How Can Trump "Sabotage" Obamacare, When Obama Already Took Care of That?

Obamacare has failed, and is in the death spiral already -- but the Protect Precious Press is trying to pin Obama's disaster on the Republicans and Trump.

Ah, fudgepops. Pooky's been calling me all day since
his psychiatrist (the one who over-prescribed Ambien, screwed up
Pooky's PT waiver, was rude to me while Pooky was in the ICU, and has
canceled critical appointments) is trying to railroad him into an
administrative discharge. The base mental health clinic is not following
its own basic procedures and Pooky's paying the price for it. I can't
have him wind up in the hospital again, but that's where Mental Health
might send him today.

Except that would provide wonderful optics for PDT, and boost his popularity. The passive aggressive shit weasels in the GOP establishment and their slimy big money donors would never do that. They hate President Trump more than the Democrats.

Appeal with an active date of December 31, 2019. That gives them almost three years to get it right. Three Years ro create a Replacement! And if the Senate Democrats block good replacement plans, you have a great club to go after all of them in the 2018 midterm elections. Twenty five Senate seats.

57 Pro-tip to Trump,

Make a speech and say, "if democrats love Obamacare so much, they can have it...good and hard." Then enforce, to the maximum extent possible, every single provision of Obamacare exactly as it is written. Taxes, penalties, no transferring money to insurance companies to keep them in the market. No exceptions for any union, or corporation.

The dirty secret of Obamacare is that we have never actually had Obamacare - he was careful to shield us from the bad stuff (executive discretion) while only implementing the good stuff. people who support Obamacare have never dealt with half the bad crap in there.

Then pass a simple law, if states want to do something different, then can "opt out" of Obamacare and implement their own plans.

86 One of the current problems is the involvement of the CBO as arbiter.

MSNBC recently had Peter Orzag on criticizing the R initiatives based off the CBO report. Even though this cocksucker was the point guy on gaming the CBO report back in 2009. Things like 10 years of revenue, vs 6.5 years of expense. Shit like. He and Gruber were a tag team fucking America with blatant lies.

One pernicious aspect was including new taxes in the CBO scoring when they could have been used for any other purpose, just as well. Now if you Repeal Obamacare (which eliminates these taxes) it's sure to blow up the deficit the way that CBO looks at it

Actually, he can. Broad new powers were specifically given to the head of HHS under Obamacare to do an enormous amount of things. It was embedded right in the law.

Aside from all the other problems with Obamacare this was a huge part of the problem. Even when the law was passed we couldn't see everything that was in the law because much of it was indeed "made up as they went along". Obamacare itself was more of a framework with most of the details being filled in by HHS after the law was passed.

However, much like Obama EOs, a lot of this can also be wiped out with a simple wave of the pen and phone.

"Until you take repeal off the table, we ca'nt support this, because it does so much damage"

256 242 But they do. The dirty little secret of Obamacare is that a huge percentage of the new enrollees are actually enrolled in Medicaid plus. And they aren't all Democrats in Democrat states.

If you completely repeal Obamacare, you completely repeal Medicaid expansion and toss millions off "insurance".

Posted by: JackStraw at March 15, 2017 03:59 PM (/tuJf)

================

I'm right in understanding that the Medicaid expansion is scheduled to be 100% state funded in the near future, right?

Combine that with the fact that it's optional at the state level, and I say: Keep it.

It's only going to hurt those states that took it.

I'm actually pretty good with that on a federalism level.

262 First, separate the entirely separate and unrelated issue of Medicaid expansion. It has literally nothing to do with the destruction of the already-mangled/strangled health insurance "markets", nor with repairing some of the recent damage.

Second, you have the f***ing govt., incl. HHS, Trump admin. - so F***ING GET THE ACTUAL NUMBERS OUT THERE. Specifically, the number of "beneficiaries" of O-care - which is *the number of people now with some non-Medicaid insurance who were, prior to 2014, INVOLUNTARILY FINANCIALLY uninsured* - and only that.

Then juxtapose that with the estimates of previously (happily, easily) insured people (mostly in the individual and small biz markets) who, since 2014, are now uninsured, or financially devastated by the premium/deductible spikes (in CA, for example, individual plans increased in price 300%, overnight, on Jan. '14, and are now up about 400% over the 2013 rates). The ratio of victims/beneficiaries is, at minimum, 5 to 1, probably more like 7 to 1 (get those f***king numbers out there, Price, and hammer then every single time you open your mouth about the topic).

Third, engage, for F***ING ONCE, in f***ing POLITICS. O-care was a political disaster for the Dems, from the outset, for a reason. It is now a *worse* political disaster for them, as it spirals down. HANG IT AROUND THEIR F***ING NECKS, 24/7.

In practical terms, there was always an obvious strategy.

* repeal everything you can via reconciliation, respecting the normal germaneness rules of the Budget Act process

* this leaves much of the damage unfixed (esp. the regs that have destroyed the individual/small biz market), so .... identify the remaining critical, urgent changes (repeals) needed, and immediately pass a bill with those through the House.

* then you put the ENTIRE political weight of not fixing the ongoing disaster on 10 or so Senate Dems up for re-election (from Trump states). Sweat the bejeesus out of them, start the campaign TODAY, massive relentless media campaign in their states stating the truth: they can vote to relieve the suffering of millions, or not.

For the politically illiterate (and there are some here, and it's surprising given their obvious smarts), the "damage" from a comparative handful of "beneficiaries" losing their "coverage" would obviously nothing compared to the gainzzz from relieving up to tens of millions from a life-changing blow to their finances.

And ..... if you want to cushion even that manageable damage, fine, write a f***ing check for whatever to buy those "beneficiaries" two years of crappy O-care type coverage, while markets are restored (to even better condition than pre-O-care), when costs should help many of them participate normally.

291 252 Our Republic doesn't have time to mess around with the filibuster. A 60 vote majority is like a once in a hundred year type phenomenon.

Does anyone have a single doubt the filibuster will be gone as soon as Democrats take control of the Senate?

It never should have been there in the first place, and when have Republicans ever used it effectively?
Posted by: Maritime at March 15, 2017 04:00 PM (1WzUn)

==================

I honestly agree. Ideally, the filibuster really shouldn't exist.

But here's the thing: the Senate largely loves it because it makes them feel important. And Mitch McConnell loves the "august nature" of the Senate, and that includes all the little rules that they've been writing and rewriting for themselves over the last 200+ years.

Politics is the art of the possible, and part of that is that the reality of the situation is that a lot of people in the Senate like the filibuster for a variety of reasons.

Screaming about uprooting that rule is about as useful as screaming about the Chevron defense. You have to work on attitudes and personnel in order to change that.

If there's anyone to blame, it's the people of Kentucky for sending McConnell back to the Senate.

The number (millions) affected by the destruction of the individual market (and it's millions, and by itself is a multiple of 3-5 times those who "gained" from O-care) can be estimated, as always opportunity costs are more like educated guesses.

If they want to stop losing, they need some new faces (Chuckie-Poo ain't it) and essentially have to have their new version of Bill Clinton, a "so-called moderate" who blathers about stuff people are really concerned with in real life.

And two, they need to blame both TFG and Hillary! for their problems, run them down, and then bring out Bill Clinton 2.0 as a guy "who's nothing like them at all" but "a new guy with new ideas" and "a third way to get things done".

But, they won't get anywhere as long as they keep tripling down on stupid.

I really can't think of a single good example for when Republicans effectively used the filibuster.

Even when Democrats lost their 60 vote majority, they still were still able to get ObamaCare passed.

The Democrats already removed much of it it whenever it got in their
way, and no doubt will formally remove all of it next time in power.

Regardless, the Senate should be a Republican dominated institution
as the Red States far outnumber the blue states, so I feel more
comfortable with the gamble.
.
.
.The filibuster as we know it is gone. If McConnell won't do away with the rest of it you can be assured that the Dems will Nuke it when they gain control of the Senate back. And yes they will get control of the Senate back in the future because.....the pendulum will not be denied.

Not true. It passed with 60 votes specifically because the Democrats did not get rid of the filibuster for legislation. I don't know why this myth continues to live on, it's not like it happened a hundred years ago and it is the entire point of what is happening right now. There were 58 Democrats, plus two Independents, Lieberman, a former Democrat and a guy who caucused with the Democrats and Crazy Uncle Bernie Sanders.

As to when the Republicans used it sometimes the threat of it is enough to not even try for legislation. Exactly what is happening right now to the Republicans and why they are looking to use reconciliation and do the process backwards.

The only part of the filibuster that Reid got rid of was the filibuster for federal judges. Something that is about to bite the Democrats in the ass when Trump starts appointing his own federal judges and he's got a bunch of them to do. Reid could have gutted the entire thing but even that crazy old loon was aware that Democrats weren't going to run the Senate forever.

When you kill the filibuster you turn the Senate into a smaller House. Straight majority rule. Yea, it's inconvenient at times but it is also inconvenient for the left when they are in power.

394 Historically the Senate filibuster has served a "republican" purpose (i.e. protecting the minority and limiting dramatic govt. action).

Predictions are hard, especially about the future (Yogi Berra?), but ..... having spent a lot of time in the Senate in a recent previous epoch, and watching it for several years more recently, I don't think there's much change the filibuster survives the next Senate Dem majority.

Reid's outrageous "time-out" from the cloture rule to stuff the DC Circuit court was a blueprint and a harbinger, not an outlier.

The civic degradation I always whine about includes, crucially, the collapse of standards and prudence among, mostly the Dems and their machine. They simply no longer share the civic values and mindset that made America unique. Thus: DC Circuit stuffing, massive voter fraud, judicial distortion of the electoral system based on race, the astonishingly anti-American idea of "card check" (no secret ballot) for unionizing votes.

So, assessment of ending the cloture rule in the Senate for legislation and nominations: risky, but probably the better call, given the actual circumstances we face now and in the future.

So that leaves the remaining 60% of seats in parties to negotiate with, and they're about 50/50 split left-and-right, and often refuse to work with antithetical parties. But there' no room for error. It will be a difficult high-wire act to get another 30% on board with the PM's party since there is so much disagreement and backroom backstabbing.

If they can't pull it off, they may have top agree to allow Wilders' party into the coalition, which is what we want.

409 In the topic of the last thread, I have just seen The Most Moronic Thing. See, apparently YouTube has decided to produce a Malthusian DOOM series to release on YouTube Red. Y'know, like you do. Malthusian DOOM being so hot right now.

So, the text is that the US is out of resources, because we're totally going to run out of fucking grain or something, and the US decides to handle this by... eliminating high-schoolers. Not eliminating Sicky McGramperson, not eliminating babies or toddlers. No, resource allocation is going to be based on who passes the SAT in the smartliest way.

I AM NOT MAKING THIS UP

Of course, this is described by Evil President Von NotTrump as ensuring that we have the best, smartliest people ever and totally awesome and if you want dumb people to live you're unamerican. Or something.

Of course, the tests are rigged for the powerful and connected because of course they are. In a fit of leftist 'tard, it's not enough that there are purges, but that the purges are unfair, because of course they are. And the brave #Resistance of high-schoolers are going to band together to defeat The Man, because of course they are.

The Most. Stupidest. Stupid. Of Stupid: those failing the test are dragged from the classroom by masked Failure Ninjas.

Dave Barry - like, I AM NOT MAKING THIS UP

"The Thinning" is apparently what they are calling this... abortion. I think. I may have left some brane behind just seeing the preview.

Schumer's relative incompetence at running the Senate could lead to it.

412 Its always true that a rule is valid until its ignored or removed. Filibuster is a useful tool in an divided nation, especially in the Senate where I prefer things slow down. The less government the better, remember? The less they do the less damage they can inflict on us?

So, just like France and LePen.

No. Parliamentary systems elect a Prime Minister (head of government) based on a majority/coaltion in parliament, which is what Wilders is running for and Rutte will likely win again.

Le Pen is running for President (head of state) which in France is a first round free for all and then a runoff between the two top candidates if no one gets 50%.

_______

You mean like the Founder's intended with the Vice President being the tie breaker?

Somehow the first 80 years of the Republic we went without a Senate filibuster.

Reid got rid of and kept parts of the filibuster as needed. The only reason he didn't formally shit can the entire thing was he found creative ways around it.

Also, had Reid been able to do it over again, he would have nuked the filibuster without question. Democrats will get rid of it as soon as it suits them, so you might as well use the next 4 years to pass some real reforms.

It's incredibly naive to think if we fall on our swords the Dems will do the same.

A great concept that the original series ended up screwing up, to many people's opinions.

Yea, like reconciliation. The very thing that Ryan and McConnell and, big and here, Trump are encouraging the Republicans to use to begin taking apart Obamacare.

At the beginning of his second term, Obama was so frustrated that he couldn't get his stuff through Congress, most specifically the Senate, that he announced he had a pen and phone and he was going to use them. And boy howdy did he. Most significant things that happened in his second term was done by EOs.

429 The rules for remakes:

1) Its so dated that it feels old and set in a time period (Omega Man)
2) Its so old that its forgotten and can be brought to a new audience (DOA)
3) You have a fresh take on the concept, or are changing it, say into a comedy or turning a musical into a drama (Philadelphia Story)
4) The story can be told better now with the tech and film making devices (Batman)

And introducing a new one that Hollywood has come up with:

5) It was a big hit, but largely unknown in the international market

Republicans took back the House in 2010, but Democrats kept the Senate so the need to kill the filibuster was basically on things like specific to the Senate like judicial nominations, which is why he only got rid of the filibuster for that purpose.

It was only when it was in his way

Had Dems had the House, believe me, he would have gotten rid of all of it

I don't share your optimism. In any case, a filibuster is like a reputation for honesty; an all-or-nothing proposition. Once you show you aren't willing to respect it, nobody will trust you again.

"The number (millions) affected by the destruction of the individual market (and it's millions, and by itself is a multiple of 3-5 times those who "gained" from O-care) can be estimated, as always opportunity costs are more like educated guesses."

There was a quote from a Democrat about that back about the time of the election. "I'd rather have 20 million new insureds than give breaks to a bunch of angry white men."

Charming.

437 Take a look at the history of the filibuster. Currently, it has little to no resemblance to the original rules for the filibuster. The first regime lasted from 1806 to 1917 with virtually unlimited debate--the only catch was that you had to hold the floor in a tag team of senators. The first real filibuster did not occur until 1837. Rule 22 adopting cloture was not adopted until 1917.

Under Wilson's prodding (I believe it was Fighting Bob Follette's filibuster of the Armed Ships Act which Republicans cynically latched onto during the whole Zimmerman Telegraph crisis to keep Congress in session but it has been awhile since I read that), the Senate established a 2/3rd's rule for cloture which was amended in 1975 to 3/5th's under the nuclear option. Reid's amendment was simply the last in a long line of changes to this institution.

It ain't the constitutional monolith that people think it is and the Senate has changed how it proceeds in a variety of ways during the last 100 years. It is not the magic wand that people think that it is and history shows that if it is inconvenient, it WILL be changed if the majority deems fit.

From Brookings but still a pretty good read.

438 McConnell likes his traditions, but Democrats are starting a brand new one; absolute sedition and mindless opposition to everything.

The filibuster's days are numbered. Good.
