Obama Engineered an Obama-Friendly Lawyer to Succeed Sessions In Case Sessions Had to Recuse Himself

On his way out the door, Obama also rewrote the line of succession in cases where the AG recuses himself. (I didn't know there was such a previously-planned chain of succession.)

He specifically wrote one senior guy out of the succession, and re-routed the succession to go right to his friendlies.

Amid Thursday;s over-hyped brouhaha about Jeff Sessions meeting with the Russian ambassador, a curious detail emerged. In Sessions's recusal memo, it was explained who at the Justice Department would be handling any investigations into the Trump campaign's alleged ties to Russia. "Consistent with the succession order for the Department of Justice, Acting Deputy Attorney General and U.S. Attorney for the Eastern District of Virginia Dana Boente shall act as and perform the functions of the Attorney General with respect to any matters from which I have recused myself to the extent they exist," reads Sessions's official statement on the matter.
Except that if the Obama administration had its way, Dana Boente wasn't supposed be the U.S. attorney to handle these matters in the event that Sessions recused himself. On February 10, USA Today reported the following:

Seven days before he left office, President Obama changed the order of succession without explanation to remove Boente from the list. Obama's order had listed U.S. attorneys in the District of Columbia, the Northern District of Illinois and the Central District of California.
That seems like awfully suspicious behavior. In fact the USA Today story noted this is pegged to the news that Trump quietly signed an executive order restoring Boente to the line of succession. The Obama administration chicanery was likely brought to White House's attention after Obama holdover and acting Attorney General Sally Yates tried to usurp the powers of the president and countermand his immigration executive order, actions for which she was summarily fired.
Why would the Obama administration make this eleventh-hour change to the line of succession at the Justice Department?

Fire.

And launch painful, expensive investigations and prosecutions.

Right now, Trump basically has a staff of paid assassins cooking his meals for him.

22 I wrote about this the other day. Trump appointed Boente to replace Yates as acting AG, which he wouldn't have done if Boente was a true Obaman.

Obama was trying to set-up Trump with a line of succession that would have let a true Obaman pick a special prosecutor if Sessions recused himself.

If I'm right on the next step, either Boente, the current DOJ #2 (the guy the Obamans kicked off the list) or the new DOJ #2 Rosenstein who is still waiting on confirmation, will give Schumer et al what they want -- a special prosecutor. But this SP will pursue a broader mandate. Heh.

An advantage is that this operation can be run as a silo with a cadre of loyalists away from the corrupt DOJ.

The fact that Trump revered it is a good sign.

Could it be "white knights" need time to track down the "poison pills" and amass evidence on the spread of this thing. Taking a few hits now is worth it to catch the whole lot. Sessions claims that his recusal has been in the works for sometime. If true is says each side is making moves and counter moves against each other.

If you know the leakers, it might be better to see who they are in contact with, etc.

No. Franken alleged that improper contacts between Trump campaign staff or allies had occurred with Russia, and asked Sessions how he, Sessions, would handle it if that alleged impropriety rose to the level of charges needing to be filed.

Sessions *could* have simply (a) gently needled Franken about the flimsy basis for the allegation, and then (b) said that no matter what happened, he would enforce the law strictly, without fear or favor. End of story. Nothing that could later damn him.

Instead, Sessions made an inexplicable assertion out of the blue about his own prior conduct in the matter. That he didn't have to be saying anything about in the context of the question.

For Pete's sake. How'd this guy manage to get through One L without flunking? He ain't an especially skilled lawyer, that's for sure.
