Of Course: Hawaiian Judge Claims Authority To Rewrite Travel Ban, Again

The law is whatever a Hillary Voter says it is.

Hawaii judge late Thursday ordered a nationwide loosening of President Donald Trump’s temporary ban on U.S. entry for some travelers from six Muslim-majority countries, ruling the administration’s strict approach contradicted a recent Supreme Court ruling.

The decision is a fresh legal blow for the president just two weeks after a Supreme Court ruling allowed the administration to implement its travel ban against refugees and foreign nationals from six countries who have no connection to the U.S.

The justices said Mr. Trump’s administration couldn’t enforce the ban against people with bona fide relationships to people or organizations in the U.S. Days after, the Trump administration adopted a narrow view of what relationships counted for an exemption from the ban.

Now, after being told by the Supreme Court that the President can issue Executive Orders and that Trump's order passed constitutional muster on all but two points, the judge decides that the Supreme Court doesn't mean what it said.

This judge appears to understand neither the law nor the Constitution. In which case, he should be doing something else for a living than being a Federal judge.

There shouldn't be any need to appeal, since its already on the docket.

The administration has grounds to say they're following the decision the court issued, since the court left the ambiguity to be interpreted.

In the Book of Mormon they describe a system with a sort of pyramid of Judges (not too different, we have that now), but here's the interesting part. If a ruling came down at level N, a certain number of Judges at level N-1 could group together and overturn that ruling. I don't know if this is common practice in other countries, or whether there are known bad side effects, but it sounds like a hell of a lot better than our current "eight robed masters are kings of the US and they cannot be overruled".

But I guess nobody told this Hawaii Judge we don't actually let this happen here, and certainly not by a single person.

Hold that the lower court cannot amend a superior court's decision, and say that you will follow the decision as written. By their own interpretation, of course, and if SCOTUS wants to clarify it, they can do so in October.

No sign of anyone in a position to make a difference is even interested in this. And almost all judicial types are blind to it all, and cannot think beyond brain-dead mechanics and process. Constitution is dead, and nobody cares or understands.

113 I do not think this ruling is a blow to the President's agenda or reputation. It is a blow to the reputation and the legitimacy of the Federal Court System.

The Administration should immediately appeal this ruling. Depending on whether they want to humiliate the 9th Circus too, or just stomp this asshole, they should demand an emergency stay at either the 9th, or SCOTUS.

Actually they're not blind to it, and they understand completely what they're doing. A large number of District Courts, the 9th Circuit, and the DC Circuit are now fully operational and empowered arms of the Left Wing of the Democrat Party, and their purpose is now SOLELY to see that party gain and hold power, at all costs.

The situation is much worse than you thought. When you hear talk that a coup is being attempted, that is an accurate description.

For now, understand what a long game this is. Understand that Trump's first 2 years is all going to be spent just fighting lawsuits and judges and getting people appointed, and not much more is going to happen than that. The rot is too deep, the deep state is too entrenched, and the current Congress isn't capable of it. We need another big election in 2018 to knock some more of the current inhabitants out and put a scare into the rest of them. (We also need to replace Kennedy, which now won't happen til next year, probably.)

This is the Battle of the Bulge, and we're under siege. It's going to take everything we got just to hang on til hopefully, some relief can come in 2018.
