The rule actually says that Senators are only allowed to speak twice during the same legislative day. And a legislative day can be extended for as long as the Senate deems fit. The 60 votes are only needed to invoke cloture w/o resorting to what they call the "nuclear option" which technically is only supposed to be used for monetary bills (Byrd rule). But is called the nuclear option because a simple majority vote can change the rule IF it is deemed a "constitutional question" by the Senate leadership.

The filibuster is dead, it just don't know it yet. The only reason Republicans would have to keep it is a notion that the Democrats would let them use it without nuking it themselves. Well, Harry Reid disabused them of that notion. If we had real leadership instead of McConnell, it would be dead for legislation as well as nominations (and we still might end up there.)

Being able to claim that the "nuclear option" wasn't used seems like no gain at all. Dems don't really care about us going nuclear, in the sense that once they get back into power, they're not going to treat us any differently if we showed restraint now. In fact, the Dems (and the MSM) will accuse republicans of using an "alt-nuclear option," and most people won't understand the difference or won't care. The narrative will be: the GOP is changing the rules/doing something weird/scary/abnormal. But as others have pointed out, this will blow over pretty quickly.
It sounds like the Senate will be frozen while they wait for all the speeches to finish. I don't know if the Senate has anything important to do. I suspect it does. Maybe this could be made into a positive by accusing Dems of "shutting down" the Senate and being obstructionist. Accusing them of obstructing Sessions himself isn't going to win us points with the public (i imagine they don't give two shits about Jefferson Beauregard, other than they don't like coastal elites looking down on him for being from the South). But accusing them of obstructing America's business by shutting down the entire senate - that might sting. All of the Dems who get up to make those speeches are going to be creating video records that could be used against them later. The speech by itself wouldn't matter, but if it can be put in the context of: "this idiot is tying up the senate, preventing the nation's business, and listen to what he's saying, he's saying nothing meaningful, it's just blah-blah-blah, what an asshole" then it might hurt them. prevent a final vote without ever lifting a finger or uttering a word of debate enforcing the two speech rule would require the obstructing senators to proactively and continually debate to delay a final vote Now Senators can just say "I'm not going to vote for cloture" and go home and they are considered to be "filibustering". This rule would force them to actually, you know, filibuster when they want to filibuster, with a limit on the number of times they speak-2 per "legislative day" (which can be as long as they want). At the end of everybody's two times speaking limit, they would no longer be "filibustering", and a floor vote would be called. No cloture needed. Cloture is a vote to end a filibuster, this just makes them actually stand there and do it for as long as they are able. Now we can argue forever over rules versus common practice but the reality of the situation is this would be a change to common practice which will be interpreted by the media and the left as "going nuclear" which in turn would allow them to do whatever they want when and if they get power. They have always operated this way and always will. No, it is not. It is a return to the actual rules of the Senate, something that we as rule of law folks should support. What's made clear, if the way McClintock wrote in Imprimis is done, Senators would be limited to two speeches, period, on each question/bill, they would have to stay on topic - no reading the phone book and most importantly all other Senate business would suspend until the speeches were over and a vote taken. That last part was undone in 1970 and has led to all the filibusters since then because there is no price to pay for the blockage.

The problem with this idea is that it will take too long to confirm Gorsuch. If he's not confirmed by April 1, he will miss some very important EPA cases, which, if stand, will continue to stifle the economy. The debate would need to start by ~March 5 to cover the 25 days that the debate can pause the vote. I doubt they can get it started that early, since questioning hasn't even started yet.

It's not custom or habit. In 1917 they changed the rules to have a supermajority [first 2/3 then changed to 3/5] to invoke cloture. In 1970 they changed the rules to have a "two track" system when when a Senator filibustered they could bypass the filibuster and go onto other business. This second change is when the filibuster became the potent weapon it is now.
