Sean Davis: You Don't Need the Nuclear Option to Confirm Neil Gorsuch. You Just Need to Strictly Enforce the Rules on Debate as Written.
The rules as written require that people actually, you know, debate to keep debate open.
However, current custom -- just habit, which has no force of precedent -- is to allow Senators to not bother with an actual talking debate at all, and just refuse to vote against cloture -- keeping "debate" open without bothering to actually have any debate or speeches. Sean Davis recommends simply enforcing the rule as written -- and making the Democrats debate during the period they want to keep "debate" open -- until they get tired and bored and then call the vote for Gorsuch. The rule actually says that Senators are only allowed to speak twice during the same legislative day. And a legislative day can be extended for as long as the Senate deems fit. So, extend the day to accommodate each Senator's two speeches, and call the vote.Comments

If the "make them actually talk for the filibuster" trick works for Gorsuch, then it should probably work for future Supreme Court nominees as well. When I read the analysis, I didn't see it that way. If every senator's given his or her 2 speeches in a legislative day, that is the end of the debate. Then it's a simple majority vote. No sixty needed.

Nah, leave it. People who know what they're doing when they filibuster (ex. Cruz and Paul) can be pretty hilarious and entertaining when they're up there. Sure, it'll make the thing take longer if the Dems decide to filibuster Gorsuch for real. But eventually exhaustion will set in. That's the point of the rule being discussed here. Since you eventually need to step aside (you'll fall asleep standing up if you don't), even if the entire Dem side of the Senate digs its heels in, they'll eventually be forced to quit due to the need to cycle in replacements and the maximum two times they'd be allowed to speak.
Also, deciding what's "on topic" can be subjective. With a sympathetic press, a future Dem Senate Majority Leader could rule all kinds of things "off topic" no matter how "on topic" we might think they are.

It sounds like the Senate will be frozen while they wait for all the speeches to finish. I don't know if the Senate has anything important to do. I suspect it does. Maybe this could be made into a positive by accusing Dems of "shutting down" the Senate and being obstructionist.
Accusing them of obstructing Sessions himself isn't going to win us points with the public (i imagine they don't give two shits about Jefferson Beauregard, other than they don't like coastal elites looking down on him for being from the South). But accusing them of obstructing America's business by shutting down the entire senate - that might sting. All of the Dems who get up to make those speeches are going to be creating video records that could be used against them later. The speech by itself wouldn't matter, but if it can be put in the context of: "this idiot is tying up the senate, preventing the nation's business, and listen to what he's saying, he's saying nothing meaningful, it's just blah-blah-blah, what an asshole" then it might hurt them.

Now Senators can just say "I'm not going to vote for cloture" and go home and they are considered to be "filibustering". At the end of everybody's two times speaking limit, they would no longer be "filibustering", and a floor vote would be called. No cloture needed. Cloture is a vote to end a filibuster, this just makes them actually stand there and do it for as long as they are able.
Now we can argue forever over rules versus common practice but the
reality of the situation is this would be a change to common practice
which will be interpreted by the media and the left as "going nuclear"
which in turn would allow them to do whatever they want when and if they
get power. They have always operated this way and always will.
No, it is not. It is a return to the actual rules of the Senate, something that we as rule of law folks should support. Right now there are a bunch of precedents in place which allow Senators to be lazy. This makes them do their jobs and actually debate.

Maybe, maybe not. The left is going *nuts* about Trump. If Schumer burns himself out trying to stop Trump's early stuff, then he's going to be in sad shape when Trump sends the next nominee through.
More important right now, imo, is finding the citizens who are actually paying attention (like Scott Adams) and getting them to think, "You know, Trump isn't really a nut-job like everyone keeps saying he is. But boy, his opponents sure are crazy." Gorsuch will help with that. Then later down the line, possibly just as the Dems are starting to calm down (which might very well be exhaustion-induced...), Trump can submit a more controversial nominee and get the frothing started all over again.

1) it's crazy and unprecedented! Well so it was when harry reid killed it for all nominations they weren't currently having. You can bet if there had been a SC opening at the time it would have covered that too.
2) but some day democrats will be in charge again! This is the worst argument. So what? They will kill it on their own then anyway. Entire point being back to #1 that there used to be a filibuster for lower nominations too, until there wasn't.
The argument appears to be that if republicans keep what's left of the filibuster that the dems destroyed, the democrats won't be able to remove the rest later. Does that fly with you?

I always do that with millenials that I can discuss things with , and it's a surprisingly easy sale, since it's basically what they all believe anyways, especially now. Sure, it would be nice to have them on the right, but trying to sell that more often than not gets at least some of them to pitch a fit and get all pissed off. BUT if you just quietly tell them it's hopeless, the game is stacked against you, nobody on any side is really looking out for you, it all sucks, they are all crooks, give it up - they lap that shit right up.
And I view getting them to stay home on election day just like a win.

If you can defeat fire with the rules, you fight it with the rules! Why? Because fighting on the same level may win you the day, but it doesn't win you anything more than that. Those wins evaporate quickly.
BUT if you can stick to principles and rules while the other side has lost all of theirs, and STILL win - that is how you create a majority that holds together for 2 or 3 generations.

That is not what's important - what is important is the message to take to the public in the 2018 and 2020 elections. And if McConnell is able to do this in the way outlined in the piece above, than that message will be - When Democrats had the opportunity, they just threw away all the rules to get what they wanted, and that is what they will always do. But when Republicans had the opportunity, they found a way to win and yet still remain inside the rules, because that is how we roll.
