24 According to Spengler at PJM their is the plotting to get Senators and Representatives to come together to force Trump to resign. A quiet coup, as it were. My response:

Let us see if they prove any more effective at stopping Trump than all of the other plots and predictions:
------------------
He won't win any primaries.
he won't win any more primaries because as candidates drop out their voters will vote against him.
He won't win the nomination.
He will have the delegate selection process set against him.
He will be denied the nomination because the delegates will be unbound.
He will never beat Clinton.
He won't win any debates.
His scandals will end him, even if we have to make them up.
Clinton has a Blue Wall.
*Nov. 8, 2016 - insert existential wail interspersed with sobbing and the sounds of drinking booze straight from the bottle*
The electors will go Hamilton and never vote for him.
Congress will not certify the vote.
The Chief Justice will not administer the oath.
*insert another scream along with the sound of a bathtub filling while a razor blade is honed*
Trump will be impeached.
Trump will be indicted.
Trump will lose all support.
Trump will quit.
Trump will be declared non compos mentis under the 25th Amendment.
We Will Force Him To Resign.
------------------
How much longer is it going to take before these guys get through the Kubler-Ross stages of grief already?

59 Carry over from the prior IQ discussion.

My pick for the biggest mind of the 20th Century would be Johnny Von Neumann.

"He made major contributions to a number of fields, including mathematics (foundations of mathematics, functional analysis, ergodic theory, geometry, topology, and numerical analysis), physics (quantum mechanics, hydrodynamics, and quantum statistical mechanics), economics (game theory), computing (Von Neumann architecture, linear programming, self-replicating machines, stochastic computing), and statistics."

He did the math to model how the first a-bombs would chain react.

He came up with Mutually Assured Destruction as a Cold War strategy.

And he told great jokes at parties!

Knowing Pascal's wager, he converted and died a Catholic, presumably to hedge his bets.

Concur. My current carry piece is a SW Shield in 9mm. Fits my had very well, balances and aimed fire is above acceptable. Concealment is top notch.

But, it REALLY shines in point shooting.

I do a close quater drill I call the hallway drill. I hip shoot (with a laserlyte insert) framed photographs on left while twisting from the right. I can go down ball sides of the hallway and not miss any pictures and can usually hit the thermostat.

Its a great drill for instictive shooting close quaters.... and the Shield really shines at it.

Well ok he actually won, but the EC won't support that. Well ok, the EC did, but he might get assassinated before being sworn in. Well ok, he's still alive now, but he'll definitely be impeached."

It just looks like it because at each step, they have to go back through denial, anger, and depression.

Appointment of Mueller as Special Counsel will put "Russia" on the back burner. A close reading of his authorization and the 28CFR regulations show that he's on a leash. Investigation will be narrow, and end in a report in a year vindicating Trump.

96 According to our old friend Lefty Robert Fisk, we took out 4 tanks, an anti-aircraft vehicle, trucks full of Iranian Guards and we're cutting Iran's lines...it's all good, Bobby!

Plus record numbers of ISIS airstrikes.

BTW, I went to check the Syria reporting of the Professional Liars at the Failing New York Times.

They had this headline: "U.S. Warplanes in Syria Hit Pro-Government Militia Convoy"

It was an Iranian Militia Convoy, boys--and Republican Guards, too. They also featured a picture of forlorn civilians walking among ruined buildings--even though the airstrike was on a tank column in the desert. And then they compared Trump to Iran's "populist hard-liner" mullah-presidential candidate--even though Trump is the one bombing Iranian hardliners and thwarting their empire.

They just can't help themselves.

I've been told by former Project physicists that the biggest contribution by von Neumann wasn't sorting out the internal fission mathematics, which were reasonably well understood, but instead solving the Rayleigh-Taylor instabilities of the Fat Man implosion system.

Before he turned his hand to it, the effort was mired in iterative attempts to empirically discover a configuration that would work. Lots of loud noises, little actual progress.

JvN walked in and produced a design derived from pure theory which worked perfectly when reduced to practice.

175 So my next "project" is to make a wooden bow.

Anyone here ever done that before?

I have a cured sassafras tree I'm going to use for wood. It was hit by lightning a few years ago, blasted the top off. I cut the rest of it down right away, peeled all the bark. Now it is well dried out. Its about 15 feet long and 4 inches at the thick end and tapers to about 1 inch at the tip.
I need to cut it down to staves I think rather than try splitting it with a wedge.

199 Appointment of Mueller as Special Counsel will put "Russia" on the back burner. A close reading of his authorization and the 28CFR regulations show that he's on a leash. Investigation will be narrow, and end in a report in a year vindicating Trump.

Posted by: Ignoramus at May 19, 2017 02:26 PM (+7/1f)

Okay, I'll bite.

Mueller is on no leash. Why?

First, Sessions will not exercise any leash over Mueller because Sessions has formally recused himself. He will not even speak to Mueller in any substantive way during his entire Special Counselship. Only Rosenstein will have any dealings with Mueller.

Second, if during the investigation Mueller's lawyers and investigators come across some rabbit trail possibly leading to wrongdoing by Trump that they want to follow unrelated to the supposed Russian hacking of the DNC, the idea that Rosenstein will step in and put a stop to it is not realistic.

If he ever tried such a thing he knows the media would go nuts accusing him of obstruction of justice and carrying Trump's political water and his career would be destroyed. The whole point of Rosenstein's selfish and cowardly act in appointing a Special Counsel in a situation in which he can't even identify a crime committed was that so that his own career would not be tainted by having to deal with this matter that Sessions recused himself on.

And anyway Rosenstein already explicitly authorized them to folllow whatever rabbit trails they want to in his letter granting jurisdiction to the Special Counsel.

Mueller doesn't have to come back to Rosenstein for permission to pursue any matter as to which he was explicitly granted jurisdiction in his appointment. And Rosenstein explicitly granted Mueller jurisidiction to pursue any crime the evidence for which directly arises in the investigation.

So if Mueller's people in exhaustively searching through The Trump Organization's financial and business records in order to determine whether there is any "link" at all in some fashion between Trump and Russia come across evidence of some other crime, Mueller is free to investigate and prosecute that if he wishes, without having to go back and ask Rosenstein for permission. And if Mueller did decide out of respect to Rosenstein to ask for permission to pursue any such thing, there is no way on God's green earth Rosenstein would ever say "no" because it would be in giant headlines the next day in the NYT and WAPO.

Mueller certainly is not going to investigate his friend Comey. Mueller's office will be filled with young, ambitious lawyers taken from Democrat or GOP NeverTrumper congressional staffs or with backgrounds in Clintonized or Obamaized prosecutors' offices. Mueller is in his late 70s. The investigation will be driven by these younger lawyers out to make their careers by scalping the one person most hated by everyone in their professional circles, Donald Trump.

I just don't see any silver lining to this Special Counsel business.

247 "I just don't see any silver lining to this Special Counsel business."

You and I have two quite different positions on this.

Having a Special Counsel appointed has some risks, but I think it solves Trump's Russia problem for the near-term and will vindicate him in the end.

Yes, Mueller can defy the limits of his mandate and dare anyone to stop him. I don't see that happening.

The law on "Special Counsels" changed in 1999. It's in 28 CFR 600 et seq. The only Special Counsel since was Fitzgerald going after the Plame leaker. Fitzgerald stuck to his narrow mandate but got Scooter for charges of perjury etc. that arose in the course of the investigation, which 28 CFR 600 et seq allows for.

As changed in 1999, Special Counsels can no longer frolic the way that Special Prosecutors did in the past.

256 I want a SIG P226 But supposedly it is old and surpassed by a different model. P229?
===================
The P229 is a significantly smaller frame. It was going to be a concealed carry version of the 226, its exactly the same shape only smaller.

Its still a bit heavy and probably not your best option if you are looking for concealment. However, if you are a 226 guy looking to conceal you probably will appreciate the 229. Also, I have hands like a raccoon (small) according to the sig instructor (I went on the factory shooting school in 2012 I think it was). the 229 was perfect fit. I bought one, elite with short reset trigger before leaving (factory discount).

The 229 would be a good gun for a lady. Now their first impression would be its "heavy". However the weight helps manage "felt" recoil. Its a pretty sweet shooter.

Understand some people hate the sig trigger set up. The first pull is 10lbs - double action as it were. They consider that to be one of the safety mechanisms. Every pull after that, single action, is much less, like 3lbs maybe 2lbs I forget. The light trigger pulls after the initial are helpful for accuracy. Especially if your grip strength is not awesome and you are shooting a fair amount in a short time like at a range, or firefight.

Most of my later ARs are 14.5 barrels with mid gas and H buffers. You can watch the bullets impact the target through the scope. Either that or KAC intermediate length. It really softens things out. A bit more ammo sensitive.

283 small thought on the Kubler-Ross thing:

The left isn't grieving, i don't think. Not the actual tacticians and decision makers, at any rate. They're losing momentum in the culture war, and fighting back accordingly with the best weapons they have. I don't think "grief" enters in to it, which is why the K-R analogy doesn't seem to sync up right.

Put another way: To feel grief, there must be a loss. To the messianic/jihadist left, the golden ideal of "The Right Side of History" can never die. So it isn't grief, really, just sheer bloody-mindedness at having to face an obstacle for once.

Mueller wouldn't be exceeding any mandate or going on any frolic if he decides to pursue any other crimes he directly comes across in the investigation.

Rosenstein explicitly granted Mueller authority in his appointment letter to do that.

What Rosenstein has done is akin to giving Trump cancer. It won't kill him tomorrow or next month and maybe not a year from now. But as the investigation drags on and smaller fish start getting taken up in the net, it will weaken Trump and his ability to achieve his agenda. Republicans who already don't like Trump won't feel like they have to bite the bullet and stand behind him.

As Trump's agenda slowly fails over time in face of emboldened resistance by Dems and GOPe, his supporters will get disappointed. It will happen in very slow motion. Then, when Trump is weakest politically, the swamp will unite as it did when Republicans in Congress went to Nixon and told him the game was over.

I carry a 239 SA/DA and love the trigger. I also love carrying it, mostly b/c it's a single stack. I accidentally had a mag in a backpack that was confiscated by the TSA once, and I looked like Jeff Spicoli sharing his pizza as I said goodbye to $40.

Where? I don't see it.

I see authority to continue the "FBI investigation of Russian government efforts to influence the 2016 presidential election and related matters" and "any links and/or coordination bet ween the Russian government and individuals associated with the campaign of President Donald Trump;"

Additional authority for "matters that arose or may arise directly from the investigation" goes to perjury etc., in light of 28 USC 600 et seq.

28 USC 600 et seq has an anti-frolic provision:

If in the course of his or her investigation the Special Counsel concludes that additional jurisdiction beyond that specified in his or her original jurisdiction is necessary in order to fully investigate and resolve the matters assigned, or to investigate new matters that come to light in the course of his or her investigation, he or she shall consult with the Attorney General, who will determine whether to include the additional matters within the Special Counsel's jurisdiction or assign them elsewhere.

The appointment letter when it grants Mueller jurisdiction to pursue "matters that ... may arise directly from the investigation" does not in any way refer to or is limited by the language in the regulations giving any special counsel the power to investigate perjury, obstruction of justice, destruction of records they discover in the investigation.

That interpretation would render the language that Rosenstein wrote meaningless, because all special counsels already have that power directly from the regulations, and it is not necessary to grant it in the appointment letter.

There's some bad video game fanfic that's almost in the class of My Immortal - one is Half Life related and one is Doom. But I agree, My Immortal is the only one where you're not quite sure if it's a masterwork by an insanely good troll or genuine rubbish from a 12 year old girl.

No fanfic could ever beat late 90's Transformers bad fanfic. Okay, maybe some could, but there a bunch of script-format fics back then that were truly special, like "Mission Not Possible," which involved dangerous mission to the North Pole to pick up a tree for Christmas. (The setting: prehistoric Earth. The cast: alien robots [from the future], one of which actually has a human [the writer's] head.)

Anyway, it inspired The World's Worst Fanfic series, which was hilarious and glorious.

410 Highly recommend the article on Rosenstein statement to congress yesterday posted at conservative treehouse. I have little to no concern that Rosenstein is going to allow Mueller who has never indicated in the past that he wants to spend years wandering around trying to dig up a crime. 450 For those who think this Special Counsel was appointed in good faith and the Office of Special Counsel will only look for specific evidence of Trump conspiring with Russian intelligence agents to penetrate the computers of John Podesta and the DNC and will not go off in other directions and will fold up its tent when they inevitably find no evidence of such a conspiracy, let me point out the following.

They already know there does not exist evidence of any such conspiracy and there was none. And everyone in Washington knows this.

This point was investigated for months and months by the Obama administration. We know from the whistleblowers that the intelligence agencies have vast databases with basically every email and financial record and telephone call in practically the world.

We learned recently that there is no longer any audit trail when someone with authorization wants to go into those database and see what we have on someone (unmasking). So there is no reason to think they were shy about checking.

If there was anything they would have used it during the election.

When people who know there does not exist evidence of the supposed crime they claim they are concerned about appoint a special counsel who is told to investigate everything about Trump to discover whether there is or has ever been a link of Trump with Russians and is authorized to pursue any crimes he discovers in the course of going through Trump's papers and associates, the purpose of this becomes clear.

It is to establish an investigatory/prosecutorial office free from control by the Trump administration to try to take it down. Don't be surprised to see rabid anti-Trump lawyers within the Justice Department who know their days are numbered as Sessions gets control of it, voluntarily leave and be hired by the Office of Special Counsel.

451 WASHINGTON — President Trump told Russian officials in the Oval Office this month that firing the F.B.I. director, James B. Comey, had relieved “great pressure” on him, according to a document summarizing the meeting.

“I just fired the head of the F.B.I. He was crazy, a real nut job,” Mr. Trump said, according to the document, which was read to The New York Times by an American official. “I faced great pressure because of Russia. That’s taken off.”

452 Mueller's scope of authority is a big fucking deal actually.

I'll concede language in order isn't perfectly clear. SG wants to read "arising directly from" broadly, to mean "other matters uncovered" or "new matters that come to light." He also says that the authorization order can be read to go beyond the regulations. I say it can't.

In the Federal Register adopting the regulations (64 FR 37042, July 9, 1999):

Paragraph (b) establishes a single procedure through which a variety of different jurisdictional issues can be resolved. For example, a Special Counsel assigned responsibility for an alleged false statement about a government program may request additional jurisdiction to investigate allegations of misconduct with respect to the administration of that program; a Special Counsel may conclude that investigating otherwise unrelated allegations against a central witness in the matter is necessary to obtain cooperation; or a Special Counsel may come across evidence of additional, unrelated crimes by targets of his or her investigation. Rather than leaving the issue to argument and misunderstanding as to whether the new matters are included within a vague category of "related matters," the regulations clarify that the decision as to which component would handle such new matters would be made by the Attorney General. The Special Counsel would report such matters to the Attorney General, and the Attorney General would decide whether to grant the Special Counsel jurisdiction over the additional matters.

Also,

Nevertheless, it is intended that ultimate responsibility for the matter and how it is handled will continue to rest with the Attorney General (or the Acting Attorney General if the Attorney General is personally recused in the matter); thus, the regulations explicitly acknowledge the possibility of review of specific decisions reached by the Special Counsel.

Posted by: Ignoramus at May 19, 2017 03:47 PM (+7/1f)

No, that is not what I am saying at all.

There are two categories of matters identified in the regulations.

One, there are matters that the appointment letter of the Special Counsel explicitly describes as being the jurisdiction of the Special Counsel. Among other matters, Rosenstein included in the explicit jurisdiction of the Special Counsel jurisdiction over anything that arises directly from the investigation.

Two, there are additional matters that the regulations give a Special Counsel jurisdiction over beyond what is specified in the appointment letter. Such as perjury, destruction of records and so forth. Or matters unrelated to what was granted him in the appointment letter where he must go back and get permission from the DOJ.

What is in category two is in addition to what is in category one.

The explicit authority granted to Mueller to go after anything he comes across in his investigation is not something "unrelated" to the jurisdiction granted him in the letter such that it comes under category two; it is PART of his specified jurisdiction by reason of it being given him in the appointment letter. He doesn't have to go back and get permission to investigate matters already formally included within his jurisdiction by his appointment letter, and "matters arising directly from the investigation" was already formally included within his jurisdiction by the appointment letter.

Why did Rosenstein give such a breathtaking sweep of jurisdiction to Mueller? Because Rosenstein no longer wants to be involved in this tar baby. He knows that if had not granted that authority to Mueller upfront to go after anything he comes across, such that Mueller would have needed to come back to him for permission, that anyway he couldn't as a practical matter have said "no" because his name and the suggestion of obstruction of justice would be on the front page of the NYT the next day.

462 The 1999 changes were intended to stop frolics.

In the Plame affair, Fitzgerald kept to his mandate, but went after incidental charges that arose directly from the investigation.

A lot depends here on Mueller, but I don't see him as the guy to invent shit to create a Constitutional crisis

463 SG, your reading is 100% in conflict with the 1999 regulations.

"Or matters unrelated to what was granted him in the appointment letter where he must go back and get permission from the DOJ."

If Mueller was free to frolic as you suggest he'd never have to go back to the DOJ

Posted by: Ignoramus at May 19, 2017 04:12 PM (+7/1f)

464 Because Rosenstein no longer wants to be involved in this tar baby.

Posted by: Scalia's Ghost at May 19, 2017 04:02 PM (m5dkR)

The crime is that Rosenstein limited this "Russian" investigation to Trump.

It may have been awkward for a day but He could have appointed a Special Counselor to investigate any and all involvement with Russian meddling.

That is exactly why Rosenstein in crafting the appointment letter granted Mueller explicit, written, upfront jurisdiction over any crime he directly comes across!

Rosenstein does not want to have to deal with this for obvious reasons. It is a career-killer for him. Rosenstein is not a stupid man.

In the future, if Rosenstein sees Mueller coming down the hall in the DOJ, Rosenstein will turn around and walk the other way.

If Rosenstein walks down to the coffee station to get a cup of coffee and sees Mueller there, Rosenstein will stop and wait until the coast is clear.

He doesn't WANT Mueller to be coming back to him and asking him for decisions.

467 Posted by: gNewt at May 19, 2017 04:16 PM (9YL+9)

Exactly. The whole point of this is to have a basis to do a thorough review of Trump's business records, the people he has associated with and all of his activities.

The Special Counsel's office has been instructed to investigate for any "links" between Donald Trump and the Russians.

So you're a young lawyer in the Office of Special Counsel and Mueller tells you to get to work.

Where do you start? You can't very well send a subpoena to Vladimir Putin or the Russian FSB or GRU.

So you send subpoenas to The Trump Organization. And since the "Russian link" might be hidden and direct, you will need to review pretty much everything.

The General Counsel's and Secretary's offices at The Trump Organization and any other entity connected to him will be very busy in coming months and years.

468 Rosenstein should be retired along with Gowdy and Issa.

469 Trump told a Russian official after firing Comey that Comey was a "nutjob" and that him being gone released a lot of pressure.
This is custom made for their base---and Juan McCain.

471 The last section of the authorization says:
"Sections 600.4 through 600.10 of Title 28 of the Code of Federal Regulations are applicable to the Special Counsel."

600.4(b) says if the SC finds "new matters that come to light in the course of his or her investigation" he has to consult with the AG first.

Posted by: Ignoramus at May 19, 2017 04:36 PM (+7/1f)

472 This should settle this.

When Comey gave Fitzgerald authority he delegated to him "all of the authority of the Attorney General" with respect to the Plame investigation, including the power to pursue administrative remedies and civil sanctions, and specified that his "position and authorities" are not limited by the restrictions set out in § 600.4(a).

Ergo, Mueller is on the the 600.4(a) leash

Fitzgerald got a broad delegation outside 28 CFR 600 et seq. It got challenged by Scooter but was still upheld.

Mueller is expressly subject to 600.4

475 600.4(b) says if the SC finds "new matters that come to light in the course of his or her investigation" he has to consult with the AG first.

Posted by: Ignoramus at May 19, 2017 04:36 PM (+7/1f)

Because Rosenstein already granted Mueller in the appointment letter jurisdiction over all crimes directly arising from the investigation, those are not "new matters" described in Section 600.4(b).

Any such matters are already part of his original jurisdiction established by the Attorney General and come under Section 600.4(a).

Since jurisdiction has already been granted to him over such crimes by the original grant of jurisdiction, Mueller does not need to make use of the "additional jurisdiction" provisions under Section 600.4(b) as if crimes directly arising from the investigation had not already been included in the matters Mueller is authorized to investigate under Section 600.4(a).

476 It appears the left will continue its war on Fox News via the discrimination suit, Bob Beckel being the latest fool. If the left would just take a breath, the Murdoch boys will do the work for them, although there would not be all the payouts to the people of the legal system.

Posted by: Locke Common at May 19, 2017 04:59 PM (Y6EAT)

477 Your premise is that Rosenstein wants to be as divorced from this as he can be.

If so he could have copied the Fitzgerald appointment order that expressly excluded 600.4 and gave him carte blanche, and was upheld when challenged by Libby. But he didn't.

Instead he used an order that ends by expressly saying that Mueller is subject to Sections 600.4 through 600.10. 600.4(b) says if you find something new you have to go back to the AG.

I see your argument, but it's not the better reading. Mueller can try to go rogue, but I see no evidence that he will.

478 How depressing is it to realize that of the three images above, one is effectively illegal for me obtain now, one is illegal for me use unless used in very specific places, and the third the government encourages me to use, even though it was originally designed to be use by people with XX chromosomes which I am no longer allowed to call sex/gender of female?

479 Posted by: Ignoramus at May 19, 2017 05:00 PM (+7/1f)

I'm not arguing that this Special Counsel, the appointment of Mueller, is not subject to Part 400.

I'm saying that jurisdiction over crimes "arising directly from the investigation" granted him upfront in the appointment letter are Section 600.4(a) matters and not Section 600.4(b) matters.

The reason these are considered Section 600.4(a) matters is because jurisdiction over such matters was explicitly granted to Mueller upfront in the appointment letter under the establishment of his original jurisdiction.

482 SG, we're not going to agree.

My noodling around shows that only this SC authorization and the one about Waco were done under 28 CFR 600, and that the other SCs were given more authority, without the limits in 28 CFR 600. So if Rosenstein wanted to get distance, or wanted to set Mueller loose without a leash, he could have written a broader authorization.

We'll see how it plays out in practice
