I have a friend whose family bought land all over Denver, the front range and even some in other states many, many years ago. Asked her what was most challenging, as she has both commercial buildings, parking lots, and residences on their properties. While they deal with a lot of hassles, such as tenants fleeing without paying rent, she said by far the worst was eminent domain. Dealing with the city/state who want to take her property is far worse than any misbehaving leasees. They just take and take and take.

And she even seems to be arguing that the state uses eminent domain to take lands that they should not -- she specifically says "I know that sometimes" its necessary but then that means that it isn't always. And her argument at no point is "this has to be done and is right" but simply "he's rich enough to fight and made me look bad"

Once the final offer has been made, and if rejected, compensation returns to the first offer amount and it all goes to court.

The City of Arlington also used Eminent Domain to wipe out an entire subdivision of working class homes, owned by a lot of ordinary people who didn't want to sell. just so Jerry could have bigger parking lots.

I admit I do not know this case, but I will look for it.

Once the final offer has been made, and if rejected, compensation returns to the first offer amount and it all goes to court.
The initial plan to take the land comes from some government entity.
The court consists of government employees who don't give a shit about the peasantry.
The assessments and offers are made by government employees.
And the sheriffs/cops who show up in the dead of night and who don't like being photographed evicting property owners are also government employees.
If you're fortunate, no family members or pets are shot.

Even if this "Monty" guy is awful, that doesn't make what she's saying right or defensible. She's not arguing that he's being unreasonable. She's arguing that he's wrong for not knuckling under like everyone else.

he promptly bought a piece of land that he KNEW was in the proposed path, and managed to get permits and a house built on that parcel of land.
he then profited from eminent domain. From them buying and taking the land and the state having to demolish the now improved property (at extra cost to the state).

In my town, some years ago, a land developer wanted to build a Wal Mart on his property, that he was developing as a strip market center.
The city said, "no", as they didn't want a Wal Mart there (and Kroger, which was on the opposing corner, didn't want a WalMart there either!), because it wasn't aesthetically appealing. Well, he proposed a series of architectural plans to satisfy the city's aesthetics, and the answer was still no. Meanwhile, the city built a road that was going to access the strip center on the south side of the property, and also some other commercial land. But since the city can't read a map, they actually built the road on the developer's land.
He offered to give them the land (valued at $130K) if they would let him build the Wal Mart.
No.
So they fought this up through the courts for several years, and the city kept losing. Next time, they were going to win, we were told.
The city blew about $400K in legal fees, losing. The primary city council member leading this fight got voted out of office.
But finally, the developer had given up, and built a Giant Eagle supermarket on the site, instead of a Wal Mart.

Yeah. Should only be one trip. Just replacing the suction cup tile lifters since the DEP brand Home Depot sells seems to be one use only. Broke a box of tiles (7 - one at a time over the course of the morning) by lifting them and it not holding the whole time. Threw it away. Lack of trust.

You would be amazed by the number of people who get elected to local office and then discover that their authority is actually rather limited. For instance, in Michigan, schools are not under local building and zoning codes, they are under state statute, the state school code. Surprises some people to no end, that sort of thing.

The City of Arlington also used Eminent Domain to wipe out an entire subdivision of working class homes, owned by a lot of ordinary people who didn't want to sell. just so Jerry could have bigger parking lots.

Would it not be more cost effective to refurbish the Ballpark at Arlington? What is wrong with that stadium?

In this state, you can own the tidelands. Several years ago, a judge bought up the local tidelands which were for sale because the taxes hadn't been paid. He gave them to the county. During our battle with DNR, they threatened to drag the county into OUR lawsuit, if they didn't give those tidelands to DNR. So they did, after lying to us about letting us know when they would have the hearing on it. AND DNR did not have to follow the law that they needed an environmental study before they could accept the gift of property.

I read the article and am pretty familiar with the article. The case was about a very large water supply line (84", or 7 feet around) which is to run from Lake Palestine in East Texas over to Lake Benbrook, on the outskirts of Fort Worth. City of Dallas is invested in the regional authority seeking to build this line.
The biggest reason that the City had to give in and settle is that this land wasn't inside city limits, it was about an easement across a big stretch of ranch land a couple counties away, near Athens, Texas, and since it wasn't developed they were trying to get away without giving him very much for it. That's why he fought, and yeah, with the size of the easement they were looking for, the amount in dispute was certainly well over a million dollars.
They even wanted to run the pipeline through a family burial site located on his property!

Long before the riots of 1969, Newark decided it needed to build public housing in about 1950-51, so it literally destroyed vibrant neighborhoods where families had nice houses, large properties and most had some kind of thriving business on same property.
The city has never recovered and sadly those who lived through it ( The Greatest Generation) are all dying off so the entire episode will soon fade down the memory hole.
Long before the riots of 1969, Newark decided it needed to build public housing in about 1950-51, so it literally destroyed vibrant neighborhoods where families had nice houses, large properties and most had some kind of thriving business on same property.
The city has never recovered and sadly those who lived through it ( The Greatest Generation) are all dying off so the entire episode will soon fade down the memory hole.

Just going by the video, I'm not so sure the woman is wrong. Most water pipes are buried, and society does need water pipes. Now, maybe the city was heavy handed in this instance, but maybe not. I would be interested in reading about what actually happened, but if all the city wanted to do was bury a pipe through his property, they may have been entirely reasonable.

(The worst entities in America about the 20 Year Rule are school districts. In my old neighborhood I've seen entire schools torn down and rebuilt for no other reason than "they are too old". The buildings torn down were perfectly fine and were built in the 1960s.)

If I'm reading that right, the government wanted to place the pipe above ground through his property. For some reason, the property owner didn't want a 7 foot pipe bisecting his property.
They can still run the pipe through his property if they want, but they have to bury it.
Good on him for sticking it to the government thugs.

Just to be clear to people who think "eminent domain" is a dirty word, Eminent Domain is authorized by the constitution, and is used every day in every city in every State where any kind of public construction projects are going on. So yeah, you will not find a major (or even minor) real estate developer anywhere in this Country who hasn't used it.
BUT - it is supposed to be kept in check and used reasonably, and our representatives are supposed to ensure that it isn't used heavy handedly. That's the issue that is on point in these cases.

Meanwhile, he's subtly trying to kick out the Mexicans from the barrio, where they've lived for many generations, so that he can put up high rise apartments along the beach for his chi-chi liberal friends, and make a killing because ... he owns much of that property.

Real estate developers all probably have a soft spot for this, but I bet Trump is WAY better on issues like tort reform and environmental nonsense being in the industry he is.
I'm far on the side of property holders in these cases, but eminent domain is in the Constitution and is something people get paid for and can legally address their issues.
Bottom line, these sorts of things are like #300 on my list for Presidents to address.

It went to court and Trump lost. She wound up taking a huge loss when she sold the property, far less than Trump offered her.

In the end, he killed himself sitting at the site. That was a decade ago, they still haven't even started work.
