of the issue -- respecting complaining witnesses, but also respecting due process rights of the accused -- in Title IX college rape court cases.

I will say that the trial court's ruling wasn't that far out of bounds. As ace noted, group defamation is tricky. That being said, of course I think the appellate court got it right and not merely because I like the outcome.

This was an outrageous case and responsibility needs to be forced on those unwilling to accept it and I use that phrasing intentionally.

I think everyone who says that Survivors Must Be Believed!!!111!!! should be asked a very simple question. Does Haven Monahan exist? Yes or no. I don't mean as a symbol. I mean is there an actual person named Haven Monahan who existed and who attended UVA? Yes or no.

It's not the size of the group that should make the difference, it's the severity of the false allegations. Our judiciary always seems to have problems with simple concepts like this. It reminds me of the "cruel and unusual punishment" clause and how the courts have totally perverted that. Punishment is only cruel or unusual with respect to the crime. For certain crimes, there is no punishment that is (relatively) cruel or unusual. Of course, our courts are too intentionally retarded to see that.

False accusations of rape are pretty much among the most egregious in our society. Hah-vahd would never hire someone who was convicted of rape ... but they have no problem hiring someone who is convicted of espionage/treason.

I'm glad to see that a court has put a little bit of reason back into the system, here.

You don't sue people who are judgment proof. As I tell people, we can get you a judgment but what I think you want is money and that is not the same thing.

There is a growing trend by those falsely accused in the Title IX kangaroo courts to name the accuser as well and I am all for that.

A woman lied to a reporter, who then did not due even basic journalism to check out the story. The lie implicated that a group of 53 people were rapists. You know those dudes who are deadbeat dads and/or wife beaters?

Worst of the worst, right? The law should show no mercy to these guys.

I know guys who paid thousands and thousands of dollars to support their kids over the years, only to have the state come along decades later and give them a bill for tens of thousands of dollars in back child support. Not just a bill, but will start raiding their bank accounts. Because they can.

I know other guys who have restraining orders, and sometimes felony convictions for domestic violence, and I swear they never laid a hand (or anything else) on their partners. The law doesn't care. Especially if she shows up at family court with her lawyer, and the dude either doesn't show up, or thinks the truth will be enough.

Publisher's Clearing House did something similar-- some magazines would *lose money* on the PCH-offer subscriptions, but when they stopped partnering (to, you know, stop bleeding cash), their numbers went down but profitability went up.

This is all from memory from the mid or late 90's IIRC, so I don't know how accurate it is now, but at the time, I thought it was interesting.

There's also the fact that judgments can last quite a long time. Plenty of time for a currently judgment-proof defendant to, say, win the lottery or inherit your judgment.

As to the "rape rape" issue there is an enormous, real issue.
It goes by many names, but the hard left is always engaged in a form of "concept creep" whereby terms such as "racist" (that originally, correctly referred to heinous acts of racial slavery, segregation, burning crosses on lawns, etc. to mean any slight, real or imagined, that might conceivably cause someone "offense" about issues of race. And so, they seek to apply the social oppobrium of the most extreme forms of "racism" to all kinds of innocent behavior, or behavior or thoughts that should rightfully fall in the zone of private thoughts, assumptions, etc that should not be matters of anyone else's "concern."

So with "campus rape." The game they play is to first be "scientific" and create a "neutral catagory" of acts that encompasses what everyone thinks of as rape, but is actually much larger and more amorphous, e.g. "sexual assault." Then they push "the definition" of "sexual assault" to include an unwanted compliment, or two kids having sex while one or both has been drinking. And so a huge swath of "gray" human behavior becomes "sexual assault" which is then over reported and conflated with "rape" so you get ridiculous statistics about 25% of college women having been "sexually assaulted" etc.

Then, when reported, it becomes "25% are raped" and anyone who dares to qualify becomes either "pro rape" or is ridiculed for talking about whether something is "rape rape."

I would say "Wednesday" or "this Wednesday" if I meant this week. I would say "next Wednesday" if I meant the Wednesday 10 days away, but I would probably say "Wednesday of next week" just to be clear.

But I know people who would say "next Wednesday" and mean the next Wednesday that comes up, like in 3 days. That's why I always clarify.

Plus.... I was able to locate 9mm barrels for mine and I honed out a replacement 7.62 barrel bushing to work with the nine so I can shoot 9mm out of mine.

This is a good point. Although they did have some good ideas. Their calendar makes more sense, I think. And they came up with a decimal clock as well but I don't think that works. 12 is best for time, because it splits up evenly so many ways.

That's the issue, it would be brutal to change over, relearn all that. We'd have to have both side by side for a couple generations and slide over to the new way over time. But in the 1970s when they were starting to teach metric, they suddenly just gave up on it. It could have been all but done by now, but it was abandoned and I'm not sure why.

Would have made trade a lot cheaper between countries, that's for sure.

To someone who grew up that way, sure. But to someone who grew up metric, a centimeter is part of their life and they can easily estimate it, along with a decimeter or 30 cm. Its just a matter of familiarity, not one being superior to the other.

Because as much as heads of industry were okay with it in theory, industry in practice said "go fuck yourself". Fastener sizing based on reduced fractional precision, sheet goods based on sizes which *just work better*, and so on - so systemic to American manufacture and lesser fields such as building that to try to crowbar through metricization by force only could go so far.

My dad, in working with a Korean carpenter, converted him to Imperial for construction purposes - because fractions are good and 4x8 sheet sizing is better. Human units.

I disagree. Mainly because, even nearly two centuries on, a centimeter is so tiny compared to a meter that things I deal with *professionally* from people in metric-dominant societies are routinely called out in irregular ways. Meters are listed to either one or two decimal points on whim - in practice - and rarely hit suitable precision. Decimeters are too large for precision and too small for large distances, so are uniformly rejected, and centimeters are so small that the temptation seems to arise to use them with decimal precision and get lost in the weeds.

Bottom line, even division of ten is not ideal for measurement on the human scale.

Once upon a time, even the possibility of gay marriage was derided as a straw man of The Right, allegedly being used for the purpose of actually opposing tolerance of gays. Now, those who voted against Prop 8 in California can be doxxed out of their jobs.

So yeah its great that public opinion has not yet been intimidated into conformity on the specific issue of due process for campus sexual assault, but this doesn't mean that Immutable Truths will win out, only that we have some viable fronts left in the culture war.
