Court Dismisses 14 of 15 Charges in the Persecution of Those Who Exposed the Trade in Organs of Aborted Babies

When you charge someone with 15 counts, and 14 of them are so obviously without merit a judge dismisses them pre-trial, it shows the prosecution to be a politically motivated exercise in weaponized government.

On Wednesday the San Francisco Superior Court tossed for lack of evidence 14 of 15 criminal charges against journalists who recorded high-level Planned Parenthood employees discussing trafficking the body parts of aborted babies, reports LifeSiteNews. California’s Department of Justice says it will re-file the charges within the ten-day deadline for providing more evidence.

...

As a Democratic member of Congress, California Attorney General Xavier Becerra received thousands of dollars in campaign donations both from Planned Parenthood and fellow abortion promoter NARAL. His predecessor, whose department initiated the action, received $81,000 from Planned Parenthood for her campaigns.

In May, another California judge, who had contributed a quarter of a million dollars to former president Barack Obama’s campaign, slapped Merritt and Daleiden with contempt charges for releasing another video despite a restraining order. Their attorneys say the videos are already public thanks to their opponents’ public court filings, and the already released videos remain on CMP’s YouTube page.

In April, California’s Department of Justice raided Daleiden’s home and seized the recordings.

5 Not just any court, a San Francisco court. Hats off to the judge who still seems to believe in the rule of law and had the guts grant the motion to throw out the charges. It'll be interesting to see if the state has more evidence to file or if they'll just throw in the towel on some of those charges.

6 A conviction is just the cherry on top. The real weapon is the process, charging, arresting and shaming the people who dare say abortionists have utter monsters among their already morally-suspect congregation.

41 I wouldn't read too much into this. I read elsewhere that the reason the judge gave was that the charges were not specific to any particular video in the set of videos that was made. So, once the prosecution amends their charges to be more specific, something the judge gave them leave to do, the prosecution will proceed. It's good that the prosecution is being forced to be more specific, so the defense can then have something more substantive to defend against, but the case will go on.

How many of you can afford to lose $10k - $20k?

That's the minimum you'll need to have a good lawyer to get you off even if you are 100% innocent.

Once the state goes after you, they have no incentive--other than the morals of the prosecutor--to change course.
Even after they have iron-clad evidence of your innocence.

1,000s and 1,000s of prosecutors around this country. Hundreds and hundreds of wrongful convictions.

And the only one I can recall that ever suffered any punishment was Mike Nifong.

90 I'm a fan of Insty's proposition on this kind of stuff:

1. Eliminate prosecutorial immunity and let the DA's office buy an insurance policy akin to malpractice insurance for the rest of the bar.

2. The DA's office must pay out of its budget the percentage of the defendant's attorney's fees for every charge that is dismissed by the court or voluntarily dismissed. So, in this case, the DA's office would pay 14/15th of the defendants' legal fees.

What's that? Then there would be shrieking about not having the money to prosecute rapists and murderers and drunk drivers? Yeah, well, explain that to the voters next reelection.

It is out and out blackmail to bring myriad questionable charges against a person in an attempt to coerce a plea deal because, hey, you're looking at a high-level felony and 20 years in jail if you're convicted of everything.

93 1,000s and 1,000s of prosecutors around this country. Hundreds and hundreds of wrongful convictions.

And the only one I can recall that ever suffered any punishment was Mike Nifong.

Odd, no?

Posted by: RoyalOil at June 23, 2017 01:43 PM (Qj2Mo)

And Nifong received the slightest slap on the wrist for what he did. He should have been sentenced to the amount of time he put the duke guys in jeopardy, in total, plus a punitive extra few years/decades for having abused his power in the government.

People like to say that no one is above the law but those who make, enforce and adjudicate the law should be held to stricter standards and should always receive the harshest punishments when they break laws.

The argument the mayor made at the end is that all taxes and fines are nothing more than legalized extortion, and she was extorting people from the outside of her town for the benefit of the people in it.

The term "confidential communication" includes any communication carried on in circumstances as may reasonably indicate that any party to the communication desires it to be confined to the parties thereto, but excludes a communication made in a public gathering or in any legislative, judicial, executive or administrative proceeding open to the public, or in any other circumstance in which the parties to the communication may reasonably expect that the communication may be overheard or recorded. Seems to me that an open-air conversation in a crowded restaurant would be a communication reasonably expected to be overheard or recorded.
