Declassified Memos Show FBI Illegally Shared Spy Data With Third Parties Who Had No Legal Right to Have It

Isn't this unexpected.

The FBI has illegally shared raw intelligence about Americans with unauthorized third parties and violated other constitutional privacy protections, according to newly declassified government documents that undercut the bureau's public assurances about how carefully it handles warrantless spy data to avoid abuses or leaks.

In his final congressional testimony before he was fired by President Trump this month, then-FBI Director James Comey unequivocally told lawmakers his agency used sensitive espionage data gathered about Americans without a warrant only when it was "lawfully collected, carefully overseen and checked."

Once-top secret U.S. intelligence community memos reviewed by Circa tell a different story, citing instances of "disregard" for rules, inadequate training and "deficient" oversight and even one case of deliberately sharing spy data with a forbidden party.

...

The court also opined aloud that it fears the violations are more extensive than already disclosed....

The court isn't the only oversight body to disclose recent concerns that the FBI's voluntary system for policing its behavior and self-disclosing mistakes hasn't been working.

...

The FBI's very first compliance report in 2009 declared it had not found any instances in which agents accessed NSA intercepts supposedly gathered overseas about an American who in fact was on U.S. soil.

But the IG said it reviewed the same data and easily found evidence that the FBI accessed NSA data gathered on a person who likely was in the United States, making it illegal to review without a warrant....

Lawmakers in both parties and both chambers of Congress are writing reforms behind closed door, leaving the intelligence community anxious it might lose some of the spy powers it considers essential to fighting terrorism, cyber attacks and unlawful foreign influence.

See also this piece by Andy McCarthy -- usually on the pro-law-enforcement side of controversies -- explaining why these are serious breaches.

Even if they "win" in Court and get a payout, it will be money well spent to stop this coup.

81 I love this bit:

The court thanked Jeffress for her thoughtful analysis but ultimately rejected her recommendation to impose on the FBI a requirement of creating a written justification why each search would help pursue a national security or criminal matter.

The Justice Department argued in that matter that the extra restriction would keep FBI agents from connecting the dots in terror cases and compared NSA searches to something Americans do every day.

"If we require our agents to write a full justification every time think about if you wrote a full justification every time you used Google. Among other things, you would use Google a lot less," a lawyer told the court.

Yes. That's kind of the fricking point. When we're talking about 4th Amendment issues, the onus should be on the person wanting to query the data to describe why it's necessary. If there's not a pressing enough purpose for it that warrants a thorough written explanation, well, tough schnikes, buddy. Come back when you've got more evidence.

You know...I watched a comspiracy-ish video recently that theorized the reason we see so many pedos and other perverts in positions of power - government, Hollywood, etc - is not by coincidence but by design. The reason being that such people can be blackmailed and controlled more easily. Now, with the left's open embrace of all sorts of degeneracy I'm not sure how effective that really would be, but it has a slight ring of truth about it.

instead of developing legal techniques and tactics they were allowed to be lazy and use illegal techniques and tactics. now, when obama leaves office and Trump takes office there is a gap in capability that increases the likelihood of something getting missed.

As are all the other astounding violations of classification laws we have been seeing (presidential phone conversations with foreign heads of state routinely leaked to the public? WTFF?).

But .... it's not a serious country, or one in which a working majority even have the values or mindset that made the country what it was, historically.

Just watch. See what happens. Comparatively minor s**t in the 60s/70s was the End of the Universe, and treated as such (the Church committee, etc.). The entire structure of congressional oversight was created in reaction to these problems.

Lessee what concrete, meaningful steps are taken in response to this. As well as seeing how many people do jail time (to echo many here).

214 see my handle?

I've been thinking of myself as an outlaw now for some time.

The idea that EITHER party gives more than lip service to Liberty and Freedom, and the rights of the individual, is ludicrous.

Today, the attack is from the Left and the corporate News Media, because they can espouse all kinds of non-workable collectivist ideas that appeal to the stupid and other-directed people in the country (probably a solid majority).
People are always morbidly consumed with the idea that either
1) somebody is getting something they didn't get, and boy, let's fix that!
2) somebody (some rich guy!) stole my money
3) I should be getting (fill in the blank) for free, or it's just costing too much.

Yeah, the evil banks made you run up that credit card debt, take out that second mortgage, mispend all your money for dumb stuff, and now you're sore about it.
And Health Care costs too much! I mean, it's FREE in Canada and the UK, why isn't it FREE here?

But the real source of all this is corporatism, the first cousin of Fascism. The real big corporations, banks, the government, are all in agreement as to how the world should be organized, and you, little person with your dumb ideas and your votes, are getting in the way.

Which is the reason that the dumbass Boehner said what he said today about Trump. And probably what a good part of the Republican congressional caucus is paid to think by their big donors.

Are we screwed? Why yes, yes we are. What can we do? Well, precious little, depending on what you want to sacrifice.

224 Trump now has a reason to fire the entire top 10% of the FBI, that is the leadership. Without those snakes the agents will be able to get back to work.

At present there is nothing but turmoil perpetrated by the management class. Leaving them in place will just contribute to the continuing erosion of public trust.

Once the people have completely lost respect for the intelligence community as a whole and the FBI in particular you might as well shut it all down and start again.

At this point in time, the burden is on those who would defend what the intelligence community does to set out, in detail, the manner in which this will be prevented and, more importantly, how those who do violate such procedures will be prosecuted.

Because until that happens? I will presume that those defending such practices believe the Fourth Amendment should be repealed but do not have the intellectual honesty to admit so forthrightly,.

266 72 Expect this article in the NYTimes soon:

Trump Already Worst President in History, Worldwide, Forever, Say Historians

According to projections made by the American Association of Infallible Historians, after Donald Trump completes his eight years in office in 2025, he will have permanently cemented his position as the worst president not only in the history of the United States, but of any nation on Earth, a badness so bad that it will never be surpassed.

As someone who went through a program, most of them are pedantic fart sniffers. Not all, but most.

When they're not sitting around arguing about who gets the office with the window (as and undergrad I was once urged to attend an important department meeting where they sat around worried about who gets an office with a window...and this went on for an hour), they're wasting their time writing articles about how many nails held Billy the Kid's boots together.

They love proving popular history or folklore wrong. I mean they LOVE it. "Did you know there were only FIVE deaths by gunfire in Dodge City at the height of the American West?!?!?!" Someone did a study on it. Neat but meh.

It's really so they feel superior to everyone else.

268 "All of that illegal snooping and yet they can't stop many "known wolf" Islamic terrorists from attacking (Boston, San Berdoo, Orlando, etc.). Who are they illegally snooping on? The world wonders."

Wonder no more. They spy on conservatives whom they consider the real enemy. They said so but we disregarded them.

269 Also, any historian worth his salt knows contemporary judgments aren't worth a bucket of spit unless you're studying how people of the time thought about a certain individual or topic.

Once had a professor in another department ask what I was majoring in and when I told him he asked what time frame because if it was within the last 150 years, it's not history it's journalism.

He pretty much nailed it. We usually only start to know and see more after a lot of time has passed.

270 Here are just a few of recent SF "child porn" cases involving "progressives":

SF political consultant may avoid jail time in child-porn case

The leading Democratic consultant for SF's political class got caught not merely with child but child torture porn -- and he was given NO JAIL TIME. Because of his "correct" politics.

Another one:

https://tinyurl.com/y8axuxql

"Billy Lockhart, 36, a resident at UCSF’s Department of Psychiatry, is accused of possessing around 1,500 images and 280 videos of children being sexually molested, some of them showing infants as young as 6 to 8 months old, prosecutors said Monday."

Part of his defense was that he was a hippy-dippy bleeding heart liberal -- which automatically makes him a good person:

"Defense attorney Charles Smith said Lockhart has no prior criminal record and despite the charges has led “an exemplary life.”

"Smith described Lockhart as the child of a single mother who had worked his way through the Yale School of Medicine and spent two years in the Peace Corps."

..and....

"San Francisco Film Educator Pleads Not Guilty To Child Porn Charges"

...etc. etc. etc. This is just in the last few months. I could go on and on.

_______LOL They actually believed Comey had notes, memos, a diary? Dumb as a box of rocks.

Posted by: gracepc at May 26, 2017 02:08 PM (OU4q6)

276 and they though Hillary would be president and nothing would come of it. How wrong they were. hehehehe

Posted by: pissed off oddnot at May 26, 2017 02:10 PM (g1MTt)

277 So this all happened under Comey's watch? Why isn't he in jail yet?

Posted by: Iblis at May 26, 2017 02:30 PM (9221z)

278 Back a year or so when I had a Twitter account, I posted a remark postulating that the FBI was thoroughly and irredeemably corrupted. That remark was answered by a stream of rebuttals from, eh, ordinary citizens.

I'm not glad to be so frequently vindicated, but I do take a measure of pride in being correct, regardless of the propaganda.

The multiple failures to prevent Islamist attacks ("known to the FBI" or "on the radar" in Boston, in San Bernardino, in Orlando, at Fort Hood, and in Dallas just to name a few), the duplicitous and corrupt James Comey and his bff Mueller, etc. etc.

Yes, a real class act, first rate.

279 At what point can We the People shut it down?

Posted by: Ummmm at May 26, 2017 03:10 PM (GnpbY)

280 I've been a prosecutor for over 30years. Andy McCarthy's position is pro law enforcement at least the way I was taught to practice it by Bob Morgenthau.

Posted by: MIK at May 26, 2017 06:24 PM (4Mh8b)

281 Who was the FBI director when this happened? But more importantly who was the 2nd guy in charge? The same guy who is now considered to be the front runner? That is not draining the swamp. We the People deserve better.
