Government Official 'Infuriated' That Citizens Have Rights, Too

I can't believe this happened in Texas. But, on the other hand, Dallas.

This is precisely the sort of arrogant pig that gives government service a bad name: "What!? We have to obey the law and stuff?"

This video needs to go viral on the outside chance that she'll get unelected next time around.

Kurt Schlichter's latest column is comedy gold. He describes a CNN staff meeting led by Jeff Zucker:

Anyway, starting now, we’re instituting new policies for handling Russia stories. Stop groaning! This important! From now on, we’re going to need your Russia stories to all have an element of truth.”

The room erupted into chaos.

“What the hell?” screeched Wolf Blitzer. “Preposterous!”

“Never!” snorted Christiane Amanpour, who had been annoying Jake Tapper because her enormous pink gyno hat was blocking his view.

“Look, I know this represents a sea change in how CNN operates, but there’s a lot of heat on us right now,” said Zucker. “Personally, I’m still heartbroken that we were unable to go forward with our plans for CNN Kidz Newz Nite With Kathy Griffin.”

“Kathy is a saint and she was robbed!” yelled Don Lemon, who staggered up the aisle, pausing to “accidentally” spill his fresh cosmo on Jake Tapper.

“Hey!” shouted Tapper. “That suit cost more than your pec implants!”

12 I have a friend whose family bought land all over Denver, the front range and even some in other states many, many years ago. Asked her what was most challenging, as she has both commercial buildings, parking lots, and residences on their properties. While they deal with a lot of hassles, such as tenants fleeing without paying rent, she said by far the worst was eminent domain. Dealing with the city/state who want to take her property is far worse than any misbehaving leasees. They just take and take and take.

Don't know diddly about the issue she's freaking about, but dollars to donuts it's about forcibly taking property from one rich person who isn't in the City Council's good graces, and using it to hugely benefit another rich person who just so happens to be friendly with the City Council.

The thing is, she makes the point that sometimes its reasonable, and sometimes it is not. And she even seems to be arguing that the state uses eminent domain to take lands that they should not -- she specifically says "I know that sometimes" its necessary but then that means that it isn't always. And her argument at no point is "this has to be done and is right" but simply "he's rich enough to fight and made me look bad"

But land isn't "taken" outright.
Before eminent domain can be used anywhere the particular landowner will have had months of what the court will review as good faith negotiations and usually has had an offer that has increased in value over and over. Once the final offer has been made, and if rejected, compensation returns to the first offer amount and it all goes to court.

99% of the time a city water line is a just a permanent easement, not an acquisition, and it's not a big deal. They bury it and move on.
Yes, they can, do, and will condemn for a utility easement. But only AFTER you've turned down what is probably quite a bit more than the properties true sale value.

And other cities aren't much better - I can never forgive Arlington for getting so excited about Jerry Jones wanting to build JerryWorld there, that they didn't just give him a huge pile of cash and tax incentives to do it. The City of Arlington also used Eminent Domain to wipe out an entire subdivision of working class homes, owned by a lot of ordinary people who didn't want to sell. just so Jerry could have bigger parking lots.

Your experiences or information differs vastly from what I've seen and read about. You're usually offered a fraction of what the market value of your property would be. They tax you at the maximum possible theoretical value of your home, but buy it at the minimum possible theoretical value.

The initial plan to take the land comes from some government entity.

The court consists of government employees who don't give a shit about the peasantry.

The assessments and offers are made by government employees.

And the sheriffs/cops who show up in the dead of night and who don't like being photographed evicting property owners are also government employees.
If you're fortunate, no family members or pets are shot.

That's not how it works for connected people. They make sure they own the needed land so that they can maximize the sale price. It helps to be working with the government people so they negotiate a good price (IIRC, this is how Harry Reid made so much money - always partial owner of valuable NV property).

Here in CO the land upon which DIA was built was owned by - get this - a yuuge CO lobbyist. He was paid very well for the land even though some parts of it are not fit to be built on (cracked runways from the get-go). But he made money on the DIA sale and probably adjacent commercial properties (hotels, etc.), too.

Some asshole in the Delaware legislature was heavily involved in the planned route for the new 'relief route' (rt 1) running North to south.

he promptly bought a piece of land that he KNEW was in the proposed path, and managed to get permits and a house built on that parcel of land.

he then profited from eminent domain. From them buying and taking the land and the state having to demolish the now improved property (at extra cost to the state).

129 In my town, some years ago, a land developer wanted to build a Wal Mart on his property, that he was developing as a strip market center.
The city said, "no", as they didn't want a Wal Mart there (and Kroger, which was on the opposing corner, didn't want a WalMart there either!), because it wasn't aesthetically appealing. Well, he proposed a series of architectural plans to satisfy the city's aesthetics, and the answer was still no. Meanwhile, the city built a road that was going to access the strip center on the south side of the property, and also some other commercial land. But since the city can't read a map, they actually built the road on the developer's land.
He offered to give them the land (valued at $130K) if they would let him build the Wal Mart.
No.
So they fought this up through the courts for several years, and the city kept losing. Next time, they were going to win, we were told.
The city blew about $400K in legal fees, losing. The primary city council member leading this fight got voted out of office.
But finally, the developer had given up, and built a Giant Eagle supermarket on the site, instead of a Wal Mart.

And then, he also sold his house and land in the city, which was worth well north of 1 million dollars, to the Seventh Day Adventists to convert his mansion to a chapel, and built a church school, which made this property, the most valuable private property in the town, tax exempt. Heh.

And you know, a few years later, they let somebody build a Wal Mart in another shopping center in town.

Our good friend, former Molester Speaker of the House, Denny Hastert. Lived in Yorkville, IL his whole life. Suddenly sells all Yorkville property to buy 700 acres of farmland in nearby rural Plano, IL. Why would he do this? Welllllll..... it just so happens that this little farm is smack-dab in the middle of the proposed right-of-way for the Prairie Parkway, a six-lane bypass around Chicago connecting I-80 to I-90.

It's a damn shame the economy collapsed and now he's stuck with a farm that is only worth $12,000/acre. I wish I had his bad luck. But nothing else.

179 In this state, you can own the tidelands. Several years ago, a judge bought up the local tidelands which were for sale because the taxes hadn't been paid. He gave them to the county. During our battle with DNR, they threatened to drag the county into OUR lawsuit, if they didn't give those tidelands to DNR. So they did, after lying to us about letting us know when they would have the hearing on it. AND DNR did not have to follow the law that they needed an environmental study before they could accept the gift of property.

190 I read the article and am pretty familiar with the article. The case was about a very large water supply line (84", or 7 feet around) which is to run from Lake Palestine in East Texas over to Lake Benbrook, on the outskirts of Fort Worth. City of Dallas is invested in the regional authority seeking to build this line.

The biggest reason that the City had to give in and settle is that this land wasn't inside city limits, it was about an easement across a big stretch of ranch land a couple counties away, near Athens, Texas, and since it wasn't developed they were trying to get away without giving him very much for it. That's why he fought, and yeah, with the size of the easement they were looking for, the amount in dispute was certainly well over a million dollars.

They even wanted to run the pipeline through a family burial site located on his property!

Long before the riots of 1969, Newark decided it needed to build public housing in about 1950-51, so it literally destroyed vibrant neighborhoods where families had nice houses, large properties and most had some kind of thriving business on same property.

The city has never recovered and sadly those who lived through it ( The Greatest Generation) are all dying off so the entire episode will soon fade down the memory hole.

Just going by the video, I'm not so sure the woman is wrong. Most water pipes are buried, and society does need water pipes. Now, maybe the city was heavy handed in this instance, but maybe not. I would be interested in reading about what actually happened, but if all the city wanted to do was bury a pipe through his property, they may have been entirely reasonable.

And now the next one will have even fewer seats overall and, I think, less outfield.

The purpose of the new park is to transfer by force tax monies from little people to new, rich people who now own the team. Every ownership group wants its handout at some point while the asset is held. Arlington will need to pony up about half a billion $US, an absurd amount.

Honestly, I am shocked that it's still standing.

(The worst entities in America about the 20 Year Rule are school districts. In my old neighborhood I've seen entire schools torn down and rebuilt for no other reason than "they are too old". The buildings torn down were perfectly fine and were built in the 1960s.)

If I'm reading that right, the government wanted to place the pipe above ground through his property. For some reason, the property owner didn't want a 7 foot pipe bisecting his property.

Just to be clear to people who think "eminent domain" is a dirty word, Eminent Domain is authorized by the constitution, and is used every day in every city in every State where any kind of public construction projects are going on. So yeah, you will not find a major (or even minor) real estate developer anywhere in this Country who hasn't used it.

BUT - it is supposed to be kept in check and used reasonably, and our representatives are supposed to ensure that it isn't used heavy handedly. That's the issue that is on point in these cases.

Pretty much what is happening in our little burg. City denies zoning permission to put a bar (IIRC) in the barrio. The mayor - the asshole who's been putting in bike lanes and roundabouts, because they have them in Europe, doncha know? - petitions the council for a zoning change down the street so he can build a distillery there on the property he owns. Sails through.

Meanwhile, he's subtly trying to kick out the Mexicans from the barrio, where they've lived for many generations, so that he can put up high rise apartments along the beach for his chi-chi liberal friends, and make a killing because ... he owns much of that property.

Grrrrr.

226 (The worst entities in America about the 20 Year Rule are school districts. In my old neighborhood I've seen entire schools torn down and rebuilt for no other reason than "they are too old". The buildings torn down were perfectly fine and were built in the 1960s.)

Oh well, I think the good still outweighs the bad.

Real estate developers all probably have a soft spot for this, but I bet Trump is WAY better on issues like tort reform and environmental nonsense being in the industry he is.

I'm far on the side of property holders in these cases, but eminent domain is in the Constitution and is something people get paid for and can legally address their issues.

Bottom line, these sorts of things are like #300 on my list for Presidents to address.

232 And just so 217 doesn't go without rebuttal: you are wrong. It was not an old woman's house, other than it was her rental property. Trump offered her more than fair price and she refused. It went to court and Trump lost. She wound up taking a huge loss when she sold the property, far less than Trump offered her.

Varies widely even in places where it should be exactly the same.

Over paying and under paying is the norm. Exactly right would only happen if Andy Taylor sold some property to the City of Mayberry.

Absolutely, esp when the 'taking' is an onerous easement. My FIL was subject to one for a water line to no where on his rural property that basically made his house unsellable - but he could live in it. He fought it for years. And, he WAS a DNR employee and had the studies that said it was not needed. Those studies were called out in internal memos as a reason not to pay even the usual reduced rate, rather then the obvious solution of not doing anything.

In the end, he killed himself sitting at the site. That was a decade ago, they still haven't even started work.

The just compensation is usually the sticking point. Cities/Counties/States/Feds like to lowball as much as possible and their lawyers use weaselly terms like "real value" to avoid paying anything close to market value.

What we really need to see is a precedent that the government must always pay greater than market rates. That's the only way that it will ever be applied with care and respect to the landowners. Furthermore, it would encourage buying properties for public use at market rates when they are made available. It would substantially reduce the incentive for injustices like Kelo as well, since the private developers could acquire the property cheaper than what the government would have to pay for its acquisition.

If the easement bisects his land and is required to be fenced off, that should be a huge issue for the landowner if it's a cattle operation.
