Hmmmm...: Mike Lee Says Senate Parliamentarian Informed Him It Might Be Possible to Undo Obamacare Regulations Via Reconciliation

So, reconciliation -- where you only need 51 votes for passage, and where a filibuster is not allowed -- is usually only allowed for budgetary measures.

It has been argued that Obamacare can only be repealed in multiple phases because step one has to be entirely budgetary in nature, in order to be doable via the reconciliation route in the Senate. Regulation reforms would have to wait for phase 2 or 3, which of course can then be filibustered. (This is why a lot of people argue phase 2 and phase 3 aren't going to happen.)

But now Mike Lee says he discussed things with the Senate Parliamentarian -- who rules on what can or cannot be done via reconciliation (among many other things)-- and it's his understanding now that some regulation repeal can be done via reconciliation too.

Sen. Mike Lee, R-Utah, said on Wednesday that the Senate parliamentarian has told him that it may be possible for Republicans to push harder on repealing Obamacare's regulations than the current House bill, which contradicts the assertion by House leadership that the legislation goes after Obamacare as aggressively as possible under Senate rules.

"What I understood her to be saying is that there's no reason why an Obamacare repeal bill necessarily could not have provisions repealing the health insurance regulations," Lee said in an interview with the Washington Examiner, relating a conversation with parliamentarian Elizabeth MacDonough about reconciliation he had on Tuesday.

Lee also said that the parliamentarian told him it wasn't until very recently, after the unveiling of the House bill, that any Republican even asked her about the possibility of repealing regulations with a simple majority.

"One of the things we've been told over and over again is the bill was no more aggressive than it has been... in part because of Senate rules," Lee said. "And the Senate rules are something those defending the bill have repeatedly pointed to in defense of why they wrote it the way they wrote it. The parliamentarian said, there's not necessarily any reason that would categorically preclude you from doing more, both on the repeal front and the replacement front, all sorts of things are possible."

He continued, "What matters is how it's done, how it's written up. There are ways it's written up that perhaps make it not subject to passage through reconciliation, but there are other ways you could write it that might make it work."

The so-called American Health Care Act already looks dicey for passage, with Republican opponents claiming they have 22 or 25 Republicans ready to vote against it, and a claim that even more can be done via reconciliation will endanger it further.

They got rid of it to back the DC circuit court because that was in their political interest at the time, I'm SURE they would have gotten rid of it to fill Scalia's seat if Scalia had died will D's controlled the Senate, and they got around the filibuster through ridiculously absurd "rules" that seemed to appear of their asses for O'Care.

Heard Lee discussing this point on the radio last week (that more can be done while still passing the "germaneness" test for a reconciliation bill).


For the thousandth time, the sensible path was obvious from the outset: repeal what was passed on reconciliation originally the same way it was passed, then have the House immediately send the rest (full repeal) to the Senate, where the Senate Dems from Trump states who are up in '18 can choose wisely, or not. And where the GOP can suspend the filibuster if needed.


It's called politics. Everyone is put on the hot seat, everyone is accountable.


Best of both worlds (and not implausible, at all): most of the vulnerable Senate Dems choose poorly, GOP ends filibuster and repeals anyway, and those Dems *still* face very tough re-election in '18 for being on the wrong side. And there is only one wrong side, politically, here. The wave elections of 2010 and 2014, and the rebellion election of 2016, weren't driven by opposition to Medicaid expansion.

The biggest problem with BarkyCare is that the whole idea is totally un-Constitutional and thoroughly un-American. The federal government has no business mucking around in individual health insurance. That is only a state responsibility. The federal govenrment's ONLY power with respect to individual health insurance is to try and make regular interstate commerce of it. That's it.

Don't know the story behind this, figure even the O administration lacked the ballz to even implement most of the law, so just created all sorts of escapes and loopholes.


And it was *not* all passed via reconciliation the first time (I think JackStraw may have done his usual yeoman patient explanation of this history here recently). Some was passed via reconciliation, some via free-standing legislation (unconstitutionally originating revenue-raising actions in the Senate, but let's not quibble).


The "tax" penalty on individuals doesn't exist. Medicaid expansion was *not* the political driver of opposition to this, and is completely unrelated to the most dramatic, immediate damage done by the ACA - destruction of the individual and small group insurance markets.

GOPe gets 'nothing done in this congress' which is pretty much what they want, then their buddies across the aisle get to run everything and they go back to putting on failure theater.

Trump's political capital collapses with his support for this sham, which makes it harder for him to get anything else done, most of which is desired by the public and horrifies D.C.

None. Like I said, the federal government's only power is in making regular interstate commerce of insurance - making "regular" not "regulation". It has nothing to say about in-state insurance companies. Those are for each state to deal with.

Some was passed via reconciliation, some via free-standing legislation (unconstitutionally originating revenue-raising actions in the Senate, but let's not quibble).


The "tax" penalty on individuals doesn't exist. Medicaid expansion was *not* the political driver of opposition to this, and is completely unrelated to the most dramatic, immediate damage done by the ACA - destruction of the individual and small group insurance markets.

Hell, we have an entire federal exchange that was only voted on by nine people and four of them voted against it. I say make the Supreme Court responsible for running what it created and have all decisions routed through them. Trump could make a perfectly reasonable argument that since there is no text anywhere authorizing such an exchange he has decided it would be a violation of his oath to pretend otherwise. And since the court authorized it and created it they can have the pleasure of running it. If they bitch about it then Trump could just ask for the plain text which created such a thing.

At some point a grand gesture like that will have to be made to chasten the court into doing its job instead of legislating. As it is, there are no repercussions for them so all incentives are towards activism.

They did, actually. February of last year they passed a very similar bill (minus the wailing and gnashing of teeth) through reconciliation and put the bill on Obama's desk where he promptly vetoed it. Ryan said at the time, and nobody said a word in protest, that this was a proof of concept, that they could get a bill to begin to repeal Obamacare through Congress and they would use this exact process if they got a Republican President.

They did and they are. All this process has proved is that some people have very short memories or they are getting all worked up for nothing.

Ryan also promised when he took the Speaker's job that business would not be done as it had over the Obama years and would instead go back to regular order which is exactly how this bill is going through the House. Four different committees with amendments allowed. This is how the House is supposed to work and something bitched about for years under Boehner.

I expect McConnell, who has promised to have this on the floor of the Senate next week if it gets through the House, is ready to go as well since he helped get it through reconciliation last February.

Some of that is already being addressed in the original bill and the amendment process from what I've heard. Specifically in the area of Medicaid expansion which is part of Obamacare and has been wildly abused by some states.

It was never going to be one big repeal process regardless of whether they had 60 Senators or not. The dirty truth is Medicaid expansion was hugely adopted by the states, including Republican states, and those governors do not want it to be repealed without some safety net.

It's going to be a slow, multi-phased unwind. We are talking about 1/5th of the economy with some things that our supposed allies want. It was always going to be difficult and messy.

The thing that makes OCare and RyanCare awful is the notion that every health insurance policy has to be identical. They all cover the same items. And they all cost the same for everyone. The only differentiator is age. But everyone aged 32 for example pays the same amount for a bronze plan. Doesn't matter if you're a man or woman. Doesn't matter if you smoke or not. Doesn't matter if you're obese or a marathon runner. You're 32 you pay $X. That is not insurance. I don't know what it is exactly, but insurance it is not.

This exactly. My cat recently had surgery to remove a cancerous tumor. Technically it was outpatient surgery, since I dropped her off in the morning and picked her up on the way home from work.

The total cost was about $795.00, which I paid out of pocket. No insurance was involved. My vet even gave me an estimate before I agreed to the surgery, so I knew what to expect.

I suspect the same procedure on myself would be a great deal more than that, and I would have no idea what it would cost beforehand. The charges could even be different depending on what kind of insurance I had, or if I had no insurance.

No other industry operates this way. Can you imagine taking your car in for work and being charged differently according to what kind of auto insurance you had?

Question is whether the political pressure from the vast majority, who have yet to feel any real pain from O-care (sorry, not considering premium hikes of less than 200% "real pain"), will be sustained.

In the end, the issue turned on whether a particular footnote in the Senate Rules was in italic, or roman, font. Byrd won, based on whichever it was. It was an amazing spectacle.

If you look at the portions of the healthcare market that are NOT normally covered by insurance and are not part of government provided health insurance benefits (like vision corrective surgery), the costs of services and new innovations drop incredibly quickly to maximize profits. This indicates to me that government interference in healthcare markets, like government interference in the market for college education, is the main cost driver.

Here's the thing - before we can get to eliminating govt. distortion of medical markets, and preventing price discovery, etc., we should really just un-do the massive (separate) blow to millions of people that O-care represents.


If 120 million people were facing what 10-15 million people in the individual insurance market have faced the past 3 years, you can bet that things would have been fixed, pronto (they still might, if not so pronto). Instead, those less catastrophically affected by O-care focus on Medicaid expansion, or the fundamental problem of govt.-induced market distortion in medicine, or .... tax reform.


O-care remains mostly an abstract outrage to most (rightly an outrage, but still mostly abstract). Not so to a lot of us.

When I lived in an apartment my downstairs neighbor had a Jack Russell terrier. She was away from home much of the time, so she kept him chained in the yard. He barked constantly, to the point where the neighbors complained.

But given her irresponsibility with other pets, I wouldn't bet against the latter.

Look at the "cost curves" for generally non-insured medical
procedures ...... flat-ish, for the most part. And this, even with the
astonishing technical advances we all now take for granted.





Here's the thing - before we can get to eliminating govt. distortion
of medical markets, and preventing price discovery, etc., we should
really just un-do the massive (separate) blow to millions of people that
O-care represents.





If 120 million people were facing what 10-15 million people in the
individual insurance market have faced the past 3 years, you can bet
that things would have been fixed, pronto (they still might, if not so
pronto). Instead, those less catastrophically affected by O-care focus
on Medicaid expansion, or the fundamental problem of govt.-induced
market distortion in medicine, or .... tax reform.





O-care remains mostly an abstract outrage to most (rightly an outrage, but still mostly abstract). Not so to a lot of us.

Two things:

First, I really like Rand Paul's idea of allowing individuals and small businesses to band together in voluntary groups (either already in existence like the NRA and the Shriners or new groups formed in the future) that then would have the bargaining power that large businesses have now in negotiating insurance rates.

Second, most people's insurance costs problems could be solved by removing insurance mandates (which would once again allow individuals to get low cost, high deductible catastrophic care insurance) and allowing everyone the ability to dedicate their own money to an HSA that could go toward paying for their actual health care rather than on insurance.

And more to your point, I doubt they use "dynamic" modeling when estimating the fiscal impact of tax cuts (the part where lower rates help allow more economic activity, whose tax revenues offset some/all of the losses through tax cuts). But I'm not sure.

1) Ryan and McConnell used reconciliation to pass a very similar bill last year saying that it proved that there is a clear path using this process to repealing Obamacare once there is a Republican President.

2) Trump, a Republican, wins the presidency.
