Sean Davis: You Don't Need the Nuclear Option to Confirm Neil Gorsuch. You Just Need to Strictly Enforce the Rules on Debate as Written.

The rules as written require that people actually, you know, debate to keep debate open.

However, current custom -- just habit, which has no force of precedent -- is to allow Senators to not bother with an actual talking debate at all, and just refuse to vote against cloture -- keeping "debate" open without bothering to actually have any debate or speeches.

Sean Davis recommends simply enforcing the rule as written -- and making the Democrats debate during the period they want to keep "debate" open -- until they get tired and bored and then call the vote for Gorsuch.

The rule actually says that Senators are only allowed to speak twice during the same legislative day. And a legislative day can be extended for as long as the Senate deems fit. So, extend the day to accommodate each Senator's two speeches, and call the vote.

If we can avoid it, we should. We can always invoke the option in the future if we need to. If the "make them actually talk for the filibuster" trick works for Gorsuch, then it should probably work for future Supreme Court nominees as well. And if it doesn't, we'll still have the option to go nuclear.

Personally, I think they should just go with it. The Dems have shown repeatedly that they will when it suits them so let's just get it over with.

Nah, leave it. People who know what they're doing when they filibuster (ex. Cruz and Paul) can be pretty hilarious and entertaining when they're up there. Sure, it'll make the thing take longer if the Dems decide to filibuster Gorsuch for real. But eventually exhaustion will set in. That's the point of the rule being discussed here. Since you eventually need to step aside (you'll fall asleep standing up if you don't), even if the entire Dem side of the Senate digs its heels in, they'll eventually be forced to quit due to the need to cycle in replacements and the maximum two times they'd be allowed to speak.

Also, deciding what's "on topic" can be subjective. With a sympathetic press, a future Dem Senate Majority Leader could rule all kinds of things "off topic" no matter how "on topic" we might think they are.

Plus, as mentioned above, it was previously used on a very important signature piece of legislation that the Dems are proud of.

In fact, a thought occurs to me. Given that the Dem leadership seems to be losing it (Pelosi apparently very literally stated that the president is Bush in a news conference just recently), it might be possible to use this to chip away at black support for the Dems. The article mentions that the method was used to get the Civil Rights Act passed. It might be possible to get stressed and sputtering Dem leadership to attack the Civil Rights Act when they invariably try to fight back against this.

But accusing them of obstructing America's business by shutting down the entire senate - that might sting. All of the Dems who get up to make those speeches are going to be creating video records that could be used against them later. The speech by itself wouldn't matter, but if it can be put in the context of: "this idiot is tying up the senate, preventing the nation's business, and listen to what he's saying, he's saying nothing meaningful, it's just blah-blah-blah, what an asshole" then it might hurt them.

320 What's made clear, if the way McClintock wrote in Imprimis is done, Senators would be limited to two speeches, period, on each question/bill, they would have to stay on topic - no reading the phone book and most importantly all other Senate business would suspend until the speeches were over and a vote taken. Sure, it would be nice to have them on the right, but trying to sell that more often than not gets at least some of them to pitch a fit and get all pissed off. BUT if you just quietly tell them it's hopeless, the game is stacked against you, nobody on any side is really looking out for you, it all sucks, they are all crooks, give it up - they lap that shit right up.

And I view getting them to stay home on election day just like a win.

401 Reid made the Donks extra lazy. By sitting on House legislation the Senate became an adult day care. At $175000/yr + perks. I'm sure they spent all that time day trading and chasing interns.

If you can defeat fire with the rules, you fight it with the rules! Why? Because fighting on the same level may win you the day, but it doesn't win you anything more than that. Those wins evaporate quickly.

BUT if you can stick to principles and rules while the other side has lost all of theirs, and STILL win - that is how you create a majority that holds together for 2 or 3 generations.

We aren't playing to win for just this session - we're playing to win the 21st century. Really.

403 It's not custom or habit. In 1917 they changed the rules to have a supermajority [first 2/3 then changed to 3/5] to invoke cloture. In 1970 they changed the rules to have a "two track" system when when a Senator filibustered they could bypass the filibuster and go onto other business. This second change is when the filibuster became the potent weapon it is now.

That is not what's important - what is important is the message to take to the public in the 2018 and 2020 elections. And if McConnell is able to do this in the way outlined in the piece above, than that message will be - When Democrats had the opportunity, they just threw away all the rules to get what they wanted, and that is what they will always do. But when Republicans had the opportunity, they found a way to win and yet still remain inside the rules, because that is how we roll.

Tom Brady found a way to do it. That's why he isn't just a winner, he's a Champion.

Here's a real question: How long will it take to fill Sen. Sessions seat after he's confirmed AG? How much will it hurt the confirmation process for Gorsuch to have that seat vacant?
